DANIA BEACH CITY COMMISSION
TUESDAY, MAY 25, 2010 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor McElyea called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event Request by Neptune Fireworks to install 3 temporary tents for outdoor
fireworks sales at 768 East Dania Beach Blvd., from June 10, 2010 to July 10, 2010
from 9:00 a.m. - 9:00 p.m.
Vice-Mayor Castro motioned to approve the Special Event request for Neptune Fireworks;
seconded by Commissioner Duke. The motion passed unanimously.
3.2 Pension Proposal - Shawn DeRosa, Northwestern Mutual (Continued from May 11,
2010)
Shawn DeRosa, 408 SE 5 h Street, representing Northwestern Mutual and the Russell Company,
said they are the only company that is AAA rated. He said that he wanted to introduce his
services to the City.
Robert Polizzi, Northwestern Mutual Financial Network, presented a PowerPoint overview of
Russell Investments, which is attached to and incorporated into these minutes. He noted that
from a fiduciary standpoint they are completely independent and the value that they bring is
helping people to consult and choose the money management in which they would then invest.
Commissioner Duke noted he has talked to Mr. DeRosa in the past and he has always expressed

an interest in getting more involved in the City. He asked what part of the City business they
want and how they could save taxpayers money.
Mr. Polizzi noted that they would bring value to the City by taking care of the management of
the pension plan assets.
Mr. DeRosa noted that they looked at last year's assets and the information did not make sense.
He further said that he made a public records request about a month ago and the City secretary
told him it was lost.
Mr. Polizzi responded for Commissioner Duke that they would provide advice to the pension
boards.
Vice-Mayor Castro noted that these are two independent pension boards, with the same attorney,
and the Commission cannot do anything.
Mr. Polizzi advised that the investment plan for the Fire Pension Board lost funds. He further
indicated that they would bring more resources than some of the investment consultants the City
has had in the past.
Commissioner Anton suggested they contact Cathy David with the Police and Fire Pension
Board and provide her with the information.
Mr. DeRosa noted he called the pension board administrators and was politely told they were not
interested. He thought bringing their presentation to a public forum would help them move
through the process.
Vice-Mayor Castro suggested they submit a public records request to the pension boards, not the
City.
Commissioner Duke noted that in light of the current losses, he would certainly be open-minded
to a different philosophy and a new set of eyes.
City Manager Baldwin noted that the City Clerk is not aware of any public records request, but
she will look into it.
3.3 Presentation by the Dania Beach Airport Advisory Board
Bob Mikes, 601 NW 7`h Street, Melaleuca Gardens, member of the Airport Advisory Board,
listed the concerns and recommendations of the Board regarding the County's proposed
mitigation plan, which was included in the agenda packet.
Commissioner Grace noted the County addressed the concerns of the residents at the May 18`h
meeting. She asked if Mr. Mikes had heard from Mr. George.

Mr. Mikes responded he had not heard from Mr. George.
Commissioner Anton requested the comments be forwarded to Attorney McAliley's office to be
incorporated into our response to the County. He noted that the County can sell the properties at
50% of the value which will attract investors for rentalproperty. This will increase crime in the

area and impact our tax revenues. Commissioner Anton pointed out that we would need more
police resources however, we have budget constraints that we also need to consider. He
suggested we call a Shade meeting with Attorney McAliley to discuss this litigation in the next
two weeks. Commissioner Anton spoke about the requirements in the Interlocal Agreement,
noise issues and the purchase assurance program. He concurred with Mr. Mikes' comments on
checker boarding in the neighborhood and thought we should add some language in our response
to protect the neighbors. Commissioner Anton asked that a copy of our letter to the County be
provided to the Airport Advisory Board for their comments.
Commissioner Duke called Mark LaRocca to the podium to clear the record for his comments.
Mr. Mikes asked Commissioner Duke to comment on the report concerning homes having no
residential value if they were located in the 70 DNL contours.
Commissioner Duke noted that Mr. LaRocca is a new member of the Airport Advisory Board
and has made improvements to his property.
Mark LaRocca, 4511 SW 34`s Avenue, noted he lives in the runway where the expansion will be,
and he insulated his house. He noted that some of his recommendations which were not
submitted to staff and the Commission were: 1) that Broward County become part of the
building permit process; 2) that Broward County should continue to fund some of the services
for police and fire; 3) that restrictions should be added for trucks not being on the highway on
nights and weekends. Mr. LaRocca would like to make corrections to the Airport Advisory
Board minutes because he did not make some of the comments that are by his name.
Commissioner Anton clarified that the County still needs to apply for and pay for any City
permits that are required. He noted that the County will not be replacing roofs; they will be
replacing ceilings as part of the sound insulation.
Commissioner Duke noted he has not heard that homes in the 70 DNL have zero value. He
thought appraisers should look for home values at similar homes in other cities.
Vice-Mayor Castro noted that the Federal Aviation Administration (FAA) will not allow homes
in the 70 DNL contours because they consider them inhabitable; hence reducing the residential
property value. She added that the FAA will not mitigate any commercial property.
Commissioner Anton noted there will be no purchase assurance or sales assistance for multi-
family homes under the 65 DNL contours. He added that there was some discussion that
duplexes may receive assistance if the owner lives in one unit.

Vice-Mayor Castro noted that we had asked the County to allow the homeowners to choose from
a list of contractors to work on the noise mitigation, but they declined our request. She further
indicated that the County will negotiate with the contractor, and the homeowner would only be a
sub-party to the agreement. We would therefore have no rights to any warranty or liability.
Vice-Mayor Castro stated that there is still a lot of work to be done on this agreement.
Mr. LaRocca noted he sees everyone struggling with defining like kind and whole. He noted
some areas that may be comparable to Dania Beach.
Commissioner Anton noted that June 71h will be the start date of soundproofing on 10`h Street in
Melaleuca Gardens. He said that they will be blasting the sound through loudspeakers and it will
be loud.
3.4 Special Event request by Saba Temple #186 Shriners for Cure for Diabetes
Walk/Rally from Bethel Baptist Church to Frost Park on June 5, 2010 from 9:00 a.m.
to 12:00 p.m.
Vice-Mayor Castro motioned to approve the Special Event request for Saba Temple #186
Shriners for Cure for Diabetes Walk/Rally; seconded by Commissioner Duke. The motion
carried unanimously.
Mayor McElyea brought Item#9.5 forward on the agenda.
9.5 RESOLUTION#2010-069
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
THE VARIANCE REQUEST SUBMITTED BY WALGREENS COMPANY FROM CHAPTER 28, "ZONING",
ARTICLE 4.201, "PROXIMITY OF BEVERAGE ESTABLISHMENTS TO CHURCHES, SCHOOLS", FOR
PROPERTY LOCATED AT 501 EAST SHERIDAN STREET IN DANIA BEACH, PROVIDING FOR
CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (Continuedjrom May 11,2010)
City Attorney Ansbro read the title of Resolution #2010-069. He advised this item was a quasi-
judicial matter and swore-in those who would speak. He asked the Commission to disclose any
communication they had on this matter.
The Commission disclosed they had been contacted by both sides.
Dwayne Dickerson, Ruden McClosky, attorney for the applicant, noted they are requesting to
sell beer and wine in a 22 square feet area at the existing Walgreens store. He pointed out that
they are located within 991 feet from the school; therefore the variance is only for 9 feet.
Attorney Dickerson noted they have installed signs authorizing BSO to be on the property; they
will upgrade their camera system with external cameras if the variance is approved; they are
offering security caps on all the wine bottles to deter criminal activity; and they are proposing no
single servings. He pulled variances for other facilities, including Pancho's, which is a lot closer
to the school, and they have consumption on site. Attorney Dickerson thought a pattern had been
established by the Commission in granting these variances. He indicated that he requested
incident reports from BSO for Walgreens, from January 2007 to date; there were three calls on

the property, two for fraud, and one for lost and found. Attorney Dickerson stated that
Walgreens has been a conscientious corporate citizen in the past and will take the necessary
measures to continue being responsible in selling regulated products.
Mayor McElyea opened the Public Hearing.
Ken Johnston, 1326 SE 5 h Court, spoke in opposition of the request.
Catherine Willshire, 1346 SE 50' Court, spoke in opposition of the request. She presented the
Commission with additional signatures to their petition which was originally submitted at the
May 11, 2010 Commission meeting. Ms. Willshire indicated they have high crime in their
neighborhood. She remarked that the Commissioners are our leaders and their primary
responsibility is to protect our community. Ms. Willshire asked for denial of the variance
request.
Andrew Kirk, Assistant Principal, Olsen Middle School, 330 SE 11`h Terrace, spoke against the
request. He noted that 501 East Sheridan Street is a route that students take on their way home.
Mr. Kirk stated that the approval of the variance request would expose our children to additional
threats and inappropriate behavior.
Nancy Bebon, 1354 SE 5`h Court, spoke in opposition of the request.
Karena Pinzon, 1318 SE 5th Court, spoke in opposition of the request. She explained the
difference between Publix and Walgreens, including the security measures implemented by
Publix for the safety of the neighborhood. Ms. Pinzon noted that they have provided the City
with over 200 signed petitions from residents who share her same concerns. She asked the
Commission to reject the variance request.
Charlotte Newbury, 1314 SE 5`h Court, spoke in opposition of the request.
Pastor Edward Legrand, 201 E. Sheridan Street, spoke in opposition of the request.
Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the
Public Hearing.
Commissioner Anton noted 205 residents are opposed to the request; this is their neighborhood.
He pointed out that there was no citizen opposition to the request from Pancho's. Commissioner
Anton remarked that it is our responsibility to listen to our citizens and to respond to their
request.
Commissioner Anton motioned to deny Resolution #2010-069; seconded by Commissioner
Grace.
Vice-Mayor Castro noted that the 22 square feet of beer and wine sale at Walgreens is not going
to impact the crime issue in this neighborhood. She stated that there is already a crime issue in
that area that needs to be addressed. Vice-Mayor Castro thought that perhaps the hotel needs to

work with BSO to make sure they stop the criminals from going there; or they should have a
security guard watching the back fence. She asked Chief Peterson to follow up on some of the
suggestions from the neighbors. Vice-Mayor Castro further noted that CRA Director Earle is
looking into presenting a workshop on a program the Attorney General's Office has that would
address the crime issue and improve the quality of life. She hopes that the residents will attend
this presentation and provide their input.
Commissioner Grace noted that we need to be careful with what we say and do. She said that if
there is a problem with the Sleep Inn Hotel, it should be addressed. Commissioner Grace wants
to be consistent in telling the residents that we will do what they want.
Commissioner Duke thanked the petitioner for their efforts in trying to meet some of the needs of
the community. He noted that his staff did research and found out that on the first petition, out
of 138 residents, only 13 voted. Commissioner Duke hopes that in the next election, all 205
petitioners will come out and vote.
City Attorney Ansbro noted that the most compelling argument is that the school has an
objection.
Commissioner Duke noted that we will have issues in the CRA because there are schools in the
center of our business district. He pointed out that it will be a challenge for the Commission to
decide what is best for our businesses and the residents.
City Attorney Ansbro noted that a couple of years ago we addressed this issue within the CRA
district which restricted the sales to beer and wine only.

4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Rae Sandler, 810 NW 71h Avenue, Melaleuca Gardens, questioned if Commissioner Duke said all
his appointees made the recommendations. She noted fighting the Airport is a collegiate effort.
Ms. Sandler just wanted to clarify that they were not only his appointees that made
recommendations. She pointed out that most of the recommendations submitted by the Airport
Advisory Board were made by the citizens of Dania Beach and they need to be acknowledged for
their comments and suggestions.

Commissioner Duke clarified some of his appointees made recommendations.
Victoria Payne, 102 W. Dania Beach Boulevard, Chamber of Commerce, noted that four
businesses of our City were nominated for Small Business of the Year. She advised that the
winner was the Dania Beach Water Gardens. Ms. Payne provided details of some upcoming
Chamber events.
Leroy Green, 326 SW 16`h Street, asked the Commission to send a letter to the residents to move
their garbage cans from the alleyway back to their yards. He requested the Commission consider
removing the road closure by the church, by the railroad tracks.
Mayor McElyea noted he would help.
Patricia Tyra, 2912 SW 54`h Street, advised that in 2007 the majority of the homeowners voted
not to have a hurricane shelter at the Estates of Ft. Lauderdale. She asked the Commission not to
consider them for a possible hurricane shelter.
Robert Chunn, 118 Phippen-Waiters Road, requested that SW 23`d Terrace be renamed Barker
Lane in honor of Mr. Art Barker, Habitat for Humanity. He remarked that Mr. Barker was a
great example to everyone who had the fortune to know him. Mr. Chunn asked the Commission
to waive the required fee.
Mayor McElyea brought Item#10.2 forward on the agenda.
10.2 Possible discussion and/or action to name a street Barkers Lane — Commissioner
Grace
Commissioner Grace motioned to proceed with the process to rename the street, and waive
the fee; seconded by Commissioner Anton. The motion carried unanimously.
6. Public Safety Reports
Joe Fernandez, Fire Chief, noted he spoke with Mr. Leroy Green after the May 11 Commission
meeting, and he is satisfied with the services of Fire Response. He reported that he attended two
meetings on the oil spill and the issues will be tarballs for the southeast coast. They are currently
looking at the type of training to be provided to municipal employees and volunteers. Chief
Fernandez advised that the Fire Department is acting pro-actively in looking at the issue.
Vice-Mayor Castro suggested staff contact Congressman Ron Klein's office to find out about
available funding for training for local communities in order to respond in a timely manner,
should it encroach in our area. She further noted that we have been declared as part of the
disaster area by the Governor's office. Vice-Mayor Castro invited Chief Fernandez to participate
in the weekly conference calls from Congressman Klein. She will provide him with the
information.

BY THE BROWARD COUNTY COMMISSION AND MODIFICATION TO THE VOLUNTARY
COMMITMENT FOR LAND USE PLAN AMENDMENT PCT 09-5—DANIA BEACH REGIONAL ACTIVITY
CENTER;PROVIDING FOR CONFLICTS;FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution #2010-081 (#7.5), and Resolution #2010-084
(#7.8).
Vice-Mayor Castro spoke about the information provided by the Director of Community
Development which was included in the Agenda packet. She explained that we are trying to
save the tomato patch which is currently residential. The County agreed to present this matter as
a discussion item on their June 15 Agenda. Vice-Mayor Castro advised that we are processing
an amendment to the recently adopted Regional Activity Center (RAC) to provide for additional
commercial and employment use. She noted some residents from the northeast area have
expressed their concerns about the City allowing construction within the 60 DNL. Vice-Mayor
Castro indicated we are not currently allowing it, but at the same time we do not want to restrict
the land use until the RAC is amended. The residents would then be able to come and participate
to change the land use and zoning.
Vice-Mayor Castro motioned to adopt Resolution #2010-081 and Resolution #2010-084;
seconded by Commissioner Grace.
Commissioner Duke noted that residents might be worried about their property rights if this is
approved. He asked Director Daniels for an explanation.
Bob Daniels, Director of Community Development, explained that the issue with the 2020 60
DNL is that a lot of the tomato field area is still undeveloped property and has a residential
zoning on it. If we were to prohibit residential development we would be subject to taking
property rights away from the owners. He noted that we want to be sure that this will not
happen.

City Attorney Ansbro read the title of Resolution#2010-083.
Vice-Mayor Castro clarified we are transferring $4.7M from reserves, of which $3.5M-$4M will
be coming back to us.
Mark Bates, Director of Finance, explained that the OPEB fund is money that the Commission
voted to set aside in trust. We are not expending the money, we are placing it into an investment
vehicle and the income derived from that would be used to pay for retiree health costs.
Vice-Mayor Castro motioned to adopt Resolution 42010-083; seconded by Commissioner
Anton. The motion carried on the following 5-0 Roll Call vote:

City Attorney Ansbro read the title of Resolution #2010-078.
Corinne Lajoie, AICP, Principal Planner, noted the applicant is requesting a special exception,
variance and site plan extension for a previously approved hotel project. She provided a history
of the project. Ms. Lajoie indicated that the current economic situation is the reason for the
request.
Commissioner Duke clarified with staff that the extension would be for an additional one year, to
May 12, 2011.

10. Discussion and Possible Action
10.1 Discussion of setting a workshop with solid waste haulers—Commissioner Duke
Commissioner Duke noted he has talked to several waste haulers, such as Waste Management,
Ace Waste, Choice Waste and Republic Services, to become informed on this issue. He pointed
out that the contract with Waste Management will soon expire. Commissioner Duke indicated
that we have some financial issues to discuss, which could include considering the increase of
franchise fees on commercial hauling. He further said that we need to look at the proposed RFP,
the audit of commercial haulers,to include looking at City staff, etc. Commissioner Duke would
like to have all interested waste haulers come to the workshop in order for the Commission to
make a joint decision. He requested staff to set up the workshop as soon as possible.
Vice-Mayor Castro spoke about the external audit requested some time ago. She would like the
audit report to be provided to the Commission before the workshop.
Commissioner Duke concurred with Vice-Mayor Castro's request.

City Manager Baldwin clarified that staff did not call the workshop because the whole
Commission did not agree.
11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton requested staff to set up a Shade meeting regarding the Airport issue.
11.2 Commissioner Duke
Commissioner Duke noted the local activities that he attended.
Commissioner Duke noted that he is very pleased with the SW Community Center. However,he
thought staff had to look at a Punch list of items in order to make the facility workable and
livable.
Commissioner Duke advised that he will be holding his first annual Town Hall meeting on
Thursday, May 27 at 6:00 p.m. He thanked staff for making the Commission Chamber available.
11.3 Commissioner Grace
Commissioner Grace thanked staff for providing her with the emergency phone numbers.
Commissioner Grace spoke about the Notice of Polling Location changes for Precincts 7S and
9S. She confirmed with City Clerk Stilson that the Supervisor of Elections Office would be
sending new cards to the affected voters.
Commissioner Grace noted activities that she attended.
Commissioner Grace noted that Elected Officials are here to serve the residents, not to air their
differences publicly. She remarked that she is her own person, and asked people not to lump her
with anyone else. Commissioner Grace encouraged the Commission to leave their discrepancies
at the door and be professional.
11.4 Vice-Mayor Castro
Vice-Mayor Castro reported on the Annual Tourism Luncheon.
Vice-Mayor Castro noted she constantly receives complaints that it is very difficult and
expensive to do business in the City. She indicated she spoke with staff to try to tackle that
problem in the next year. Vice-Mayor Castro stated that small businesses do not need additional
fees, especially during these difficult economic times. We need to entice small businesses and

make it a friendly environment. She suggested creating a mini task force with staff and reach out
to our partners for any programs that could be implemented.
Vice-Mayor Castro spoke about the crime issue in our City. She referred to her previous
comments regarding an anti-crime initiative called "Analyzing your Community for Success"
being implemented by the Attorney General's Office. Vice-Mayor Castro would like both BSO
and the Fire Department to be present at the meeting. Lastly, she asked for support from the City
Manager and the Commission to bring this meeting to fruition.
Vice-Mayor Castro noted that she met with the Broward Children's School regarding a problem
with Florida Power and Light and a pole. She indicated that she will discuss the issue with FPL;
however, if she is unsuccessful with her request, she may bring this issue to the Commission for
consideration.
11.5 Mayor McElyea
Mayor McElyea commented the "Walk for Alina" event was very well attended.
Mayor McElyea noted he attended the Maritime luncheon.
12. Appointments
Vice-Mayor Castro appointed Linda Sacco to the Airport Advisory Board.
Commissioner Duke appointed Mark LaRocca to the Airport Advisory Board.
Commissioner Grace appointed Ronald Nuby to the Charter Review Board.
Commissioner Grace appointed Ernest Ren Jackson to the Nuisance Abatement Board.
Commissioner Anton confirmed the appointment of Carolyn Jones as the 91h Member of the
Police and Fire Pension Board.
Commissioner Anton motioned to approve the appointments; seconded by Vice-Mayor
Castro. The motion carried unanimously.

regarding the Water Supply issue,which is attached to and incorporated into these minutes.

SUBJECT: Water Supply Report
Since the last City Commission meeting staff and consultants have continued negotiations
with the South Florida Water Management District (SFWMD) and Broward County on
potential solutions.
Broward County Raw Water Solution
There has been no change in this area since last meeting. The County staff remains
confident that the source of raw water that will be available for use by the City in an amount
sufficient to meet its long term needs is a feasible option and the County is continuing to
pursue that option.
Well G
The City's consultants and SFWMD are nearing a solution to the outstanding permit issues
relating to Well G. While there are a number of details to be worked out, the County and
SFWMD have been cooperative and it appears that the City will be able to meet its current
demands through a combination of City wells and raw water purchased from Broward
County.
10-year Water Supply Plan
A sure indicator that we are making progress on water supply is that the SWFMD has
suggested that we call the Florida Department of Community Affairs together to request that
the administrative hearings scheduled for June 30, 2010 be rescheduled. A conference call
is being scheduled with both agencies later this week.
