Call to Order/Roll Call Vice-Mayor McElyea called the meeting to order at 7:00 p.m. 2. Invocation and Pledge of Alle fiance Commissioner Jones gave the invocation followed by the Pledge of Allegiance to the United States Flag. Present: Vice-Mayor: C.K. "Mad' McElyea Commissioners: Bob Anton Walter Duke Albert C. Jones Asst. City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Louise Stilson Absent: Mayor: Anne Castro City Manager: Robert Baldwin Commissioner Anton motioned to excuse the absence of Mayor Castro; seconded by Commissioner Duke. The motion carried unanimously. Vice-Mayor McElyea pulled the Addendum to the top of the agenda. ADDENDUM 3.6 Abatement request for Georgette S. Prince, Case #06-1211, for property located at 2870 W. Marina Drive (0232-16-5400)—Tim Ryan, Esq., Code Compliance Counsel Attorney Tim Ryan advised this case is for 3 violations of junked and abandoned vehicles being parked or stored on the property. The fine ran for 186 days for a total of$28,049.50, including recording fees. The Special Magistrate recommended an abatement of$5,000.00. The City filed for a foreclosure, and we found it was in an estate. Steven Stralio, attorney for the applicant, agreed to the $5,000.00, as recommended by the Special Magistrate. He advised that the property is listed for sale and the lien will be paid upon closing. Commissioner Duke motioned to abate the lien to $5,000.00, to be paid within 180 days; seconded by Commissioner Jones. Presentations and Special Event Approvals 3.1 Presentation by the Smart Growth Partnership of South Florida (Continued from May 26, 2009) Ralph Johnson, Professor of Architecture at Florida Atlantic University and a member of the Board of Directors of the Smart Growth Partnership of South Florida, presented a PowerPoint overview of the Community Outreach Charettes and Meetings held recently in Dania Beach for the Griffin Road Corridor. He noted that this is an area where the City is trying to introduce mixed-uses. It is also appropriate for transportation and transit issues because of its proximity to major highways. The Commissioners thanked Mr. Johnson and his students for participating in this project. 3.2 Central Broward Transit Impact Study Scott Seeburger, Florida Department of Transportation, Project Manager, noted they have been working on this project for some time. He advised that the Central Broward East-West Transit Analysis is looking to develop high performance transit between the Sawgrass Mills area and downtown Fort Lauderdale. Zafar Alikhan, Jacobs Engineering, Project Manager, presented a PowerPoint overview of the Draft Environmental Impact Statement, which is attached to and incorporated into these minutes. He noted that they are looking for involvement from cities and citizens to narrow down the route options. Mr. Alikhan indicated they are currently in the initial screening phase and are looking to submit their recommendation to the Federal Transit Administration in December 2010. He advised that this project would require fifty percent funding from the Federal Government. Mr. Alikhan provided a schedule of upcoming meetings related to the project. Commissioner Jones clarified with Mr. Alikhan that, as opposed to diesel, the most common application of Bus Rapid Transit (BRT) is the hybrid bus. Mr. Alikhan advised that the connection between this project and the Intermodal Airport-Seaport Connector is critical. Commissioner Anton questioned the alternatives for the Griffin Road Corridor. Mr. Alikhan explained that some of the solutions being considered for that Corridor would include operating in the median, or the curbside, within that right-of-way with un-frequent stops. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,June 9,2009—7:00 p.m. 3.3 National League of Cities Prescription Discount Card Program — Colin Donnelly, Assistant City Manager Colin Donnelly, Assistant City Manager, provided a PowerPoint overview of the National League of Cities (NLC) Prescription Discount Program. He explained the NLC has launched a free prescription discount card program for cities to help residents cope with the high cost of prescription drugs. The program offers savings on prescription drugs to residents who are without health insurance, a traditional pharmacy benefit plan, or have prescriptions not covered by insurance. The NLC Prescription Discount Card program is administered by CVS Caremark. Assistant City Manager Donnelly advised there is no cost to the City to sponsor the program, and CVS Caremark will produce and provide personalized prescription discount ID cards which will include the City logo. He further noted that a Press Release will be issued tomorrow and distribution points will be located at City Hall, Public Services, Fire Stations, City Parks, Library, Chamber of Commerce, and the Humane Society of Broward County; the information will also be posted on the City website and cable station. Commissioner Jones noted we have a lot of people who are suffering, and this program will help. Commissioner Duke commended Commissioner Jones for his efforts on behalf of the residents of Dania Beach. 3.4 Special Event Request for the City of Dania Beach July 4, 2009 Celebration to be held at Dania Beach from 2:00 p.m. — 10:00 p.m. Commissioner Anton motioned to approve the Special Event request for the City of Dania Beach July 4 Celebration; seconded by Commissioner Duke. The motion carried unanimously. 3.5 Special Event Request for the City of Dania Beach Fire Department Car Wash to be held at 105 N. Beach Road on June 13, 2009 from 9:00 a.m. —4:00 p.m. Commissioner Duke motioned to approve the Special Event request for the City of Dania Beach Fire Department Car Wash; seconded by Commissioner Anton. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Thomas Bordowsky,400 S. Federal Highway, was concerned with items on the agenda that were not bid competitively. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,June 9,2009—7:00 p.m. Janet Komocsin and Remy Komocsin, 514 NE 3rd Street, requested that the hockey rink at Frost Park be turned into a Skate Park. She indicated that companies are willing to sponsor the project and pay for part of the cost. It was the consensus of the Commission to have staff research the costs and Liabilities. Victoria Payne, Dania Beach Chamber of Commerce, provided an update of upcoming Chamber events. Mario St-Cyr & Christina Boeri, 1919 Van Buren Street, Hollywood, president of Paddles and Boards, noted they signed a contract with the concession owner of the Pier to provide services. They would like to bring a Power Point presentation at a future date, so the Commission can see the services they offer. They have not been able to obtain a permit, in spite of many contacts they have had with several City departments. City Manager Baldwin arrived at 8:00 p.m. Ms. Boeri indicated that the Assistant City Manager has not responded to where they can park their trailer in the parking area. Colin Donnelly, Assistant City Manager, noted we are aware of the situation. He advised that there is an issue with leaving a large trailer in our parking lot on a regular basis. There is also a safety issue, since we no longer have a lifeguard on the Pier. Assistant City Manager Donnelly suggested we work it out with Mr. Jutz and the City Attorney. City Attorney Ansbro noted the problem is leaving the large trailer in the restaurant parking lot. He remarked that the parking area is only for restaurant patrons. Commissioner Duke stated that the Commission is always supportive of recreational activities in the City, however, there are certain regulations and requirements that we all need to adhere to. He advised that they need to work out the details with City staff before coming to the Commission for action. Ralph Eddy, 150 SE 3`d Avenue, indicated that the City does not have an ordinance for "Pooper Scoopers". City Attorney Ansbro advised we do have an ordinance, and it is enforced by BSO. Mr. Eddy said that he spoke to several people about the SE 2nd Street closure, and none opposed it. He also thanked BSO for monitoring the area. Jimmy Crimminger, 237 SW 15d' Street, noted a family in the SW area moved due to a home robbery. He addressed the FPL resolution on the Consent Agenda, for the relocation of transmission facilities, and noted that the cost is high. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,June 9,2009—7:00 p.m. Teddy Bohanan, 312 SW 15`s Street, wants to fight drugs in her area, but she can't do it by herself. She said the elected officials need to take drug tests. 6. Public Safety Reports There were no reports at this meeting. 7. City Attorney Ansbro read the title of Resolution 42009-115. Commissioner Jones requested clarification as well as the timeframe to complete the job. Dominic Orlando, Director of Public Services, noted the original estimate was for $50,000.00, but once the engineering was complete, the actual cost was $61,685.00. He explained that we need FPL to start immediately, to assure continued progress with the Southwest Community Center project. Commissioner Jones motioned to adopt Resolution #2009-115; seconded by Commissioner Duke. Public Hearings and Site Plans 9.1 ORDINANCE #2009-005 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY CYNTHIA A. (SECOND READING) City Attorney Ansbro read the title of Ordinance #2009-005. Corinne Lajoie, AICP, Principal City Planner, explained that the request is for a perimeter plat. She indicated that the note on the plat restricts the property to a maximum 400-room hotel, however, no site plan has been submitted for this property. Ms. Lajoie advised that both the Planning and Zoning Board and staff recommend approval of the request. Vice-Mayor McElyea opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Anton motioned to adopt Ordinance #2009-005, on second reading; seconded by Commissioner Duke. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,June 9,2009—7:00 p.m. Kristin Dion, City Planner, advised the applicant is requesting a variance for a boat lift to extend 19.5 feet into a canal, while Code allows a maximum of 10 feet. Commissioner Anton confirmed with Ms. Dion that there have been no complaints from any of the adjoining neighbors. Vice-Mayor McElyea opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Anton motioned to adopt Resolution 92009-111; seconded by Commissioner Duke. City Attorney Ansbro read the title of Resolution#2009-112. Kristin Dion, City Planner, advised the applicant is requesting a variance for a boat lift to extend 19 feet into a canal, while Code allows a maximum of 6 feet at this location. She pointed out that staff was contacted by a neighbor who thinks the applicant's boat would infringe into their property moving east to west. Vice-Mayor McElyea opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Anton noted this is a neighbor that lives across the canal. He remarked that the applicant will use less space once the boat lift is installed. Commissioner Anton further indicated he did not see the need for a guide pole since the property is located on a dead end canal. Commissioner Anton motioned to adopt Resolution #2009-112, with the condition to eliminate the guide pole provision; seconded by Commissioner Jones. Corinne Lajoie, AICP, Principal City Planner, explained that the applicant is requesting a two- year extension for a previously approved site plan to construct 200,000 square foot of office space with two parking garages. She advised that the request letter from the applicant states that the current economic situation prevents them from meeting their original development schedule. Vice-Mayor McElyea opened the Public Hearing. Jimmy Crimminger, 237 SW 15u' Street, suggested a one year extension as opposed to two years. Seeing as there was no one else to speak in favor or opposition, Vice-Mayor McElyea closed the Public Hearing. Federal Highway 10.5 Request by Peggy Lee for an annual renewal of a Local Business Tax Receipt for a Palmistry/Fortuneteller License for property located at 219 N. Federal Highway 10.6 Request by Elizabeth Miller, d/b/a Astrology Fortune Teller, for an annual renewal of a Local Business Tax Receipt for a Palmistry/Fortuneteller License for property located at 2730 Griffin Road Nick Lupo, Code Compliance Manager, reported that both BSO and Code Compliance have no issues with any of the above requests. Commission Comments 11.1 Commissioner Anton Commissioner Anton noted City staff recently had a Dispute Resolution meeting with Broward County regarding the South Runway Airport Expansion. He said Broward County had requested a response from Dania Beach by July 1 regarding the Early Action Voluntary Sound Insulation Program, however they agreed to give us until September 1, 2009 to provide a response. Commissioner Anton noted the information is available on the City Website. He suggested that residents speak to an attorney before signing the agreement. Commissioner Anton proposed that during the last week in July, the City hold a public workshop to allow the residents to comment on this important issue. He would also like a presentation by Broward County at this meeting, and a consultant with expertise in this type of document, to provide direction. 11.2 Commissioner Duke Commissioner Duke noted that Bob Daniels, our newly appointed Community Development Director, is a good addition to the City. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,June 9,2009—7:00 p.m. Commissioner Duke advised that negotiations are in progress between Jeremy Earle, CRA Executive Director, and the highest ranked firm for the 109 Park project. 11.3 Commissioner Jones Commissioner Jones welcomed Bob Daniels to the City. Commissioner Jones noted that he attended the Anti-Crime Symposium in Deerfield Beach and he will provide the information to the City Manager. Commissioner Jones wants to schedule another Rap Session at P.J. Meli Park. Commissioner Jones attended a presentation at Olsen Middle School where Ms. Kim Flynn was recognized as Principal of the Year for Broward County. He noted they presented her with a Proclamation and a Key to the City for doing a great job with our children. Commissioner Jones advised he presented a Proclamation and a Key to the City to Sterling Collins who was recognized for his accomplishments and contributions as a lifelong resident and citizen of Dania Beach. Commissioner Jones requested information on the recent traffic homicides occurring around 3151 Avenue,near Publix. City Manager Baldwin noted Chief Peterson prepared a letter for the Mayor's signature three weeks ago, which was sent to the Florida Department of Transportation, but we have not yet received a response. He will keep the Commission posted on this issue. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea noted that as President of our Historical Society, he is looking for Dania Beach Pioneers. Commissioner Jones suggested the new Library have an archives section for Dania Beach. Vice-Mayor McElyea noted he did not receive the lights that were on top of the elevated water tank that was removed. He commented that the plaque is missing as well. Dominic Orlando, Director of Public Services, advised that we have the lights and several pieces of the steel, the contractor has the plaque, and we are looking for the phone. He further noted that in accordance with the contract, the contractor owns all the parts; however, we have asked him to return certain items to us. 11.5 Mayor Castro Mayor Castro was not present at this meeting. Administrative Reports 13.1 City Manager City Manager Baldwin noted that Bob Daniels should do a great job. He thanked Corinne Lajoie and the entire Community Development Department for the job they did in the interim. City Manager Baldwin noted the public needs to get out and support the Broward Sheriff and talk to the County Commission. He said what the County is proposing would eventually affect the contract cities and our contract could go up by $1M. The Sheriff cannot provide a proposal until he resolves the issue with the County Commission. City Manager Baldwin proposed we advise the Sheriff that we are willing to extend the contract for another year under the existing conditions. It was the consensus of the Commission to send the letter to the Broward County Sheriff requesting a one year extension to the current contract. City Manager Baldwin noted we are negotiating with Waste Management for the commercial solid waste collection. He further stated that we will advertise and go out to bid for the residential component. City Manager Baldwin asked if the Commission would lower the Pier admission fees by 50% during the summer months. He noted that this reduction would cost the City approximately $18,000.00 City Attorney Ansbro will bring a resolution forward at the next meeting to be effective retroactively. Colin Donnelly, Assistant City Manager, provided a memo on the TIGER Grant to the Commission. He noted that considering the selection criteria required for this grant, this is the perfect funding vehicle to finance the City's aspirations to become a marine center. Assistant City Manager Donnelly indicated that we should hire a Planning Consultant that specializes in transportation, to help with the Transportation Investment Generating Economic Recovery (TIGER) Discretionary Grants Program. The cost involved in hiring a consultant is estimated at $50,000.00, which would most likely be funded by reserves. It was the consensus of the Commission to move forward with the TIGER Grant and hire a consultant.
