HomeMy WebLinkAboutR-2010-119 WETTAPS Emergency Repairs RESOLUTION NO. 2010-119 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING AN AGREEMENT TO BE EXECUTED BY THE PROPER CITY OFFICIALS WITH WETTAPS, INC. FOR NECESSARY EMERGENCY REPAIR OF A PORTION OF A STORMWATER DRAINAGE SYSTEM IN AN AMOUNT NOT TO EXCEED FORTY ONE THOUSAND SIX HUNDRED SEVENTY FIVE DOLLARS ($41,675.00) FOR FISCAL YEAR 2009-2010, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), provides that during unusual conditions or emergencies, the City Commission may, by resolution, authorize the purchase by the City Manager of designated supplies, services, equipment and materials in amounts in excess of $25,000.00 without competitive bidding and without advertisement for bids; and WHEREAS, the Public Works Director has determined that an emergency condition has occurred stemming from degraded stormwater infrastructure that presents an immediate safety concern to the public that requires purchase of necessary emergency repair services from WETTAPS, Inc. for repairs to a portion of a stormwater system which serves the public located at the Meadowbrook Condominium Complex; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the emergency purchase of stormwater repair services for the work described above is authorized in an amount not to exceed forty one thousand six hundred seventy five dollars ($41,675.00) to be paid to WETTAPS, Inc. for the emergency repair service. Section 2. That this City emergency repair is approved based upon the commitment from authorized Meadowbrook Condominium property owner representatives to pay the City of Dania Beach 50% of the emergency repair cost. Section 3. That funding for this previously unplanned work shall be provided by a transfer from Stormwater Fund contingency account #403-3801-538.99-10 (which has a projected available balance of $214,830.00 as of July 22, 2010) to Stormwater Maintenance account#403-3801-538.46-60. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on July 27, 2010. 0 s p�q C. K.
