PRESENTATIONS

Representative Anne Mackenzie stepped forward to advise the
Commission to transmit further information to the Department of
Natural Resources by August 15 in order to obtain the grant funds

necessary to complete the bike path along Dania Beach Boulevard .
j Representative Mackenzie reported that. the Annexation Bill passed
on July 7 , without the governor ' s signature, and expressed her
understanding that Dania will be conducting a workshop with the
residents in the effected area far their referendum vote for the
November ballot . Representative Mackenzie stated that she has i
received a positive response from the people in the annexation
area of their willingness to be annexed into Dania . i

Commissioner Cook commended Representative Mackenzie for her E
efforts in obtaining the funds for completing the bike path on
Dania Beach Boulevard.
Representative Mackenzie introduced her new Legislative
Assistant , Susan Stacey; and commended her previous assistant ,
Pam Roland, for her years; of service .
City Manager Fl.atley informed the audience that , in cooperation
with the Dania Clean-up Project ; the Dania Pose, consisting "f
i the Mayor, Commission and himself , will ride in the Mayor ' s 1933
j pickup truck beginning July 1.1 to arrest homeowners who are found [
making improvements to their properties . Mr . Flatley mentioned I{
that Posse tee shirts will be given out_ to each participant .

1 .2 A motion was made by Vice Mayor Mikes, seconded by
Commissioner Bertino to correct item 8.2 in the regular
minutes of June 26 to appoint Ed Houston to the Broward j
County Marine Advisory Board for a period of one year
and to approve the minutes as amended.

Resolution
1 .3 City Attorney Adler read the title of the
resolution approving agreemert between Dania and
Broward County for installation of additional stop
signs within the City of Dania; and authorizing the
appropriate city officials to execute said agreement.
Commissioner Cook stated that this agreement involves
the locations at SW 4th Avenue & SW 5 Street, SW 2nd
Avenue & SW 5 Street, and SW 4th Avenue & SW 3 Street.
A motion was made by Commissioner Cook, :seconded by
Commissioner Grace to adopt the resolution approving
" the agreement with the County for additional stop signs
at the locations mentioned.

1 .4 City Attorney Adler read the title of the ordinance for '
first reading amending Chapter 8 of the Code of Ordinances
of the City of Dania, Florida, by adding Article VIII i
thereto entitled "Private Alarm Systems" ; providing
definitions; providing prohibition and removal of unlawful i
systems; providing for deactivation of audible alarms; i
providing for permits; providing for penalties; providing G
for codification; providing for separability.

Commissioner Bertino explained the problem of false alarms
going off within the City for extended periods of time and
the disturbance that this has caused to citizens.
Commissioner Bertino requested the City Attorney to explain
J the vital parts of the ordinance to the audience so that
{ revisions can be made prior to adoption on second reading.

A motion was made by Commissioner Bertino, :seconded by
J Commissioner Grace to adopt this ordinance on first reading.

Administrative Ordinances (second & final reading)
4 . 1 City Attorney Adler read the title of the
ordinance for second reading to provide for minimum
standards for commercial , residential and institutional
structures within the city; providing definitions ;
providing for enforcement; providing for inspections ;
providing for separability.
Will Allen, Growth Management Director , stepped forward
to explain that this item adopts a property standards
ordinance that will supplement. the South Florida
Building Code and provide a greater capability for
maintaining property in residential and nonresidential
areas of the City . Mr . Allen mentioned that this
ordinance was prepared from regulations being enforced
in the City of Hollywood .
Commissioner Cook expressed the need for this type of
ordinance in Dania and felt that the Code Enforcement
Board will now have the ability to enforce the proper
maintenance in the City. Commissioner Cook expressed
appreciation to the Commission and staff for their

assistance in preparing this ordinance .

amending garbage and trash pick-up times within the

i Mayor McElyea mentioned that several residents had
complained to him regarding the disturbance caused by
trash being picked-up from heavy dumpsters prior to
6 : 00 a . m. in the City. Mayor McElyea suggested to
includo garb age pick-cap on Sunday:; t� et:ween 9: 00 a .m.
and 5:00 p.m.
Mayor McElyea operied the public hearing. Hearing no
one speak in favor or opposition , the Mayer closed the
public hearing .
A motion was made by Commissioner Cock, seconded by
Commissioner Grace to amend this ordinance by including
garbage pick up on Sundays from 10 :00 a .m. to 1 :00 P.M.

6 . 1 City Attorney Adler informed the Ccnnmission of a
request to expend the sum not to exceed $'12 , 500 to
retain Mary Stanford & Co. to remarket the City' s life
and health insurance coverages .

` F City Manager Flatley informed the Commission that the
City is not happy with the present insurance carrier
due to administrative delays in turnaround on claims .
Mr . Flatley felt it is necessary to research the best
possible alternative for employee health insurance so
that a new proposal can be effective November 1 .

Commissioner Bertino confirmed that. Mary Stanford does
not receive commissions directly or, indirectly from any
insurance provider in relation to her recommendations .
Mike Smith, Personnel Director , recommended approval of
this request as he feels tho City can save far more
than 12 , 000 and explained that: Mary Stanford will
complete the RFP package and do a detail analysis . t
A motion was made by Commissioner Cook, seconded by
Commissioner Bertino to approve the expenditure request
for $12, 500 to retain Mary Stanford & Co. to remarket
the City' s life and health insurance coverages .

t 1 7. SPECIAL REQUESTS
7 , 1 Don Henderson , Florida Department of
Transportation, stepped forward to request_ that the
Commission reconsider charging PDOT for permit fees on
their project to install storm drainage and paving
along Tigert.ail Boulevard and Brydn Road to the C-10
Canal . Mr. Henderson explained that permit fees in
question should amount to an estimated ,^,,50 , 000 and that:
the funds allocated for FDOT to complete the bike path
along Dania Beach Boulevard will be reduced by the
amount they pay for permit. fees . Mr . Henderson
proposed that Dania waive the permit fees for the
drainage and paving along Tigertail and DOT will cover

the additional costs , above the $50 , 000 in grant funds,
to complete the bike path down Dania Beach Boulevard .
Commissioner Bertino stated that it would be logical
for Dania to waive their permit fees if FOOT will pick-
up the additional costs estimated around $70 , 000 needed
to complete the bike path.
City Manager Flatle_v stated that he would contact
11 Hollywood to sign a reciprocal waiver of permit fees
since the bike path to he completecl involves some
unincorporated property of Hollywood .
Mr . Henderson stated that this will not be necessary
since the portion of property in question is on the
state 's right-of-way and a permit is not required .
A motion was made by Commissioner Bertino, seconded by
Commissioner Cook to reconsider the request by Florida
Department of Transportation to waive permit, fees .

{ Flatley that. the City will be waiving approximately w.
$15 , 000 in permit fees in exchange for the Florida
Department of Transportation covering the additional
$70, 000 in fees needed to complete the bike path along
y Dania Beach Boulevard .
A motion was made by Commissioner Bertino, seconded by
Commissioner Cook to waive Lhe permit fees as requested
by the Florida Department of Transportation for storm
drainage and paving along Tigertail Boulevard from
Bryan Road to the C-10 Canal .
Vice Mayor Mikes explained that his opposition is not
against: the completion of the bike path but that he is
against the installation of a 60" drainage pipe into the C-
10 Canal area . Vice Mayor Mikes expressed his opinion that
this project should have been done as a retention area type
project and opposed the dumping of storm water into the
Dania Cutoff. Canal.

Mr . Henderson responded to Vice Mayor Mike ' s concern by
explaining that FOOT did not. have enough right-of.-way on the '
south end of the project built under the old criteria and
that they preferred to retain the nt.orm water on site but it
t was not possible.

B. APPOINTMENTS - None
9. DISCUSSION
9 . 1 Commissioner Bertino reported that he met with
representatives from the Broward County Parks and
Recreation Division to discuss plans for developing the wNd
Westlake area. Commissioner Bertino mentioned that the a

plan will involve nature walk areas and a number of
bicycle paths . f

j Commissioner Bertino stated that after reviewing the
proposed bike paths , it was discovered that the bike j
i path was only going to go north tip to Dania Beach
J Boulevard and stop directly south of the canal .
Commissioner Bertino mentioned that Broward County was
not aware that Dania was going to comple',,e a bike path
down Dania Beach Boulevard and he suggested connecting
the bike paths by constructing a bridge across the
canal and extend the bike path out to Dania Beach
Boulevard .
9 Commissioner Bertino staged that the Broward County
j Parks and Recreation Division needs a letter from Dania
explaining that there is a bike path being constructed
down Dania Beach Boulevard and that Dania wants the
Westlake Bicycle Path to cut. into the Dania Beach
j Boulevard Bicycle Path in order for them to redesign
their plans .

Commissioner Bertino stated that he also discussed the
possibility of a bicycle path along the eastern side of
5th Avenue from Dania Beach Boulevard to Sheridan
Street and that Broward County would also consider this
idea.
City Manager Flatley assured the Commission that he
will prepare a letter to the Broward County Parks &
Recreation Division covering the completion of these
two bicycle paths as presented by Commissioner Bertino.

ADDENDUM ITEM
9.2 Vice Mayor Mikes brought up discussion of property
acquisitions by the Airport Authority that was
mentioned in a recent Sun Sentinel article and
requested that City Manager Flatley report on the
a progress that has been made by the planner looking into

i the D.R . I . review.
It
City Manager Flatley reported that it has been
difficult to work with the airport even though they !!!
have set up inter-agency review meetings on a monthly 1
basis to discuss common problems.
Mr. Flatley stated that Earl Gallop, the person who has
worked directly with him on annexation matters and who
was hired to review the D.R . T . , is ready to issue a
draft report this week detailing the kinds of tax
revenue land that Dania will be losing with this most
recent proposed expansion of the south runway. Mr .
Flatley mentioned that Mr . Gallop will report on the
expected loss of land and what the new building
restriction lines will mean to get; a handle on what
kind of future revenue loss we can expect . Mr . Flatley
expressed his frustration for not: being able to meet �
with the proper airport individuals to determine
exactly what land is involved .
Vice Mayor Mikes stated that Dania may want to look
into legal recourse in this matter and suggested that
funding be available in the budget to pursue a possible
lawsuit . Vice Mayor Mikes stated that he felt this to
be cost effective since this matter involves a loss of
substantial amount of future tax base for the City of
Dania .

City Manager Flatley informed the Commission that a L meeting is scheduled for July 24 with the South Florida t
Regional Planning Council on the early findings for
this substantial deviation D.R . I . for the south runway.
Mr. Flatley mentioned that the County has scheduled a
formal public hearing for September 5 and that Dania {
must also set a public hearing sometime in the month of
October to issue our own development order.
Commissioner Bertino suggested City Manager Flatley
send a registered letter to the County demanding a
response on exactly what land the County will be
purchasing . Commissioner Bertino stated that a time
limit for the County' s response be included in the
letter and if. Dania does not receive a response to go
forward with legal recourse.
Commissioner Cook suggested Mr. Flatley set up a
meeting with Mr. Lubomiski to clarify this issue to
determine where Dania stands.
# Commissioner Grace expressed the need for Mr. Flatley
to meet with the proper County officials prior to j
reserving finds in the budget to pursue possible legal f
recourse in this matter . {
William Wosenitz , 341 NE 2 Court , stepped forward to
inform the Commission of two lawsuits in process
against the County relating to the condemnation of
properties and noise problems relating to the expansion ,W_.
i of. the airport by the County .

9. 3 City Attorney Adler reported on a request by
J Meadowbrook Condominium Board of Director's for
clarification of drainage easements to Meadowbrook
Lakes South . Mr. Adler was informed by Rubin Snyder,
Attorney with the law firm of Abrams & Anton in
t Hollywood , that he will research his records to see if
they have the recorded easements .
City Manager Flatley mentioned that tie .is in the
process of finalizing the drainage study for this area
to determine if one or another outlet isn ' t: necessary. d
Mr. Flatley stated that if it is determined the outlet
is not necessary for flooding purposes , Dania will
close it up. Mr' . Flatley stated that he will keep the
people at Meadowbrook informed of the study results .

In response to Mayor McElyea ' s request , City Manager
t Flatley informed the Commission that H & }1 Crane will
1 be working on the drainage problem located at Phase V
a and VI of Meadowbrook sometime this coming week . f

Commission get together and take a tour of the areas
newly annexed into Dania on July 17 and , after the

11 . 1 . 3 City Manager Flatley distributed copies of the
Fiscal Year 90-91 budget and mentioned that a budget
workshop is scheduled for tJuly 13 at 9 :00 a .m.

{ Mr . Flatley reported that this budget proposal does not
increase the millage rate and focuses on hiring
employees with expertise for the Utility and Recreation
j Departments . Mr . Flatley mentioned that he is
proposing to use previous years surplus funds to be
used for a five year capital improvement program that
will he set out for public review and approved by the
Commission .

11 .2 . 1 City Attorney Adler made a stratus report on
Hollywood/Dania Large User Sewer Agreement that
replaces the 1973 Agreement . Mr. Adler mentioned that
the major change in the agreement involves Cities being
charged for actual flows instead of allocations . Mr.
J Adler reported that the lawsuit with Hollywood has been
worked out and the last calculation confirmed that
Dania is to receive $244 , 000 in settlement charges .

Mr . Adler mentioned that Hollywood is expected to
approve this agreement tomorrow and he advised the
j Commission to wait and approve this agreement after
Hollywood.
Mr . Adler mentioned that an amendment. to schedule D
relating to the settlement charges is expected from
Hollywood in the next day or so.
City Manager Flatley explained that, a portion of the
t settlement from Hollywood will be used to establish an
I & I fund to repair the ,ewer lines . Money saved each
year on the payment of sewer flows will be placed in a
5 year revolving fund . Repairs will be warranted for a
5 year period . This should reduce the cost of sewer
service in the future .

12. 1 Commissioner Bertino
Commissioner Bertino inquited as to whether or not the i
dumpster situation has been resolved with MEBA.
iWill Allen, Growth Management Director, reported that
MEBA has a proposal to present on relocating the trash
facility but that there has been a delay in setting up
a meeting due to being unable to reach the individuals
involved and MEBA representatives , ;

Commissioner Bertino informed the Commission that there
is an eagle scout interested in transforming land into I
a park owned by the City of Dania as part of an eagle `
scout project. Commissioner Bertino stated that the
i property is located off of. :Stirling Road directly south
of the C-10 Canal
j Commissioner Cook informed Commissioner Bertino that
she is in the process of drafting letters to various
organizations regarding a project called "Adopt A Park"
and suggested including this eagle scout project as the G
first park.

jCommissioner Cook asked City Attorney Adler if he has
been able to obtain ordinances from other cities

regarding the safety of lakes in the City.
City Attorney Adler mentioned that he has not been able
to locate this information but stated that, he will
continue .
Commissioner Cook reported that she attended a recent i
Country Commission Meeting with Mike Smith , Personnel
Director, and mentioned that Dania has a very high
rating in obtaining Community Development Block Grant
funds . Commissioner Cook mentioned that Dania should

be receiving around $275 , 000 in grant funds this year .
12 . 3 Commissioner Grace
Commissioner Grace commended Commissioner Cook for her
efforts in several projects in Dania .
Commissioner Grace expressed the need to encourage
young people graduating from high school to pursue
college opportunities . Commissioner Grace reported
7 that: Commissioner Cook was with her on Sunday at Bethel
{ Baptist Church to honor 17 students who live in the

Dania area and mentioned how impressed she was with
their scholastic abilities .

12 . 4 Vice Mayor Mikes
Vice Mayor Mikes expressed the need for establishing
single family home areas .
Vice Mayor Mikes suggested the need to prepare an
ordinance to review the site plan approval process and
mentioned the need for elevation views as a
requirement . Vicc Mayor Makes suggested adding d time
limit on site plan ; once they are approved to require
permits to he pulled and action to he taken .
Will Allen, Growth Management_ Director , agreod will'
Vice Mayor Mikes that. a time limit should be added to
site plans as circumstances do change and the
Commission would have the ability to make revisions
after a few years go by.
Vice Mayor `tikes mentioned that he attended a meeting
at Port Everglades regarding the proposed construction
of an incinerator plant_ and stated that he transmitted r
the information that Dania is in apposition of this
project . Vice Mayor Mikes stated that a public hearing -
is scheduled next week for Port Everglades to
reconsider and possibly deny this project .

Vice Mayor Mikes welcomed the new citizens into Dania
I who were annexed into the City with the passing of the C
recent annexation bill .
12 . 5 Mayor McElyea I
Mayor McElyea mentioned that City Manager Flatley is
going to address the problem of numerous street lights
that are out along US 1 , near the Hilton Hotel on New
Griffin Road and other areas in the City.
Mayor McElyea stated that the Sheraton Hotel on Griffin
Road has been rated number 1 for their fine restaurant ,
service and hotel facilities .
Mayor McElyea expressed the need for, a left hand turn
signal on New Griffin Road for persons going into
Melal.eauca Gardens .
The Commission generally agreed to have City Manager
Flatley draft a letter to County Commissioner, Nicki
Grossman, to be signed by the entire Commission, I
expressing the need for a left hand turn signal on New
Griffin Road .
This regular commission meeting was then adjourned.

MAYOR'S PROCLAMATION
i
WHEREAS, according to the Vital Statistics Department in
Dade , Broward, and Palm Beach Counties , over 180, 000 babies have
been born in South Florida during the past three years , with an
estimated 65,000 babies expected to be born in our area this year;
and

WHEREAS, on August 18 and 19, 1990, JOY 107 FM will host the
first-ever "Baby Fair and Children' s Exposition" in the City of
Fort Lauderdale War Memorial Auditorium; and
WHEREAS, admission ticket proceeds from this event will
benefit the Children's Home Society of Florida, a voluntary
ished in 1902, with a mission to
non-profit organization establ
preserve and strengthen family life; and
WHEREAS, the services provided by the Children' s Home Society
include counseling and assistance for pregnant teenagers and young

WHEREAS, in Broward County, the Children's Home Society is
