Call to Order Jay Fields called the meeting to order at 7:00 p.m. 2. Roll Call Members Present: Jay Field Daniel J. Payne Joe Payne Linda Sacco Boisy N. Waiters Bob Mikes Rae Sandler Jocelyn Lummis Terry Hale-Hicks Members Absent: Beulah Lair(excused) Betty Sokol (excused) Dick Sokol (excused) Sulie Spencer(excused) Clive Taylor (excused) Mike Grady (excused) Jocelyn Lummis motioned to grant excused absences, seconded by Rae Sandler. The motion passed unanimously. 3. Approval of May 28, 2009 Minutes Jay Field motioned to amend the minutes to remove: Jay Field noted that the Broward County Commission would like to speak with the Mayor, although Commission Bob Anton is the spokesperson for all airport matters. Also to be removed and corrected; The Airport Advisory Board should appoint someone that has legal background along with being well rounded with the city of Dania Beach, seconded by Linda Sacco. The motion carried unanimously. Boisy N. Waiters made a second motion to approve the corrected minutes as amended, seconded by Daniel Payne. The motion carried unanimously. 4. Presentation and Sub Committee Reports 4.1 Selection of Chair and Vice Chair Jocelyn Lummis motioned to vote on Chair and Vice Chair when more members are present; seconded by Bob Mikes. The motion carried unanimously. 4.2 Reconsidered Vote for Spokesperson for Airport Matters w Jay Field advised that no one made a motion for the reconsidered vote for spokesperson for the airport. He also noted that he sent a memo to the Dania Beach Commission referencing the need for a spokesperson for the airport issues, recommending that the Mayor speak for the city and be the contact person for airport issues. Bob Mikes noted that Mayor Anne Castro discussed the letter of recommendation for spokesperson for airport matters at The City Commission Meeting she stated that she received a call from a Broward County Commissioner to discuss the possibility of rezoning, density changes, and redevelopment changes. Mr. Mikes also noted that Mayor Castro said that she has too much on her plate and that Commissioner Anton would remain the contact person. Jay Field noted that the Broward County Airport Director, Kent George, plans to attend the July Airport Advisory Meeting. Terry Hale-Hicks asked if we could have a representative from the City Commission attend the July Airport Advisory Meeting. Linda Sacco thanked Jay Field for his invitation letter to the Ft. Lauderdale Airport Director, Kent George. She noted that Mr. George is a very interesting person to listen to, and that he has a lot of information that he can share. 4.3 Discussion of Runway Proiect. Master Plan Update & Part 150 Bob Mikes noted that he attended the Interlocal Dispute Meeting held on June 3, 2009. He advised that when a governmental Agency enters into formal litigation with a governmental Agency they must follow the process outlined in Florida Statue 164. Mr. Mikes noted that the City Manager, City Attorney and Special Counsel Neal McAiley met with Broward County Administrator Bertha Henry, Director of Aviation Kent George, and members of the Broward County Attorney's Office to discuss the mitigation process, as required by the Interlocal Agreement. Bob Mikes also noted that the city of Dania Beach already filed the 164 Notice, indicating that the city does not think the county is following the Interlocal Agreement with this Pilot Mitigation Program. He said that both sides agreed on many points, there by eliminating the need formal litigation, or the F.S. 164 process, although the option is still open. Mr. Mikes advised the city and the county will be in recess for the next month. Mr. Mikes also advised that the county will comply with agreement. He noted that the F.A.A. must have a mitigation program in place before they begin the work on the runway. He noted they also discussed the purchase insurance verses the sound reduction and pollution guarantee because they want to test the concept, and it is not the only offer under this program. Mr. Mikes noted they know that a number of people will not be satisfied with the sound reduction program, and that there will be other options offered. Mr. Mikes noted that Commissioner Anton commented that with the FAA approval, a number of people will have to relocate and they want to know how there going to sell there homes. Bob Mikes noted that the meeting went well and that it is possible that the city can lose the litigation and the runway will go in, and that some mitigation needs to be involved. Jay Field noted that in the discussion of the various runway alternatives, there was a proposal to have a runway of 6000 ft. north of the present south runway. His experience is that the commissioners do listen to the staff. Minutes of Meeting 2 Airport Advisory Board June 25,2009-7:00 p.m. Linda Sacco questioned how the Interlocal Agreement affects the people that were annexed in and noted and are they are legally protected in Davis Isle. Rae Sandler responded that legally she believes this will be a challenge to the noise contours, because at a Broward County Commission meeting the City of Davie proposed to put up new residences and Kent George, Ft. Lauderdale Airport Director wrote responded and drew up a contour map that showed that 65 DNL goes into Davie, she questioned if 65 DNL goes in Davie, then how come it does not cover all of Dania Beach Jay Field noted that the map they have is part of the Environmental Impact Statement and that it is the yearly average map. A single event of one airplane in that 65 line goes out to Pine Island Ridge, but this is not the yearly average. The FAA will not to go beyond the 60 DNL and they will discuss the 60 DNL. Bob Mikes noted that the annexed areas are legally covered and that the average noise contours are gaming sequences. He also noted that this agreement will hold up because there was a revenue issue and it was not just the approval of the runway; it was lumped into one package of litigation and they do realize that they have a problem. Mr. Mikes advised that the good aspects are that they will pre-mitigate the runway before they use it. He noted that in the Intergovernmental Dispute Meeting they agreed that the Pilot Mitigation program is not the total program and that they are going to work with the city. Mr. Mikes noted that he feels it is very important that the committee get out and make sure the citizens knows what options they have, and to make recommendations to the commission. Jocelyn Lummis noted that her intent as a citizen of Broward County is to say that the South runway is in abysmal violation of public trust by the Broward County Commissioners it's not no to any airport expansion, because that is her opic, but the south runway is the worst possible options. She believe that there are better options that are less costly and are more efficient much more environmentally and community friendly that the south runway. Bob Mikes advised that the City of Dania Beach has fought 20 years with the FAA. He noted he is not for the South Runway but, it may happen and we must prepare for both options. He also noted that Neal McAiley may pull it off, but we must prepare for both options. 4.4 Pilot Mitigation Program Jay Field noted that the Pilot Mitigation Program has not been approved because they are working on the contract. He also noted Broward County cannot do anything until they come to the city. 5. Unfinished Business No unfinished business discussed.
