Southeast drainage study. 1 i City Manager Flatlet' requested Berry & Calvin to report ,._ on their findings of the drainage study for the Southeast section of the City and present their analy< is on the effects of disconnect iny the f Meadowbrook Lakes from the city drainage ,ystem . i John Calvin, Berry & Calvin , mentioned that: his firm has conducted a drainage study on an area encompassing 420 acres bounded by Federal Highway and S . E. 5 Avenue on the west and east: , and by Dania Beach Boulevard and Sheridan Street on the north and south . Mr. Calvin mentioned that the Southeast. ection of the city has low lying elevations making it !ausceptible Lo heavy flooding during moderate rain storms occurring several t times throughout any given year . a j Mr. Calvin mentioned that the governing agencies which i j regulate drainage improvements in this area were contacted with regards to Lheir findings and that there ideas were well received . J Tim Welsh , Engineer with Berry & Calvin , presented a cost analysis of seven options the City (,ould choose for solvin t:he drai.nace g 1 problem in the Southeast section of the City . Several citizens -i.n the area and from Lhe Meadowbrook d j Lakes Condominiums slopped forward to express their concerns for rc olvrng thi drainage tu-oblem due to the pollution and algae problem created when the c-ity !!! draining system wafi ronnocted into the Mo-adowbrook Lakes \f ter heat ing from r c.pr esenCat ivc s from tha� Meadowbr'ook Condominiums , Mr . Flitley agrr,,ed to research and report back on who gave the City permission to t,ike over Lhe maintenance contract with Aquatic. Systems . Further into the meeting , Mr . Adler was given a Meadowbrook Lakes Memorandum dated October 2.7 , 1987 from a Mr . Henry Levisc,n , President of the Central Board , giving permissinrr to the City of Dania to maintain the lakes at Meadowbrook. � f WORKSHOP MEETING 1 SEPTEMBER 19, 1990 i The Commission generally agreed to have the City Manager and City Engineers look into funding alternatives and come back with a recommendation on which option would be the most positive alternative for a solving the drainage problem in the southeast section f and protect the residents at Meadowbrook Lakes j Condominium . ADDENDUM ITEM 7. WAS DISCUSSED AT THIS TIME ITEM 8 WAS DISCUSSED AFTER ITEM 7 ITEM 4 WAS DISCUSSED AFTER ITEM 8 I ITEMS 2, 3, 5 AND 6 WERE CONTINUED TO ANOTHER WORKSHOP MEETING TO j BE SCHEDULED BY THE COMMTSSTON. i 4. Review of Wyatt Study. i Mike Smith , Personnel Director, informed the Commission of a proposed pension ordinance to allow uses of actuarial gains to offset retiree health insurance premiums and to stabilize costs in the event of an actuarial loss . I j Mr. Smith explained that if the City established the pension rate of contributions at 9 . 5% for 1990-91 the � result in a reserve fund from actuarial gains would be j $244 , 000 and mentioned that this would allow the City j to work within its existing budget . If the City chose a 10% rate of contribution the reserve fund would be $328 , 000 but would require: the city to provide an additional $10, 000 from the contingency fund . i Mr . Smith stated that Marie Jabalee, Finance Manager, and himself have requested the Police k Firefighters a.n Pension Board and Union to develop language in the proposed ordinance to ensure the city retains the right to yearly review its option to leave total actuarial gains in the plan or take the appropriate reduction in its contribution rate. Mr. Smith stated that they also covered the situation that should the need for the reserve fund, namely to offset retiree health insurance Premiums , no longer exist at some point in the future, then said actuarial gains may he used by the City without any need for further bargaining . Vice Mayor Mikes expressed his concern that this program has not been utilized by other cities and felt it to he irresponsible for the city to be muni_pulating pension funds of employees , Vice Mayor Mikes stated that the City should stay with the nwre conventional Programs that have been proven . jMr . Smith stated that ince the fiends still remai.n in the control of the Commission , he felt the city wouldn ' t be any worse off than they are now . Vice Mayor Mikes expressed his dissatisfaction with discussing this issue prior to obtaining state and agency recommendations and approvals of the program. Mr. Smith responded to Vice Mayor Mikes ' concern by explaining that he didn ' t feel it to he cost effective to obtain written approvals for this program until after he was sure the Commission agreed with the concept of the program. THE MOTION PASSED UNANIMOUSLY. ITEM 7 . WAS DISCUSSED AFTER ITEM 1 � I 7 . Discussion of Dania ' s position regarding the South Runway Expansion at the Airport . f Attorney Curtis representi.ng the City of Dania in the South Runway Expansion at the Airport stepped forward to describe the progress of the negotiations wit,lr the j Airport regarding noise mitigation and the types ()f use of the new commercial south runway. Mr' . Curtis mentioned that the two areas of concern have been to assure Dani.a ' s tax base is maintained and to protect the residents from the ,,()rind pollution of this development . Mr. Curtis mentioned that the three basic areas for protection of the sound pollution are west of the south runway which is the newly annexation area , the -�. Melaleuca Gardens area and NF Dania off the southeast end of the diagonal runway. Mr . Curtis reported that two major- goals have been accompl.ished involving establishing that Federal Funding will. be set aside prior to mitigation occurring and that the County will only be using stage three aircraft on the south runway. Mr . Curt-is stated that he has not been able to obtain a conuniturent from the County on the number of aircraft that wi11 he used or on the time restrictions for the runway. Mr . Curtis mentioned that a meeting will he held with the City of Fort Lauderdale and thc, City of Dania to i attempt to come up with an agreement ()n a preferred � runway system which would involve curfew ions . Mr. Curtis explained that Browar,d County approved a I Part. 150 Study in 1989 which is a noise study <;n the impact. fire airport has on the surrcnuuling neighborhood. Mr. Curtis explained ghat his position is to mitigate this issue since this study was; not considered in the DRT in 1981 or when they expanded the terminal to allow the increase in operations . Mr . Curtis expressed doubt in obtaining an agreement. with the County on this issue. Mr. Curtis explained that the last area of mitigation involves the types of easements and restrictions that will be implied on Lhe impacted area which can affect Dania ' s tax base for revenue . Mr . Curtis mentioned WORKSHOP MEETING 3 SEPTEMBER 19, 1990 y' z' J y i f +t i 7 that there are three phases set up to negotiate with the County to determine the financial impact on Dania and if no agreement is reached after going thru the three phases , the city will have to file a lawsuit. . i� Discussion continued on the County involving around 1 , 000 people in their Part 150 study and that the ' additional residents in the annexation area , anticipated by the year 1995, not hei.ng included in the study. City Manager Flatley expressed hia; concern on the lack of information being available to the City from the County on this issue . City Manager Flatley stated that he is adding a resolution to the next regular commission meeting requesting to delay the public hearing process on the Airport south runway expansion until current data, updated from 1980, is available. Mr. Flatley mentioned that Dania may still go forward with their proposed November 1 public hearing as scheduled in an effort. to give citizens an opportunity to respond on this issue but that it would ho c(.)ndueted on a forum type of meeting. P After further discussion , it was determined that Mr . Flatley and Mr. Curtis would present- further discussion of this item prior to the adoption of the resolution at � the next regular meeting of September 25, 1990 . s ^ 8 . Fence Ordinance revisited . rorr- Commission Grace requested the following changes he made to the fence ordinance : 1 . To allow a 6 ' fence to the front of the house line j and no further than 4 ' from the maximum. 1 2 . To allow the fence t.o the property line with no 1� setback . I 3 . To delete the landscaping regniremeni:s . 4 . To include all above grade seawalls or retaining walls as part of the height of the fence. 5. To include that the grade for the fence height or the crown of the adjacent. road of the street be measured from the crown . 6 . To require the good side of the fence face the outside towards the street. The Commission agreed that this ordinance be revised I and discussed at the next regular meeting of September 2.5 , 1990 . Vice Mayor Mikes expressed his dissatisfaction for spending the amount of tame the Commission has spent on discussing this proposed c.crdi_nance when he doesn ' t, feel there is an overall need to the citizens of the city . Commissioner Grace. expressed her view that this ordinance is important and will implement positiva action for Dania citizens . t.
