DANIA BEACH CITY COMMISSION
TUESDAY, FEBRUARY 9, 2010 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor Castro called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Alle ig ance
Pastor Mario Cinelli, Lighthouse Community Church, gave the invocation followed by the
Pledge of Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
There were no presentations at this meeting.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Jim Hampel, G&G Shipping, 1300 Eller Drive, requested a 90 day code compliance waiver for
use of a property located adjacent to their property, which is owned by Florida Power and Light
(FPL), to aid in relief to Haiti. A detailed email request is attached to and incorporated into these
minutes.
It was the consensus of the Commission to allow the use of the property for 90 days. The City
Attorney will discuss the issue with City staff to work out the details.
Nick Lupo, Code Compliance Manager, noted he has already been in touch with FPL and they
have tentatively worked out some of the restrictions to protect the City and make sure that the
time does not exceed the 90-day request.
Rose Lizana, 214 SE 2"d Street, spoke in favor of the request by G&G Shipping.
Bobbie Grace, 110 NW 8`h Avenue, reminded everyone of the ribbon cutting ceremony at the
SW Community Center on Saturday, February 13 at 12:00 p.m. She provided an update of the
Relay for Life activities.
David Clark, 411 SE 5`h Street, noted he requested a total sum on the Linear Park and traffic
circle projects and received the information. He spoke about the irrigation item on the list of
costs for the projects. Mr. Clark pointed out that to date the City has spent almost $1 M on the
two projects and said that if this was Bond money we would need to pay back with interest. He
further commented on an article published on January 31, 2010 regarding the water issues the
City is currently facing. Mr. Clark would like the water issue to be re-visited after April 13 when
we will have a full Commission. Lastly, he asked what we received for the money spent on these
projects.
Commissioner Duke invited the public to attend the workshop on Saturday to address the
Commission.
Mayor Castro noted the workshop is for the City Commission.
Victoria Payne, Chamber of Commerce, provided an update on upcoming Chamber events.
David Eiglarsh, 304 Mallard Road, Weston, represents a group of men called the power-
paragliders. He spoke in opposition to the proposed Ordinance #2010-003. Mr. Eiglarsh advised
that their group is self-regulated with certifications issued by federal recognized aviation
institutions. He noted the many contributions their aviation activities provide to the community.
Mr. Eiglarsh stated that they are willing to work with the City to come up with an alternative
solution.
Patrick Phipps, PO Box 897, commented on the antique car and motorcycle show last weekend.
He noted things are changing in Dania Beach and he is happy about it.
Jocelyn Lummis, 809 NW 10`h Avenue, noted on January 301h she received "fan mail' in her
mailbox. She noted she is a member of the Airport Advisory Board. Ms. Lummis stated that
this offensive letter, which is attached to and incorporated into these minutes, will make her
work harder to make Dania Beach a better place to live.
6. Public Safety Reports

Dania Beach City Commission
Tuesday, February 9, 2010—7:00 p.m.
Donn Peterson, BSO Chief, was available to answer questions regarding a news story that was
on Channel 7 regarding an alleged beating of a supposedly Dania Beach resident at the hands of
BSO.
Mayor Castro would like a phone call at a later date with more information on this issue. She
further commended BSO for a job well done on the incident at Meadowbrook involving an
elderly lady.
Commissioner Duke commented on the Fire Department discussion from the last meeting. He
referred to the report provided by Fire Chief McCartt in October, 2009 regarding the status of the
department. Commissioner Duke further said that the department does not have adequate
equipment, and does not have adequate staff. He provided details of the needs of the department
and added that he wanted to set the record straight. Commissioner Duke directed the City
Manager to tell Chief McCartt to address the Commission at the next meeting and tell them what
is needed, so that we can get it done.
Mayor Castro noted that at the last meeting Deputy Fire Chief Cassano stated that everything
was fine in the department. She explained the costs involved in the purchase of fire equipment
and the difficult economic times we are facing. Mayor Castro pointed out that this Commission
and the previous one have always supported the Fire Department. She spoke about the City's
revenue loss in the upcoming year and the discussions with the Fire Department to find
alternative solutions regarding their retirement plan. Mayor Castro stated we are not playing
politics in the Chamber anymore because it is not appropriate. Furthermore, we are not going to
terrorize the residents of Dania Beach with all sorts of accusations just to suit someone's political
purpose. She asked Chief McCartt and Deputy Chief Cassano to come before the Commission at
the next meeting with their statements.
Vice-Mayor McElyea questioned if we are hiring a new Fire Chief as a result of Jack McCartt's
resignation. He noted there have been very few breakdowns of the fire equipment; he would
know because his company tows the equipment. Vice-Mayor McElyea stated he thinks our
equipment is good. He said he has always supported the Fire Department.
Commissioner Anton recommended the City Manager find out the maintenance problems with
the fire equipment. He agreed with the Mayor that using scare tactics was unfair to the citizens.
Commissioner Anton said the comments made at a political rally stating the Commission is not
doing anything to address the Fire Department's problems is an affront to him and the rest of the
elected officials.

Kristen Jones, Director of Parks and Recreation, noted she is concerned with the increased
number of fliers on the north section of the beach, which could become a liability to the City of
Dania Beach. She clarified we have four lifeguard towers located on the south side of the pier,

but the north side is unguarded. Director Jones noted that if the Federal Aviation Administration
(FAA) has given them approval they could make arrangements to launch from John U. Lloyd
State Park in Hollywood.
Mayor Castro noted they can still fly over our airspace because we do not control it. She further
confirmed with Director Jones that they take one parking space like any other vehicle using the
parking lot at the beach.
Director Jones clarified for Mayor Castro that her department is not aware of any major incident
occurring with the paragliders, other than the one which took place last Christmas.
City Attorney Ansbro noted that most of the Florida cities that are on the coast have some
prohibitions at their public beaches.
Commissioner Anton asked if John U. Lloyd State Park and Hollywood would allow them to
launch from their beach.
Director Jones responded not to her knowledge.
City Attorney Ansbro noted the City of Hollywood advised they would not want them to launch
from their beach.
Vice-Mayor McElyea motioned to deny Ordinance 42010-003, on first reading; seconded
by Mayor Castro. The motion carried on the following 4-0 Roll Call vote:

Mayor Castro asked Director Jones to meet with the power-paragliders group in order to address
her concerns.

7.19 RESOLUTION # 2010-027

OFFICIALS TO EXECUTE AN AGREEMENT WITH BROWARD COUNTY THAT PROVIDES FOR
FUNDING AND ADMINISTRATION OF THE 35Tn YEAR COMMUNITY DEVELOPMENT BLOCK GRANT
PROGRAMS IN THE AMOUNT OF $226,192.00; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING

Vice-Mayor McElyea motioned to adopt the Consent Agenda, with the addition of Item
#7.19 and the exception of Item #7.18; seconded by Commissioner Anton. The motion

9. Public Hearings and Site Plans

10. Discussion and Possible Action
10.1 Discussion of Code Compliance foreclosed property located at 47 NW 14 Avenue,
Dania Beach
Nick Lupo, Code Compliance Manager, noted a Certificate of Title was issued by the Clerk of
Court transferring title to the subject property to the City of Dania Beach. He further explained
that the cost to the City is $6,000 plus the demolition of the structure which is considered unsafe.
The property is worth $13,460. He pointed out that the City must pay the property taxes
currently owed, to avoid any action by Broward County to place this property on a tax deed sale.
Commissioner Duke noted the property has little market value and the City should consider
keeping it for a pocket park.
It was the consensus of the Commission to pay the property taxes and demolish the structure.
The Commission further suggested bringing the issue back after the property is demolished.
Mr. Lupo suggested we take a portion (approximately 10%) of the code violation fines we
receive and keep them separately from our operating budget, for future use to board up houses
and foreclosed and abandoned properties.
Mayor Castro noted it is a good idea and suggested discussing it during the upcoming budget
process.
10.2 Selection of Special Counsel for A to X Video Outlet Store Adult Use Litigation -
City Attorney
City Attorney Ansbro noted we ran out of insurance money and we need the balance of the funds
to pay the defense in this litigation case. He said he obtained cost quotes from the current
council and Weiss Serota. City Attorney Ansbro further advised that costs will be recovered
through the code fines being accrued daily. He confirmed that to date the amount of$75,000 is
available to the City at a local bank. City Attorney Ansbro recommended hiring the law firm of
Weiss Serota.

Vice-Mayor McElyea motioned to select the law firm of Weiss Serota, and pay the current
bill for Lydecker; seconded by Mayor Castro. The motion carried on the following 3-1 Roll
Call vote:

11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton commented on all the activity in the City last weekend. He commended
everyone involved in making each of the events a success.
Commissioner Anton commented on the decrease in revenue forecast by the Property
Appraiser's Office. He noted we would need to find approximately $2M to cover expenses in
the next budget cycle. Commissioner Anton pointed out we will need to watch our expenses
very closely in order to move in the right direction.
11.2 Commissioner Duke
Commissioner Duke noted the Vintage Motorcycle Show held last weekend was a success. He
further said that the Folk Art and Antique Festival was not very well attended and that it was
only busy at the organizer's cafd. Commissioner Duke stated that in its current form this Festival
is hard to support, unless it is combined with another event.
Commissioner Duke noted he has been meeting with different waste haulers, and his preference
would be to go out for an RFP in order to get the best deal for our taxpayers.
Commissioner Duke noted he was interviewed, on behalf of the City, by the Urban Land
Institute Sustainability Committee, which works on initiatives and programming on issues of
sustainability and green buildings. He noted we are one of three cities that are being considered
for this prestigious pilot program.
Commissioner Duke asked residents to send him any items of concern to be discussed at the
Town Hall meeting to be held at the Estates of Ft. Lauderdale next month.
Commissioner Duke noted he is working with the IT Department to put the Commission
meetings on the website.
11.3 Vice-Mayor McElyea
Vice-Mayor McElyea commented on the flooding on 3`d Terrace and 51h Avenue.

Vice-Mayor McElyea noted people need to stop feeding the ducks. They are becoming
aggressive.
Vice-Mayor McElyea spoke about the Vintage Motorcycle Show last weekend. He said he
would like to see more antique motorcycle shows and suggested having a flea market with it.
11.4 Mayor Castro
Mayor Castro noted Governor Charlie Crist addressed the Seniors on February 4`h. She thanked
the Seniors for inviting the Governor to visit our City.
Mayor Castro noted that we purchased a table for the April 9`h luncheon for the Port Everglades
Association Economic Engine.
Mayor Castro commended the City Clerk for working with the Estates of Ft. Lauderdale for the
upcoming Town Hall meeting.
Mayor Castro commended City staff and the Fire Department on the recent flood event.
Mayor Castro noted the workshop on Saturday would begin at 9:00 a.m. She said we will break
before noon for the ribbon cutting ceremony at the new SW Community Center located at the
Public Services site.
Mayor Castro noted the Linear Park dedication would be scheduled for next month.
Mayor Castro commented on the gaming industry. She noted we may see some drastic changes
during this legislative season. Mayor Castro said that we need to discuss citywide traffic issues
in order to be prepared for whatever is coming.
Mayor Castro spoke about the revenue figures published by the Property Appraiser's Office.
She noted that the numbers shown do not include new construction. Mayor Castro pointed out
that although our City is in good financial condition, we will need to face new challenges.
Mayor Castro requested an update on the One Code.
Corinne Lajoie, AICP, Principal Planner, noted the consultant will bring forward an amended
contract next month. She advised that it will then be presented to the Planning and Zoning Board
and the City Commission. Ms. Lajoie said we may have it completed in the summer.
Mayor Castro requested an update on Mr. Camacho's seawall issue. She wanted to make sure
staff is in communication with Mr. Camacho.
City Manager Baldwin advised that the seawall is eligible for FIND money.
Mayor Castro commented on the Arts and Antique Festival. She said it may not have been as
crowded as in previous years, but it definitely brought customers to our downtown businesses.

Pursuant to conversation, I am forwarding this email to your attention so that it may be forwarded on to
the City Commissioners and the Community Development Director in advance of tonight's meeting.
During the civic comments portion, I intend to speak to the commission in regards to the following:
G&G Shipping has mobilized four of its cargo vessels to assist with the Haiti Earthquake Relief effort.
Yesterday, Feb 8rh, we sent out a shipment of flatbed trucks that, upon arrival in Haiti, will assist in
delivering desperately needed relief goods to the citizens of that county. More vehicle shipments will
follow.
National non-profit organizations have contacted G&G to use us as resource in delivering these much
needed vehicles and supplies to Haiti. It is anticipated, that"relief cargo volumes will continue to grow in
the next 90 days and we are doing everything possible to store these items within our existing facilities.
However, G&G may reach a point where it would become necessary to utilize alternate storage sites near
our port in Dania.
There is a 2-acre site that is nearby, owned by FPL, adjacent to an existing leased parcel we occupy from
FPL.
However, the two-acre parcel is presently registered in Dania zoning office as undeveloped land and no
permitted uses are allowed at this time.
Last year, FPL incurred fines with the City of Dania in order to make the parcels comply with present
zoning classification (see below email) and thus they are hesitant to have any business operation resume
use on the parcel.
Nonetheless, as landlord, they would be willing to assist with the earthquake relief efforts and possibly
allow G&G Shipping to utilize the parcels for this cause, contingent upon the clear understanding &
agreement with the City of Dania Beach that there would not be additional assessments from the city.
Since the parcels presently have no permitted use, my intention in speaking tonight is to seek approval
with City of Dania Beach officials and request a special "use exception" be granted to allow G&G to
temporarily store earthquake relief cargoes on these two acres for a period up to 90 days.
As Jeff Long (FPL) indicates below: "provided that FPL and city zoning and code enforcement mutually
agreed to permissible conditions", he has provided his landlord consent below.

As we look to find ways to assist the people and country of Haiti, this is one way, on a local level, right here in Dania Beach that
we can have a direct positive impact!

Gentlemen,
I'm certainly in favor of efforts to support disaster recovery in Haiti, and I know that City of Dania Beach officials will feel the same,
but given what FPL has experienced in resolving code violations issued by the City for the subject site and given that G&G caused
a large share of those violations, I will not grant an unconditional approval at this time for G&G to resume using it even on a
temporary basis. The violations have cost FPL a combined total of tens of thousands of dollars in lost revenue, cleanup by
external contractors, business travel and payroll expenses, and a monetary fine.
However, in the spirit of humanitarian assistance, I hereby grant tentative approval contingent upon understanding and agreement
between FPL and the City as to such things including, but not limited to, the nature of the use, anticipated duration, hours of
operation, maintenance standards, etc. If FPL and the City agree on all such matters, then I will allow G&G to temporarily use the
site to support the relief effort.
You may share this letter with City officials. If they agree to support it, then I will work with them to define the scope and choose
from a few methods that I can implement to facilitate it.

SUBJECT: Water Supply Issue — Status Update
Since the regular City Commission meeting of January 26, 2010 the following actions have
taken place.
On January 28, 2010 the Community Development Director, Bob Daniels, provided
information to Francis Henderson at Broward County Water and Wastewater Services in
order to determine the possibility of obtaining the city's necessary water supply from the
county. Since that correspondence, city staff has responded to inquiries of Mr. Henderson
on two (2) occasions and continues to work with county staff.
Consumptive Use Permit
The City was notified by the South Florida Water Management District (SFWMD) on
February 2, 2010 that its consumptive use permit was approved. The maximum allocation
for the drawdown of raw water is 1.1 mgd until such time as a safe yield study for the
proposed new Well G confirms that and allocation of 1.8 mgd is justified.
Time Line
The following time line has been established to meet the City's requirements and was
reported previously by the Community Development Director.
February 12 Submission of land use plan amendments to Broward County
Planning Council
March 9 Final Report by Keith & Schnars
March (TBD) City Commission Water Supply Workshop
March 23 City Commission action on preferred alternative for water supply (first
reading)
April 13 City Commission action on preferred alternative for water supply
(second reading)
April 30 Submission of proof of an assured long-term water supply to Broward
County Planning Council as supporting information for the land use
plan amendments
May 7 Submission of all information necessary to finalize DCA's review of
the 10-year Water Supply Plan
