Call to Order/Roll Call Mayor Castro called the meeting to order at 7:00 p.m. Present: Mayor: Anne Castro Vice-Mayor: C.K. "Mac" McElyea Commissioners: Bob Anton Walter Duke Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Gary Garofalo, Chaplain, American Legion Post #304, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Green Power Lighting Solutions—City Manager City Manager Baldwin removed this item from the agenda. 3.2 Special Event Request for the Big Car Show-Off and Toy Drive to be held at Boomers, 1700 NW I` Street, on December 13, 2009 from 12:00 p.m.— 6:00 p.m. Commissioner Jones motioned to approve the Special Event request for the Big Car Show- Off and Toy Drive; seconded by Vice-Mayor McElyea. The motion carried unanimously. 3.3 Request by the Dania Beach Improvement Committee for the use of 4 Shuttle Buses, and a waiver of the $55 per hour fee, for the 2"d Annual Dania Beach Historic Homes Tour to be held on Saturday, December 5, 2009 from 12:00 p.m. —4:00 p.m. Commissioner Jones motioned to approve the use of 4 Shuttle Buses and waive the $55 per hour fee for the Historic Homes Tour; seconded by Commissioner Anton. The motion carried unanimously. Item #3.4 was heard after Item #3.5 3.4 Update on the A I A Celebration and Ribbon Cutting Ceremony—Jimmy Crimminger Jimmy Crimminger, 237 SW 15d' Street, noted that the celebration designating SR AlA corridor as a Florida Scenic Highway will be held on Wednesday, November 18, 2009 at 4:30 p.m. at Bonnet House Museum and Gardens. He provided a history of the request for the designation which originated in April, 2003. Mr. Crimminger advised that the Florida Scenic Highways Program was developed to preserve, maintain, protect and enhance Florida's outstanding historical, archaeological, recreational, cultural, natural and scenic resources. He thanked the sponsors of the event and invited everyone to attend. Item #3.5 was heard after Item #3.3 3.5 Special Event Request for the Harleys & Hot Rods Cruise Night to be held at Dania Jai Alai as an ongoing monthly event on the I" Tuesday of every month beginning December 1, 2009 Commissioner Jones motioned to approve the ongoing monthly event request for Harleys & Hot Rods Cruise Night for 6 months; seconded by Vice-Mayor McElyea. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Jimmy Crimminger, 237 SW 15`h Street, noted he attended a free training class sponsored by the Chamber of Commerce, the Dania Beach Library and City Bank Financial Services. He also attended the grand opening of the newest cruise ship terminal at Port Everglades. Victoria Payne, Executive Director, Chamber of Commerce, 102 W. Dania Beach Boulevard, provided an update on upcoming Chamber events. Lisa Duke, 2860 Marina Mile #109, invited everyone to attend the 8th Annual Thanksgiving Day Feast for the Dania Beach Heights Civic Association to be held on Monday, November 16 at 7:00 p.m. in the Conference Room at City Hall. Joe Van Eron, 1500 SW 2"d Avenue, congratulated the City, its elected officials and staff, as well as the entire community, for obtaining approval by the Broward County Commission of the expansion of our CRA boundaries. He also addressed the Commission for the Charter Review Board. Mr. Van Eton requested clarification that the Board operates under the Sunshine Law, Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. effective the date the Board members were appointed. He did not see any reason why it should, and asked if this requirement would only apply to the Charter Review Board. City Attorney Ansbro clarified that all the advisory boards operate under the Sunshine Law. Mayor Castro asked for all the advisory board members to be notified of this requirement. Donnie Coumbe, 2460 W. State Road 84, addressed two motorcycle events planned on State Road 84 at the Roadway Inn. He expressed concerns on the traffic and safety implications of these events. Linda Sacco, 4481 SW 38`h Terrace, spoke about the Westside Master Plan and how it might affect Davis Isles. She indicated that only six residents from Davis Isles attended the meeting held by the Mellgren Planning Group. Ms. Sacco urged the Commission to take this into consideration when the conceptual Plan is presented to the Commission for approval on November 24, 2009. Addendum 10.2 Agreement with the City of Hollywood for the purchase of water via an interconnect system Commissioner Anton introduced John Mulliken, from the South Florida Water Management District. Mayor Castro asked Mr. Mulliken to provide a summary of the issues involving Dania Beach with regards to water capacity, in connection with the approval of the application for the establishment of a Regional Activity Center (RAC). She pointed out that the City has been working hard to get everything in order however, the water issues have not been addressed in a timely manner. Mayor Castro remarked that the City is willing to correct the problems as soon as possible, not only because of the RAC application but because our residents deserve it. John Mulliken, Program Implementation Manager, South Florida Water Management District (SFWMD), noted the City has water supply issues on three major fronts: an expired drinking water permit which involves saltwater intrusion problems; the 10-year water supply plan and related comprehensive plan amendments, was found to be "not in compliance" by the Florida Department of Community Affairs; and providing enough water supply to adopt the Land Use Amendment. He noted the City does not have the adequate water supply to handle the development that would occur as a result of this amendment. Mr. Mulliken indicated the SFWMD is willing to work with City staff in order to resolve the problems; however, they currently do not have a viable option to address their concerns. He remarked that they have a responsibility to protect the water resource issues for the benefit of our citizens. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Mayor Castro asked if the SFWMD could withhold their objections to the RAC based on the fact that this Amendment would not require additional water capacity. She further noted that the City would give the guarantee that we will be working on the other two items without delay. Mr. Mulliken responded he would have to consult with the District's attorneys and executive officers. He further advised that the City does not have the water availability to serve the designated area. Mr. Mulliken noted it was highly optimistic to expect this issue to be resolved as early as April, 2010. He indicated that the Broward County Planning Council's deadline for a response is November 18, 2009, in order to prepare for their December 3 meeting. Mr. Mulliken explained the requirements in the event the City would like to delay the Amendment to the next cycle in February, 2010. He said that they have not come up with a viable alternative to an agreement for water. Commissioner Anton noted it is hard for the Commission to accept that we should have taken care of this issue a long time ago however, we now need to resolve the problem. He noted he is willing to meet with the SFWMD executives to discuss this issue. Commissioner Anton asked Mr. Mulliken to explain the definition of a horizontal well and how it could be applied to our case. Mr. Mulliken briefly explained how a horizontal well would work. He further noted that their Water Supply director could provide more details of their experience to not proceed with horizontal wells. Mr. Mulliken further stated that there is no commitment within their district for using horizontal wells at this time. Commissioner Duke noted that today he had a very informative conversation with Mr. Mulliken and the SFWMD staff. He also indicated that he has spoken with the City Manager for the City of Hollywood on several occasions, regarding our water supply issue. Commissioner Duke stated that we are attempting to get the proper legal approvals to redevelop our City in the best possible way and provide our residents with water. He echoed his fellow Commissioners request for the SFWMD to help us during this precarious situation. Commissioner Duke asked Mr. Mulliken if he was optimistic about our approach. Mr. Mulliken thought it would be difficult to find an agreement that would allow them to satisfy their obligations without the City having to make some commitment. City Attorney Ansbro noted we have contacted about 45 people in the last few days, including attorneys and lobbyists, to help us with this problem. Mayor Castro reiterated the City's intentions and seriousness to address the water issue. She thanked Mr. Mulliken for his time and Commissioner Anton for arranging this presentation. City Manager Baldwin noted that he would like to meet with each Commissioner to review the proposed agreement with the City of Hollywood and make modifications if necessary. He read the memo he sent to the Commission which is attached to and incorporated into these minutes. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Bob Daniels, Director of Community Development, presented a PowerPoint overview of the issue, which is attached to and incorporated into these minutes. Commissioner Duke questioned who prepared the Water Plan that was rejected. Leigh Kerr, Planning Consultant for the City of Dania Beach, noted he worked with Fred Bloetscher and Dominic Orlando on the Water Plan. Vice-Mayor McElyea noted we used to have a very good deal with Hollywood but somebody dropped the ball. He offered his assistance in this matter. The workshop will be combined with the Special Meeting on November 17 at 7:00 p.m. Derrick Hankerson, 746 SW 3`d Street, noted he is stunned. He asked if the City was notified that the permit expired in 2006. Mr. Hankerson spoke about the $8.8M contract for the Nanofiltration Plant and questioned the ramifications if the contract is broken. Mr. Mulliken responded the status of the permit is that they are continuing to work with the City in order to satisfy all of our needs. Item #10.3 was heard after Item #10.2 10.3 Follow-up Discussion to the SE Traffic Calming Workshop Magaly Fernandez, 415 SE 4`' Terrace, would like the Commission to think about what they are going to do and consider the neighborhood. Elizabeth DelSapio, 417 SE 4t' Terrace, provided a handout to the Commission. She provided her opinion on what should be done which is Option #1, i.e., keeping the new alignment of the road but not adding any speed humps adjacent to her street. Ms. DelSapio indicated that Dominic Orlando made false statements last night and she is surprised the Commission has not brought him to task. She wants the Commission to tell Mr. Orlando that this is a priority. Ms. DelSapio further requested that the City stand by their commitment and put the road back the way it was. She read her second prepared speech. Ms. DelSapio stated that she was confident that the City would do the right and acceptable thing to the majority of the residents. She added that she wants to make sure that what the residents see in the drawings, matches the engineer's specifications. Mark Mechanic, 409 SE 4t' Terrace, noted his position is to put the road back to its original configuration. He said the raised intersections should not be a consideration. Mr. Mechanic noted he is not against slowing down traffic, but he is confused as to how to fix the problem. He questioned if Mr. Orlando has been reprimanded and subject to termination due to this project. Mayor Castro clarified that staff responds to the City Manager, not the Commission. Vice-Mayor McElyea noted that Mr. Orlando has saved us a lot of money in the City. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Sue Rybski, 406 SE 4`h Terrace,thought people concluded that by eliminating the circle, the City would get rid of all the calming devices. She noted there are two locations that need traffic calming, but not her street. Ms. Rybski also indicated that she had an issue with her sewer line; she spoke with a lady in Public Services who was kind enough to send someone to check what the problem was. She advised that the Public Services employees were not helpful and did not want to get involved. Ms. Rybski expressed her frustration and disappointment with the way Public Services handles the residents' issues. Diane Holleger, 416 SE 4th Terrace, provided a handout to the Commission. She complained about the sidewalks and expressed her disappointment to see that nothing has been done. Ms. Holleger also wants the curb removed. She said she does not want the raised intersection and questioned what the new plan looks like. Mayor Castro noted there is no new plan yet; last night we only discussed options. David Clark, 411 SE 5`h Street, complained nothing has been done in a month. He remarked that the Commission voted 5-0 on October 13, to make them whole. Mr. Clark said the City needs to take care of this matter now and address the traffic calming at a later date. Geri Massaro, SE 4`h Terrace, wants the bulldozers out there without further delay. She complained that a teenager was driving in the roundabout area and that this issue has now become a safety hazard. Dominic Orlando, Director of Public Services, noted the storm drainage was modified; it cannot be put back to original; it needs to be redesigned. He proposed the same alignment and transition as the sidewalks for the Linear Park. Director Orlando indicated that it will cost over $3M to fix the storm drainage. He clarified that the flooding should not be any worse on the two impacted properties. Director Orlando thought they had begun working in the affected area last week however, he will visit the site to confirm this statement. Commissioner Duke said the SE Traffic Calming Plan has merit. The residents have spoken loud and clear; everyone agrees they want traffic calming on SE 5`h Avenue, and the circle needs to go. He remarked that we need to revisit the SE 5`h Avenue traffic calming issue. Commissioner Duke noted that Mr. Orlando said the cost could be lower than what he said last night. Commissioner Duke motioned to direct staff to re-mobilize the contractor immediately to raise the existing improvements, and return the intersection and impacted homeowners street and road improvements to its pre-construction status, as quickly as possible; seconded by Vice-Mayor McElyea. Vice-Mayor McElyea noted the City Manager needs to direct Director Orlando to make the repairs,or he can make a motion to fire them both. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Commissioner Anton noted we need to talk to the people when we go out to do the work. He indicated that Public Services staff needs to talk to the people and let them know what they are doing. Commissioner Anton said the people should not be pointing the finger to Director Orlando, but to the Commission. He noted that all the property in that circle belonged to the City, not the property owners. Commissioner Anton stated that he supports smaller traffic circles along SE 5th Avenue, even if we need to fire our traffic engineers. We need to come up with a way to take care of our own. He said that the City Manager should contact the City of Fort Lauderdale to find out how they did it. He cannot support a vote to remove the circle without knowing what we will do there. Commissioner Jones noted a majority of the people want the road back to its original configuration. Those who want traffic calming are in the minority. He will vote to put the street back to its original status because two property owners have been impacted. Commissioner Jones said we need to look at an assistant for the Public Services Director who can look at things with a fresh set of eyes. Mayor Castro supported the motion to return the roadway to its original shape. Her concern is that other property owners will be affected. Mayor Castro said to bring it back at the next meeting, not to worry about the ribbon cutting at this time. Commissioner Anton wanted a better communication between the City and the residents. He remarked the importance of keeping the neighbors informed of what is happening in their area. Vice-Mayor McElyea asked when are they going to start removing the roundabout and working on the road. Director Orlando noted he was told to wait until we had the workshop. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. It was the consensus of the Commission to begin the work as soon as possible. Item #6 was heard after Item #10.3 6. Public Safety Reports Donn Peterson, BSO Chief of Police, read the information provided via email, which is attached to and incorporated into these minutes. 7. Commissioner Jones questioned raising fees for the sake of raising fees. He pointed out that we will probably get less revenue due to the increased fees. Commissioner Jones noted he had asked for a report on revenues and what kind of programs are implemented at our parks, but has not received the information. He would like to have this information in order to understand the reasoning behind this action. Commissioner Anton questioned if this was included in the budget. He suggested we table the resolution until we have more information. Public Hearings and Site Plans City Attorney Ansbro advised the remaining items were quasi-judicial matters and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. 9.1 RESOLUTION#2009-219 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY PROPERTY OWNER JORGE FALLAD, ORNAMENTAL DESIGNS, FOR AN EXTENSION TO THE APPROVED VARIANCE (VA-59-08) BY RESOLUTION 2008-206 AND SITE PLAN (SP-58-08) BY RESOLUTION 2008-207, GRANTED ON OCTOBER 28, 2008, FOR PROPERTY LOCATED AT 102 NORTH FEDERAL HIGHWAY, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2009-219. Corinne Lajoie, Principal City Planner, noted the request is for a one year extension to a previously approved variance and site plan for a showroom/office. She advised that staff recommends approval with the previously approved conditions and phasing plan, provided the applicant obtain after-the-fact building permits for work already completed. Mayor Castro opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. City Attorney Ansbro read the title of Resolution #2009-217 and Resolution #2009-218 because they relate to the same property. The Commissioners disclosed that they met with the representatives. Corinne Lajoie, Principal City Planner, noted that the South Florida Regional Transportation Authority is requesting a landscape variance and site plan approval for the construction of the Tri-Rail parking garage. She explained the location of the property. Ms. Lajoie advised that the Planning and Zoning Board, as well as staff, recommended approval. Mayor Castro opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearings. Commissioner Anton motioned to adopt Resolution #2009-217; seconded by Commissioner Jones. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Commissioner Anton motioned to send a letter similar to the one sent by the City of Tamarac to the Broward Sheriffs Office; seconded by Commissioner Duke. Commission Comments 11.1 Commissioner Anton Commissioner Anton noted he received many comments because a Commissioner appointed his wife to a City Board. He indicated the City Attorney confirmed it is legal. 11.2 Commissioner Duke Commissioner Duke noted he will place a team in the Lions Club One Ton Tug. He challenged the rest of the Commissioners to put a team together and raise funds for charities. Commissioner Duke noted that the Tourism Council Website has improved and he hopes they continue to do so. Commissioner Duke advised he met with City Manager Baldwin, Community Development Director Daniels and Director Orlando regarding the crosswalk on SE 2"d and Dixie Highway. Commissioner Duke provided an update of all the activities he attended. Commissioner Duke thanked the men and women who serve our country. 11.3 Commissioner Jones Commissioner Jones discussed the school boundary changes and how it affects our children. Commissioner Jones asked the Commission to look at the ordinance regarding foreclosure cases which was recently adopted by the City of Fort Lauderdale. Commissioner Jones spoke about the Neighborhood Stabilization Program. He noted that the 14 entitlement cities should give ten percent for affordable housing initiatives. Commissioner Jones provided information on the Broward League of Cities Education Committee. Minutes of Regular Meeting 12 Dania Beach City Commission Tuesday,November 10,2009—7:00 p.m. Commissioner Jones advised that the U.S. Census Bureau has job opportunities available. He noted that those interested can call 1-866-861-2010 or access their Website: www.2010censusiobs.gov. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea noted the palm trees on the beach need to be trimmed, as well as the sea grapes. He also said that there is trash near the pier that needs to be removed. Vice-Mayor McElyea noted the water bills have gone up; people are complaining that some are over $200. He indicated that the residents are calling the City but nobody answers. They want the Commissioners to help out and see what is wrong, but this is a matter for staff to resolve. 11.5 Mayor Castro Mayor Castro advised she also received calls regarding the water bills. She noted that something is wrong because we have the same issue every year. Mayor Castro asked staff to look at the speed hump on SE ls`Avenue to try to stop the flooding. Mayor Castro noted she attended the grand opening of Terminal 18 at Port Everglades on Friday, November 6. The inauguration took place one week prior to the arrival of Royal Caribbean International's largest passenger cruise ship "Oasis of the Seas". Mayor Castro thanked everyone who attended the meeting held at Broward County today, where our RAC was discussed. Mayor Castro noted that we need to look at the policy on charitable organizations. City Manager Baldwin will look into the matter. Mayor Castro noted that the Living Green Fair will be held November 14-15 at John U. Lloyd State Park. She encouraged our High-School students to go to w-ww.LivingGreenFair.com and take the Mayor's Challenge. Mayor Castro explained that the City with the most participants will receive a 45 foot Wyland mural to display in their City for one year. Commissioner Anton recognized the City officials and residents who attended the County Commission meeting today. He further commended Mayor Castro for her outstanding job in representing the City. 12. Appointments Mayor Castro appointed Betty Cooper to the Dania Beach Housing Authority. Ladies and Gentlemen: Good evening. The men and women of the Dania Beach District were very busy last week and I'd like to share news of what they've been up to... The Broward Sheriff's Office joined forces with the Drug Enforcement Administration, state Probation and Parole, the Department of Health and Human Services, as well as the Hallandale, Hollywood, Lauderhill and Sunrise police departments in a massive crackdown that led to 132 arrests. The large-scale, two-day operation that ended at 2 am Saturday targeted criminal activity such as prostitution, online sexual predators, street-level drug deals and the illegal sale and distribution of prescription medication. This is the third such multi-agency operation organized by BSO in the past six months. In addition to the multiple felony arrests, the operation resulted in the confiscation of four guns, 1,842 prescription pills such as Oxycodone and Hydrocodone, 407 pounds of marijuana, 3.4 kilos of heroin, 877 grams of cocaine, eight vehicles and more than $63,000 in cash. One of the recovered guns had been reported stolen. BSO's Internet Crimes Against Children Task Force arrested two men, each on counts of possession of child pornography. Of the 132 arrests made during the two-day operation, 21 of them were made right here in Dania Beach: Day i • 4 suspects were arrested along the Federal Highway corridor for soliciting prostitution. 3 of those suspects had outstanding warrants. • 7 suspects were arrested in a reverse prostitution sting conducted at 1200 South Federal Highway. Day 2 11/10/2009 Page 2 of 2 i ' • 5 suspects were arrested for various charges including narcotics, felony traffic violations, and obstruction. • 3 female suspects were arrested for soliciting prostitution, 1 of whom was additionally charged with possession of methadone, possession of cocaine, and possession of Xanax. • 1 male suspect was arrested and charged with living off the earnings of a prostitute. • Additionally, a narcotics search warrant was served that resulted in the arrest of 1 suspect. The suspect was charged with possession of cocaine with intent to distribute (21.6 grams), possession of cannabis w/intent to distribute (121.7 grams), possession of Oxycodone and other scheduled prescription drugs. 2 firearms were seized, 1 of which was reported stolen from a burglary in North Miami. The suspect was a convicted felon who admitted to buying the stolen firearm for $20,00. Also seized was $1,860.00 as crime proceeds.
