Mayor Bertino issued a proclamation recognizing the week of
December 8-15 , 1986 , as "Drug Awareness Week" .

3 .1 Award of bid for SE 5th Avenue construction project .
City Manager Jewell recommended that the bid be awarded to All
Rite Engineering, in the amount of. $434 ,571 .30 , and a change
order with a decrease of $89 ,971 .90 , making the actual award
$344 ,599 .40.
A motion was made by Commissioner Hirsch , seconded by Vice Mayor
Byrd to accept the City Manager' s recommendation and award the I
bid to All Rite Engineering. The motion passed on the following
roll call vote : ;

A motion was made by Vice Mayor Byrd, seconded by Commissioner
Hirsch to approve the change order reducing the amount of the

RZ-72-86 - Rezoning request from RD-6000 to C-3 . (0 .44 acres )

The title of an ordinance rezoning all of Lots 7, 8 , 9 and 10,
and a portion of Lots 48, 49 , 50 and 51 ; all of Lots 5 and 6 ,
and a portion of Lots 52 and 53 ; and all of Lots 11 and 12 , and
a portion of Lots 46 and 47, lying South of Griffin Rd. , Block
C, "Hanson & Nelson Subdivision" , from RD-6000 to C-3 was read
for second and final reading by City Attorney Adler.

Mayor Bertino opened the public hearing. Hearing no one speak
in favor or opposition, the Mayor closed the public hearing.
A motion was made by Commissioner Hirsch, seconded by
Commissioner Cook to adopt the rezoning ordinance (RZ-72-86 ) on
second and final reading. The motion passed on the following

PL-69-86 - Plat Approval request. (3 . 9383 acres )
The title of an ordinance approving the plat of "C. I .D.B. Plat"
was read for second and final reading by City Attorney Adler.
The Planning and Zoning Board recommended approval subject to

Mayor Bertino opened the public hearing. Hearing no one speak

in favor or opposition, the Mayor closed the public hearing .
Building Official Maxwell recommended approval.
A motion was made by Vice Mayor Byrd, seconded by Commissioner
Cook to adopt the ordinance (PL-69-86 ) approving the plat of
"C.I .D.B. Plat" on second and final reading , subject to City
Engineer' s approval . The motion passed on the following roll

PUBLIC HEARING -
5E-70-86 - Special Exception request to allow live
entertainment.
Mr. Gonzales , General Manager of the Ft. Lauderdale Airport
Hilton stepped forward to request a special exception for a live
entertainment lounge, approximately 2 ,000 sq. ft. , top 40 ' s
music catering to business _neonle in the AnnrnvimnVA Ana hYnnboF
t of 25-50 .
1 Mayor Bertino opened the public hearing. Hearing no one speak
in favor or opposition, the Playor closed the public hearing.

A motion was made by Vice Mayor Byrd, seconded by Commissioner
Cook to grant the special exception (SE-70-86 ) for one year,
automatically renewable if no violations, no nude entertainment ,
and subject to the satisfaction of the City Manager. The motion
passed on the following roll call vote:

4 .4 Petitioner: 3M National Advertising Company; owner: Alfred
Sears; property located at 2081 Griffin Rd.
PUBLIC HEARING -
I VA-71-86 - Variance request to allow the replacement of two
existing wood billboards with new steel billboards .
i
David Cohen and Gerald Lewis, representing 3M National, stepped
3 forward to explain the variance request to upgrade the two old
signs located west of I-95 on Griffin Rd.
The Planning and Zoning Board recommended approval subject to a
fence with weaving being erected to cover the view from the road
and the base of the billboards being landscaped .
Though the Commissioners expressed anti-billboard sentiments, it
was noted that the old wooden ones can legally remain there if
this variance is not granted.
Mayor Bertino opened the public hearing. Hearing Vincent
Carroll suggest that nature would eventually destroy the old
signs and hearing Bob Mikes speak in opposition, the Mayor
closed the public hearing .
A motion was made by Vice Mayor Byrd, seconded by Commissioner
Hirsch to deny the variance request (VA-71-86 ) . The motion to
deny passed on the following roll call vote :

PUBLIC HEARING -
.,Jw VA-73-86 - Variance request to allow a warehouse building with
zero lot lines (20 ' required ) along the side and rear property
lines .
Mr. McCutcheon stepped forward to explain the variance request,
asking for zero lot lines on the side and a 10 ' setback in the
rear. Building Official Maxwell reported that the 30 ' in front
meets requirements and the Planning and Zoning Board recommended j
approval . i

in favor or opposition, the Mayor closed the public hearing.
A motion was made by Commissioner Hirsch , seconded by Vice Mayor
Byrd to grant the variance request (VA-73-86 ) . The motion

PUBLIC BEARING -
VA-76-86 - Variance request to allow 4 units on an oversized iot
with insufficient frontage .
A motion was made by Commissioner Cook, seconded by Commissioner
McElyea to continue items 4 . 6 and 4 .7 , variance requests
VA-75-86 and VA-76-86 until the next regular meeting of December
9 , 1986, at the petitioner' s request. The motion passed
unanimously.
ADMINISTRATIVE ORDINANCES (Second & Final Reading)
4 .8 An ordinance amending Section 22-5 of the 1980 Code of
Ordinances entitled "Pavement, Improvement and Use of Drainage
Swales" by adding a subsection (I ) thereto prohibiting the
placement of objects in swale areas within the public
right-of-way of streets, or other public rights-of-way owned or
controlled by the City of Dania. (Cont' d. from 11/11/86 )
AND
4 .9 An ordinance amending Sections 13 .68 and 13 .69 of Article IV,
Chapter 13 of the 1980 Code of ordinances entitled "Garbage and
Trash" , to amend the definition of "small business" and to amend
the services and charges for services provided by the City.

A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to continue the second and final reading of
the ordinances contained in agenda items 4 . 1 and 4 . 2 until the
next regular meeting of December 9, 1986, as the directed
changes to the ordinances are not yet completed. The motion
passed unanimously.
4 .10 The title of an ordinance annexing to the City of Dania certain
properties described as the N 1/2 of Lot 2, Palmeador Half Acres
No. 2 was read for second and final reading by City Attorney
Adler.
Mayor Bert.ino opened the public hearing. Hearing no one speak
in favor or opposition, the Mayor closed the public hearing.
A motion was made by Commissioner Cook, seconded by Commissioner
McElyea to adopt the annexation ordinance on second and final
reading. The motion passed on the following roll call vote:

to vacate dedicated road located between 250 & 254 SW 8 Street .

Commissioner Cook to waive the replatting requirements and to
refer the vacation request to the Planning and Zoning Board.
After comments by Vice Mayor Byrd and Commissioner McElyea
expressing reluctance to give away any City property, the motion
jpassed, Commissioner McElyea dissenting.
7 .2 Request by John A. Bond to vacate Shull Road.
City Manager Jewell expressed Administration' s desire to table
this item until more information can be gathered to make a
recommendation.

A motion was made by Commissioner Hirsch, seconded by Vice Mayor
Byrd to table the request by John A. Bond to vacate Shull Road.
The motion passed unanimously.
7 .3 Adoption of Resolution approving application for Local
Government Comprehensive Planning Assistance Funds. a
City Manager Jewell explained the request for Commission t
approval of the application for State grant in the amount of
$21 ,524 .00 .
i A motion was made by Commissioner Hirsch, seconded by
Commissioner Cook to adopt the resolution applying for grant .
The motion passed unanimously.
ADDENDUM ITEM:
7 . 4 Adoption of Resolution supporting the Parent Teacher Association
of Dania Elementary School in its effort to have additional
traffic control devices installed in the school area of U.S . #1 .
A motion was made by Commissioner Hirsch, seconded by
Commissioner Cook to adopt the resolution.
In response to Vice Mayor Byrd' s comment that this should be
extended to include all the schools in Dania, City Manager
Jewell explained that this is to petition D.O.T. and Dania
Elementary is the only school in Dania located on a federal
highway. The Commissioners agreed that if either of the other
two schools indicate that a traffic hazard exists , it would be
"! the City' s responsibility to address and correct it.
After discussion, the motion to adopt the resolution passed
unanimously .
8 . APPOINTMENTS - none
9 . DISCUSSION
9 . 1 Discussion concerning community center at Harbour Towne Marina.
Commissioner Hirsch
:�. Commissioner Hirsch commented that the terms incorporated into
the motion extending the Harbour Towne Marina lease have not
been lived up to by Mr. Graham, placing the lease in default,
and called for action to be taken toward cancellation of the y
lease.
City Attorney Adler advised that the City must file suit to
cancel the lease.
A motion was made by Commissioner Hirsch , seconded by i
Commissioner McElyea to direct the City Attorney to notify the
lessee and instigate a lawsuit to cancel the Harbour Towne s
Marina lease. j
During discussion of whether or not the Building Department
j should continue to issue permits , City Attorney Adler advised
against stopping the issuance of permits , not wishing the City j
to be a party to causing further default.
After discussion , the motion passed on the following roll call
