Call to Order/Roll Call Mayor McElyea called the meeting to order at 7:00 p.m. Present: Mayor: C.K. "Mac" McElyea Vice-Mayor: Anne Castro Commissioners: Bob Anton Walter Duke Bobbie Grace City Manager: Robert Baldwin City Attorney: Tom Ansbro City Clerk: Louise Stilson 2. Broward County Proposed Draft Noise Mitigation Plan Neal McAliley, Airport Special Counsel, noted the City is in litigation with the FAA over the airport expansion. However, tonight's issue is noise mitigation, as required by the Interlocal Agreement between Broward County and the City of Dania Beach. He asked everyone to extend courtesy to County staff present at tonight's meeting. 2.1 Presentation by Broward County Aviation Department Staff Kent George, Broward County Aviation Director, introduced Chris Lee, Broward County Senior Attorney; Jacques Baumier, Noise Mitigation Officer; Diane Carter, Project Manager for the Urban Group; Howard Stinels, Urban Group; Bob Diffenderfer, Ken Spillius, and the Deputy Director of Aviation. Mr. George presented a Powerpoint overview of the Proposed Draft Noise Mitigation Program, which is attached to and incorporated into these minutes. He noted the program was put together by BCAD staff and followed the Pilot Program, which is currently in existence. This is the same presentation that was made to the Broward County Commission. Mr. George noted the County removed avigation easements from the requirements for the Pilot Program and the Mitigation Program. He said they have the first 50 homes for the trial program, and they have started the evaluation. Mr. George advised that acquisition of vacant parcels is not part of the program because they are already compatible. They expect to have substantial completion of homes in the 65 and above dnl prior to the opening of the runway in the fall of 2014. Mr. George encouraged everyone to go to their website and view all the information that is presented tonight, as well as other information regarding the expansion. He also encouraged everyone to visit their office located on East Dania Beach Boulevard. Mr. George advised that they are recommending the Voluntary Sales Assistance Program, which would begin one year after the south runway opens. The home must be sound insulated and owner occupied. He feels this is a good program and will help the neighborhood; it will also keep the properties on the taxrolls. The City of Dania Beach has to present their comments to the County by June 14, 2010. 2.2 Public Comment William Nelson, 829 NW 13`h Avenue, commented that duplexes and multi-family homes are not included in the sales assistance program. He felt this was unfair to the property owner. Dean & Jennifer Harley, 606 NW 8h Street, questioned what would happen to homeowners whose properties are now valued less than when they were purchased. They suggested future home values should be considered. Thomas Lietaert, 726 NW 12`h Avenue, questioned the expense for an airport expansion that most people in the county do not want. It makes more sense, county-wide, to consider other options. He said that it seems to him that the assistance program will checkerboard a neighborhood and the remaining property owners will be stuck with it. Mr. Lietaert said noise proofing the homes was good. Commissioner Anton pointed out that the sales assistance program only applies to properties located within the 65 or higher dnl. Gary Luedtke, 4461 SW 341h Drive, had 3 comments: 1) operations at the airport are down 19% from what they were at the peak, there is actually a 38% difference; 2) this is a boondoggle, it is a 50' sloped runway; 3) even if the homes are soundproofed, they are not vibration proof. The Interlocal Agreement calls for relocation, but is not mentioned by the County; this should be the easiest for the attorneys to agree upon. Joe Ruppert, 4424 SW 27`h Avenue, questioned how outdoor noise mitigation would be addressed. He also asked if a health impact study had been conducted. Pat Wright, 4391 SW 34`h Lane, challenged the Broward County Commission to honor the Interlocal Agreement for like value and relocation. She said she does not trust the County and questioned what the catch was for the soundproofing program. Zachary Adams, 837 Argonaut Isle, noted everyone here is qualified to address quality of life. He addressed the safety factors for the proposed runway; he is an airline captain and a consultant. Mr. Adams said the sloped runway is a safety factor and pilots do not want to use them. He said there is no reason for this project to exist; it has surpassed its need. Mr, Adams said we need a sound management traffic program because we only need an extra runway for 2.5 hours a day. He noted people will not be able to enjoy the outside of their homes, they will have to stay indoors. Mr. Adams said property values have declined due to the airport expansion, and the decline in the economy. There is no reason to make the project happen. Lenny Mujica, 610 NW 7`h Street, questioned the program as it stands. He recommended that all homes be eligible for all parts of the program, not just those within the 65 or higher dnl. He asked what would happen if nobody buys the 23 homes in the program. Stephen Dehnert, 4401 SW 35`h Avenue, confirmed that if his home is outside of the 65 dnl, he cannot participate in the sales assistance program. He noted he currently owes more for his house than it is worth, and questioned how further declining property values would affect property owners. Victor Lohmann, 7404 Nautilus Isle, noted the tax base transportation issue is not addressed in the sales assistance program. He said that all relocation costs should be part of the program. Mr. Lohman stated he would rather be subjected to the federal standards for condemnation, than to the draft agreement; that would be more equitable and fair. He noted the Interlocal Agreement calls for a mitigation program to be in place before the expansion, the proposed program begins a year after the expansion. Sacha Conner, 196 NE 6`h Court, noted the location of her townhouse is not included in the noise mitigation zone. She questioned what would happen to them when everyone leaves. Ms. Conner said County Square Townhomes should be included in the boundary because neighborhoods are based on homes. Linda Sacco, 4481 SW 38`h Terrace, objected that sound mitigation begins one year after the runway is completed. She requested the mitigation begin before the runway opens, as required by the Interlocal Agreement. Ms. Sacco wants the relocation program implemented and to be made whole. Mark LaRocca, 4511 SW 341h Avenue, thanked the commission for helping the residents with this project. Bob Mikes, 601 NW 7`h Street, noted he was a sitting commissioner when they negotiated the Interlocal Agreement with Broward County. He said the County is trying to get out cheap; they are doing what the ATA wants; the ATA was never included in the agreement. Mr. Mikes referenced a letter written by former Governor Graham to An McKenzie, after the Interlocal Agreement was signed. A response from the attorney for the FAA noted the Interlocal is a contract enforceable in court, and the advanced noise mitigation must be funded and implemented prior to increased activity being allowed on the new runway. Mr. Mikes noted that we will have to fight to get a reasonable solution for the residents. He thinks we have a very strong case and this should be an easier fight than what we have going with the FAA. Mr. Mikes said the proposed program is a formula for blight in the neighborhoods. He noted it will be difficult to sell the properties, and it will also be difficult to have decent rentals. Mr. Mikes said the Commission needs to take a strong hand to help the entire city. Minutes of Noise Mitigation Workshop 3 Dania Beach City Commission Wednesday, May 12,2010-7:00 p.m. Manny Jeffers, 4405 SW 35`h Avenue, noted he is in the 64.99 dnl level. He said he cannot afford to give away his house, and questioned what will happen when his neighbors leave. Doug Dyszer, 4516-18 SW 33rd Avenue, noted he owns a couple of triplexes in the area. He questioned why multi-family homes were excluded from the program; he felt this was discrimination. Mr. Dyszer asked if there was an attorney who would represent the people. He said his only option would be to go into foreclosure and stop paying his taxes. Clifford Iacino, 1771 SW 30`h Place, owns 5 parcels in Melaleuca. He noted the common thread stated in the 60 page document is creating a viable neighborhood and maintaining the integrity of the neighborhoods. Mr. Iacino said the word "homeowners" should be replaced by the word "property owners". He suggested if the County provided a safety net to everyone involved, less people would opt out and more people would stay. Irene Lathrop, 818 NW 10`h Avenue, questioned if the Broward County Commission approved the expansion of the runway and how it would be paid. She also questioned if the Master Plan had been updated recently. Ms. Lathrop asked where the dnl levels came from for the year 2020, and if research had been done. She also questioned why we should wait until after the expansion, as opposed to being able to participate in the program before the expansion. Ms. Lathrop stated she is thoroughly disgusted with the County. Richard Pfenniger, 4613 SW 37 h Avenue, noted there is no protection for rental properties. He noted his home was initially in the 70 dnl, however, he currently is in the 60-65 dnl. How did that happen? He said we need more clarity in the zones. Bob Del Chiocco, 734 NW 12`h Avenue, noted Broward County does not want any responsibility for any project they take on. The only warranties will be from the people who do the work, not the County. He suggested the homeowners should receive a bond for the materials and workmanship done on their homes, and the bond should come from the County. There should be verbiage in the agreement between the County and contractor, that they will not file a Contractor's Lien against the properties because Broward County is notorious for being slow at paying. 2.3 Commission Discussion Commissioner Anton thanked Kent George and his staff for attending tonight's meeting; he also thanked the residents for being respectful to them. He noted this is a draft plan; it is not the final version. Commissioner Anton noted a lot of valid comments were made tonight and will be taken into consideration. He advised that there would be a public hearing when this comes before the County Commission and everyone can attend and express their thoughts. Commissioner Duke thanked City staff for their time on this important issue. He also thanked the County staff and citizens for participating in tonight's meeting. Commissioner Duke noted all comments will be taken into consideration for our response to the County. He commended attorney Neal McAliley and expressed his confidence in his ability to litigate this matter. Minutes of Noise Mitigation Workshop 4 Dania Beach City Commission Wednesday, May 12,2010-7:00 p.m. Commissioner Grace thanked Kent George for his presentation. She thanked the residents for their comments and concerns. Commissioner Grace noted she was taken with Mr. Nelson's proposal; the concerns of the young couple who just purchased their home; the airline pilot; and the concerns for outdoor enjoyment. She said we need to address the property owners who live just outside of the zone. Commissioner Grace requested legitimate answers for the people who live in the area. Vice-Mayor Castro thanked Kent George and his staff for tonight's presentation. She noted there was a mix of old and new people at tonight's meeting, and encouraged them to contact the County Commissioners and write letters to the editorial boards. Vice-Mayor Castro noted she wants to follow the Interlocal Agreement. She acknowledged that Attorney McAliley has a difficult job, and noted that she wants to attend his oral arguments in Washington. Vice-Mayor Castro commended Commissioner Anton for being the point person and for all the time and effort he has spent on this matter. She noted that Bob Mikes was right on for requesting a baseline health study around the airport. Vice-Mayor Castro said she appreciates the respect that everyone showed the Broward County Aviation Department tonight. Mayor McElyea thanked Kent George for tonight's presentation. He noted he has many friends and family in the affected areas, and he supports all of the residents in the city. Mayor McElyea said he will continue to help the residents in any way he can. He recognized Brenda Chalifour and asked if she wanted to make any comments. Brenda Chalifour thanked the people who were out pounding the pavement over the weekend to get the message out for tonight's meeting. She commended Rae Sandler for all of her work. Ms. Chalifour noted in the end, we will have full honest disclosure. She also thanked Mr. George and his staff for tonight's presentation. She indicated that the education process has taken us a long way, and she hopes the County is listening and will accept a lot of the recommendations presented. Ms. Chalifour noted noise insulation does not protect from reverberation. She thanked the Mayor for recognizing her and giving her time to speak. 3.
