A RESOLUTION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING
THE SITE PLAN REQUEST(SP-31-09)SUBMITTED BY MERRILL ROMANIK
WITH THE FIRM CUBELLIS, INC, REPRESENTING THE CITY OF DANIA
BEACH FOR PROPERTY LOCATED AT 100 WEST DANIA BEACH
BOULEVARD,IN THE CITY OF DANIA BEACH,FLORIDA;PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building
permit; and
WHEREAS,Merrill Romanik,with the firm Cubellis, Inc.,representing the City of Dania
Beach,is requesting site plan approval to allow construction of a 10,000 square foot public library in
the City of Dania Beach; and
WHEREAS,the Planning and Zoning Board on September 14,2009,recommended that the
City Commission grant the site plan request(SP-31-09),based upon the criteria set forth in Section
8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-31-09) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A"is approved with the following
conditions:
1. Please substitute the row of six Alexander Palms in the northwest corner of the site with a
row of six coconut palms. The designation for the existing Alexander Palms should be
changed from relocation to removal. This change is for the landscaping to more closely align
with the City's landscape concept described by the CRA Director(Landscape Consultant).
2. The above change will require compensation for removal of canopy,which will be satisfied
by the new coconut palms (Landscape Consultant).
3. At the eastern side of the northern entrance to the site(across from the location of the row of
six palms referred to in comments 1 and 2),please change the live oak closest to the entrance
to a cluster of 3 single stem coconut palms (min,. 6' grey wood) (Landscape Consultant).
4. On the southern side of the row of 3 parking spaces in the northeast corner,please remove
the designation for relocation of the existing holly tree and change the designation for that
tree to removal. Instead, please plant three Coconut Palms (min. 6' grey wood) in this
location. One of three Coconut Palms will count as replacement of the canopy removed by
the loss of the holly tree, with the other 2 being surplus to code requirements. Due to the
confined space, the proposed Cocoplums (on the south side of the walkway) should be
removed as well (Landscape Consultant).
5. Four Live Oaks are proposed in excess of the number of trees required by the code. After the
change from comments above,there will be 3 excess Live Oaks and 5 excess Coconut Palms.
These Live Oaks and Coconut Palms that are above code requirements maybe used to help
offset the specimens tree replacement cost. To compensate for the value of these additional
trees,please lower the fee to be paid to the Tree Trust as follows:Current total($42,700.00)-
$405.00 per Oak and $216.00 per Coconut=$40,405.00 (Landscape Consultant).
6. Please update the existing tree and palm resolution table and the plant list in accordance with
comments 1-5 (Landscape Consultant).
7. Please make the following changes to the proposed shrub planting in order to more closely
align the project with the City's landscape concept described by the CRA Director.
i.Replace Gold Mound with Simpson's Stopper
ii.Replace Green Siland Ficus with Dwarf Firebush
iii.Replace Viburnum with Spanish Stopper
8. To increase visibility from the traffic circle to the south of the site, please replace the
Cocoplum along the southern border with dune sunflower,which will be counted as shrub
equivalents in this location(Landscape Consultant).
9. Please submit an irrigation plan at the time of tree removal permit application (Landscape
Consultant).
10. Fire flow demands — calculations to be signed and sealed by engineer of record (Fire
Marshal).
11. Water Supply must be adequate for building demand(Fire Marshal).
12. Flow test required after new water main installed(Fire Marshal).
13. 6" diagonal orientation is shown incorrectly. Please resolve and denote spacing between
strips (Public Services).
14. Clarify use of the"bay"(drop off for library)along 1st Avenue and show appropriate related
signing(Public Services).
15. Show all crosswalks existing and proposed prior to final approval (Public Services).
16. Please provide valley gutter through driveway entrance to allow flow in gutter to continue to
catch basin west down West Dania Beach Boulevard(Public Services).
17. Please ensure all curb ramps are labeled with proper CR#(Public Services).
18. Please add a legend for different concrete hatches shown on plans (Public Services).
19. Please define "temporary sidewalk" and provide details as necessary. Please ensure
sidewalks across driveways are 6"thick. Revise detail on C4 according(Public Services).
20. Please show grades at SW corner of 0 Avenue and West Dania Beach Boulevard to ensure
no ponding is caused by proposed widening(Public Services).
21. Clarify proposed drainage on west side of SW 1"Avenue where proposing D curbs with
sidewalk(Public Services).
22. Dip water main on SW 3 Avenue, south end needs to be connected to existing 10" water
main south of existing 6"water main on Park Street(Public Services).
23. Please revise the concrete pavement and sidewalk detail note#3 to include 6"thick concrete
required where sidewalks cross a driveway(Public Services).

24. Please show 4"limerock curb pad in"Type D Curb Detail"and"Pavement and Curb detail
adjacent to sod". Revise Sheet SP-002. Also, typical parking detail — 6" wide striping
(Public Services).
It is further noted that the original site plan is maintained in the office of the Community
Development Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p)of Article 1 of Chapter
8 of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically
expire and become null and void unless the applicant files a complete building permit application
and submits complete contractor drawings within twelve (12)months from the date of approval of
the site plan by the City Commission and the applicant obtains a building pemvt(including payment
of all fees)within eighteen(18)months of the date of this Resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
