A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE VARIANCE REQUEST SUBMITTED BY PROPERTY OWNERS LUIS
AND BARBARA AMELIEIRAS, FROM THE DANIA BEACH "ZONING
APPENDIX"SECTION 33-40,FOR PROPERTY LOCATED AT 967 NAUTILUS
ISLE,DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, "Zoning Appendix", Section 33-40
"Regulation and use of waterways and facilities related thereto"prescribes the regulations for the
installation of boat lifts within the City of Dania Beach; and
WHEREAS,Luis and Barbara Ameijeiras own property located at 967 Nautilus Isle,and are
requesting a variance (VA-17-09) to allow a boat lift to extend 19 feet into a canal (Dania Beach
"Zoning Appendix", Sec. 33-40,"Regulation and use of waterways and facilities related thereto',
allows a maximum of 10%of the canal width to be occupied by such a lift,which equals six(6)feet
for this property); and
WHEREAS, the Planning &Zoning Board on May 20, 2009,made a recommendation to
approve the variance request(VA-17-09)submitted by the applicants with the following condition:
1) That a post or a floating device with a reflector be installed to warn other boaters of the
submerged portion of the boat lift structure;
the above recommendation was based upon the criteria set forth in Section 10.13 of Article 10, of
Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That that certain variance application VA-17-09 from the requirements in the
Dania Beach"Zoning Appendix",Sec. 33-40,"Regulation and use ofwaterways and facilities related
thereto', of the City Code of Ordinances is approved without the condition identified above.
Section 2. That this variance approval shall automatically expire unless: 1.)the applicant
submits a building permit application and construction drawings within twelve(12)months of City
Commission approval,and 2.)the applicant obtains a building permit(including payment of all fees)
within eighteen(18)months of City Commission approval.
Section 3. That all Resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
