HomeMy WebLinkAboutR-2009-176 Site Plan City Hall Parking Garage RESOLUTION NO. 2009-176 A RESOLUTION OF THE CITY OF DANIA BEACH,FLORIDA, APPROVING THE SITE PLAN REQUEST (SP-29-09) SUBMITTED BY HANK THOMAS WITH THE FIRM GREENHILL DEVELOPMENT COMPANY,REPRESENTING THE CITY OF DANIA BEACH FOR PROPERTY LOCATED AT 100 WEST DANIA BEACH BOULEVARD, IN THE CITY OF DANIA BEACH,FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS,Hank Thomas,with the firm Greenhill Development Company, representing the City of Dania Beach,is requesting site plan approval to allow construction of a 449 car parking garage and 36,644 square feet of office/retail building in the City of Dania Beach; and WHEREAS,the Planning and Zoning Board on September 14,2009,recommended that the City Commission grant the site plan request(SP-29-09),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-29-09) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A"is approved with the following conditions: 1. Building facades facing streets or pedestrian spaces shall incorporate appropriate architectural features to enhance the aesthetic environment. These features must conform to the chosen style of the building, and must include cornice detailing, ornamentation, moldings,changes in materials and textures,color variations and other architectural sculpting that enhances the ground level and adds interest and appeal to the building's exterior. Address the northern elevation of the garage accordingly. 2. The applicant must relocate all utilities prior to issuance of a building permit. • Comcast — has existing/active cable attached to the utility poles within the limits of this project. No objection to vacation provided a utility easement is established for the existing lines, or the City pays for the cost of relocating lines. • BellSouth/AT&T — No objection to the vacation or right-of-way, however the cost of removal of the existing facilities must be paid before vacation can begin. • Teco Peoples Gas—has facilities within the referenced area to be vacated. No objection to this vacation providing a utility easement is incorporated in the replat, or the applicant will pay for the relocation or replacement of these facilities. • Florida Power & Light — FPL cannot abandon the existing easements until such time as arrangements have been made to remove its facilities at the Customer's expense and adequate easement is provided necessary to relocate any existing customer's services. • Public Services —No objection to vacating the road. Cost to relocate the utilities will be included in the library budget. 3. Cameras CCTV:recommend installing a camera system at the entrance to monitor vehicles as they enter and exit. Install cameras in the stairwells and at the elevators on each floor. The recording system could be placed inside a meter room or a direct line to the police station(BSO). 4. Tree protection fencing is not shown for trees to remain in the NW corner of the site, and existing trees to remain are not included on the Existing Tree and Pal Resolution table. Please update the plans accordingly(Landscape Consultant). 5. Replace proposed mahogany trees with gumbo limbo (Landscape Consultant). 6. A hedgerow appears to be easily accommodated in line with the row of trees on the west side of the dry retention area along the west side of the property. Please incorporate a hedge row in this location to meet perimeter buffer requirements (Landscape Consultant). 7. Please submit the irrigation plan at time of the tree removal license application(Landscape Consultant). 8. Please replace green island ficus with Simpson's stopper(Landscape Consultant). 9. Please add to the remarks for the proposed Sable Palms that they are to be booted(Landscape Consultant). 10. Please replace existing Sable Palms with new booted Sables as opposed to relocating the trees. Existing Sables are in poor physical and aesthetic condition(Landscape Consultant). 11. In the plant list, 6 Verawood are listed, with 4 designated toward VUA landscaping and 6 designated as canopy replacement trees. Trees may not be double-counted, please adjust plans accordingly(Landscape Consultant). 2 RESOLUTION#2009-176 12. In the Landscape Code Requirements Table, 15 Coconut Palms are counted but only 12 are shown on the plant list(Landscape Consultant). 13. Comparing the Plan List to the Code Requirements Table, it appears that 2 pigeon plum, 5 live oaks and 10 sables are proposed in excess of those attributed toward landscape code requirements. Based on the Landscape Requirements Table, it appears that an additional 4 trees are proposed beyond landscape requirements. Please utilize some of these 21 trees/palms identified above to meet the shortfall identified in comments above. The remainder of these trees should be used to reduce the amount of fees required for the Tree Trust Fund. To do this, multiply the tree cost(average Plantfinder cost)by 2.7 (Landscape Consultant). 14. The handicap space does not seem to work from a traffic flow point of view. Please redesign (CRA Director). 15. Landscape needs to be more tropical (CRA Director). 16. Remove plantings from temporary park south of City Hall (CRA Director). 17. Remove landscaping from inside of dry retention area. The plantings will have to be removed during Phase 2 or 3 (CRA Director). 18. More ground covers and plantings are needed `around' the dry retention areas (CRA Director). 19. What happened to the fountain in the traffic circle? There is no landscaping inside of it (CRA Director). 20. There should be no hedges in front of the new office building. Trees should be in tree wells with possible grates. Explore the use of double washy's etc (CRA Director). 21. For the entry feature, explore the use of Medjools,etc. (CRA Director). 22. The planting on the south of the garage looks sparse (CRA Director). 23. The AHJ is requiring the structure's fire flow demand. You may use NFPA 1,2006 edition, Annex H or The Guide for Determination of Needed Fire Flow,latest editions,as published by the Insurance Service Office(ISO). All calculations must be demonstrated and provided. Fire flow calculations shall be prepared by a professional engineer currently licensed in the state of Florida for each newly constructed building(Fire Marshal). 24. Change the note on sheet PH-1-PM to reflect clearances of 7'6"in front of and to the sides of the fire hydrant, with a 4' clearance to the rear of any hydrant or fire protection appliance (Fire Marshal). 3 RESOLUTION#2009-176 25. Provide a class 1 standpipe system for the garage. See the Fire Marshal for locations of standpipes and exterior FDC's. Hydrant must be within 100' of the exterior FDC's. Please demonstrate the standpipe locations in the stairwells and at the west end of the garage as agreed in meeting at 8/5/09 (Fire Marshal). 26. Provide a copy of the complete set of approved plans in PDF format on CD-Rom disc (Fire Marshal). 27. From pervious review: "provide a FIRM elevation certification demonstrating the proposed finished floor is set one foot above the certified elevation." The response statement by the respondent regarding the 100 Year Flood Elevation fails to identify the source to justify the 7.5 NGVD elevations sited. Please address (Public Services). 28. Drainage calculations provide by the respondent includes 2 independent basins and a single retention area for both attenuation and quality volumes. The 2 basins are interconnected by pipes; however, this interconnection is not modeled as required for equalization. This may explain the difference in maximum stage elevations between basins. Please provide flood routing calculations that match the drainage design (Public Services). 29. Since the designated retention area is being used for storm runoff attenuation and quality, please explain the function of exfiltration trenches shown on plans (Public Services). 30. The approval is conditioned upon the entry by the applicant into a development agreement with the City. It is further noted that the original site plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 84(p)of Article 1 of Chapter 8,of the Code of Ordinances of the City of Dania Beach,all site plan approvals shall automatically expire and become null and void unless the applicant files a complete building permit application and submits complete contractor drawings within twelve(12)months from the date of approval of the site plan by the City Commission and the applicant obtains a building permit(including payment of all fees) within eighteen (18) months of the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 4 RESOLUTION#2009-176 Section 4.
