RESOLUTION NO. 2009-175 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SPECIAL EXCEPTION REQUEST SUBMITTED BY HANK THOMAS WITH THE FIRM GREENHILL DEVELOPMENT COMPANY,REPRESENTING THE CITY OF DANIA BEACH, FOR PROPERTY LOCATED AT 100 WEST DANIA BEACH BOULEVARD, DANIA BEACH TO ALLOCATE 180 RESIDENTIAL UNITS; 42,644 SQUARE FEET OF COMMERCIAL, AND 180 HOTEL ROOMS;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Zoning Code,Chapter 28,"Zoning",Article 21,"Downtown Transit Oriented Development(TOD)and Transit Oriented Corridor(TOC)Districts"provides for all permitted, conditional and special exception uses within the TOD/TOC zoning district; and WHEREAS,Hank Thomas with the firm Greenhill Development Company,representing the City of Dania Beach, is requesting site plan approval for the proposed construction of a 449 car parking garage and a 36,644 square feet office/retail building; and WHEREAS,the applicant is requesting a special exception relating to a conceptual master plan for the future development of a new City hall,residential building,two restaurants and a hotel which requires the assignment of residential units, commercial square footage and hotel rooms as follows: 1) 180 residential units, leaving 2,225 residential units remaining in the Local Activity Center(LAC); 2) 42,644 square feet of commercial use, leaving 48,956 square feet of commercial use remaining in the LAC; and 3) 180 hotel rooms, leaving 334 hotel rooms remaining in the LAC, for property located at 100 West Dania Beach Boulevard, City of Dania Beach; and WHEREAS,the Planning&Zoning Board on September 14,2009,recommended that the City Commission grant the special exception request,based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations", Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-42-09,for special exception approval for the following: 1) 180 residential units, leaving 2,225 residential units remaining in the Local Activity Center(LAC); 2) 42,644 square feet of commercial use, leaving 48,956 square feet of commercial remaining in the LAC; and 3) 180 hotel rooms, leaving 334 hotel rooms remaining in the LAC, for property located at 100 West Dania Beach Boulevard,in the City of Dania Beach,(a copy of which application is attached and made a part of this Resolution as Exhibit "A"), is approved, with the following conditions: 1. There is currently a plat dedication restriction on the City Hall parcel indicated a"park"use of the property. If still in place,this would conflict with the proposed residential/commercial use. Although the subject parcel has not been used for a"park," and even though the City has acquired the reversionary interest(and thus any contrary use would cause ownership of the parcels to revert to the City resulting in a merger of interest),in the replat the notation on this parcel as"park"and dedication should be removed. Must replat the property to address this issue prior to site plan approval. 2. The property must be platted prior to construction of the residential or commercial building on the City hall site. 3. Proposed hotel, restaurants and residential building must be submitted for full site plan review and approval. 4. Maximum height = 7 stories/80' + 7 stories (w/bonus) = 150' permitted; 145' proposed. Identify what bonuses are being applied to allow the proposed building height as part of site plan application. 5. A total of 62,644 s.f. (excluding library) requires 3 loading spaces; only 2 are provided. Must identify as part of site plan application. 6. Parking: • Restaurant=must provide s.f.of customer service area to calculate required parking. If40% of the total restaurant floor area is used as customer service area then 32 parking spaces would be required. • Residential=must provide number of bedrooms in each unit to calculate required parking. If all 180 units are 1 bedroom, 270 parking spaces would be required. 2 RESOLUTION#2009-175 • 472 parking spaces to be provided in residential building garage, additional information is needed at time of site plan application to confirm parking calculations. 7. The approval is conditioned upon the entry by the applicant into a development agreement with the City. Section 2. This approval shall automatically expire and become null and void unless the applicant submits a building permit application and construction drawings within 36 months (3 years) of the effective date of this Resolution, and unless the applicant obtains a building permit (including payment of all fees) within 6 months from the date the building permit application is submitted. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
