AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING THE DANIA BEACH ZONING MAP TO
REZONE CERTAIN PROPERTIES WITHIN THE CITY OF DANIA BEACH
COMMUNITY REDEVELOPMENT AREA (CRA) FROM THE CURRENT
ZONING CLASSIFICATION OF RD-8000 (DUPLEX) TO RO (RESIDENTIAL
OFFICE) AS SPECIFICALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS ORDINANCE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, in January of 2009, the City Commission of the City of Dania Beach
adopted the Dania Beach Community Redevelopment Agency Redevelopment Plan ("CRA
Plan"); and
WHEREAS, the CRA Plan outlines certain redevelopment concepts and implementation
strategies in order to enhance and reinforce the Community Redevelopment Area (CRA) sub
areas; and
WHEREAS, rezoning certain properties West of U.S. I and East of SW 41h Avenue
(Dixie Highway), is recommended by the CRA Plan in order to provide a transition between the
neighborhood and busy roadways along the Sheridan Street and Stirling Road corridors east of
the FEC tracks; and
WHEREAS, the City Commission finds that this Ordinance is necessary toward meeting
the general implementation strategies of the CRA Plan addressing protection measures for the
adjoining neighborhoods along these corridors;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City of Dania Beach Planning and Zoning Board reviewed the
proposed amendment and determined that the rezoning should be recommended to the City
Commission of the City of Dania Beach as consistent with the Dania Beach Comprehensive and
Community Redevelopment Agency Redevelopment Plans.
Section 2. That public notice has been given and public hearings have been held
pursuant to Section 166.041, Florida Statutes.
Section 3. That the rezoning request filed by the City of Dania Beach on behalf of the
Community Redevelopment Agency Redevelopment Plan, for a rezoning from the "RD-8000"
(Duplex) zoning classification to the "RO" (Residential Office) zoning classification, for
properties located West of U.S. 1 and East of SW 4u' Avenue (Dixie Highway) within the City of
Dania Beach, Florida, and more specifically described in Exhibit "A", a copy of which is
attached to this Ordinance, is granted.
Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 6. That this Ordinance shall be effective immediately upon its adoption on
second reading.
