A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, RELATING TO THE AWARD OF DESIGN AND
BUILDING OF A NANOFILTRATION WATER PLANT; AUTHORIZING THE
AWARD OF BID TO CDM CONSTRUCTORS, INC. IN THE AMOUNT OF
$8,820,923.00; AUTHORIZING THE CITY MANAGER TO EXECUTE THE
AGREEMENT; DESIGNATING AUTHORIZED REPRESENTATIVES;
PROVIDING ASSURANCES; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission adopted Resolution 2002-120 approving the Water,
Wastewater and Stormwater Facilities Plan; and
WHEREAS,the Nanofiltration Water Plant is a major part of the plan; and
WHEREAS, advertisements for bids were placed in local newspapers on April 9 and
16, 2009; and
WHEREAS, on June 5, proposals were received from seven firms; the five (5) person
City selection committee evaluated the seven proposals and met on June 18, 2009. At the June
18 meeting, the scoring indicated that two of the firms had much higher scores than the rest of
the firms. As a result, the selection committee requested cost proposals from only the two top
ranked firms; and
WHEREAS, on August 18, the City received sealed bids from the two remaining bidders
which showed CDM Constructors, Inc. to be the low bidder as follows:

; and
WHEREAS, the City and its project management consultant are comfortable that the
costs provided by CDM Constructors, Inc., are reasonable when compared to other bids and that
CDM Constructors, Inc. can perform the work, and therefore recommend the bid be awarded to
the low bidder, CDM Constructors, Inc. in the amount of $8,820,923.00 ($9,070,923.00 less
Allowance 1 in the amount of$250,000.00);
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the foregoing findings are incorporated by this reference and made a
part of this Resolution.
Section 2. That the bid be awarded to the low bidder, CDM Constructors, Inc. in the
amount of$8,820,923.00.
Section 3. That the first $2,550,000.00 of the loan monies will come in the form of a
principal forgiveness loan provided through ARRA stimulus funds, to the City of Dania Beach,

with the remainder coming from a supplemental SRF loan through the Department of
Environmental Protection under the State Revolving Fund for project financing.
Section 4. That the City Manager is designated as the authorized representative to
provide the assurances and commitments required by the loan.
Section 5. That the City Manager is designated as the authorized representative to
execute the agreement which will become a binding obligation in accordance with its terms
when signed by both parties. The City Manager is authorized to delegate responsibility to
appropriate City staff to carry out technical, financial, and administrative activities associated
with the loan agreement.
Section 6. That all resolutions or part of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 7. That this Resolution shall become effective immediately upon its passage
and adoption.
