Motion passed unanimously. Minutes Approval -April 15,2009 Regular Minutes. Motion made by Derrick Hankerson, seconded by Tim Pribisco to approve the April 15, 2009 Regular Planning and Zoning Board minutes. Motion passed unanimously. Community Meeting Announcement Kristin Dion, City Planner announced that a community meeting will be conducted in the City of Dania Beach by the Mellgren Planning Group on behalf of the City. Community participation at this meeting is strongly encouraged. Dania Beach Blvd.) Planning and Zoning Board Meeting 1 MINUTES Mav 20,2009 Organization - Administration of Oath and Sunshine Law review — City Attorney Thomas Ansbro Administration of Oath — Lou Ann Patellaro administered the oath to the newly appointed Planning and Zoning Board members in attendance Tim McDade Pribisco and Angeline Flowers. Sunshine Law review— City Attorney Thomas Ansbro asked that this item be deferred until the entire Planning and Zoning Board is present. PLANNING AND ZONING BOARD ITEMS (ADVISORY) 1) VA-16-09 —Variance request by property owner Kevin O'Riordan for a boat lift on property located at 4496 SW 38 Terrace, Dania Beach, Florida. The variance request is to allow a boat lift to extend 19 feet into a canal. (Dania Beach Zoning Appendix Sec. 33-40. "Regulation and use of waterways and facilities related thereto" allows a maximum of 10 % of the canal width which equals a maximum of 10 feet for this property.) Kristin Dion, City Planner addressed the board to describe the proposed variance request to allow the boat lift. She indicated that staff is leaving recommendation of this item to the boards discretion. Kevin O'Riordan addressed the board describing the reason and criteria for his request to install a boatlift an additional 9 feet into the canal. Acting Chairperson Angeline Flowers opened the item for public comment, hearing no one and seeing no one further,the public hearing was closed. Board member Derrick Hankerson questioned the type of reflectors the applicant would be willing to install. Mr. O'Riordan indicated that he would be willing to install solar lights or any type of reflector the board feels necessary. Motion was made by Derrick Hankerson to recommend approval of variance VA-16-09, seconded by Timothy Pribisco. Motion passed on the following roll call: Angeline Flowers — yes Derrick Hankerson — yes Timothy Pribisco — yes City Attorney Ansbro confirmed that the hearing date for this item before the City Commission would be June 9, 2009. 2) VA-17-09—Variance request by property owners Luis and Barbara Ameijeiras for a boat lift on property located at 967 Nautilus Isle, Dania Beach, Florida. The variance request is to allow a boat lift to extend 19 feet into a canal. (Dania Beach Zoning Appendix Sec. 33-40. "Regulation and use of waterways and facilities related thereto" allows a maximum of 10 % of the canal width which equals a maximum of 6 feet for this property.) Planning and Zoning Board Meeting 2 MINUTES Mav 20,2009 Kristin Dion, City Planner addressed the board describing the proposed variance request to allow the boat lift. She indicated that staff is leaving recommendation of this item to the boards discretion. Luis Ameijeiras addressed the board describing the reason and criteria for his request to install a boatlift with an elevator, making the parking of the boat more secure and less of an impact on the neighbors. Acting Chairperson Angeline Flowers opened the item for public comment, hearing no one and seeing no one further,the public hearing was closed. Board member Timothy Pribisco questioned the reason for the elevator as opposed to using the davit's as the other neighbors. Mr. Ameijeiras indicated that with the logistics and shape of his property being on an angle an elevator lift would give better restraint for boat storage. Discussion regarding the code relating to boat lifts intruding into a waterway and research relating to submerged structures located in a waterway. Further discussion relating to how the structure would be submerged and ways to warn other boaters navigating in this canal. Mr. Ameijeiras further indicated that where his property is located the canal curves giving additional maneuvering space to other boaters. City Attorney Ansbro suggested to the board that if they choose to recommend approval, a condition be placed with the motion to locate a pole or other floating device with a reflector to warn other boaters about the submerged structure. Motion was made by Timothy Pribisco to recommend approval of the variance VA-17-09 with the condition that a post or floating device with a reflector be installed to warn other boaters of the submerged structure, seconded by Derrick Hankerson.
