DANIA BEACH CITY COMMISSION
TUESDAY, MAY 11, 2010 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor McElyea called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
City Attorney Ansbro spoke about the A to X store litigation case. He noted A to X has agreed
to leave the site and they will pay the City $35,000.00 upon signing the agreement. Additionally,
around the middle of July, the City will receive $125,000.00 covering legal costs and related
expenses. City Attorney Ansbro recommended the Commission adopt a motion to proceed with
the settlement.
Commissioner Grace motioned to accept the A to X proposal; seconded by Vice-Mayor
Castro. The motion carried on the following 5-0 Roll Call vote:

Hank Thomas, Greenhill Development, reported that he is under contract for the purchase of the
Pirates Inn, located on Dania Beach Boulevard and US1. He clarified that Lisa Duke represents
the seller in the transaction, not him. Mr. Thomas noted that he is interested in bringing in major
retailers on the site. He is hoping to bring a site plan for consideration within the next 90 days.
Mr. Thomas responded for Vice-Mayor Castro that the commercial office market is not favorable
at this time.
Commissioner Duke noted that a SWAT team is going to use the Pirates Inn site for live training
before the building is demolished. He recognized Mr. Thomas for his efforts to develop our
downtown area.
Mayor McElyea brought Item 410.3 to the point of the agenda.
10.3 Removal of Road Closure at Federal Highway and SE 2"d Street - Mayor McElyea
Chickie Brandimarte, 101 SE 3`d Avenue #604, requested the Commission bring the community
together and remove the street closure.
Kim Farrington, 318 SE 3`d Street, noted her street floods every time it rains. She said that she is
looking to move to another city because of the politics in Dania Beach. Ms. Farrington would
like to host a breakfast social so the Commission can experience the traffic in the morning. If the
closure is removed it will impact the quality of life for the residents on the street. She noted the
Mayor campaigned and stated that he would not vote in favor to remove the street closure. Ms.
Farrington requested that this issue be tabled until the information is provided to the people who
live on the street most impacted by the closure.
Elizabeth Smith, 215 SE 1" Terrace, noted the ladies who live at the Danians are concerned with
the street closure and would like to see it removed.
Annette Hibbits, 26 SW 11d' Street, noted she is against the street closure. She addressed the
flooding in her neighborhood and the street closures in her neighborhood. Ms. Hibbits is happy
that Commissioner Duke is having a Town Hall meeting at City Hall. She hopes we have a
better turnout than the one at the Estates of Fort Lauderdale.
Jeffrey Guzawski, 238 SE tad Street, noted the Commission agreed that residents would be
contacted whenever there would be a meeting regarding street closures. He addressed traffic,
flooding and safety in his neighborhood. Mr. Guzawski remarked the City is expending
$60,000.00 in a concession stand instead of fixing a drain problem in his neighborhood. He
opposed removing the street closure.
Michael Smith, 215 SE 1 st Terrace, noted in 2009 they were not allowed to express their feelings
about the street closure. He was unaware of the street closure until the day before it was
installed. Mr. Smith requested the closure be removed.
Teddie Bohanan, 312 SW 15d' Street, noted no one is blocked off from Federal Highway. She
noted the roads have always flooded.
Roy Lopiparo, 431 SE 3`d Street, explained there is a problem. He noted the residents requested
the closure be removed immediately after the installation in November, 2008. Mr. Lopiparo
indicated that a petition was given to Dominic Orlando but nothing has been done. He said there
is more crime since the closure. Mr. Lopiparo stated that the Commission should do something
immediately, either close the road down completely or open it so that people can get in and out
of their homes.

Patrick Phipps, 266 SW 5d' Street, reported that the Corridor of Crime is closed. He noted the
residents are now settling into a peaceful and tranquil environment. Mr. Phipps thanked the
Commission and City staff who contributed to this closure. He also recognized BSO for their
hard work in our community.
Michele Burrege, 238 SE 2"d Street, said notices regarding the street closures were sent out. The
people complain about being inconvenienced only if they come from Stirling Road. She stated
that there is a petition to close the street in the file, which was delivered long before the casino
negotiations started. Ms. Burrege opposed the removal of the street closure.
Vincent "Jimmy" Rubino, 101 SE 3`d Avenue, spoke against the street closure. He questioned
why the street was closed, and when it would be reopened.
Denise Kennedy, Sunshine Villa, noted she frequently almost is involved in collisions because of
the street closure. She thought it was a big safety hazard. Ms. Kennedy requested the closure be
removed.
Ralph Viviano, 131 SE 3`d Avenue, noted the closure was supposed to be for six months, and
then the issue would be reviewed. It has been two years and we are still having discussions. He
indicated the taxpayers did not pay for the study, Boyd Gaming did. Mr. Viviano proposed to do
something with Stirling Road by the food store. He requested consideration for the people who
live in Meadowbrook.
Commissioner Grace noted everyone has a legitimate concern. She said people were parking on
the street near IHOP on Sunday, and the partial closure is a safety hazard. She noted she needs
to make decisions to protect everyone in the City. Commissioner Grace thought the street should
be opened for the benefit of the community.
Vice-Mayor Castro noted there were traffic problems in the area before Boyd Gaming. She
confirmed for the record that Boyd Gaming paid for the study, which was expensive. Vice-
Mayor Castro stated that the barrier was placed as a temporary measure and added that not all the
traffic calming pieces have been installed. She noted that if we remove this closure, we should
remove all the closures. Vice-Mayor Castro said that the real recommendation from the
engineers was to close the street completely. She noted Ms. Farrington changed her mind
tonight. Vice-Mayor Castro remarked that the quality of life of a few people is important.
Vice-Mayor Castro motioned to leave the street closure and ask Chen and Associates to
include the suggestion made by Mr. Viviano at the April 10 Workshop, notice everyone and
have a public hearing where people can voice their opinion; seconded by Commissioner
Anton.
Commissioner Anton noted there is a tremendous traffic problem on SE 2"d Street. He agreed
the partial street closure is not a good idea, and that Mr. Viviano had a good suggestion.
Commissioner Anton said we should not change the closure at this time. He remarked that the
City changed the SE 5 h Avenue traffic circle because two homes were affected. The quality of

life is hampered by the traffic on SE 2nd Street. He indicated that he does not have a problem
with closing the street completely; however, it was not done because of the Fire Department.
Commissioner Anton agreed the signage on Stirling Road should be changed, and perhaps the
City Manager, City Attorney and the Public Services Director could address the issue. He said
more notice should have been provided to the residents. Commissioner Anton stated that he is
doing what he thinks is right for the City. There will be more traffic when Boyd Gaming opens
up. He cannot support opening the street until we come up with another alternative that would
provide some relief for the residents on SE 2"d Street.
Commissioner Duke noted the idea was good at the time. The execution was less than ideal; the
signage should have been changed. He said that he has discussed this matter with everyone.
Commissioner Duke advised that he is in constant touch with Boyd Gaming and they are
nowhere near development. Furthermore, they do not know what they are going to do. He
indicated that we should readdress this issue when Boyd Gaming comes back. Commissioner
Duke stated that we should not open up every street. This was an experiment that we lived with
for two years. He is in favor of removing the closure. Commissioner Duke noted he is
sympathetic to the residents on SE 2"d Street. He said that we need to look at the different
solutions. Commissioner Duke reiterated that the closure should be removed now, with the
condition that the issue be revisited if Boyd Gaming comes back; but at that time it should be
done correctly.
Mayor McElyea made a substitute motion to remove the street closure; seconded by
Commissioner Duke.
Vice-Mayor Castro noted she is speaking to different representatives from Boyd Gaming than
Commissioner Duke. She advised that Boyd Gaming may not be building a new facility at this
time, but they are looking at adding some development to the existing property. Vice-Mayor
Castro provided a history of the study conducted. She suggested the City Manager contact Boyd
Gaming to see what they are doing.

Leroy Green, SW 16`h Street, said the property owners should be tightened up to keep the area
clean.

9.2 RESOLUTION #2010-069
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE VARIANCE REQUEST SUBMITTED BY WALGREENS COMPANY FROM CHAPTER 28, "ZONING",
ARTICLE 4.201, "PROXIMITY OF BEVERAGE ESTABLISHMENTS TO CHURCHES, SCHOOLS", FOR
PROPERTY LOCATED AT 501 EAST SHERIDAN STREET IN DANIA BEACH, PROVIDING FOR
CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution #2010-069. He swore-in those who would
speak on this matter.
The Commissioners disclosed that they had contact with representatives for this item.
Commissioner Grace presented a petition against the Walgreens proposal.
Kristin Dion, City Planner, noted the applicant is requesting a variance for the sale of alcohol
less than 1000 feet from a school. She presented an overview of the request. The Planning &
Zoning Board recommended denial of the request. Ms. Dion advised that staff recommends
approval.
Dwayne L. Dickerson, Ruden McClosky, representing Walgreens, noted Olsen Middle School is
991 feet away from Walgreens, so they are requesting a variance for 9 feet. He explained that
the existing Walgreens store will not be expanded; they will be using 22 square feet of the
current shelving space to sell a limited amount of beer and wine. Attorney Dickerson indicated
that Walgreens has taken several measures to insure they sell beer and wine responsibly. They
will meet all code requirements; they will not sell liquor or any single servings which could lead
to immediate consumption on their premises or the surrounding area. He advised that Walgreens
has partnered with BSO to allow an authorized officer to ask anyone to leave the store if they are
doing anything inappropriate. Attorney Dickerson said that they will continue to meet with the
neighbors to address any concerns they may have.
Mayor McElyea opened the Public Hearing.
Karena Pinzan, 1318 SE 5a' Court, spoke against the request because there is a high crime
problem in her neighborhood.
Catherine Willshire, 1346 SE 5`s Court, provided additional signatures to the petition. She spoke
against the request due to high crime in her neighborhood.
Gregg Derk, 1338 SE 5a' Court, noted that Walgreens should have the outside store area cleaned
of trash, tires and broken TV sets. He further indicated that there are vagrants living at their
front door and the store manager has not done anything about it. Mr. Derk asked for denial of
the variance request.

Nancy Bebon, 1354 SE 51h Court, spoke against the request due to safety and quality of life in
their neighborhood.
Pastor Edward Legrand, 201 E. Sheridan Street, spoke against the request. He indicated that one
day he will also be a commissioner in Dania Beach.
Betty Sokol, 609 NW 10`h Street, spoke against the request.
Annette Hibbits, 26 SW I I th Street, was not in favor or against the request.
Tom Bordowski, 400 S. Federal Highway, requested the Commission adopt a law to give BSO
authority to stop panhandling.
Joe Van Eton, 1500 SW 2"d Avenue, does not understand the objection to this request because
beer and wine sales do not increase crime. He questioned why we would deny the request. It is
a good project for the neighboring hotel. Mr. Van Eton supported the request.
Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the
Public Hearing.
Commissioner Anton agreed with Joe Van Eton, but realizes that the City does not belong to him
or the Commission. The neighborhood has a right to express their concerns. He will support
what the neighbors want and vote against the request.
Commissioner Anton motioned to deny Resolution #2010-069; seconded by Mayor
McElyea.
Attorney Dickerson addressed some of the concerns raised by the neighbors, and stated they
would agree to all the requirements. He remarked that denying the request would treat them
differently from the other businesses in the area which already sell beer and wine and are closer
to the school than they are.
Vice-Mayor Castro asked Attorney Dickerson if they would agree to add a condition that the
approval is granted for a 22 feet only designated area within the store, as well as not allowing
any single servings.
Attorney Dickerson responded in the affirmative. He added that in some of the cities where they
have submitted this type of request, they have also included a caveat giving the Commission
ability to review the issue at a later date and revoke the variance if needed.
Commissioner Grace asked Chief Peterson if we have received any reports of crime happening at
Walgreens or the neighboring hotel.
BSO Chief Peterson responded BSO has plenty of teeth regarding aggressive panhandling. They
receive shoplifting complaints from Publix and Walgreens. He remarked that it is a safe
neighborhood and he did not think it fair to establish any co-relation between a crime and

Walgreens. Chief Peterson advised that he has not received any complaints of crime regarding
the hotel.
Commissioner Duke noted that Chief Peterson provide a professional opinion that the sale of
beer and wine would not create undue crime problems in the neighborhood. He suggested
tabling this issue and talk to the neighbors. Commissioner Duke remarked that it would be
worthwhile if Walgreens could do a better job of communicating with the residents in the area.
Commissioner Duke offered a substitute motion to table this item until the May 25, 2010
Commission meeting; seconded by Vice-Mayor Castro.
Commissioner Anton noted that Walgreens has reached out to the neighbors but they were not
interested. He reiterated that Walgreens should respect what the neighborhood wants.

3. Citizen Comments
Chip Brockman, 305 SE 4d' Street, talked about the "Walk for Alina". He encouraged Dania
Beach residents to participate in this Walk in honor of Alina, a 3rd grader at Dania Elementary,
who suffers from a rare type of cancer. Mr. Brockman advised that all proceeds will go to
benefit Memorial Sloan-Kettering Cancer Research Center.
George Jason, 4549 SW 37`h Avenue, spoke to the Commission about their endorsement of
candidates for election. He hoped the City would prohibit the endorsement of candidates for
City Commission.
Robert Del Chiocca, 734 NW 121h Avenue, noted he dislikes the bickering and polarization on
the Commission occurring for the past year. He remarked it is not proper and it is unhealthy.
Mr. Del Chiocca stated that not one Commissioner has the mandate to point fingers at anyone
else. The problems we currently have are not all the result of the sitting Commission, they are
old problems. He said that one of the problems that has never been addressed is money. Mr. Del
Chiocca noted that the City has spent $1.3M in legal fees to fight the Airport. In reality, the
largest threat is the loss of tax revenue if the Airport expands. The revenue will be lost forever.
He hopes that we will prevail, but he wants to know that the Commission has done everything
they can to protect this City and its residents. Mr. Del Chiocca asked the Commission to act as
responsible adults,to stop bickering and to have unity.

Joe Van Eton, Dania Beach Tourism Council, reminded everyone that this is National Tourism
Week, and the Appreciation Luncheon will be held on Thursday. He spoke about the importance
of promoting tourism in our community.
Christopher Johnston, 745 NW 12t' Avenue, Melaleuca Gardens, addressed the Noise Mitigation
Program from Broward County. He requested the Commission ask the County to reimburse
homeowners for legal services for review of documents.
Mark LaRocca, 4511 SW 34 h Avenue, questioned the RFQ for Solid Waste. He asked who
received the bid because he has not seen any publication. Mr. LaRocca asked if an RFP will be
issued for solid waste collection due to the expiration of the current agreement in September,
2010. He noted he is a taxpayer and a small business owner who would like to do business in the
City. Mr. LaRocca indicated that the document provided by the waste hauler is grossly
misrepresented. He requested the City go out for RFP to make a decision that benefits the
taxpayers. Lastly, Mr. LaRocca suggested a solid waste workshop to better educate the
Commission and City staff.
4. Presentations and Special Event Approvals
1. Pension Proposal - Shawn Derosa,Northwestern Mutual
City Clerk Stilson advised the representative left and requested a continuance until the next
Commission meeting.
2. Special Event request for Jocelyn's 5th Birthday Party to be held at C. W. Thomas Park
on Saturday, May 15, 2010 from 2:00 p.m. to 6:00 p.m.
Commissioner Grace noted there is a conflict on this date. The Northwest Byrd Point group had
already received approval to use C.W. Thomas Park from 5:00 p.m. to 8:00 p.m.
Kristen Jones, Director of Parks and Recreation, noted she will check the dates.
Commissioner Anton suggested Northwest Point hold their meeting immediately after the
birthday party at 6:00 p.m.
Vice-Mayor Castro motioned to approve the Special Event request; seconded by
Commissioner Anton. The motion carried unanimously.
3. Special Event request for Dania Beach Fire Explorers Car Wash Fund Raiser to be held at
100 N. Beach Road on Saturday, May 15, 2010 from 9:00 a.m. to 4:00 p.m.
Vice-Mayor Castro motioned to approve the Special Event request for the Dania Beach
Fire Explorers Car Wash Fund Raiser; seconded by Commissioner Duke. The motion
carried unanimously.

5. Proclamations
There were no proclamations at this meeting.
6. Public Safety Reports
Donn Peterson, BSO Chief, reported a Dania Beach officer would be recognized for her
lifesaving efforts.
Chief Peterson advised that the City of Dania Beach has been selected by BSO as a model
district.
Chief Peterson noted that hurricane season is soon approaching. He advised that BSO District 2
is ready to go and serve the citizens in the event of a storm.
Chief Peterson spoke about the importance of BSO outreach. He advised that they attend
community meetings and are involved in special events. Chief Peterson asked anyone who does
not feel connected to their Police Department, to contact the Chief directly at 954-926-2400.
Joe Fernandez, Fire Chief, provided an update on the deep water well oil problem. He advised
that a meeting will be set by the Broward County Mayor with the coastal cities to discuss some
strategies for any action we might need to take. Chief Fernandez further noted that the threat is
not to the SE Florida coast.
Commissioner Anton asked Fire Chief Fernandez to look into the problem Mr. Green had with
his response when he had some heart issues.

City Attorney Ansbro read the title of Resolution#2010-074.
Vice-Mayor Castro was pleased to see that we will be using CDBG funds to address the
stormwater issues in the City. She questioned the total cost and where the funds are coming
from.
Colin Donnelly, Assistant City Manager, responded $224,000.00 will be derived from the 36`h
year CDBG; the match to complete the project will come from the Stormwater Fund. He
clarified that the Dania Cut-Off Canal dredging will be coming from reserves.
City Manager Baldwin noted that staff is proposing to increase stormwater fees.
Vice-Mayor Castro noted that she does not want to keep balancing our budget by increasing fees
and taxes which would affect the residents of Dania Beach.
Mark Bates, Finance Director, noted the Stormwater Fund has money that was not used for the
Canal dredging. He advised that the issue mentioned by the engineer is not addressed.

Assistant City Manager Donnelly confirmed for Commissioner Duke that Broward County has
torn up the streets. He noted that Chen and Associates identified this as a good area to do the
work because we can do our stormwater improvements without having to rip up a new road.

Kristin Dion, City Planner, noted the applicant is requesting landscape and parking variances for
a Pre-School. She provided an overview of the request. The Planning and Zoning Board
recommended approval of the requests. Staff also recommended approval provided the applicant
obtains a building permit and installs a sign that meets City code regulations.
Mayor McElyea opened the Public Hearing. Seeing as there was no one to speak in favor or

City Attorney Ansbro read the title of Resolution 42010-070.
Bob Daniels, Director of Community Development, noted he has not made a recommendation
because the Code section that relates to the Port Everglades Development District (PEDD) is not
clear. He clarified they are not in opposition to the applicant's request; however, it would be
technically incorrect for staff to recommend approval since we are taking a different view of the
issue.
Dick Coker, Coker and Feiner, attorney for the applicant, noted that a portion of the property is
currently being used as a Park N' Go parking lot facility which mainly serves cruise ship
passengers. He advised that staff is unclear of the permitted uses in the PEDD District. Attorney
Coker explained that a "parking garage" is allowed, but a "parking lot" is not specifically
addressed. He requested consideration of their request to allow this business to continue and
expand to support the port.
The Commission disclosed they had communication.

City Attorney Ansbro read the title of Ordinance #2010-009.
Corinne Lajoie, AICP, Principal Planner, noted the request is to rezone property from Residential
to Residential-Office consistent with the CRA Redevelopment Plan. She provided an overview
of the project. Ms. Lajoie advised that both the Planning and Zoning Board and staff
recommended approval of the request.
Commissioner Anton asked how the redirection of traffic on 41h Avenue would affect this plan.
Ms. Lajoie responded that Stirling Road would remain as a 4-lane roadway.
Bob Daniels, Director of Community Development, noted that the primary purpose of the zoning
is to address properties that have already been affected by street widening, irrespective of what
would happen to Stirling Road.
Vice-Mayor Castro noted Sheridan Street has a lot of abandoned houses; however, Stirling Road
has single family homes. She was concerned with traffic coming out of the alleyways on
Sheridan Street. Vice-Mayor Castro also asked if there were any design guidelines to improve
the appearance of the buildings when they become home/office.
Ms. Lajoie noted that the architectural design would be maintained in conformity with the
surrounding neighborhood.

Mayor McElyea opened the Public Hearing.
Joe Van Eton, President of Triangle Village Civic Association, provided a handout to the
Commission. He noted this is what was proposed in the CRA Plan. Mr. Van Eton said this was
short notice to the neighbors. He is concerned that we do not give the wrong message to the
property owners prior to rezoning. Mr. Van Eton commented that no one knows if Sheridan
Street widening will occur. He questioned if our rezoning supersedes what the Florida
Department of Transportation (FDOT) did on the rezoning in 2002 and if this could be
incorporated into the rezoning. Mr. Van Eron thought that in this case we should think out of the
box and look at a more intense use, not just Residential-Office, expanding it to 15d' Street.
Bob Bartelmes, 214 SW 2"d Terrace, noted the neighbors are against the proposal.
Teddie Bohanan, 312 SW 15 Street, said she is in favor of anything that will improve the area.
City Attorney Ansbro noted that there are no FDOT restrictions on any properties. He further
advised that FDOT would have to pay for the property as RO, if they ever take the property.
Faye Bartelmes, 214 SW 2"d Terrace, is concerned because she only owns half a lot. She wants
to know that whatever would be located next door would be a compatible business. Ms.
Bartelmes indicated that there is not enough parking, except for residences. She also does not
want any flashing lights in the neighborhood.

Public Hearing.

10. Discussion and Possible Action
10.1 COPS Recovery Hiring Program
City Manager Baldwin noted he would have approved this item but he does not have the
authority to do so. He asked the Commission for consideration of the request.
Commissioner Anton explained that the COPS Program would allow the City to fund five
positions for deputies for a three year term. The Program requires that the positions awarded be
retained for a minimum of 12 months at the conclusion of the grant. He noted this is a great

opportunity to offset the cost of five positions in the budget during these difficult economic
times.
Vice-Mayor Castro motioned for the City Manager to submit the application for the COPS

10.2 Schedule Summer Break
It was the consensus of the Commission to cancel the July 13, 2010 Regular Commission
meeting and the July 15, 2010 Abatement Hearing.
11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton reminded everyone of the Airport Workshop meeting tomorrow at 7:00
p.m. He requested the back door of the Commission Chamber be unlocked.
11.2 Commissioner Duke
Commissioner Duke noted the activities that he attended.
Commissioner Duke was pleased to report that the Boat Sales Tax Cap passed the Legislature.
He noted this would help Dania Beach to save marine industry jobs and to increase sales tax
revenue.
Commissioner Duke noted he met with Fire Chief Fernandez to discuss several issues and talked
about the opportunity to promote diversity in our Fire Department.
Commissioner Duke noted he has attended almost every meeting of the Charter Review Board
and there are several items that need to be updated.
11.3 Commissioner Grace
Commissioner Grace thanked Vice-Mayor Castro for attending the League of Cities dinner for
her.
Commissioner Grace noted that Relay for Life had a very good turnout. She thanked all those
involved in such a good cause.
Commissioner Grace spoke of activities in the community.

Commissioner Grace reminded everyone that we are all human. She noted that the Commission
is sincere about the citizens of Dania Beach. Commissioner Grace remarked that each and
everyone on this Commission is worthy of her accolades because they have done a good job.
11.4 Vice-Mayor Castro
Vice-Mayor Castro attended the Broward League of Cities for Commissioner Grace. She
reminded everyone to get out and vote in August.
Vice-Mayor Castro spoke about the Pet Waste Stations for the Linear Park. She commented they
are more expensive than she realized.
City Attorney Ansbro noted we can use Park Impact fees to cover the cost of the 12 stations.
Vice-Mayor Castro questioned if there would be a better use for Park Impact fees.
Vice-Mayor Castro commended Bob Del Chiocca on his suggestions regarding the Noise
Mitigation Program. She noted once she received Mr. Del Chiocca's email she forwarded it to
the Broward County Commission. Vice-Mayor Castro encouraged everyone to attend the
Airport Workshop meeting tomorrow night at 7:00 p.m. She advised that representatives of the
Broward County Aviation Department will be present and our residents will have the opportunity
to voice their concerns.
Vice-Mayor Castro congratulated the Broward Children's Center on Stirling Road. She noted
that the building is not yet complete but it is looking a lot better than before. This is a great
project for the community which addresses the problems of highly medically challenged
children.
Vice-Mayor Castro noted she will be participating in the American Cancer Society "Jail and
Bail".
Vice-Mayor Castro noted that we need to schedule a workshop with the Charter Review Board in
order to meet the schedule of the Broward County Supervisor of Elections.
Vice-Mayor Castro noted that the Fort Lauderdale Housing Authority purchased property in
Dania Beach for below low income people. She advised that they want to buy 17 properties
outside of Fort Lauderdale to be used as rental property.
Colin Donnelly, Assistant City Manager, explained that the Fort Lauderdale Housing Authority
is acting as an agent for Broward County and using Neighborhood Stabilization Program (NSP)
funds. He noted that when the Dania Beach City Commission agreed to accept SIAM in NSP
funds, we provided a list of single-family homes; however we did not have multi family homes
on our list. Assistant City Manager Donnelly further indicated that he and Director Daniels will
meet with Broward County to see what can be done to prevent them from buying these multi-
family homes in Dania Beach.

City Attorney Ansbro noted that when the City of Oakland Park objected to this proposal, they
backed off. He suggested the Commission motion to object to any further investment by the
Housing Authority without the City's consent. City Attorney Ansbro also advised that a certified
copy of this portion of the minutes be sent to the Director of the Fort Lauderdale Housing
Authority.
Vice-Mayor Castro motioned to oppose the Fort Lauderdale Housing Authority program
to purchase property in Dania Beach; seconded by Commissioner Grace. The motion

11.5 Mayor McElyea
Mayor McElyea spoke about the Relay for Life event. He questioned why we could not put a
double lock on bathroom doors.
Kristen Jones, Director of Parks and Recreation, noted she will look into it.
The Commission generally agreed that we need to insure that City facilities are available during
City approved events.
12. Appointments
Vice-Mayor Castro appointed Mimi Donly to the Charter Review Board to replace Pat Tyra, who
resigned for personal reasons.
Vice-Mayor Castro appointed Shaun Koby to the Green Advisory Board.
Vice-Mayor Castro noted she cannot continue to attend the General Employees Pension Board
due to her work schedule. She requested that Commissioner Grace take the position.
Commissioner Grace declined.
Commissioner Duke accepted the position of Commission Representative on the General
Employees Pension Board.
Commissioner Anton motioned to approve the appointments; seconded by Vice-Mayor
Castro. The motion carried unanimously.

13. Administrative Reports
13.1 City Manager
13.1.1 Mid-Year Budget Review
Mark Bates, Director of Finance, reviewed the document that was included in the backup
material in the agenda packet. He noted that a Budget Amendment will be presented at the next
meeting for consideration.
13.1.2 General Budget Discussions for Fiscal Year 2010-2011
City Manager Baldwin noted we need to raise revenues and reduce expenses. He stated that staff
hopes the Commission will keep an open mind for all suggestions.
Vice-Mayor Castro referred to Mr. Bates' report. She spoke about the Building Fund and
questioned if it would be carried over or if adjustments could be made. Vice-Mayor Castro also
talked about the Marina Fund and asked whether Westrec has already taken over the Marina
management.
Director Bates noted that the Marina contract with Westrec is still under negotiation. He further
advised that the Building Fund is being adjusted.
Vice-Mayor Castro asked if Other Post Employment Benefits (OPEB) is fully funded.
Director Bates noted we are partially funded.
Vice-Mayor Castro spoke about the Parking Garage. She noted that CRA Director Earle is
trying to submit other funds for reimbursement.
Director Bates noted that Director Earle is hoping to be reimbursed by the County for other CRA
projects; however, we would still be $600,000.00 short.
City Manager Baldwin noted that Fire and Police costs will impact our budget because they are
going up. He commented that this year staff made changes in code compliance and beach
lifeguards. City Manager Baldwin indicated that the Commission has expressed an interest in
hiring a project manager for Public Services. Furthermore, we will be hiring 9 new firefighters,
staffing the SW Community Center and allocating additional costs for BSO. He stated that we
may need to consider some service changes, such as implementing furlough/reduced hours
programs, a hiring freeze, employee costs for benefits as well as looking at some outsourcing
opportunities.
13.2 City Attorney

City Attorney Ansbro noted he provided a report on the status of the litigation for the Dania
Beach Hotel and the Beach Watch. He advised the Commission should not discuss or make
comments to anyone on these matters.
City Attorney Ansbro noted he and City Clerk Stilson will arrange for future Sunshine Law
training for new board members. He indicated that there are handouts available which
summarize the information on the DVD. City Attorney Ansbro said that he will also provide a
memorandum outlining the importance of complying with the Sunshine Law requirements. He
further stated that we are trying to make arrangements with the Florida League of Cities to set up
a workshop for Board Members at a cost of$45.00 per person.
City Attorney Ansbro discussed the request by Director Jones for a motion to purchase Pet
Waste stations for the Linear Park.
Commissioner Duke did not want to pay $3,399.00 for this item. He suggested looking at other
options.
Vice-Mayor Castro would like to find a cheaper solution. She noted this is a health issue and we
need to address it,but we should look for other options.
Kristen Jones, Director of Parks and Recreation, noted 12 stations are required for the entire
Linear Park. She indicated she can reduce the amount of stations if the Commission wants.
Commissioner Grace confirmed with City Attorney Ansbro that there is a "do it yourself'
ordinance that addresses this issue.
City Attorney Ansbro suggested we post signs stating that residents are obligated to comply with
the ordinance.
It was the consensus of the Commission to post signs, as opposed to purchasing stations.
Commissioner Anton noted that we all have to be careful with what we say tomorrow night since
there will be County attorneys present at the meeting. He said that Neil McAliley recommended
that we hold a brief workshop in 10-15 days to review and make comments to the Airport
Advisory Board.

We, the undersigned, are requesting that you reject the appeal of Walgreens for the above
mentioned variance to sell alcoholic beverages at their property at 501 East Sheridan
Street, Dania Beach, Fl.
We feel that the granting of this variance will adversely affect the quality of life in our
neighborhood.
We are a community of families with small children and retirees, and we already have a
crime problem and do not want it to be exacerbated by alcoholic beverage sales so
closely adjacent to our homes, churches and schools on a property without 24 hour
security.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission of the City of
Dania Beach on Tuesday. May 11 2010 at 7.00 p.m., or as soon thereafter as possible in the Dania Beach City
Commission Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004_ for the
purpose of hearing any comments which might be made to the following request:
VA-14-10 — The applicant Walgreen Co., is requesting a variance for the sale of alcohol less than 1,000
feet from a school for property located at 501 East Sheridan Street. (City of Dania Beach Code of
Ordinances Chapter 28 Zoning Article 4.201. Proximity of beverage establishments to churches, schools
requires a 1,000 foot distance separation.)
Property is legally described as: A portion of Parcel A, US LEND LEASE PLAT NO. THREE.. according to
the Plat thereof, as recorded in Plat Book 113, at page 14, of the Public Records of Broward County, Florida,
being more particularly described as follows: Begin at the Southeast corner of said parcel `A"thence North 00'
05'42" East, along the East line of said Parcel "A'' for a distance of 306.00 feet; thence North 90100'00" West.
for a distance of 262.70 feet to a point on the West line of said parcel "A"thence South 00°OT10" West alone
the West line of said Parcel "A" for a distance of 193.01 feet; thence South 08°09'10" West, for a distance of
78.71 feet: thence South 44°56'25" East, for a distance of 49.55 feet; thence South 90°00'00" East_, alone the
South line of said Parcel "A" for a distance of 238.76 feet to the POINT OF BEGINNING.

Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., Monday—Friday please

SUBJECT: Pet Waste Stations for Linear Park
I have researched the Pet Waste Stations as requested at a previous
Commission Meeting in April. The total cost for 12 stations will be
$3399.96 Public Services Department will install.
After an inquiry to Tom Ansbro to see if we would be able to use Park
Impact Fees, the determination was made that we are approved to purchase
12 stations using these funds. I am requesting permission to move forward
with the purchase and installation of these Pet Waste Stations.
Once approved, the stations will be in place within a month.

SUBJECT: Water Supply Issue—Status Update
Since the regular City Commission meeting of April 27, 2010 the following actions have
taken place.
Well G
Drilling of Well G has been completed and pumping equipment was being installed as of
May 10, 2010. Testing of the well is beginning on May 11. The City's consultants are
continuing with the development of a safe yield methodology that will be acceptable to
SFWMD.
Broward County Raw Water Solution
Broward County staff continues to work on the long-term alternative water supply solution
referred to in the April 27, 2010 update. The County and Hallandale Beach submitted their
applications for consumptive use permits (CUP) in the week of May 3 — 7. If approved, the
permits will allow for development of a new well field for Hallandale Beach and the
reallocation of approximately 600,000 gallons per day of raw water by Broward County to
the City of Dania Beach. The permit must first be reviewed and approved by the South
Florida Water Management District (SFWMD), which means that this provides a potential
solution for Dania Beach, but one that will take 3—5 years to develop. The County has also
included in its CUP discussion of another potential solution, which is currently being
considered by the County for feasibility. Staff is continuing to work with our partners at the
County and SFWMD on all potential solutions.
