A RESOLUTION OF THE CITY OF DANIA BEACH,FLORIDA,AUTHORIZING
THE PROPER CITY OFFICIALS TO EXECUTE A SECOND AMENDMENT TO
THE EXISTING AGREEMENT FOR UNIFIED LAND DEVELOPMENT CODE
SERVICES WITH THE MELLGREN PLANNING GROUP, INC. TO PROVIDE
ADDITIONAL CONSULTING SERVICES FOR AN AMOUNT NOT TO EXCEED
$79,125.00; PROVIDING FOR FUNDING; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,on February 12,2008,pursuant to Resolution 2008-027 the City Commission
approved an agreement with the Mellgren Planning Group for consulting services for the preparation
of the Citywide Unified Land Development Code; and
WHEREAS, on March 11, 2009, pursuant to Resolution 2009-044 the City Commission
approved an amendment to the agreement with the Mellgren Planning Group for consulting services
that incorporate zoning changes developed for the CRA Redevelopment Plan into the Citywide
Unified Land Development Code; and
WHEREAS,additional consulting services are required relating to follow up items that will
complete the Unified Land Development Code and assist in the implementation of the CRA Plan,as
listed in Exhibit "A";
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That a second amendment to the Agreement dated February 12, 2008 and
amended March 11, 2009, for consultant services with The Mellgren Planning Group, Inc., which
amendment is attached in substantial form as Exhibit "A" is approved, in connection with the
Citywide Unified Land Development Code tasks specified in the Exhibit and the proper City officials
are authorized to execute such Amendment to the Agreement dated February 12,2008,for an amount
not to exceed Seventy Nine Thousand One Hundred Twenty Five Dollars($79,125.00)to be funded
from the Community Development Department's Professional Services Fund 1501-515.31-10
(budgeted at$500,000.00 with $445,409 remaining) .
Section 2. That the City Manager and City Attorney are authorized to make minor
revisions to such Amendment to the Agreement as are deemed necessary and proper for the best
interests of the City.
Section 3. That all Resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

AMENDMENT TO THE AGREEMENT BETWEEN
THE CITY OF DANIA BEACH AND THE
MELLGREN PLANNING GROUP, INC.
This is a second Amendment to an Agreement, which exists between the City of Dania
Beach, Florida ("City") and The Mellgren Planning Group, Inc., a Florida Corporation
("Consultant"). This Amendment is entered into and becomes effective on 2010,
and is an amendment to the existing Agreement(s),dated March 4,2008 and further amended March
11, 2009 (the "Agreement').
City and Consultant wish to amend the Agreement to provide for additional consulting
services relating to follow up items that will complete the Unified Land Development Code and
assist in the implementation of the CRA Plan.
In consideration of the mutual covenants,terms and conditions contained in the Agreement
and this Amendment, and for other good and valuable consideration, the adequacy and receipt of
which are acknowledged,the parties agree to the following:
1. Exhibit"A", letter dated February 24, 2010, sent by Michele C. Mellgren, AICP to
Robert Daniels,City of Dania Beach Community Development Director,a copy of which is attached,
which specifies additional services, is incorporated by this reference.
2. City agrees to pay Consultant an amount not to exceed Seventy Nine Thousand One
Hundred Twenty Five Dollars ($79,125.00) for such additional services.
3. In all other respects, except as amended by this Amendment to the Agreement, the
Agreement is ratified and reaffirmed and remains in full force and effect.
IN WITNESS OF THE FOREGOING,the parties have executed this Amendment on the day
and year first above written.

Re: Amendments to QneCode
Dear Mr. Daniels:
This letter serves as our proposal for the requested follow up items that will complete
the OneCode and assist in implementing the CRA plan.
1. Payment in Lieu of Parking and Streetscapingin Downtown
Under this scope of work, The Mellgren Planning Group (TMPG) will format and
integrate "payment in lieu of parking" language as prepared by Kimley Horne into the
code. TMPG will also prepare language to address "payment in lieu of landscaping" in
the downtown.
Professional Fee: $3,200.00
2. Local Mobility Strategy
Prepare a comprehensive local mobility strategy as required by SB 360 and incorporate
regulations into the code. The local mobility strategy will serve as the basis for
transportation mitigation for development and redevelopment, and will provide a
revenue stream for the City.
Professional Fee: $26,500.00
3. Si na a Master Plan
Evaluate signage master plan language prepared by IBI Group against provisions
included in QneCode, modify as necessary, and integrate into the code. This includes a
reference to design standards and criteria for applying them, and creating a signage
incentive program for superior design and flexibility in signage administration. Prepare
and present a PowerPoint presentation to Planning & Zoning Board and to the City
Commission as part of attendance at one Planning Et Zoning Board meeting and two City
Commission meetings.
Professional Fee: $6,600.00

4. Green Code Recommendations
Research the green codes of other local governments in Florida, including Tamarac,
Coconut Creek, Delray Beach and Sarasota, and formulate recommendations for the
City of Dania Beach. Prepare and present a PowerPoint presentation to Planning Et
Zoning Board and to City Commission.
Professional Fee: $11,000.00
5. Development Review Process
Prepare and integrate regulations that will reconstruct the development review process
to allow certain items to be approved administratively to encourage redevelopment.
Professional Fee: $2,500.00
6. Urban Big Box Regulations
Identify the types of urban "big box" retailers that are desirable and formulate
regulations and development standards to allow them in the downtown CRA area.
Prepare and present a PowerPoint presentation to the Planning @ Zoning Board and to
the City Commission, as part of attendance at one Planning at Zoning Board and two
City Commission meetings.
Professional Fee: $8,000.00
7. Changes to Banner Requirements
Currently the code requires that applicants post a $100 bond to ensure that any
temporary banner is removed within 30 days. The requirement results in a very labor
intensive process. The language will be modified to eliminate the bond requirement
and provide for enforceability through code enforcement.
Professional Fee: $825.00
8. Legal Review of Additional Provisions
Provide legal services and review as follows:
• Participate in one meeting with TMPG and/or City staff to develop the strategy i
for the additional revisions
• Provide up to six hours of consultation to TMPG and/or City staff
Provide additional work as follows and in the following order:
• Finalization of ordinances substantially prepared by TMPG to formally adopt the
OneCode
• Prepare ordinances adopting zoning map amendments to implement the OneCode
• Review additional sign code provisions described in Task 3 above
• Review local mobility strategy provisions described in Task 2 above
• Review provisions for payment in lieu of on-site parking
Legal assistance will cease if and when the stated not-to-exceed amount is exhausted.
Professional Fee: hourly, not-to-exceed $10,500.00

9. Additional Modifications Identified Through Review Process
A code is a living document that requires adjustments identified through the
application process. This task allocates funds to address minor modification issues that
may arise through use and application of the code. This item also includes mileage,
which will be billed at the prevailing government rate.
Professional Fee: hourly, not-to-exceed $10,000.00
