HomeMy WebLinkAboutR-2010-113 SFTTO Table Tennis Special Exception RESOLUTION NO. 2010-113 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY CARLOS ZELLER, REPRESENTING THE SOUTH FLORIDA TABLE TENNIS ORGANIZATION ("SFTTO") TO ALLOW INDOOR COMMERCIAL RECREATION AS A SPECIAL EXCEPTION USE IN AN "IG" (INDUSTRIAL GENERAL) ZONING DISTRICT FOR PROPERTY LOCATED AT 11 SW 12T" AVENUE, BUILDING 4, UNITS 101-103 FOR PROPERTY OWNED BY PHIL VON KAHLE,ASSIGNEE FOR IIS HOLDINGS LLC,IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Zoning Code Chapter 28,"Zoning",Article 4.20, "Schedule of Use Regulations",provides for all permitted and special exception uses within the IG(Industrial General)zoning district; and WHEREAS,the Dania Beach Zoning Code,Chapter 28,"Zoning",Article 4.20,"Schedule of Use Regulations",provides that"Commercial Recreation"is allowed as a special exception use when conducted within a completely enclosed building, in the IG zoning district; and WHEREAS, Carlos Zeller, representing the South Florida Table Tennis Organization (SFTTO)has applied for a special exception request to allow a commercial recreational activity as a use within a completely enclosed building on property located at 11 SW 12`h Avenue, Building 4, Units 101-103, in City of Dania Beach; and WHEREAS,the Planning and Zoning Board on July 21, 2010,recommended that the City Commission grant the special exception request based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations", Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-30-10 fora special exception use approval to allow commercial recreational activities within a completely enclosed building in the IG zoning district for property located at 11 SW 12`h Avenue, Building 4, Units 101-103, in the City of Dania Beach(a copy of which application is attached and made a part of this Resolution as Exhibit"A"),is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. Specifically,the use should be permitted as a special exception and will not cause a detrimental impact, but will increase the value of existing contiguous use in the general area and zoning district. BTTC's use is compatible with existing uses on the contiguous property and general area and with the general character of the area. Landscaping has been provided. More than sufficient parking is provided and ingress and egress will not interfere with traffic on abutting streets as most of the traffic will occur after other businesses close for the evening and on weekends. BTTC's use as a table tennis club will not have a detrimental environmental impact upon any properties located In the area or an environmental impact Inconsistent with the health,safety and welfare of the community. BTTCs use will not have a detrimental effect on vehicular or pedestrian traffic,or parking conditions,and will not result in the generation or creation of traffic inconsistent with the health,safety and welfare of the community. Most of the traffic will be after 5:00 pm during the week when the other businesses are closing and on weekend days. BTTC will have no shipping or deliveries that will result in traffic inconsistent with the health,safety and welfare of the community. BTTCs use will not have a detrimental effect on future development of contiguous properties or the general area. As there Is no manufacturing,its use will not result in the creation of incompatible noise, lights,vibrations,fumes,odors,or dust. The use will not overburden existing public services and facilities. There is complete accessibility for fire,police, rescue and other essential public services. BTTCs use will be consistent with the definition of a special exception and will meet the standards and criteria of the zoning classification In which such use Is proposed to be located end all other requirements for such particular use set forth in the zoning code.
