HomeMy WebLinkAboutR-2010-003 Shaggy Dog Site Plan RESOLUTION NO. 2010-003 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE SITE PLAN REQUEST SP-39-09 SUBMITTED BY MARK ENGEL ARCHITECT, REPRESENTING THE PROPERTY OWNER RUSSEL M. LAZEGA, PRESIDENT OF SHAGGY DOG HOLDINGS, FOR PROPERTY LOCATED AT 45 EAST SHERIDAN STREET, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHERE Mark Engel, an architect representing the property owner Russel M. Lazega, President of Shaggy Dog Holdings, is requesting site plan approval to allow the construction of a 9,538 square foot addition for a proposed office building in the City of Dania Beach; and WHEREAS,the Planning and Zoning Board on December 16,2009,recommended that the City Commission grant the site plan request(SP-39-09),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-39-09) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A"is approved with the following conditions: • Fire hydrant flow tests must be completed (Fire Marshal) • Provide verification of Sanitary Waste service provider(Public Works/Planning) • Provide renderings of proposed signage (Planning) It is further noted that the original site plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p)of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless the applicant files a complete building permit application and submits complete contractor drawings within twelve (12) months from the date of approval of the site plan by the City Commission and the applicant obtains a building permit(including payment of all fees)within eighteen(18) months of the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. The site is within the CRA boundaries and more specifically the TOC-2 zoning district In order to maximize the site and to conform with the master plan and vision for the CRA,we will be renovating approximately 50%of the building and replacing the other half with a 2 story Key West style office building. The site currently has approximately 10 parking spots. In order to comply with current code with regards to handicapped parking and landscaping,the existing parking in the front of the building will be reduced to 6 spots. In addition,in compliance with the goals of the CRA,we will be providing 6 additional on street parking spots. The building as proposed would require approximately 31 spaces. In order to meet the parking requirements the site has an off street parking agreement with the neighboring Church. Since the Church is used primarily on the weekends and the office building will be used during the week,this arrangement works well. In order to get site plan approval this project will require a variance to reduce the amount of on site parking spots from 31 to 6 with the knowledge that 6 additional parking spots will be installed on street and an agreement for 33 additional spaces is in place offsite. Section 10.13 of the City's Zoning regulation sets forth the criteria for obtaining a variance. These criteria,and the responses are below: (a) That special conditions and circumstances exist which are peculiar to the land,structure or building involved and which are not applicable to other lands,structures or buildings in the same zoning district; The proposed site has been greatly reduce due to additional ROW and there is not enough room in front of or behind the existing building to provide the required parking. (b) That the special conditions and circumstances do not result from the actions of the applicant; The ROW was taken by the County from a previous owner and were not the result of any actions from Shaggy Dog Holdings,LLC. The redevelopment of the site would further enhance the surrounding properties and help reduce the amount of land used for parking. (e) That Hte Parulncc granted is the minimum vanes that will make possible the reasonable use of the land,building or structure; Every attempt has been made to maximize the amount ofparking that can be provided around the existing building. Due to the size of the lot and increased landscaping requirement,only 6 spots can be provided on the existing site. (0 That the grant of the va=J'-66 will be in harmony with the general intent and purpose of this chapter,and that such vakl41E0 will not be injurious to the area involved or otherwise detrimental to the public welfare The granting of this variance will in no way negatively effect the surrounding area. By allowing shared parking, the City can reduce the amount of land used for parking and allow for the expansion and renovation of a dilapidated structure. The renovation of the building which is dependent on the granting of the variance will greatly improve the look of the neighborhood,bring more visitors to the surrounding business and will allow for more efficient use of land and ultimately a better tax base for the city. We feel our request for a parking variance meets all the requirements of Section 10.13 of the Dania Beach Zoning Code and hope you will approve the variance.
