A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to excuse Mayor Byrd . The motion
passed unanimously .
PRESENTATION :
By Judge Korda regarding the Juvenile Diversionary Program.
Judge Korda described a program, piloted by the cities of
Cooper City, Davie, Pembroke Pines and Miramar, based on the
concept of neighborhood counseling for juvenile first time
offenders toward the goal of resolving early developmental
'
problems in the neighborhood . He said the P 9 program is now
i under a $75, 000 .00 County grant to operate the program
already begun in the southwest and expand it to the i
southeastern portion of the County, i .e. Dania, Hollywood and
Hallandale . He said they intend to have an independent Board
of Directors made up primarily of Juvenile Officers or Police
Chief designees . He mentioned that the Commission will soon
be asked to approve Dania ' s participation in the program as
well as a $ 5, 000. 00 good faith contribution . i

€ 1 . 2 Commissioner McElyea asked for item 1 . 2 (adoption of Flood
Damage Prevention Ordinance ) to be pulled from the Consent
j Agenda so that it could be handled as an emergency item .

i City Planner Leeds explained the necessity to revise the City
Flood Damage Prevention Ordinance due to revised regulations of
the National Flood Insurance Program . He described two minor
changes that are to be incorporated into this proposed ordinance
per review by the Federal Government . He reported that in order
to meet the program requirements, the ordinance must be updated
by February 17th.
A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to declare the adoption of this ordinance
with the designated changes an emergency item . The motion

The title of an ordinance of the City of Dania , Florida ,
amending the development order for the Design Center of the
Americas Development of Regional Impact adopted by City of Dania j
Ordinance No . 20, as amended by City of Dania Ordinance No .
04-84, City of Dania Ordinance No . 22-84, and City of Dania
Ordinance No . 05-87, to modify the phasing schedule described in
the Design Center of the Americas application for development
approval ; providing that all terms and conditions of the
development order shall remain in full force and effect, except
as amended by this ordinance ; providing that all ordinances or
parts of ordinances and all resolutions or parts of resolutions
in conflict herewith be repealed to the extent of such conflict ;
providing for severability ; and providing for an effective date
was read for second and final reading by Acting City Attorney
Ryan .

A motion was made by Commissioner Bertino, seconded by
Commissioner Hirsch, on the sign portion of VA-02-88, to grant a
variance to allow a 200 sq . ft . , 50 ft . high pole sign , with the
condition that the sign shall comply with any material factors
in the City ' s sign ordinance . The motion passed on the

Vice Mayor Cook opened the public hearing . In response to
questions raised by Vincent Carroll and Bob Mikes, Attorney Ryan
advised that the Commission has the authority to make a Charter
change and City Clerk Mullikin explained the need to update the
Charter to comply with state statute reducing the public hearing
advertising notice time from 14 to 10 days . Hearing no one
speak in favor or opposition, the Vice Mayor closed the public
hearing .
A motion was made by Commissioner Hirsch, seconded by
Commissioner McElyea to adopt the ordinance on second and final

classification was read for second and final reading by Acting
City Attorney Ryan .

7 . 1 Request is made by Aquatic Divers of Dania, Inc . to renew their
permit to fly a 10 ' x 10 ' "Divers Down " flag at 1327 South
Federal Highway .
A motion was made by Commissioner Bertino, seconded by
Commissioner Hirsch to grant Aquatic Divers of Dania , Inc .
permission to fly a 10 ' x 10 ' " Divers Down " flag for a period of
one year, provided the condition of the flag meets the Building
official ' s specifications . The motion passed on the following

8 . APPOINTMENTS
8. 1 Appointment to Industrial Advisory Board - Mayor Byrd &
Commissioner Bertino ' s appointments (Joseph Maniglia and Helen
Udell ' s terms expire in March) .
The Commission unanimously approved Commissioner Bertino ' s
reappointment of Joseph Maniglia to the Industrial Advisory
Board .
9. DISCUSSION
9 . 1 Discussion and possible action on designating SW First Avenue as
a one-way street .
Per Commission direction regarding the previous request by the
owners of Grampa ' s Bakery to designate SW 1st Ave . as a one-way
street, the Police Department took a neighborhood survey, the
results of which indicated the neighborhood majority electing to
let it remain a two-way street .
Tom Grimes, the Manager of the bakery, stepped forward to
withdraw the one-way street request . He suggested instead that
the placement of some of the no-parking signs should be looked
into . The area parking problems, as related to the no-parking
signs, were discussed with Police Chief Thivener .
A motion was made by Commissioner Hirsch, seconded by
Commissioner Bertino to withdraw agenda item 9 . 1 . The motion
passed on the following roll call vote :

City Manager Jewell was directed to look into the possibility of
removing some of the no-parking signs from SW lst Ave . and SW

question of whether any city ordinances have been violated by i
the Thomas project still has not been answered .
Acting City Attorney Ryan advised that if a violation of a
conditional ordinance or permit exists, then the ordinance or
permit can be withdrawn for noncompliance with the terms . He
said his opinion regarding the question presented to him about
the general problems of dredging and noise and vibration is
that, if the dredging, noise and vibration was affecting only tie
several people in the area, then those persons have a private
nuisance action that they can bring against the adjoining
landowner for affecting their peaceful and quiet enjoyment .
Mr . Ryan ' s determination that the City cannot take action
because it is not a public nuisance led to discussion of the
difference between private nuisance and public nuisance .
Mr . Ryan was asked to prepare a written opinion regarding city
ordinance violations, to be submitted to City Attorney Adler for
review and dissemination to the Commission . Al Spies suggested
