HomeMy WebLinkAboutO-2010-005 LU-11-10 LAC - Griffin Road ORDINANCE NO. 2010-005 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE TEXT OF THE FUTURE LAND USE ELEMENT OF THE DANIA BEACH COMPREHENSIVE PLAN TO CREATE A LOCAL ACTIVITY CENTER ("LAC") LAND USE CLASSIFICATION; AMENDING THE FUTURE LAND USE PLAN MAP OF THE DANIA BEACH COMPREHENSIVE PLAN TO CHANGE THE LAND USE OF APPROXIMATELY 155.3 ACRES AS DESCRIBED IN EXHIBIT "A" ATTACHED TO THIS ORDINANCE, FROM LOW (5) RESIDENTIAL, LOW- MEDIUM (10) RESIDENTIAL, MEDIUM (16) RESIDENTIAL, MEDIUM- HIGH (25) RESIDENTIAL, IRREGULAR (10) RESIDENTIAL, COMMERCIAL, OFFICE PARK, PARKS AND RECREATION, INDUSTRIAL, AND UTILITIES, TO LOCAL ACTIVITY CENTER ("LAC"); PROVIDING FOR TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL AND STATE AGENCIES; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; REQUESTING RECERTIFICATION FROM THE BROWARD COUNTY PLANNING COUNCIL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach ("City") desires to amend its Comprehensive Plan's Future Land Use Element to create the land use classification for "Local Activity Center" ("LAC"); and WHEREAS, in conjunction with the creation of the land use classification, the City proposes to amend its Future Land Use Plan Map to designate a Local Activity Center on the Future Land Use Plan Map, as applicable to approximately 155.3 acres for properties immediately adjacent to Griffin Road from Anglers Avenue to State Road 7, as further described in Exhibit"A"; and WHEREAS, the City's Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on March 17, 2010, and determined that the proposed amendment to the Future Land Use Element and Future Land Use Plan Map (the "Amendment") is consistent with the goals and objectives of the City's Comprehensive Plan and, therefore, recommended approval of the Amendment; and WHEREAS, the City Commission held a duly noticed public hearing on March 23, 2010, regarding the Amendment and determined that the Amendment is in the interest of the City's public health, safety and welfare and should be adopted for transmittal to the Florida Department of Community Affairs for its review pursuant to Chapter 163, Florida Statutes; and WHEREAS, on 2010, the City Commission held its second public hearing on the adoption of the Amendment, for final adoption in accordance with the requirements of Chapter 163, Florida Statutes; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City's Future Land Use Plan Map in the City's Comprehensive Plan is amended to change the designations of land, within the area described in Exhibit "A" attached to this Ordinance, from Low (5) Residential, Low-Medium (10) Residential, Medium (16) Residential, Medium-High (25) Residential, Irregular (10) Residential, Commercial, Office Park, Parks And Recreation, Industrial, And Utilities, to Local Activity Center (LAC). Section 2. That the text of the Future Land Use Element of the City's Comprehensive Plan is amended according to Exhibit `B" to this Ordinance to establish the land use classification of"Local Activity Center" ("LAC") and supporting objectives and policies. Section 3. That the City Commission authorizes the City Manager to transmit the Amendment to the Florida Department of Community Affairs and other state agencies pursuant to the requirements of Chapter 163.3184, Florida Statutes. Section 4. That the City Commission authorizes the City Manager to transmit an application to the Broward County Planning Council to request amendment of the Broward County Land Use Plan text and map, to establish a LAC in Dania Beach, and to request recertification of the City's Future Land Use Element, including the Future Land Use Plan Map. Section 5. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. Section 7. The effective date of this Amendment shall be after the second reading and adoption of the amendment by the City Commission and, subsequently, the date a final order is issued by the Florida Department of Community Affairs finding the amendment to be in 2 ORDINANCE#2010-005 TRANSMITTAL STAGE compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes. Local Activity Center Use: The intent of the Local Activity Center (LAC) land use designation is to encourage redevelopment of the Griffin Road Corridor in an attractive and transit supportive manner and to provide a mix of living, shopping._workinci and recreational opportunities. Dania Beach Local Activity Center land use designation - density and intensity specifications Land Uses: Maximum Intensity (unless otherwise indicated) Residential*: 169 single family homes 400 townhomes 1091 garden apartments 200 mid-rise apartments Commercial 104.21 acres Industrial 1.14 acres Office Park 8.6 acres Utilities 1.6 acres Parks and 5.6 acres (minimum) Recreation *Dwelling units from an given category (ex: single- family, townhouse, etc.) may substituted for dwelling units of another category provided that the substitution results in the same or lesser student generation using the county's adopted. student generation rates. Obiective XXVIII The intent of the Local Activity Center (LAC) is to encourage redevelopment of the Griffin Road Corridor in an attractive and transit supportive manner to provide a mix of living shopping, working and recreational opportunities, The City establishes following policies to govern the development within Griffin Road.Corridor LAC: Policy 28.1 The Local Activity Center land use designation shall support a balanced mix of land uses characterized by compactness, pedestrian friendly design neighborhood-scaled structures framed bv architecture and landscape design appropriate to local history and ecology. Policy 28.2 Development patterns within Local Activity Center shall generally reflect planning and design principles such as walkable neighborhoods oriented around the five-minute walk, primary orientation towarddoublic transit systems, a centrally_._located community- serving land use or land uses and greater integrationL of housing,, employment, shopping and recreation at the neighborhood level. Policy 28.3 The City shall adopt design standards within the land development regulations ensuring compatibility between existing and planned land uses within and adiacent to the Local Activity Center. Palicy_._28.4 The city shall adopt local design guidelines that require transit shelters in the Local Activity Center to ,provide safe and comfortable service _ and to encourage transit usage. Policy 28.5 The City of Dania beach shall_.execute an interlocal agreement with Broward County no later than six months from the effective date of the adoption of a Local Activity Center which provides that the City is responsible for the monitoring of development activity and enforcement of permitted land uses densities and intensities stated herein. Policy 28.6 In order to ensure that all properties__can be developed within the overall density and intensity limitations of the Local Activity Center, the City shall establish and implement a development tracking system based on the following rules: a Whenever a conforming use, or portion thereof, is replaced with another category or cateaories_of use (ex: residential to mixed residential and commercial) the nonresidential floor area or number of residential units that are demolished or convert and replaced by another use type shall be available for use on another development site. When conforming development Is demolished the property shall be vested for that level of development intensity until such time as the property is fully redeveloped.: However, in no event shall the development allowance for such a_property be less than what was allowed by the previous land use plan designation based upon residential units or a floor- to-area ratio of .23. b. Nonconfor_ming uses and intensities of use shall not be the basis for determining the allowable development on a Property, c. No new single family homes are permitted within the LAC. d. Any residential development on a property that has not been previously developed as residential and fronts on Griffin Road shall be developed only as a part of a mixed use development where at least the first floor of the development _houses a non- residential use. Policy 25,7 The maximum intensit sy tandards for nonresidential development in the Local Activity Center are as follows: 1. All properties are permitted a maximum Floor-to- Area Ratio (FAR) of 1.5 except that properties with a parks and recreation land use designation are permitted a maximum FAR of .25. Policy 28.8 Properties_ within the Local Activity Center shall obtain centralized sanitary sewer service prior to any new development or redevelopment_ meeting the following criteria: a. Non-residential: floor area ratio of .23 or greater. b. Residential: density greater than four units. per acre not including individual single-famiiv home developments. Obiective XX=X Coordinate future Land Uses with the availability of Public Elementary and Secondary Education Facilities. Rel et48:t Policy 29.1 The City shall determine the consistency of land use plan amendments with their Public School Facilities Elements. The consistency finding shall address whether sufficient capacity is available, or anticipated within the short or long range planning horizon of their Elements, to accommodate the projected student impact of proposed amendments. As provided for within the Amended Interlocal Agreement for Public School Facilities Planning (ILA), the School Board of Broward County shall advise the City regarding the projected student impact of amendments and the availability of capacity at impacted schools. Pe4ey 28:-2 Policy29.2 The City shall not accept a building permit application, nor issue a building permit, for new or additional residential units, unless the applicant presents evidence from Broward County that the impact of the proposed development an public educational sites and facilities has been mitigated by payment of school impact fees, based on the fee schedule and accompanying provisions of the Broward County Land Development Code. Alternative methods of mitigation for school impacts may only be approved via a recorded agreement among the property owner(s), Broward County, and/or the City and the School Board of Broward County. Policy-2�� Policy 29.3 The City, Broward County and the School Board of Broward County shall coordinate through the processes and procedures identified in the ILA to ensure collaborative planning and decision making on population projections and public school siting and to accomplish coordination between the adopted local comprehensive plans and the School Board's District Educational Facilities Plan. Nelic-+-28:4 Policy 29L4 The City, Broward County and the School Board of Broward County shall explore and evaluate opportunities for collocation and shared use of school facilities and civic and recreation facilities during their capital improvement planning processes and other processes as provided for in the ILA. nrvky-2-8-.5 Polic 29.5 The City, Broward County, and the School Board of Broward County will coordinate through the procedures established in the ILA and the Broward County and local land use planning process to ensure that proposed public school facility sites are consistent and compatible with the land use categories and policies of their comprehensive plans and enable a close integration between existing and planned schools and surrounding land uses.
