Public Hearing - SE-37-89 - A special exception is requested to allow a parking lot in an RD-6000 zoning district . She stated that they would like to tear down the existing McDonalds building at 30 S.W. 14th Street and rebuild it . But in order to comply with the current parking code they had to acquire the property directly west of the building which was zoned RD-6000 and they were requesting a special exception to use it as parking. i Mayor McElyea opened the public hearing. No one spoke concerning this item. The Mayor closed the public hearing and invited comments from the Commission. Larry Leeds stated that the petitioner complies with all zoning code requirements. After further discussion, a motion was made by Commissioner Cook , seconded by Commissioner Grace, to approve the special exception request . Mayor McElyea opened a public hearing on this item. No one spoke for or against the site plan. A motion was made by Commissioner Cook , seconded by Commissioner Grace to approve the site plan with a 4 foot CBS wall , with a ficus hedge , an additional 2 trees along the rear west lot line making a total of 6 live oaks, and subject to all fire regula- tions. The motion passed on the following roll call vote: Commissioner Cook-yes Vice-Mayor Mikes-yes , Commissioner Grace-yes Mayor McElyea-yes 4 .3 Petitioner/Owner - Joe De Bellas; property located at S .W. 31st Street and Ravenswood Road Public Hearing - VA-43-89 - A variance is requested to allow the construction of a billboard sign subject to the following conditions: a) Maximum 14 ' x 48 ' per sign face ( two faces permitted) b) Maximum 65 ' height ; subject to federal , state, county, and municipal aviation requirements. Due to the fact that Ed Stacker, attorney for the petitioner had stepped out of the meeting , Commissioner Cook made a motion, seconded by Commissioner Grace to table this item to the end of the meeting . Motion carried unanimously. 1 This item was brought back before the commission following item { 4 .4 . { Mr. Ed Stacker, attorney presented the this variance .this request for Mr. Stacker stated that even though this area of the City and g property is in the annexed i y governed by the county zoning code, j that the City would consider any permitting or variance f procedures in connection with this request, i Mayor McElyea opened the public hearing and Mr, Hugo Renda stated their objectionsMto thecent variance. Based upon the facts that were discussed at the workshop concerning this item, Commissioner Grace made a motion, seconded i by Commissioner Cook , to grant the variance with the following conditions : a) sign to be located in the eastern area and that it be two faced; b) sign to be no more than 65 feet in height and the size to be 14 feet by 48 feet and subject to federal , state , FDOT, and municipal requirements; and that the proper landscaping be provided. I In response to Vice-Mayor Mikes concern as to whether the City j of Dania has the right to grant a variance on this since it is under the county code , City Attorney Adler stated that even though they are subject to county zoning until the City of Dania changes it , they are still subject to the City of Dania' s approval for permitting and variances, f After further discussion, the motion passed on the following roll call vote: Commissioner Cook-yes Vice-Mayor Mikes-no Commissioner Grace-yes Mayor McElyea-yes 4 . 4 Petitioner - Charles Gillet; Owner - La Quinta Hotel ; property located at 1900 Griffin Road. A) Public Hearing - VA-50-89 - A variance is requested to allow the construction of a hotel in a C-4 zoning district with: a) 217 parking spaces ( 247 required) 4 b) 65 ' height ( 40 ' maximum permitted ) , subject to local county, state and federal aviation requirements. Mr, Michael Green, attorney representing La Quinta Hotel , presented the request and introduced Charles Gillet, architect i for La Quinta who explained the details of the request. Mayor McElyea opened the public hearing . No one spoke for or against this item. Mayor McElyea closed the public hearing and invited comments from the Commission. r a In response to Commissioner Grace' s concern regarding the number of rooms in relation to the number of parking spaces, Mr. Gillet i explained that the parking would be sufficient for the hotel rooms, restaurant , and the meeting rooms. A motion was made by Vice-Mayor Mikes , seconded by Commissioner Grace to approve this variance request. Commissioner Cook made a motion, seconded by Commissioner Grace to approve the site plan. Motion passed unanimously. 4 .5 Petitioner - Richard Stoinoff; Owner - Ellen Stoinoff ; property located between West Dania Beach Boulevard and N.W. 1st Street Regular Commission Meeting 3 August 8 , 198 low lying east of N.W. 12th Avenue. Public Hearing - PL-40-89 (second and final reading) . i The title of an ordinance approving the plat of "Stoinoff ' s Valhalla" was read by City Attorney Adler. i Mr. Richard Stoinoff pointed out that the petitioners listed on i item 4 .6 and 4 .7 were reversed on the agenda. I Mr. Stoinoff inquired of the commission as to their intentions to extend N.W. 12th Avenue through. Mayor McElyea expressed that he felt that this should be retained as an easement for future roadway purposes . Mayor McElyea opened the public hearing. No one spoke for or against the plat approval . The Mayor closed the public hearing and invited comments from the Commission . City Attorney Adler suggested that the Commission secure the easement now for the road . The petitioner had no problem with granting the easement. A motion was made by Vice Mayor Mikes, seconded b C Grace to approve the plat with a 30 ' easement . Mr. Douglas Cowan representing the petitioner presented the request to the commission. Mayor McElyea opened the public hearing. No one spoke for or against the plat . The Mayor then closed the public hearing and invited comments from the commission. Commissioner Cook made a motion, seconded by Vice-Mayor Mikes to r approve the plat . McElyea . A motion was made by Vice-Mayor Mikes , seconded by Commissioner Grace to amend the ordinance to reflect an additional 10% increase in all fees over the proposed. Motion passed unanimmously. A motion was made by Commissioner Cook , seconded by Commissioner Grace to approve the ordinance as amended. Mayor McElyea opened the public hearing. No one spoke for or against this item. The Mayor closed the public hearing and invited comments from the commission. SITE PLAN REQUESTS i ** 5 . 1 Petitioner - Mike Brandon for Ben Franklin Corp.; Owner - Salvatore Studiale; property located at 1901 Griffin Road SP-45-89 - A revised site plan ap proval pproval is requested for a hotel i in a C-4 zoning district. Mr. Mike Brandon presented the request to the commission. Larry Leeds, Growth Management Director, stated to the "a commission that this is a revised site plan and it meets all zoning code requirements. Mr . Leeds asked the commission to make the plan subject to fire department access requirements. Mayor McElyea opened the public hearing . No one spoke for or against the site plan. The Mayor closed the public hearing and 1 invited comments from the commission. A motion was made by Commissioner Cook , seconded by Vice-Mayor Mikes to approve the site plan subject to fire department access requirements . SPECIAL REQUESTS 7. 1 Request to a i pprove on first reading , ordinance providing for a dual referendum annexation vote. I * (The following discussion of this item was held at the beginning of the meeting) : i Regular Commission Meeting 5 August 8, 198 I �I 1 City Manager Flatley stated that the area subject to a dual referendum vote is the City of Dania and the area generally bounded by Ravenswood Road on the east , Stirling Road on the South, State Road 441 on the west , and the westerly boundary of Alandco on the west and then State Road 84 on the north. Due to the lengthy legal description of the ordinance, City i Attorney Adler read the body of the ordinance excluding the f legal description at this time. At this time Mayor McElyea invited any questions from the audience concerning this item. i Residents of the unincorporated area , the City of Dania , the City Manager of Hollywood and the Mayor of Hollywood expressed opinions for and against the proposed referendum election. (The following discussion of this item was held following Item 5.1 on the agenda) : The entire ordinance no. 37-89 annexing to the City of Dania pursuant to Florida Statute 171 . 0413 and providing for a referendum vote was read by City Attorney Adler. (copy attached) A motion was made by Vice-Mayor Mikes , seconded by Commissioner I Grace to approve ordinance no. 37-89 along with the attachments, exhibits, and dates. A motion was made by Commissioner Cook , seconded by Commissioner Grace to approve the request . Mr. Felix Mitchell , Chairman of the Broward County affiliate of Habitat for Humanity presented the request to the commission . i Based on the previous action taken by the commission for this same request by Habitat for Humanity on another house, a motion I1 was made by Vice-Mayor Mikes , seconded by Commissioner Grace to I waive the building permit fees and grant a 3 year note at 108 interest for the payment of the impact fees . The motion passed on the following roll call vote: J Regular Commission Meeting 6 August 8 , 198 i I 1 Commissioner Cook-yes Vice-Mayor Mikes-yes Commissioner Grace-yes Mayor McElyea-yes 7 .4 Request by Humane Sooiety of Broward County to extend a previous i variance for a temporary office trailer. , jMr. . Richard Collard , executive director of the Humane Society presented the request to the commission. He explained that the request last year for this trailer was a little premature. They were not prepared to go into the building campaign at that time but are ready now and need to extend the variance . A motion was made by Commissioner Cook , seconded by Vice-Mayor Mikes to grant the extension of the variance for another year to be considered at the end of that time for another extension if necessary. A motion was made by Vice-Mayor Mikes , seconded by Commissioner Cook to approve the change for the meeting from Tuesday, August 22nd to Friday, August 18th at 8 :00 p.m. and to hold a special a. meeting on Saturday, August 19th at 8 :00 p.m. Motion passed on the following roll call vote: Commissioner Cook-yes vice-Mayor. Due to Commissioner Bertino' s absence at this meeting , this item was deferred to the August 18th meeting. 8 . 2 Appointments by Vice-Mayor Mikes , Commissioner Bertino, and J Commissioner Grace to the Safe Neighborhood Advisory Board. (must be property owners or residents within the district) Vice-Mayor Mikes appointed Katherine Philpart , Commissioner Grace appointed Jessie Davis, A motion was made by Commissioner j Cook, seconded by Commissioner Grace and passed approving these appointments. j 9. DISCUSSION j9 .1 Discussion of a request from L.E.S . to operate two vending stands under the Youth Enterprise Service Program. 1 Mr. Henry Graham, director of Liberia Economic Social Development Inc. presented the request to the commission. j He explained that they would like to set up removeable concession stands where the young people that are a part of this program will be able to sell candy, cookies , ice cream,and f Potato chips. A portion of the proceeds will go to the young j people and a portion will go back into the program for the f J purchase of more stock for the concession stands and a portion fi ' will be invested in a savings account for future school needs , 1 He requested ap proval the sta to use Modello Park as one of the I locations for the stands. i After discussion , Commissioner Cook made a motion, seconded by Regular Commission Meeting 7 August 8 , 198 4 , 17 � 1 Commissioner Grace , to approve the request. The motion passed unanimously. j 9 .2 Discussion of the South Florida Regional Planning Council review of the Airport D.R. I . City Manager Flatley requested approval from the Commission to retain Earl Gallop for a fee not to exceed $750 .00 to do a sufficiency review of the D.R. I . A motion was made by Vice-Mayor Mikes , seconded by Commissioner Cook, to approve this request and that the City Manager work very closely with Mr . Gallop on this issue. i 10 . He expressed his concern for an inspection program in the city to have better control on the safe and efficient operation of the adult congregate living facilities in the city. j 12 .5 Mayor McElyea commended the public works department on the j clean up throughout the city. i He also commented on the good work of Dania BSO District 9.
