Call to Order/Roll Call Mayor Castro called the meeting to order at 7:00 p.m. Present: Mayor: Anne Castro Vice-Mayor: C.K. "Mae" McElyea Commissioners: Bob Anton Walter Duke Albert C. Jones City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Commissioner Jones gave the invocation followed by the Pledge of Allegiance to the United States Flag. Proclamations were heard after the Invocation Presentations and Special Event Approvals were heard after Proclamations 3. Presentations and Special Event Approvals 3.1 Special Event Request for the 41h Annual Dania Beach Vintage Motorcycle Show & Poker Run to be held on the east half of Frost Park on Saturday, January 30, 2010 from 10:00 a.m. — 5:00 p.m. Clive Taylor, 642 NE 3`d Street, co-promoter of the event, introduced Clare Frost, their bookkeeper. He said antique motorcycles seem to be on the rise and invited everyone to participate in this event. Vice-Mayor McElyea motioned to approve the Special Event request for the Vintage Motorcycle Show and Poker Run; seconded by Commissioner Anton. The motion carried unanimously. 3.2 Special Event request for a Christmas Festival to be held at Boomers on December 17, 2009—January 3, 2010 Commissioner Jones motioned to approve the Special Event request for the Christmas Festival; seconded by Commissioner Anton. The motion carried unanimously. Commissioner Anton asked for an explanation of the request for funds for the Motorcycle Show, which was included in the informational packet distributed to the Commission tonight. Clare Frost, 642 NE 3rd Street, responded that last year they were part of the Arts and Antiques Show and received money from the City. This year they are at Frost Park and need funds. She advised that they will make this a City of Dania Beach Motorcycle Show, not a part of the Arts and Antiques Show. Ms. Frost requested a donation of$1,622.00 for the event. Vice-Mayor McElyea commented he would like this event promoted like the one at Daytona Beach. Vice-Mayor McElyea motioned to approve the funding request. Commissioner Duke noted he is very supportive of the event; however, we set up a budget for these types of requests, and this should go through the process. He suggested waiting before approving the funding. Mayor Castro noted she wanted to give the City Manager the opportunity to look for funds, before approving the request. The Commission agreed to review the funds before making a commitment. The City Manager will make a recommendation. Vice-Mayor McElyea personally contributed $1,622.00 to the event. 3.3 Westside Master Plan presentation by the Mellgren Planning Group Michelle Mellgren, The Mellgren Planning Group, presented a PowerPoint overview of the Westside Master Plan, which is attached to and incorporated into these minutes. She noted she would be present at the next Commission meeting for approval of the plan. Commissioner Duke noted he is pleasantly surprised. He noted it is incumbent upon the Commission to have a unified vision for the west side and move forward with it. Commissioner Duke asked the Commission to understand that this is just the beginning. He thanked Michele Mellgren and her staff for their hard work on this project. Commissioner Anton concurred with Commissioner Duke. He reemphasized that if the South Runway goes through and we need to change the residential areas, we are trying to come up with a secondary plan for guidance as to what we can do. We need to get the plan in place and stick with it. Commissioner Anton asked Ms. Mellgren if they were planning to meet with any community groups to show them the finished product, which he thought would be a good move. Lastly, he thanked Michele Mellgren and staff for a good plan. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. Ms. Mellgren noted the property along Griffin Road could ultimately be commercial, and the mixed residential is not non-conforming. Commissioner Jones noted Ms. Mellgren and her team did an excellent job. He said that the citizens were involved during the Charettes and we should continue with their input. Commissioner Jones asked if we looked east of Griffin Road. Ms. Mellgren responded in the affirmative, and noted they did not see much work to be done there. Commissioner Jones confirmed with Ms. Mellgren that the study did not go east of Federal Highway. Vice-Mayor McElyea noted Ms. Mellgren has done a great job with this plan. Mayor Castro commended former Commissioner John Bertino for spearheading this study. She asked if staff could provide a timeline on the land use changes due to the Hometown Democracy Amendment. Bob Daniels, Director of Community Development, noted he is familiar with the plan put together by Michele Mellgren. He advised that he is already preparing a work program which will help us to understand our priorities. Commissioner Duke thanked Director Daniels, Corinne Lajoie and staff, as well as CRA Director Earle, for an excellent job. He further cautioned the Commission on the mixed land use, which may not always work. Commissioner Duke noted this is going to be a challenge for us as we attempt to redevelop Griffin Road. Gordon Ditzel, 2006 Tigertail Boulevard #8, said he is very excited about the Westside Master Plan. He noted that Delray Beach has blossomed and that is where Dania Beach needs to be. Mr. Ditzel remarked that this is great for all business owners in the City. 3.4 Green Power Lighting Solutions, LLC Presentation on L.E.D. (light emitting diode) Lighting City Manager Baldwin noted that staff has been looking into some energy conservation measures and this is a possible alternative. He advised that staff converted one office with the LED lights as an experiment and the savings are remarkable. City Manager Baldwin said that we are now in a position to recommend LED lighting and added that this is just a presentation. Peter Baker, 221 SE 2nd Terrace, noted he and two partners began this company. He advised that their company funds LED lighting and the City of Dania Beach would have no expense. They take a portion of the savings and the City uses the remainder for other things. Mr. Baker presented a PowerPoint presentation which is attached to and incorporated into these minutes. He explained that this would be the first City proposal. They would do a no-cost, no-obligation Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. snapshot survey, an energy audit, and would guarantee the savings. Mr. Baker asked for the Commission to review their proposal. Commissioner Jones commented LED is the lighting of the future. He advised that he has provided information on LED lighting to the Green Advisory Board. Commissioner Jones asked how the fixtures would be retrofitted and what the cost would be. Mr. Baker responded there is no cost to the City. He clarified that they absorb 100% of the cost and the risk, and share the savings with the City. Commissioner Jones suggested we look at this proposal to be implemented in areas that use a lot of lighting, such as parks and other facilities throughout the City. Commissioner Duke wanted the Commission to avoid jumping into something. We would be foolish not to consider it; and he recommended that we direct staff to review it and bring back recommendations/options. He said we could integrate it into our redevelopment plan. Commissioner Duke further said that it is a great idea, but we need to do it the right way. Mayor Castro noted there must be a contract and requested this be placed as a discussion item on the next agenda with a recommendation from staff. She suggested a Pilot Program so we can measure the savings. Mayor Castro also advised that staff provide the information to the Green Advisory Board. Citizen Comments were heard after Item #3.4 Proclamations were heard after the Invocation 4. Proclamations 4.1 Broward County Diversity and Inclusive Community Month Commissioner Jones presented the Broward County Diversity and Inclusive Community Month proclamation to Roland Foulkes, Past Chairman of the Broward County Diversity Advisory Council. Mr. Foulkes thanked the City for the Proclamation. He spoke about the importance of recognizing diversity and considering the expansion of inclusion. Mr. Foulkes noted that the diversity of our community is an asset that we must value. He invited everyone to celebrate in 2010, the 8ch Annual January as Broward Diversity Community Month. Commissioner Jones noted this is his last meeting as Commissioner in Dania Beach. He promised that we would be with him wherever he is. Commissioner Jones said that he serves with a group of people who make the best Commission. The electorate elects good people to become public servants. He said that he needs to find a new residence within 30 days as one of the requirements of the County. He indicated that he will never berate staff or try to put them in their place. Lastly, Commissioner Jones thanked everyone for their time. Presentations and Special Event Approvals were heard after Proclamations Citizen Comments were heard after Item #3.4 5. Citizen Comments Moses Padro, 1200 S. Federal Highway, Moe Moe's Brooklyn Hot Dogs, invited everyone to come to their restaurant. Howard Rolle & Steve Moody, 715 SW 7`h Terrace, addressed the Commission for Calvary Baptist Church. They were kicked out of the 50-50 Sidewalk program and would like to be reinstated. City Manager Baldwin will address the issue. David Clark, 411 SE 5`h Street, thanked the City for tearing out the traffic circle on SE 50' Avenue. He specifically thanked Commissioner Duke and Vice-Mayor McElyea. Mr. Clark commended the Commission for accepting their mistake and doing the right thing for the neighborhood. Victoria Payne, 102 W. Dania Beach Boulevard, Chamber of Commerce, provided an update of Chamber events. Ralph Eddy, 150 SE P Avenue, wished Commissioner Jones good luck. Patrick Phipps, 30 SW 12th Street, requested a workshop for a BSO Substation in the southwest neighborhood with citizen involvement, to discuss the needs of that section. Mayor Castro noted this should be added to the Capital Improvement Projects (CIP) workshop. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, reported a homicide on Sunday evening. One of the suspects was taken into custody and they are currently looking for another. The good news is that during the holiday season they are undertaking proactive enforcement in the corridors and shopping areas. 7. Consent Agenda Items removed from Consent Agenda: #7.3 Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. 7.1 Minutes: Approve minutes of October 22, 2009 Abatement Hearing Approve minutes of October 27, 2009 City Commission Meeting Approve minutes of November 9, 2009 SE Traffic Calming Workshop 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION#2009-226 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, PROVIDING FOR APPROPRIATION OF FUNDS FOR FISCAL YEAR 2009-2010 PERTAINING TO SCHOOL RESOURCE OFFICER COSTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2009-226. Commissioner Anton noted there was a 50150 program for the School Resource Officers. He explained that the Broward County School Board is not funding their portion of the program and the City has to pick up the cost of the officers. Commissioner Anton further advised that this is a 5-year plan and the School Board is only funding 29%, instead of 50%, which will result in an additional $86,000.00 to come from the Contingency Fund. He remarked that the School Resource Officers play an important role in our schools. Commissioner Jones noted that the City of Dania Beach has always been proactive in supporting our schools and will continue to do so. Commissioner Anton noted that City boundaries should not be taken into consideration when dealing with schools. He would like to see the County take some action which would work better for our students. Commissioner Anton motioned to adopt Resolution #2009-226; seconded by Commissioner Duke. The motion carried on the following 5-0 Roll Call vote: Commissioner Anton Yes Vice-Mayor McElyea Yes Commissioner Duke Yes Mayor Castro Yes Commissioner Jones Yes Ordinances (Titles read by City Attorney) 7.4 ORDINANCE#2009-016 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA,AMENDING CHAPTER 25,"TRAFFIC", OF THE CITY CODE OF ORDINANCES BY AMENDING SECTION 25-79, "FINES", TO INCREASE FINES FOR SPECIFIED PARKING VIOLATIONS PURSUANT TO SECTION 25-79 AND TO ESTABLISH A FINE FOR OVERTIME PARKING IN THE CITY BEACH PARKING LOT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. Commissioner Anton motioned to adopt the Consent Agenda, with the exception of Item # 7.3; seconded by Commissioner Jones. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 RESOLUTION #2009-225 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE DELEGATION REQUEST (DR-44-09) SUBMITTED BY CARLOS FONTECILLA REPRESENTING NW 79'" STREET STATION, INC., TO CONSTRUCT A NEW 200 FOOT ACCESS DRIVE ON THE PLAT KNOWN AS THE "GREENSLEEVES PLAT", FOR PROPERTY LOCATED AT 4051 STIRLING ROAD; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2009-225. Corinne Lajoie, Principal City Planner, provided an overview of the property. She noted this is a delegation request to amend the plat in order to construct a new 200 foot access drive. Ms. Lajoie advised that there are three minor comments that need to be addressed prior to the issuance of a building permit. Mayor Castro opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. The Commission disclosed that they spoke with the company representative. Commissioner Duke motioned to adopt Resolution #2009-225, subject to staff conditions; seconded by Commissioner Anton. Discussion and Possible Action 10.1 Advisory Boards—Commissioner Duke Commissioner Duke questioned how we operate the advisory boards and how efficient they are. He has found that we have an absenteeism problem, some excused, others not. Commissioner Duke did not know if there was a way to address this issue, because it is hard to get anything Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. accomplished when we do not have a good attendance. He also noted that the same people are on multiple boards. Some boards have contention and this is being addressed. Commissioner Duke thought we also need to make the boards more engaged, such as the Planning and Zoning Board. He stated that we might have an issue with the Sunshine Law. Commissioner Duke further asked the City Attorney to prepare a written notice to all board members explaining the Sunshine Law requirements as well as information on the Code of Ethics. He also asked if the City Charter provides what we do with Commissioner Jones' appointments. Addendum 10.2 Legal Services—Commissioner Duke Commissioner Duke noted that last night's workshop on legal services was immensely helpful. The item we all agreed upon was accountability. He pointed out that only Brenda Chalifour, our environmental consultant, is not accountable for her billing. Commissioner Duke asked the City Attorney to provide a written agreement with Ms. Chalifour to retain her on an as needed basis, with incremental billing. Commissioner Jones commented that this item could have been handled better. Mayor Castro asked Commissioner Duke to change his request because Ms. Chalifour is an environmental consultant, not an attorney. She also recommended that she deal with the City Manager, not the City Attorney. Commissioner Jones agreed to the request for incremental billing in 15 minutes and description. Discussion followed among members of the Commission regarding the main purpose of the workshop on legal issues. 10.3 Special Election Louise Stilson, City Clerk, explained that the City will have to hold a Special Election to fill Commissioner Jones' vacancy. She noted that after considerable discussion with the Supervisor of Elections Office, they advised that the earliest possible dates for the Primary and General Election would be March 9 and April 13, 2010 respectively. Commissioner Duke asked for the cost to cover the Special Election, as well as the funding source. City Clerk Stilson advised that the cost would be approximately $90,000 to be derived from the Contingency Fund. She further asked the Commission for approval to bring forward a Resolution calling a Special Election and another one to enter into an agreement with the Supervisor of Elections. The resolutions will be included in the Agenda for the December 10 Special Meeting. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. It was the consensus of the Commission to approve the recommendations made by the City Clerk. 11. Commission Comments 11.1 Commissioner Anton Commissioner Anton congratulated Commissioner Jones on his appointment to the Broward County Commission. 11.2 Commissioner Duke Commissioner Duke noted he is thankful for the Commission and City staff. Commissioner Duke congratulated Commissioner Jones on his advancement and political life. Commissioner Duke congratulated Bobbie Grace on her interest in re-entering the political race. 11.3 Commissioner Jones Commissioner Jones again thanked everyone for their support and allowing him to serve. He further asked when the SW Community Center would be completed. Dominic Orlando, Director of Public Services, responded it will be completed in December. 11.4 Vice-Mayor McElyea Vice-Mayor McElyea congratulated Commissioner Jones on his appointment. Vice-Mayor McElyea congratulated the City Manager and Public Services Director on the SE 5`h Avenue traffic circle. Vice-Mayor McElyea reminded everyone of the events happening this weekend, such as the Holiday Flea Market and the Historic Homes Tour. Commissioner Jones noted if we do not move forward with the dual flush toilet retrofit, the money from South Florida Water Management District(SFWMD) will go away. Commissioner Jones reported on the legislative plan approved by the Florida League of Cities. 11.5 Mayor Castro Mayor Castro noted she attended the Metropolitan Planning Organization (MPO) meeting and they approved the long range transportation plan. She let MPO know that Dania Beach would be bringing projects forward. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. Mayor Castro advised that the Broward Planning Council meeting will be held December 3, and our Recreational Activity Center (RAC) request is being presented for approval. This item will then be included in the County Commission agenda on December 8, 2009. Mayor Castro noted that the Living Green Fair was a huge success. She thanked everyone who participated and noted we came in second. Mayor Castro asked City Manager Baldwin to write a letter to David Etzler, founder of Living Green Fair, thanking them for bringing the event to Dania Beach. She spoke with Mr. Etzler about the Wyland mural which Coconut Creek will be displaying for a year. Mr. Etzler, who lives in Dania Beach, advised Mayor Castro that the mural belongs to him personally. He agreed, at the Mayor's request, to allow our City to display the mural during the second year. Mayor Castro would also like our letter to Mr. Etzler to confirm his verbal agreement with her. She thought that a nice place for the mural would be at the new Library. Mayor Castro commended DCOTA on their new sign, which is very beautiful. Mayor Castro thanked everyone for the work with the water issue and the South Florida Water Management District. She noted it is nice to see everybody working together for the benefit of our residents. Mayor Castro advised that she presented a plaque and Key to the City to the two new cruise ships in Port Everglades. She noted that the captain and bridge crew of the "Oasis of the Seas" were trained at the STAR Maritime Center in Dania Beach which they consider to be the best simulator in the world. Mayor Castro thanked Commissioner Jones on his service to the City of Dania Beach. She knows that he will represent the citizens well due to his integrity. Commissioner Jones noted that he asked the Governor to override our Charter, in order to avoid the costs associated with the Special Election, but he cannot. He suggested the Charter Review Board look at this issue. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted they will meet again tomorrow on the water issue. He thanked the Commission for their support with this matter. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,November 24,2009—7:00 p.m. Bob Daniels, Director of Community Development, provided a status update on the water supply issue, which memo is attached to and incorporated into these minutes. Dominic Orlando, Director of Public Services, advised they have an issue with a transformer from Florida Power and Light at the SW Community Center. He noted that we should break ground on the Library project next month. Director Orlando also noted that staff removed the traffic circle and one of the curbs yesterday. They will do more work tomorrow and the contractor should finish the work next week. Mayor Castro confirmed that we would have a workshop with options as to what can be done on 5`h Avenue. Director Orlando noted it would be extra work for the consultant. They were not going to do any work until after the workshop. Commissioner Anton noted the consultants already provided a list of options as to what can be done. We need to re-explain what they are to the residents. He further said that Kimley-Horn should be able to come up with a menu of options. Commissioner Anton stated that he is not ready to scrap the option of smaller traffic circles. He also wants someone to explain why other cities can have them and we cannot. Director Orlando noted that whatever we do on 5 h Avenue will not affect the interior area. He clarified the consultant is Chen and Associates, not Kimley-Horn. He will ask Chen and Associates to bring options for the workshop. Mayor Castro does not want just recommendations; she wants the pros and cons for each proposal. City Manager Baldwin congratulated Commissioner Jones on his appointment to the Broward County Commission. He bought Commissioner Jones a gift (pen) and presented it to him. 13.2 City Attorney City Attorney Ansbro asked for authorization to proceed with the execution of the documents needed by Florida Power and Light for the SW Community Center. Commissioner Anton motioned to authorize the execution of the documents with Florida Power and Light; seconded by Commissioner Jones. The motion carried unanimously. City Attorney Ansbro noted that the ordinance authorizes City officials to execute the agreement, but we do not necessarily need to sign it until a final decision has been reached. Commissioner Anton noted that we promised the South Florida Water Management District that we would move forward with the agreement. 14. G.\Agenda\PUBLIC SPEAKING FORM.doc CITY OF DANIA BEACH COMMUNITY DEVELOPMENT DEPARTMENT STAFF REPORT DATE: November 24, 2009 TO: Robert Baldwin, City Manager FROM: Robert Daniels, Director SUBJECT: Water Supply Issue — Status Update The City Commission acted at its special meeting of November 17, 2009 to authorize staff to revise the City's Regional Activity Center future land use plan amendment to incorporate policy language that was a result of negotiations between the City and the South Florida Water Management District (SFWMD). This action has been taken and the amended package has been forwarded to the Broward County Planning Council. At the City Manager's recommendation the Commission also outlined action steps to be pursued to resolve the water supply issue. 1. Coordinate with the Florida Department of Community Affairs (DCA) on actions necessary to resolve outstanding Ten-Year Water Supply Plan compliance Issues. Staff and consultants have contacted DCA and provided a detail verbal update on the City and District's efforts to date. Recognizing that the time needed to exhaust the Broward County alternative and to have an assessment of our water and sewer program performed by an outside consultant will require that the administrative hearing on the Water Supply Plan amendments be rescheduled, DCA's Community Planning staff has indicated its support for a change of date. A formal request has been forwarded to the DCA Division of Administrative Hearings to move the hearings to June 2010. 2. Immediately pursue with the SFWMD the resolution of issues relating to the City Consumptive Use Permit (CUP). The staff of the SFWMD confirmed via email on November 20, 2009 that it plans to deliver a draft of the permit and other sample documents in a very short time, possibly by November 24. The SFWMD is preparing a draft permit for Dania Beach for 3 years. The allocation will be 1.8 MGD with a limiting condition of 1.1 MGD. Another limiting condition of the permit will require the City to demonstrate that it can safely withdraw the full allocation of 1.8 MGD (safe yield analysis). This permit is being moved ahead quickly because the City is operating without (expired) permit. 3. Continue discussions with the City of Hollywood, Broward County and any other potential water suppliers to address our long-term water supply needs. Staff confirmed with Broward County on November 23 that its modeling has been completed and the County has identified over 600,000 gpd in additional water. The County staff indicated that it will be able to commit 550,000 gpd to the City of Dania Beach when permitting is completed. At this point the County does not know how long permitting will take. 4. Engage an independent consultant, not to exceed the City Manager's current spending authority, to evaluate, clarify and report on the City's past actions and existing water supply and sanitary sewer program. The city's Purchasing Coordinator is contacting firms and will provide a listing of three firms to the City Manager for him to discuss with the City Commission at the December 8, 2009 meeting.
