HomeMy WebLinkAboutR-2010-055 BC Commission Transmittal Hearing RESOLUTION NO. 2010-055 A RESOLUTION OF THE CITY COMMISSION OF DANIA BEACH, FLORIDA, REQUESTING A TRANSMITTAL HEARING BY THE BROWARD COUNTY COMMISSION ON OR BEFORE THE AUGUST 10, 2010 COUNTY COMMISSION MEETING, TO CONSIDER LAND USE PLAN AMENDMENTS PCT 10-5-DANIA BEACH REGIONAL ACTIVITY CENTER (RAC); PC 10-9-LOCAL ACTIVITY CENTER MAP AMENDMENT; AND PCT 10-4-DANIA BEACH LOCAL ACTIVITY CENTER (LAC); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 4, 2010, the State of Florida will hold a statewide election to consider State Constitutional Amendment IV, which will affect the Comprehensive Land Use Plan amendment process within the state; and WHEREAS, passage of this constitutional amendment would result in significant costs to the public for comprehensive plan changes that are necessary for the implementation of local government development and redevelopment goals; and WHEREAS, the City of Dania Beach is processing comprehensive plan amendments that will require companion amendments to the Broward County Land Use Plan; and WHEREAS, the proposed land use plan amendments have been submitted to the Broward County Planning Council for review as items PCT 10-4 and PC-10-9 relating to the land use plan text and map amendment for a Local Activity Center (LAC) and PCT 10-5 relating to the land use plan text amendment to the Regional Activity Center(RAC); and WHEREAS, the City Commission of the City of Dania Beach wishes to have review of these amendments completed by the Broward County Commission and State Reviewing Agencies before the November 4, 2010 statewide election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the City Commission of the City of Dania Beach respectfully requests that the County Commission hold a transmittal hearing on August 10, 2010 to consider the following Dania Beach Comprehensive Plan Amendments and their companion amendments to the Broward County Land Use Plan: PCT 10-4 — Local Activity Center Text Amendment; PC 10-9 Local Activity Center Map Amendment; and the PCT 10-5 Regional Activity Center Text Amendment. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. These amendments, PCT 10-4, PC 10-9 for a Local Activity Center (LAC), and PCT 10-5 for a Regional Activity Center (RAC) have been submitted to the Broward County Planning Council. As you are aware, municipalities throughout the South Florida Region are proposing amendments to their comprehensive plans now in order to ensure the completion of review before the November 2010 statewide election at which constitutional amendment 4 will be considered. Passage of that constitutional amendment would result in significant costs to the public for comprehensive plan changes that are necessary for the implementation of local government development and redevelopment goals. Under its current rules the County Commission now normally holds land use hearings on the last Tuesday of each month. In order for the Broward County Land Use Plan amendments to be adopted in the necessary time-frame for adoption to occur before November a County Commission first, or transmittal, hearing must be held on or before August 10, 2010. A County Commission transmittal hearing after August 10 may not afford the opportunity for the Broward County Land Use Plan amendment to be adopted by November 2010. At its meeting of April 27, 2010 the City of Dania Beach Commission enacted the attached resolution R 2010-055 respectfully requesting that the County Commission to hold a transmittal hearing on or before August 10 to consider the above referenced Dania Beach comprehensive plan amendments and their companion amendments to the Broward County Land Use Plan.
