HomeMy WebLinkAboutR-2010-011 Marina Food Parking Variances RESOLUTION NO. 2010-011 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUESTS (VA-02-10) SUBMITTED BY THE CITY OF DANIA BEACH, REPRESENTING THE PROPERTY OWNER, MARINA FOODS,INC.FROM CHAPTER 28,"ZONING",ARTICLE 6.21,"OFF-STREET PARKING" AND THE ZONING APPENDIX, ARTICLE V, "OFF-STREET PARKING REQUIREMENTS" FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF NW 3RD AVENUE AND NW 1ST STREET,DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 6.21, prescribes the off-street parking regulations within the City of Dania Beach; and WHEREAS,the Dania Beach Code of Ordinances,Article V of the Zoning Appendix"Off- Street Parking",requires all parking areas to be hard surfaced for properties located within the City of Dania Beach; and WHEREAS,the City of Dania Beach,representing the property owner, Marina Foods, Inc. has applied for the following variances (VA-02-10): 1. To allow off-site parking; City of Dania Beach Code of Ordinances Chapter 28, "Zoning", Article 6.21(k)(4)"Schedule of Off-street Parking Requirements"requires variance approval for off-site parking; 2. To allow off-site parking to be located approximately 450 feet from City Hall;City of Dania Beach Code of Ordinances Chapter 28,"Zoning",Article 6.21(k)(5)"Schedule of Off-street Parking Requirements" requires off-site parking to be within 300 feet of the principal use; and 3. To allow the use of an unpaved, gravel parking area; City of Dania Beach Code of Ordinances Section 33-211, Article V, "Off-street Parking Requirements" of the Zoning Appendix requires all parking areas to provide a hard surface, for property located at the southwest corner of NW 3rd Avenue and NW I"Street Dania Beach;and WHEREAS,the Planning and Zoning Board on January 20, 2010, recommended that the City Commission grant the variance requests based upon the criteria set forth in Section 10.13, Article 10, Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the application for the variances described above from requirements in Chapter 28, "Zoning" and the Zoning Appendix of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit"A",is approved. Section 2. That this approval shall automatically expire and become null and void unless the applicant submits a building permit application and construction drawings within twelve (12) months of City Commission approval, and the applicant obtains a building permit (including payment of all fees) within eighteen(18) months from the effective date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4.
