A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
THE SITE PLAN REQUEST(SP-30-09)AND LAND USE FLEX ASSIGNMENT
(LUF-33-09) SUBMITTED BY JON M. GRANT, GRANT VENTURES DANIA
CONDOS LLC, FOR PROPERTY LOCATED AT 4638 SW 32ND AVENUE, IN
THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building
permit; and
WHEREAS, Jon M. Grant, Grant Ventures Dania Condos LLC, is requesting site plan
approval (SP-30-09) for the proposed construction of a 56 foot tall, 28,732 square foot apartment
building with 20 units,a pool,and a dock providing for 10 boat slips on one(1)acre of propertywith
Irregular Density(10)future land use designation utilizing the assignment of 10 Residential Land use
Flex units(LUF-33-09), for property located at 4638 and 4648 SW 32"d Avenue,in the City of Dania
Beach; and
WHEREAS,the Planning and Zoning Board on September 14,2009,recommended that the
City Commission grant the site plan request(SP-30-09)and the assignment of 10 Residential Land
use Flex units(LUF-33-09),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8
of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application(SP-30-09)for site plan approval and assignment
of land use flex (LUF-33-09), a copy of which is attached and made a part of this Resolution as
Exhibit"A" is approved subject to the condition that the variance requests are approved subject to
the following conditions:
1. A tree removal license application is required prior to commencing work.
2. A Broward County Surface Water Management permit is required to obtain final permit
approval.
3. Final drainage calculations are required prior to final permit approval.
It is further noted that the original site plan is maintained in the office of the Community
Development Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 84(p)of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan and flex unit assignment
approvals shall automatically expire and become null and void unless the applicant files a complete
building permit application and submits complete contractor drawings within twelve (12) months
from the date of approval of the site plan by the City Commission and the applicant obtains a
building permit (including payment of all fees) within eighteen (18) months of the date of this
Resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Darla Beach Grant Ventures LLC is requesting the following variances for its proposed apartment project.
at 4638/4648 East 32nd Ave:
• We aree requesting an increase In allowable building height from 35 feet to 43 feet plus an
additional-8 feet for roof ornaments that screen mechanicaj equipment and the elevator
penthouse
• We are requesting an increase in the number of units from the surplus density pool of 10
dweging units
• We are requesting a reduction of total parking spaces required from 47 spates.to 40 spaces on
site and 4guest spaces provided on the street:to front of"the project:
justification for these variances is based on a response to Dania,Zoning Cedes settion 1Q.13.
I have Included a response to each applicable subsection as follows:
raj The base elevation ufthis property is 3 feet above-sea level.In 2007 new Dania Beach Building
Code stated that the first floor of all structures In Dania must beat elevation 4 which is one foot
above FENIA regulations,Zoning regulations require that elevation calculations be taken from
elevation H even though elevation 91s a zoning requirement which reduces the height by one
foot for all properties located in low lying areas.This area will be impacted by the noise of the
proposed new runway from Ft.Lauderdale Haywood Airport,to address:jnctsasing housing
options ar4econclotic and cultural diversity of the,neighborhood,This direction points to the
development of%vorkliorce or better market rate'apartmerMs,which will require greater density
to be viable.The:narrow/deep shape of these lots with the most desirable view to the rear as
well as the counVt request for a mangroyesanctuary and almost total repiantingof existing
vegetation has dramatically limited the building fc>atprint for the site.These factors require an
additional 8-feet of building height at the parapet and the inclusk+n in that height of an
additional story of apartments to make this project wtsrkable,We also need additional height for
roof ornaments that abscure rooftop equipment and give the building a most residential
character.

The project will be usingthe land,as is,without anysignificant modifications. rta significant
changes have been made to the land prior to this application outside of required removal of an
antiquated structure that was deemed by the City of Dania Beach as a.hazard. No grading or
modification to the elevation of the site occurred during this maintenance project. This
property Is surrounded on East 32"Ave by poorly maintained,high density few Income,
multifamily housing.constructed at elevation 6:or above including a four storyufffce building at
the Intersection of East 32 Ave,and Griffin Road and a four story senior apartment building at
the intersection of East V"'Ave,and 44t' Street.The development of this market rate project
will set a new standard for this neigistrorhood;which the community agrees is in need of
renewal and economic diversification,The project Will also feature complete handicapped
accessibility,sustainable design features and increased vegetative buffers on all sides',
There are two other existing properties on this street with 20 units per acre or higher densities
which have:had no negative~on the health;safety or welfare of the neighborhood.
This property is 300 feet deep and abuts a OD wide Canal-with a 6t1400t.uplands dredging across
the canal making neighboring front and rear properties quite a distance away and reducing the
apparent Height of this structure..
We have tequested.that our two and three bedroom units provide only 2 parking spaces;
Residents of-the two and three bedroom units will be required in their lease to not park or own
more than two vehicles and have their guests use the 4 spaces provided in front of the project,

increasetheprobabilityof maintaining full cceupartcy
(d) Granting this variance will provide the applicant With the:minimum relief required to create a
well conceived and architecturally attractive multl-family,structure on.8 narrow(deep lot that
shins the canal.This property is consistent with the latest area planning report for the
neighborhood,encouraging handicapped accessibiity,increased etanomltdlvetsity,and
sustainable design.

this land Insurmountable The height restriction makes it impossible to use roofs ornaments and
parapets to hide roof top equipment that will affectthe visual quality of the project in the
neighborhood:
ltj The variances requested are the minimum required to provide the architecturally balanced,
attractive,sustainable;economically diverse,complex we have envisioned that will meet the
directives of the area planning report.

(g) The development of this site,as a high quality multifamily housing project,will increase the
values of the properties on East 320"Ave,Which have multifamily toning.The generous rear and
front setbacks will make the apparent height of this structure lowerto residents across East 32'a
Ave and to those across the canal.The project includes upland dredging,which will Increase the
[ width of the So foot wide canal by 30 feet to 90 feet,and all docks will be recessed to provide
no Interference with neighboring docks or boat trMffieflow.The landscaping of the project,
j fncludns two mangrerveretention zones,will be the most dense and attracdve:on the street.It
will become a model of Best Management Practices and will perform as such. We will create
sidewalks and on street parking spaces in front of the complex.The project win use bollard and
i box lighting fixtures to reduce any impact the parking jot and rear yard/dock lighting may
otherwise have on neighboring properties.The tandem parking spaces we use for the apartment
unitsW41 minimize paving on.the site and thus re4cee storm water impact while increasing
Infiltration,purificaticin and retention standards;all key components of the sustainable design
features of the project and in keeping with desired Best Management practices.
