Call to Order/Roll Call Mayor Castro called the meeting to order at 7:00 p.m. Present: Mayor: Anne Castro Vice-Mayor: C.K. "Mac" McElyea Commissioners: Bob Anton Walter Duke City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Mayor Castro gave the invocation followed by the Pledge of Allegiance to the United States Flag. Presentations were heard after Proclamations 3. Presentations and Special Event Approvals 3.1 Possible City acquisition and rehabilitation of property at 1221 NW Is` Street, Dania Beach—Tim Ryan, Special Counsel Tim Ryan, Special Counsel, noted the property owner has offered to turn the property over to the City in exchange for a release and dismissal of a pending Special Magistrate case for various building violations. The City would then make the necessary repairs, declare the property to be surplus and sell the property so we can continue to protect the neighborhood. Commissioner Duke noted this came to him in February, and seemed like a good idea. His concern is the cost. Attorney Ryan noted the City does not usually endeavor in this type of action. However, he feels this is the most cost effective way to handle this property. Furthermore, it is appropriate to act now, considering the number of vacant properties within the City. He advised that the numbers appear to work out in a positive way. Commissioner Duke questioned who would handle the renovation and disposition of the property. Attorney Ryan noted it would be the City Manager's responsibility to go out to bid. There is also a provision in the Charter as to sale of property. City Manager Baldwin noted he feels confident to handle the property. Vice-Mayor McElyea noted it is a good situation for the City. Mayor Castro confirmed that the property would end up with us one way or the other. She thought if we take it now it would reduce any future expenses. Commissioner Anton motioned to acquire the property; seconded by Vice-Mayor McElyea. The motion carried on the following 3-1 Roll Call vote. Proclamations 4.1 LWV Making Democracy Work Day Commissioner Duke presented the LWV Making Democracy Work Day proclamation to Alice Levy, President of the League of Women Voters of Broward County. Alice Levy, President of the League of Women Voters of Broward County thanked the Commission for the proclamation. She commended the City of Dania Beach for having such an active group and good attendance at the Commission meetings. 4.2 City of Dania Beach Firefighter Appreciation Month Vice-Mayor McElyea presented the Dania Beach Firefighter Appreciation Month proclamation to Colleen Sparks, Executive Director of the South Florida Muscular Dystrophy Association, and several members of the Dania Beach Fire Department. Colleen Sparks, Executive Director of the South Florida Muscular Dystrophy Association, thanked the City for the proclamation. She recognized the efforts of our Fire Department in trying to fight Muscular Dystrophy. 4.3 Water Conservation Month Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Commissioner Anton presented the Water Conservation Month proclamation to Carole Morns of the South Florida Water Management District. 4.4 Water Reuse Week Mayor Castro presented the Water Reuse Week proclamation to Carole Morris of the South Florida Water Management District. Carole Morris, South Florida Water Management District, thanked the City for supporting these important issues. 4.5 Women's History Month Mayor Castro read the Women's History Month proclamation. Jeremy Earle, CRA Executive Director, announced that the Intercontinental Hotel Group approved the hotel development for Hank Thomas. He noted they are hoping to start construction by the end of this year. Hank Thomas, developer for Indigo Hotel, thanked the Commission for supporting the project. He noted he has been awarded the franchise for the City of Dania Beach. Presentations were heard after Proclamations Citizen Comments were heard after Presentations 5. Citizen Comments Charlotte Sloboda, 2905 Lake Shore Drive, invited everyone to attend tomorrow night's Town Hall meeting at the Estates of Ft. Lauderdale at 7:00 p.m. She asked for Commission support on a traffic control issue at the Estates of Ft. Lauderdale, which she has already discussed with City staff. Joanne Morrow, 102 W. Dania Beach Boulevard, Chamber of Commerce, provided an overview of upcoming Chamber events. David Clark, 411 SE 5u' Street, commented on the City's Consumptive Use Permit. He questioned why Dania Beach did not renew their permit in 2006 when it was due. Mr. Clark noted he spoke with John Mulliken, South Florida Water Management District (SFWMD), who told him the Mayor and City Commission should have directed the Public Works/Utilities Director to renew the permit. He accessed the SFWMD Website and showed the audience the steps to be taken in order to renew the Water Consumptive Use Permit. Mr. Clark remarked we are the only City in Broward County that did not renew the permit when it expired. He spoke about the ambiguous way that the Commission speaks from the dais. Mr. Clark further stated Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. that Mr. Mulliken confirmed for him that there is no new well and that the City is only refurbishing our old well. Mayor Castro noted that the permit is currently in place. She further indicated that it took 5-6 years for the permit issue to be clarified. John Mulliken, South Florida Water Management District, noted Mr. Clark misunderstood some of the things they discussed over the phone. He confirmed that the City currently has a temporary permit in place. Mr. Mulliken noted the responsibility of applying for the renewal of the permit is different with every city. He advised he is here tonight to try to find a long-term solution for our water issues. Betty Sokol, 609 NW 10`h Street, questioned if the City was trying to take the firefighters' pension away. She noted that she heard the comments at Saturday's Beach Blast, and asked if this was true. Mayor Castro provided a history of the problems with the firefighters' pension. She explained that the City and the Fire Department representatives have been in negotiations to try to find the best solution for our firefighters. Mayor Castro stated she has suggested that current firefighters stay with the City retirement plan, while newly hired firefighters would enroll in the Florida Retirement System (FRS). Commissioner Anton noted he is not trying to take away the pension plan from anybody. He remarked that it would be unfair to do that because people work hard to have benefits upon their retirement. Mayor Castro noted she has never been a proponent of sending the Fire Department to the County. Ms. Sokol noted she and her husband live on a pension and she was concerned. John Williamson, Dania Beach Firefighters, noted the Mayor was right on and accurate. He stated that they are currently working very hard on pension reform. Bobbie Grace, 110 NW 8ch Avenue, noted she will be honored as one of the women for outstanding services at Mt. Sinai Church. Patrick Phipps, PO Box 897, reported on an experience he had with BSO. He thanked BSO Chief Peterson and staff for allowing him the opportunity to look at things from their perspective. 6. Public Safety Reports Jack McCartt, Fire Chief, commented on a BSO incident that saved a life last night. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Donn Peterson, BSO Chief of Police, noted it is nice to hear the positive comments, but he only leads the team. He announced that on Saturday, April 10 at 9:00 a.m., BSO will be conducting Operation Medicine Cabinet. Chief Peterson explained the purpose of the program is to help prevent prescription drug abuse. He encouraged our residents to bring their unused/unwanted medications for safe disposal at City Hall. 7. Consent Agenda Items removed from Consent Agenda: #7.3 7.1 Minutes: None 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION #2010-037 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA EXPRESSING THE SUPPORT OF THE CITY COMMISSION IN CONNECTION WITH THE SUBMISSION OF A RECOVERY ZONE APPLICATION TO BROWARD COUNTY RELATED TO FUNDING OF THE PROPOSED HOTEL PROJECT ASSOCIATED WITH THE DANIA BEACH CITY CENTER; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2010-037. Commissioner Anton noted he questioned the liability for the City regarding this project. He has discussed the matter with CRA Director Earle and Finance Director Bates who have assured him that the City would not be liable. Commissioner Anton motioned to adopt Resolution 42010-037; seconded by Commissioner Duke. Bids and Requests for Proposals 8.1 RESOLUTION #2010-039 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO THE AWARD OF CONTRACT FOR SOLAR STREET LIGHTING;AUTHORIZING THE AWARD OF BID TO SIGNAL TECHNOLOGY AND INSTALLATION CORPORATION FOR THE PURCHASE AND INSTALLATION OF SOLAR LIGHT POLES AND RELATED EQUIPMENT IN AN AMOUNT OF UP TO $652,384.00 USING FUNDING PROVIDED BY COUNTY CDBG GRANT AWARDS; AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE THE AGREEMENT; DESIGNATING AUTHORIZED REPRESENTATIVES; PROVIDE FOR FUNDING; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2010-039. Mayor Castro noted she requested an overall plan for the solar lighting from Public Services Director Orlando and City Manager Baldwin. Dominic Orlando, Director of Public Services, explained that the initial scope of services for this project involved the installation of 47 solar street lights. When County funds in the amount of $652,384.00 became available, the City decided to include 86 additional fixtures to the project. He distributed a list of the original project and a list of added items, which is attached to and incorporated into these minutes. Discussion followed between Director Orlando and Mayor Castro regarding the proposed plan and how funds would be best allocated. Commissioner Duke noted he received complaints as to the look of the solar lights. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Director Orlando noted technology is improving every day. He said that in the future we may see changes such as smaller panels, different shapes of lights, smaller batteries and a possible decrease in unit costs. Commissioner Anton motioned to adopt Resolution #2010-039; seconded by Commissioner Duke. Public Hearings and Site Plans There were no public hearings at this meeting. 10. Discussion and Possible Action 10.1 Discussion of Water Supply Issue with Keith and Schnars City Manager Baldwin noted that the final report from Keith and Schnars is not yet complete. A final report will be brought forward at the next meeting. Mayor Castro noted that representatives from the South Florida Water Management District and Broward County were present at tonight's meeting. Louis C. Aurigemma, P.E., Director of Civil Engineering, Keith and Schnars, presented a powerpoint overview of the water supply report, which is attached to and incorporated into these minutes. Mayor Castro confirmed with Mr. Aurigemma that in order for the City to get approval from the Broward County Planning Council to change our land use plan, we need to demonstrate that we have enough water capacity for a future increase in population and density. Mr. Aurigemma advised that a meeting between Broward County and the City of Hallandale Beach is scheduled with the South Florida Water Management District in West Palm Beach on Friday. He noted they will attend to hear what is going on. Mr. Aurigemma summarized that the following would be their three recommendations: • Option A- RI: Raw Water Supply from Broward County- it would not require any action; it is also a no cost option to the City • Option B- F1A: Finished Water Supply from Broward County- it may require some City and County Commission action • Option C- F2A: Finished Water Supply from the City of Hollywood- it would cost the City money. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Mayor Castro explained how Amendment 4 is causing cities to scramble to make changes to their comprehensive plans before it is enacted into law. She pointed out that we are working closely with the SFWMD to try to address our current and future water problems. Mayor Castro noted that we are hoping to resolve these issues by June, when our paperwork needs to be filed with the Broward County Planning Council in order to change our land use plan amendment. Bob Daniels, Director of Community Development, clarified that the June date is the date of our extension with the Department of Community Affairs (DCA) for the water supply plan; however, we need to be ready by April for the Broward County Planning Council. 10.2 Marlowe & Company — Washington D.C. Trip Summary for Federal Funding Requests for Dania Beach Projects Mayor Castro noted that she and CRA Director Earle travelled to Washington, D.C. to meet with our lobbyists and various members of the United States Congress to discuss funding requests from the City of Dania Beach. She provided an overview of their trip which was included in the agenda back-up. Mayor Castro commended Marlowe and Company for their vast knowledge of the process as well as their excellent relationship with the members and their staffs to assure the access needed was successful. 11. Commission Comments 11.1 Commissioner Anton Commissioner Anton noted he would not be able to attend the Town Hall meeting tomorrow evening. He said he is very supportive with what the Commission has been able to accomplish for the western area of the City which includes the Estates of Ft. Lauderdale. Commissioner Anton noted that the Beach Blast was well attended. He congratulated City staff and the Chamber of Commerce for their hard work. Commissioner Anton further expressed his concern that only one candidate was listed as a sponsor. The Chamber representative confirmed the other candidate refused to sponsor the event. 11.2 Commissioner Duke Commissioner Duke noted the Sound Insulation Pilot Program is beginning tomorrow. Commissioner Duke noted he attended the Melaleuca Gardens Homeowners' Association meeting where a lot of important issues were discussed. Commissioner Duke noted he is looking forward to the Town Hall meeting to be held at the Estates of Ft. Lauderdale tomorrow night. Commissioner Duke listed some of the civic organization meetings he recently attended. Minutes of Regular Meeting g Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Commissioner Duke urged the community to participate in the Commission Candidate forum sponsored by the Dania Beach Chamber of Commerce to be held on Thursday, March 11 at 7:30 a.m. Commissioner Duke noted the Beach Blast was a great event. Commissioner Duke referred to the easement granted by the Commission in April, 2009, to the owner of the Stirling Design Center property. He pointed out that he is always against giving away taxpayers land. Commissioner Duke further advised that he read in the newspaper today that they did a$500,000 lease of the center and that the owner is doing well with our land. Commissioner Duke noted that the Dixie Highway traffic calming has been approved by Broward County. Commissioner Duke noted that the Charter Review Board meetings are making progress. He is looking forward to their recommendations when they are presented to the Commission. Commissioner Duke noted he has been invited to attend the 2nd Annual State of the County to be held on Friday morning. 11.3 Vice-Mayor McElyea Vice-Mayor McElyea noted he has received complaints from citizens regarding the trash containers along US 1. Vice-Mayor McElyea noted that streetlights are out on the east side of the road, on Dania Beach Boulevard and I" Avenue. Vice-Mayor McElyea noted that his alley has broken telephone cables hanging. Vice-Mayor McElyea questioned what we are doing with the Pirates Inn, the Dania Beach Hotel, and the Sans Soucy Motel. He remarked that they are an eyesore for the progress we are trying to make. Vice-Mayor McElyea would like an answer from staff on the status of these properties. 11.4 Mayor Castro Mayor Castro noted the railroad track crossing on Sheridan Street will be closed this weekend. Mayor Castro thanked Martin Outdoor Media for their offer to install free census ads on the bus benches. She also noted that Martin Outdoor will not be renewing the pain clinic ads once they expire. Mayor Castro encouraged everyone to respond to the census information which determines funding for cities based on population. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Mayor Castro noted that many people have signed up for U-verse services with AT&T, but they do not seem to have a public access station for Commission meetings. She asked City Manager Baldwin and City Attorney Ansbro to find out if other cities have the same issues. Mayor Castro further suggested we request the Florida League of Cities approach AT&T and ask them to live up to their responsibilities. Mayor Castro noted she attended a meeting of the Charter Review Board. She commented we should already have an Ethics Code in place. Mayor Castro further asked City Manager Baldwin to find sample codes for the City Commission to implement. She did not see a reason for the Commission to wait for the Charter Review Board recommendation and suggested adding this issue to the upcoming workshop. Mayor Castro encouraged people to attend the workshop on Saturday, April 10, starting at 9:00 a.m. 12. Appointments Commissioner Duke appointed Patrick Phipps to the Airport Advisory Board to replace Terry Hale-Hicks. The Commission approved the appointment unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted that the International City Managers Association (ICMA) and the Broward City-County Managers Association are expecting a report on the BSO contracts with the cities on March 28. City Manager Baldwin noted that the water supply issue will be discussed again at the next Commission meeting. City Manager Baldwin advised that a preliminary Budget meeting will soon be held in order to get some general direction from the Commission. Bob Daniels, Director of Community Development, advised he has been assigned as the City liaison for the Broward County Airport Mitigation Program. He provided an overview of the Program which was officially opened yesterday. Director Daniels noted that there are meetings scheduled for tomorrow night, conflicting with our Town Hall meeting. The County should have all applications for the Pilot Program by April 10. The Assessment and Design Work is scheduled for late April, 2010 and in January, 2011 they will actually begin working. Mayor Castro noted that the Program would only include certain properties at this time. She suggested the City put the addresses of covered properties on the Website, Twitter and Facebook, so our residents can check whether they qualify or not. Mayor Castro commended Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,March 9,2010—7:00 p.m. Commissioner Anton for making the County eliminate the Avigation Easement requirement from this Program. She reminded everyone who is applying for the Mitigation Progam to have an attorney review their documents before they sign them. Commissioner Anton noted the Pilot Program meeting tomorrow night is for the first group of homes eligible for the Program. He advised that the Outreach office for those interested is located at 200 E. Dania Beach Boulevard. Commissioner Anton indicated that Director Daniels is involved because Broward County Aviation Department requested a staff liaison person to assist with the process. Colin Donnelly, Assistant City Manager, provided a grant activity report, which is attached to and incorporated into these minutes. Mayor Castro asked staff to contact the Florida Department of Transportation (FDOT) regarding the trees on the comer of Griffin Road near DCOTA. She noted the trees were cut but the fence is torn down and something needs to be done to the site. 13.2 City Attorney City Attorney Ansbro had no comments. 13.3 City Clerk - Reminders Wednesday, March 10, 2010 - 7:00 p.m. Town Hall Meeting at the Estates of Ft. These public hearings are required to seek community comments. In past years, these hearings coincided with regular City Commission meetings with the second and final hearing concluding with a resolution to approve a project. This process may short change the public's input by predetermining the outcome. Results from each public hearing will be provided to the City Commission prior to the March 23, 2010 Commission Meeting. Public input may also betaken during the Public Comment portion of the March 23, 2010 meeting. A project has been identified that meets a community need and is consistent with the 2005 CPTED (Crime Prevention Through Environmental Design) Study. This proposed project is storm drainage in a west Griffin neighborhood, north of Griffin Road in Census Tract 804.04 Block 1, which is bound by Griffin Road to the south, SW 34'h Drive to the west, the Cut-off Canal to the north and SW 30`'Way to the east. The CPTED Studies identified improvement in lighting, sidewalks, storm drainage, and signs and have been the source for previous CDGB projects. The anticipated CDBG is approximately$226,000. Florida Inland Navisation District Waterway Assistance Program (WAP) Applications are being made for two projects, dock repair for the IT Parker Center and seawall construction for the north terminus of N.E. Second Street along the Cut-off Canal. The IT Parker applications will be a `construction applications" and require that all permits be in-hand prior to October 1, 2010. The NE Second Street may be Phase I application which will pay for the engineering costs, then the following year the City can apply for a Phase II construction grant. Two projects were considered but are not being pursued. The first was the repair of the seawall at the end of S.E Third Street along S.E. Second Street. This project is not eligible since the seawall abuts a man made waterway. The second project was for dock space and shoreline restoration for the Dania Cove property. This application is being postponed until the design and environmental impact of the Dania Beach Marina is 1 of 2 completed. In the event that the marina project requires environmental remediation for sea grass,the Dania Cove shoreline can be designed for this mitigation. Broward Beautiful Right of Way Grant A grant to beautify state owned rights of way. Community Development, Public Services and the CRA will be developing a project recommendation. MPO—Transportation Enhancement Grants This grant is for transportation improvement to be constructed in three years. There is a 50% match and high priority is for projects that promote multimodal transportation, and those projects that promote safety/security. Community Development, Public Services and the CRA will be making a project recommendation. WaterSIP (Savings Incentive Program)—I attended the South Florida Water Management District (SFWMD) workshop on the grant application. Representatives from Meadowbrook were present. Mr. Viviano confirmed that Meadowbrook will file an application. The City will reach out to Meadowbrook to assist them in their application with maps, technical assistance or anything else they may need. Federal Funding Requests — Marlowe and Company has submitted the City's earmark requests to the City's Congressional representatives. 2 of 2
