HomeMy WebLinkAboutR-2009-225 Stirling Station Delegation Request RESOLUTION NO. 2009-225 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST (DR-44-09) SUBMITTED BY CARLOS FONTECILLA REPRESENTING NW 79TH STREET STATION, INC, TO CONSTRUCT A NEW 200 FOOT ACCESS DRIVE ON THE PLAT KNOWN AS THE "GREENSLEEVES PLAT", FOR PROPERTY LOCATED AT 4051 STIRLING ROAD; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary plat known as the "Greensleeves" Plat was approved by the Broward County Commission and recorded in the Official Records Books on February 9, 1995; and WHEREAS, Carlos Fontecilla, Owner and Managing Member of NW 79`h Street Station, Inc., desires to amend the plat by constructing a 200 foot access drive from SW 40`h Avenue east of the existing gas station facility as legally described in Exhibit "A", copies of which are attached to this Resolution; and WHEREAS, Broward County requires that the City Commission of the City of Dania Beach concur with this revision prior to a review by the Broward County Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City of Dania Beach approves the revision amending the "Greensleeves Plat" (Plat Book 157 Page 33) by adding a new 200 foot access drive on SW 40`h Avenue, on the east side of the referenced Plat provided the following items are addressed by the applicant prior to obtaining a building permit for construction of the drive: I. The applicant must meet all Broward County and FDOT requirements for changing the NVAL. Please contact Broward County Development Management Division for additional information about obtaining County Commission approval (Public Services). 2. Water quality for the additional impervious areas must be accounted for and copies of the approved drainage permits provided (Public Services). 3. Please add the following language as a note to your final print that you submit to the City: A pre-construction meeting with the Dania Beach City Landscape Consultant is required prior to landscaping activities including removal and relocation of trees and/or installation of plant material. Call 954-924-6805 a minimum of 5 days prior to desired start date to schedule pre-construction meeting. (Landscape Consultant) Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
