City Attorney Adler explained that. this resolut,io❑ covers an exchange of right- of- way property from the west side to the east side in the Mount. Dania area with the Department. of Transportation in order for them to const.ruct a straighter road and install drainage. Commissioner Cook explained that. the Coca-Cola Bottling Company is going to donate a baseball scoreboard to be used at Modello Park. City Manager FiaLley mentioned that this scoreboard i. valued at around $2, 000 and that it will take about 4 A to 6 weeks to receive after it: is ordered. � k. Will. Allen , Growth Management Di-rector, explained that the first reading of this ordinance require ; a public hearing as it is an amendment to the zoning code which could affect 5% or more of the limit. : of the municipality . Mr. Allen mentioned that the ordinance addresses the type of fence that can he used in residential or in commercial areas of city. Mr. Allen explained that: an additional 7 height has been added for residential areas that abut commercial areas for screening purposes, the street side yard (area from Lhe o .m front to the rear of the house) fence height was increased from 4 ' to 6 ' for additional ,pace activity area , screening and security purposes , and the use of barbed wire fence; was prohibited in residential areas. j Mr. Allen mentioned that in Lhe nonresidential areas, 1 a fence height of R ' was: included , setbacks are the same as residential wiLh the exception of when a fence e abuts a street in the commercial area , they must, have a �^ setback for landscaping to provide better traffic safety. I i Commissioner Cook reminded the Commission that. there was a need to make these changes to the zoning code in relation to fences , hedges and walls in an effort to make Lhe area, more consistent. . i Will Allen informed the Commission that the Planning � Zoning Board recommended approval with Lhe suggestion that. in Lhe st-reel. side yard area to move the fence back approximately 12" for screening purposes . i i Commissioner Grace commended Commissioner Cook for her effort, in preparing this ordinance and felt Lhat this will bring Dania in line with other cities; rogulat. ions . Mayor McEl yea opened the public hearing. Kurt. Ely requested the Commission possibly change Lhe non y n­:. idaniial term used in the ordinance as he fell. it Ei was loo broad but in general spoke in favor , Tim I McCloud spoke in favor and requested commercial areas I be required to add anL1 noise materials to their chain link fences, Faye Bartelmes expressed the need to have fences constructed close to sidewalks for easier maintenance of Lhe areas. Discussion continued on whether or not to leave the fence request; under the variance procedure for better control by the Commission or to amend the ordinance to r : include residential property only . A motion was made by Commissioner Cookseconded by i Commissioner Grace to adopt the ordinance on first. reading with the amendment of deleting the Commercial_ portion of the ordinance and the recommendation of the Planning & Zoning Board concerning street sideyards in residential areas to have a one foot, sel,back on fences from Lhe property line and landscaping be placed in this twelve inch area and in regards to chain link fence, it would be placed on the property line with a hedge on the inside of the fence .
