RESOLUTION NO. 2010-005 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY PIER BALLESTEROS WITH T-MOBILE REPRESENTING THE PROPERTY OWNER MARINA MILE BUSINESS PARK LLC, TO INSTALL A NEW 100 FOOT TELECOMMUNICATION TOWER ON THE NORTHEAST SIDE OF PROPERTY GENERALLY LOCATED SOUTH OF 3251 SW 26TH TERRACE,DANIA BEACH AS A SPECIAL EXCEPTION IN AN IROM (INDUSTRIAL RESEARCH OFFICE MARINE) ZONING DISTRICT, PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Zoning Appendix,Article VIII,"Telecommunication Towers and Antennas"provides for the regulation of telecommunication towers and antennas in the City of Dania Beach; and WHEREAS,the Dania Beach Zoning Appendix Article VIII,"Telecommunication Towers and Antennas", Section 33-308 provides that Monopole and Stealth guyed towers are permitted as a special exception use in the IROM zoning district; and WHEREAS,Pier Ballesteros with T-Mobile,representing the property owner,Marina Mile Business Park LLC,has applied for a special exception request to allow construction of a 100' tall stealth telecommunications tower to be located on the east side of the property, adjacent to SW 26 Terrace within a 1,000 square foot leased area, generally located on the northeast side of property immediately south of 3251 SW 26th Terrace,Dania Beach., City of Dania Beach; and WHEREAS,the Planning and Zoning Board on December 16,2009,recommended that the City Commission grant the special exception request,based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations", Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-54-09,for a special exception use approval to allow construction of a 100' tall stealth telecommunications tower in the IROM zoning district, for property generally located on the northeast side of property immediately south of 3251 SW 26th Terrace, City of Dania Beach, (a copy of which application is attached and made a part of this Resolution as Exhibit "A"), is approved, provided the applicant obtains FAA approval and confirmation from FAA that the location and height of the tower will not prohibit the possibility of a north runway expansion at the Fort Lauderdale-Hollywood International Airport. Section 2. That this approval shall automatically expire and become null and void unless the applicant submits a building permit application and construction drawings within twelve (12) months of City Commission approval and the applicant obtains a building permit(including payment of all fees)within eighteen (18) months from the effective date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. The search was conducted within a 1 mile(1.6 KM)radius of our Search Ring center(6FB 1195) Latitude=260 5' 7.80"N,Longitude=80° 10' 57.00"W,Radius=1.6 Kilometers. The first tower(878288)was found 0.05 miles from the Search Ring center at Latitude=26°5' 9.39"N,Longitude=800 10'58.91"W but was determined"unmarketable"by the tower owner. The second tower(812039)was found 0.60 miles from the Search Ring center at Latitude=260 5' 6.84"N,Longitude=800 10'22.78"W but was not viable due to its proximity to an existing T- Mobile site(6FB1125C). The need for this installation is to improve In-car/In-Building coverage in this area. As part of this letter,I am including propagation plots to further substantiate our lack of In- Car/In-Building coverage in the area. T-Mobile is the holder of the PCS license given by the FCC in the E and F Blocks with ranges from 1885 MHz to 1895 MHz in the receive and from 1965 MHz to 1975 MHz in the transmit. Due to the lack of spectrum,T-Mobile is forced to re-use its channels within our assigned area. With the increase of subscribers,T-Mobile is forced to adhere to a severe downtilt program in order to accommodate traffic. The dimensioning of the cells becomes smaller due to downtilting,and cells are split, defined as the installation of additional base stations within each cell depends on the degree of cell density in each area and on the coverage effect of each base-station antenna. Thus, allowing us to repeat the channels on numerous occasions by using numerous cells of a small radius, which provide a sufficient signal to noise ratio and a low level of interference with received signals within the coverage area. Attached are predictive analysis plots of the site and specifications of the proposed site and the search ring showing a radius of 1.0 miles. The plots show the projected propagation prediction of the signal level in dBm that will exist in the indicated geographical areas with and without the candidate site. The ability to build a site will enhance the lack of coverage in the area and allow us to re-use our limited spectrum more efficiently in this area of Broward County. The antennas are capable of handling both the transmit and receive side of the bands. 6.) Bases for any losses for foliage, clutter, and building penetration: Foliage losses are usually around 8-10 dBm of pathloss,while the surrounding clutter in this area is suburban which is also typically 5.10 dBm. The in-building penetration loss used for this model was 12-15 dBm.
