HomeMy WebLinkAboutRap Session MINUTES OF RAP SESSION DANIA BEACH CITY COMMISSION THURSDAY, MAY 28, 2009 - 6:30 P.M. Mayor Castro called the Rap Session to order at 6:34 p.m. Mayor Castro welcomed everyone and asked the community to express their concerns in a respectful and courteous manner. She thanked Commissioner Jones for setting up this meeting to address the issues our community is currently facing. Commissioner Jones noted that in light of the current economic conditions, the increasing crime issues, and our children being on vacation, we must try to find solutions to prevent these problems from happening. He advised that each speaker will be allowed to talk for 3 minutes. Mayor Castro noted that representatives from the City, BSO, and the Dania Beach Housing Authority were available to answer any questions. She introduced BSO Chief Donn Peterson. Chief Peterson introduced the following: Kevin Granville,Assistant Chief of Police Detective Richard Tarrant, Crime Prevention Specialist Nicholas Lupo, Code Compliance Manager Anne Marie Gundersen, Dania Beach Housing Authority Dominic Orlando, Director of Public Services Kristen Jones, Director of Parks and Recreation Jeremy Earle, CRA Executive Director Colin Donnelly, Assistant City Manager Mayor Castro introduced the City Officials at the dais: Vice-Mayor C.K. McElyea Commissioner Bob Anton Commissioner Walter Duke Commissioner Albert Jones City Manager Robert Baldwin City Clerk Louise Stilson Mayor Castro opened the session to public comments. Teddy Bohanan, 312 SW 15`s Street, addressed the crime issue in her neighborhood. She noted they do not have enough community policing in their area. Ms. Bohanan advised they have a serious drug dealing problem and asked for everyone that is involved in the City to take a drug test. Mayor Castro noted that every new hire is subject to drug-screening. She asked whether random tests were conducted after someone is employed. Colin Donnelly, Assistant City Manager, advised that the information is contained in the General Employees Labor contract, not in the Fire Union contract. He further noted that a drug test is done in the event of an accident. Richard Sokol, 609 NW 10`h Street, spoke about the Citizens on Patrol (COPS) Program and encouraged residents to join them in trying to make our community a better place to live. Mayor Castro asked for an explanation of the COPS Program. Detective Richard Tarrant explained that this is a 4-hour Program, incorporated about 10 years ago, which is meant to be the eyes and ears of BSO. He noted that people involved in the Program patrol their neighborhoods and contact BSO if they find something suspicious to them. Detective Tarrant advised that BSO provides the car, gasoline, and the training. They currently have 105 active members in the COPS Program. Jay Field, 4501 SW 30`h Way, noted he would like the City to establish the Blue Ribbon Advisory Committee, where the City would set up a geographic group of civic associations who would create a master plan in order to make improvements for a particular neighborhood. If the master plan is approved by a super-majority of that geographic area, the City would pay to implement the plan. He noted the City of Fort Lauderdale has been very successful with this program. Mr. Field further stated that he is in favor of development, but the residents should be the first ones to decide whether it is convenient for the community or not. He also asked for the City to create a Newsletter to be mailed to the residents with information on what is happening in the City. Mr. Field pointed out that information posted to the Web Site is good, however, some people cannot afford a computer and should still be updated with the City's current events and opportunities by mail. Gloria Black, 802 NW 3`d Street, noted there is a store in her neighborhood that is open 24 hours, and police officers hang out there most of the night. She said there was no need to keep that business open all night. Ms. Black also noted that she would like to see police officers do a better job when they arrest youngsters in her neighborhood. She also complained about the lack of response from BSO and the crime issues occurring in the entire City, not only in the northwest area. Bob Mikes, 601 NW 7`h Street, suggested placing cameras in a test area within the City which would allow us to catch those involved in a crime. He noted we did not have to hire a BSO deputy, but a contractor could do the job and provide the report to the City. Mayor Castro remarked this was a good idea. She suggested the test section of the City have signs posted to let the neighbors know that the area is under surveillance. Faye Bartelmes, 214 SW 2nd Terrace, spoke about the "Pooper Scooper" issue. She said people should think about their neighbors when they walk their dogs. Minutes of Rap Session 2 Dania Beach City Commission Thursday, May 28,2009—6:30 p.m. Annette Hibbits, 26 SW I V Street, talked about the drug dealing and decreasing property values in the southwest area. She noted people do not want to rent in that neighborhood anymore. Ms. Hibbits hoped her neighborhood would get some improvements. Patricia Tyra, 2912 SW 54`h Street, Estates of Fort Lauderdale, thanked the COPS Program for their assistance to the community. She thought funding for this Program should be included in the budget process. Ms. Tyra also said that the new BSO "Cybervisor Alert" Program is great and suggested people sign-up for the Program. Ms. Tyra noted the City should support the use of historic signs, because they are helpful and people use them to find locations. She asked the City to re-visit the decision to remove historic signs. Ms. Tyra complimented City staff for the improvements to the City Web Site. She spoke about the warning alert at P.J. Meli Park and the need to educate the community to understand what action they need to take when the alarm goes off. Mayor Castro explained that people who sign-up for the BSO/Cybervisor Program will receive important community information via email. Sally Leonetti, 249 SW 12`h Street, spoke about the drug issues in her neighborhood. She asked for assistance in trying to clean up her area from this type of crime. Chickie Brandimarte, 101 SE P Avenue, questioned why calls for our BSO district are transferred to the Fort Lauderdale main number. She would like to have immediate access to a Dania Beach police officer instead of listening to general information on the Broward Sheriffs Office. Commissioner Anton clarified that all calls will be routed through the main call center, so they can be tracked down when needed. If it is an emergency, people should call 911. He further noted that a non-emergency call will be transferred to the downtown office, and directed to the right department. Mayor Castro remarked that in case of emergency, the dispatch officer will communicate the urgency by radio, while the call is transferred to the downtown center for action. She noted this is a way to use computer technology to track down information when required. Chief Peterson advised that whenever a call is on hold for BSO, there will be a recording with a public service announcement instead of music. Ms. Brandimarte also asked for the limit of the duties of the Code Compliance Unit inspectors, once an offender has been cited. Nick Lupo, Code Compliance Manager, explained that when a complaint is reported to the Code Compliance Unit, an inspector visits the site to determine the type of violation involved. He noted that we follow a procedure which includes actions such as: sending courtesy notices, certified letters, scheduling a hearing before the Special Magistrate, imposing sanctions, contacting Public Services if required, filing liens against the property, and if they are still not in Minutes of Rap Session 3 Dania Beach City Commission Thursday,May 28,2009—6:30 p.m. compliance, proceeding with foreclosure. Mr. Lupo further advised that about 2-3 years ago the state law changed to allow cities to pursue civil action against those individuals. Mayor Castro questioned if there was a limit for recurring offenders. Mr. Lupo responded we have procedures in place that would make the violator appear before the Special Magistrate, and eventually a Final Order is issued. This Court Order affects that property for five years and once it becomes a repeat violation, they are subject to a $500.00 per day fine. He further indicated that Ms. Brandimarte may be referring to an issue with an unlicensed contractor in the Meadowbrook Condominium area which does not fall under the City's jurisdiction, although it is duly documented for our records. Mr. Lupo advised that the matter under discussion needs to be addressed by the County. Mark Benevento, representing Aware Digital, noted they are the company in charge of the video surveillance system installed at City parks. He advised they are willing to discuss any other project regarding the installation of cameras in other areas within the City. Karen Drayton, 1426 NW 2"d Street, questioned the procedure followed by police officers to enter people's homes. Chief Peterson noted that Ms. Drayton is referring to a warrant for an arrest. He advised that a police officer is authorized to take whatever action is needed in order to fulfill his duties. Chief Peterson remarked that the intent of the law is that criminals might be brought to justice. Discussion followed between Chief Peterson and Ms. Drayton regarding her son being imprisoned. Chief Peterson further explained some of the procedures followed by BSO in cases that involve people who are already in custody and the warrant order is still served. Ms. Drayton affirmed that the individuals who came to her house were not Federal Marshals. Commissioner Anton suggested Ms. Drayton engage the services of an attorney to find out what her legal rights are in this case. Chief Peterson responded for Commissioner Anton that if offenders are caught on surveillance equipment doing a drug deal, BSO is not able to take any action unless there is direct testimony from one of the people on tape, i.e., an under-cover officer. He remarked that technology is great but it does not mean anything without the human component. Mayor Castro questioned the best course of action when someone in the neighborhood suspects drug dealing is taking place at a certain location. Chief Peterson advised that this is a lengthy process that usually involves an under-cover officer. He noted that in most cases they would rather arrest a suspect than let him continue doing something wrong. Minutes of Rap Session 4 Dania Beach City Commission Thursday,May 28,2009—6:30 p.m. Commissioner Jones noted we might need to do something different to try to resolve the drug issue in our City. Detective Tarrant noted that BSO has a program where they contact landlords to let them know their tenants are selling drugs, which has proven to be very successful. Nick Lupo, Code Compliance Manager, noted that BSO and Code Compliance are using every resource available to educate landlords to make them more interested in their properties and the type of tenants they bring to the community. John Frosbutter, 133 SW 3rd Street, questioned if we could establish a mutual aid package where a Code Officer could work as an agent of the County, as well as the City. He commented that people on a bike late at night should be stopped and identified. Mr. Frosbutter offered some alternatives to try to prevent crimes from happening. Lastly, he suggested that police officers take some sensitivity training so they can empathize with the people they are dealing with. Jeff Hatcher, 125 NW 7"' Avenue, noted the drug issue has been going on for years. He suggested late night police patrolling in order to make the drug dealers aware that they are being watched. Mr. Hatcher asked the Parks and Recreation Department to create more activities for the children in our community. Dennis Rader, 260 SW 14w Street, established a comparison between dogs with fleas and crime offenders in our community. He said we need to do something dramatic to eliminate these parasites from our City. Mr. Rader stated we did not have to be diplomatic about posting signs in our neighborhoods. He noted that if we take the appropriate action now we could turn the southwest area into a delightful place to live. Patricia Chukerman, 545 SE 4d' Court, asked if a law could be created requiring every prospective renter or buyer to pass a background check. Mayor Castro responded it would be very difficult to implement such a law. Ed Darling, 720 SW 8d' Street, questioned the next step in finding a solution to the problem. He noted the residents, as well as City staff, have done a great effort in trying to redevelop the northwest and southwest areas. Mr. Darling commended the BSO officers who are always available when we need them. He was confident that our Elected Officials would try to resolve the crime issues in our community. Commissioner Duke was pleased to hear Mr. Darling's comments. He noted there are some measures that should be taken immediately such as: • Homeowners' Associations need to meet more often and on a regular basis • Discuss the crime issues during the upcoming Budget session • Continue to support our CRA and the improvements it will bring to our community • Negotiate the renewal of our police services contract with BSO • Continue to support Code Compliance Minutes of Rap Session 5 Dania Beach City Commission Thursday,May 28,2009—6:30 p.m. Commissioner Duke stated that all of these components would help staff address the crime issues in our City and attract better quality owners and investors into southwest Dania Beach. Commissioner Anton concurred with some of the items mentioned by Commissioner Duke. He noted it is hard to explain to our youngsters that there is a decent and respectable way to work for a living without having to sell drugs. Commissioner Anton would like to see a Marine Technical School in Dania Beach to send our children in the right direction. He further commented on the possibility of installing cameras in certain areas of the City. Commissioner Anton thought some people may not be happy, but we need to try different ways to eliminate the drug dealing problems. He encouraged residents to go out and be visible so those involved in crime are aware that they are being watched. Vice-Mayor McElyea agreed with the installation of cameras, and suggested Code Compliance officers visit some alleyways in the southeast area where they will find lots of junk yards. He noted we need to educate our children to become an asset to our community. Vice-Mayor McElyea thought that communication was an important aspect to move in the right direction. Commissioner Anton spoke about the issues between the Broward Sheriffs Office and the County Commission. He noted that the proposed cuts in services would dramatically impact every community. Commissioner Anton encouraged everyone to send their comments to the County Commission stating that when the economy is bad, it is not recommended to cut back on public safety. Mayor Castro asked City Manager Baldwin to coordinate with the Department Heads involved in this issue to discuss the creation of a Task Force to look for possible solutions. She suggested CRA Director Jeremy Earle search for funding sources which could improve the look of our communities. Mayor Castro also thought that BSO should visit our schools and discuss with our children the importance of staying away from trouble on their way to and from school. She remarked that budget constraints make it more difficult to find solutions. Mayor Castro noted we need to come up with a list, check costs and effectiveness of some of these tools used by other cities, so we can then prioritize them. She stated that crime is a citywide issue, but we have target areas that need immediate attention. Mayor Castro asked the community to participate in the upcoming Budget meetings, in order for the Commission to shift funds as needed. She concurred with Mr. Field's suggestion for an electronic newsletter distributed to the residents to keep them informed. The newsletter could include City events as well as crime information. Mayor Castro noted that there are going to be short term and long term goals in this process, but we are sending the message to the offenders that we are not going to tolerate this situation anymore. She thanked everyone for their comments and ideas, and for showing interest in the City of Dania Beach. Commissioner Jones expressed his appreciation to all of those who took the time to come and express their concerns. He said the COPS program is good, but we are not implementing it right. Commissioner Jones talked about the lack of communication within the community. He stated that BSO needs to get more involved, as well as Code Enforcement and Parks and Recreation. Commissioner Jones noted this is a common effort and we need to move forward to make our community a better place. Commissioner Jones remarked we need to act and stop this situation now, and suggested having this type of open dialogue on a quarterly basis for the benefit of the entire City. He reaffirmed that the community could approach BSO, Code Enforcement, Public Services, and the Dania Beach Housing Authority, if they think they need help. Annemarie Gundersen, Operations Manager, Dania Beach Housing Authority, clarified that although people living in Section 8 Housing have a bad reputation, this is not always the case. She noted that they do an extensive criminal background check when people are admitted to the program. If they are found to have a criminal history, they are not accepted into the program. Ms. Gundersen advised they work closely with BSO to reduce the criminal activity in our community. She encouraged landlords to do the same thing with their prospective tenants. Ms. Gundersen provided details on the percentage of Section 8 Housing residents in Dania Beach and the County respectively. Colin Donnelly, Assistant City Manager, advised that the Grant Advisory Board is working on a grant application for the Weed and Seed Program. He noted that this Program reflects a comprehensive approach to community revitalization through the use of coordinated crime reduction activities combined with a mix of social, economic, and housing improvement programs in targeted geographic areas. Assistant City Manager Donnelly explained that the funds would go to a neighborhood coordinator who would put the Program in place and would work directly with law enforcement and the Attorney General's Office.
