A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
EXPRESSING THE INTENT OF THE CITY COMMISSION OF THE CITY OF
DANIA BEACH TO ENTER INTO AN AGREEMENT WITH BROWARD
COUNTY TO PROVIDE FUNDING FOR THE DREDGING OF THE DANIA
CUT-OFF CANAL FROM THE BEGINNING OF THE CANAL AT PORT
EVERGLADES WEST TO THE US 1 BRIDGE, PURSUANT TO A GRANT
APPLICATION TO BE FILED BY BROWARD COUNTY WITH THE
FLORIDA INLAND NAVIGATION DISTRICT (FIND); PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, a representative of Broward County in March 2007 presented a proposal to
the City of Dania Beach City Commission, which would provide for the dredging of the Dania
Cut-off Canal from the beginning of the canal at Port Everglades west to the US 1 Bridge, which
would be principally funded (seventy-five percent (75%)) by a grant from FIND with a twenty-
five percent (25%) grant match to be made by Broward County; and
WHEREAS, Broward County proposed that the City share in one-half of the cost of the
match cost (i.e. 12.5%) and the City Commission was amenable to such proposal; and
WHEREAS, the Dania Beach City Commission is willing to join in the application and
to commit to payment of one-half(1/2) of the match cost, provided that the cost to the City does
not exceed $1,170,000.00 and that spoils from the dredging are not used for the construction of
the proposed south runway at Ft. Lauderdale/Hollywood International Airport, and that the
proceeds from the sale of the spoils, if sold, are not used in connection with that project; and
WHEREAS, the Waterway Assistance Program Grant application is due to FIND no
later than April 1, 2010;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City Commission of the City of Dania Beach expresses its intent
to enter into an agreement with Broward County to provide funding for the dredging of the Dania
Cut-off Canal from the beginning of the canal at Port Everglades west to the US I Bridge,
pursuant to a grant application to be filed by Broward County with the Florida Inland Navigation
District(FIND).
Section 2. That the City will commit to pay 12.5% of the match grant costs up to a
maximum of$1,170,000.00 (the match is 25% of the total cost), provided that the dredge spoils
are not used for the construction of the proposed south runway at Ft. Lauderdale/Hollywood
International Airport, nor shall they be sold with any proceeds to be used in connection with the
runway project, and provided that the City costs shall not exceed the amount specified below.
Section 3. That in connection with the County grant application, the City of Dania
Beach represents to Broward County that an amount not to exceed $1,170,000.00 is hereby
appropriated from the City's available General Fund — Unreserved Undesignated Fund Balance
(the total available balance as of 9-30-2009 is $18,118,760) in the City's current 2009- 2010 City
Budget for the required 12.5% match and further directing that this City budget appropriation be
transferred to the City's Capital Project Fund to await award of all other project funding within
the coming 12 months.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
