A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, RELATING TO CHANGE ORDER NO. 2 FOR THE
NANOFILTRATION WATER PLANT PROJECT; REALLOCATING
ALLOWANCES FOR NO NET INCREASE IN TIME AND AN INCREASE IN
COST OF A NOT TO EXCEED AMOUNT OF $285,992.00; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission adopted Resolution 2002-120 approving the Water,
Wastewater and Stormwater Facilities Plan; and
WHEREAS, one of the major projects was the nanofiltration water plant; the City
received proposals for design and construction of a 2.0 MGD nanofiltration water treatment plant
on the City's existing water plant site; and
WHEREAS, the City Commission awarded Camp Dresser & McKee, Inc. the
designibuild contract in the amount of$8,820,923.00 in November 2009; and
WHEREAS, the contract will require additional new funding to complete and also
contain a series of allowances intended to address issues that could not be adequately bid prior to
design; and
WHEREAS, the new funding and contract allowances would be provided as follows:

WHEREAS, there is no increase in time; however, there is a need to provide increased project
funding by an amount not to exceed $285,992.00 for this Change Order No. 2;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA,AS FOLLOWS:
Section 1. That the foregoing findings are incorporated by this reference and are
made a part of this Resolution.
Section 2. That the City of Dania Beach, Florida, approves Change Order No. 2 for
the Nanofiltration Project with no increase in time, use of available project Contingency in the
amount of$202,000.00, and increasing the project funding by an amount of$285,992.00 through
transfer of appropriations from the Water Fund Contingency Account #401-3301-533-99-10 for
this Change Order No. 2, resulting in an account balance of $613,000.00, and the proper City
officials are authorized to execute it.
Section 3. That all resolutions or parts of Resolutions in conflict with any of the
provisions of this Resolution are repealed.
Section 4. That this Resolution shall become effective immediately upon its passage
and adoption.

This Change Order constitutes full, final, and complete authorization for compensation to the Contractor
for all costs,expenses, overhead, and profit,and any damages of every kind that the Contractor may incur
in connection with the above referenced change(s) in the Work, and any other effect on any of the Work
under this Agreement. The Contractor acknowledges and agrees that(a)the Lump Sum of$8,820,923.00
under this Agreement will be increased by $285,992.00 by this Change Order, and (b) the schedule of
performance of Work will be unchanged by this Change Order. Contractor expressly waives any claims
for any additional compensation, damages or time extensions in connection with the above referenced
change(s). Except as modified by the document, all terns of the Agreement shall remain in full force and
effect and shall cover the performance of, and payment for, any work authorized under this document.
Any defined terms not defined in this Change Order shall have the meanings set forth in the Agreement.
By signing below the parties indicate acceptance of this Change Order as set forth in it.

This Change Order provides means of payment from the Contract Allowance Accounts and
Contingency Accounts. CDM will remove and dispose the existing lime softening motor
control center and provide and install a new lime softening motor control center in the new
Membrane Building Electrical Room. CDM will connect the existing electrical loads from
the Lime Softening System to the new Membrane Building Electrical Room.
CDM will incorporate the existing lime softening controls into the new Membrane Building
Control Room.CDM will connect to the existing lime softening control wiring to the new
Membrane Building Control Room with the minimum interruption to the existing plant
operations. CDM will remove and dispose the existing lime softening control panel.

A CPAM is issued to memorialize the allocation of the Owner's Allowance Account.The Owner's
Allowance Account is available at the discretion of the Contract Administrator authorizing the
commencement of specific Work. CDM Constructors, Inc shall not perform Work subject to the
Owners Allowance Account without the prior issuance of this CPAM transferring approved
amounts and authorizing to proceed with Work.

(TITLE) Rehabilitate Electrical System and Control Upgrades from Existing Lime Softening
System
DESCRIPTION OF WORK(INCLUDE ANY ATTACHMENTS OR REFERENCES):
Item No. 1—Rehabilitate Electrical System from Existing Lime Softenin¢System.
Price Proposal—August 14. 2009 Scope of Work
The Allowance in the Bid Sheet for modifications of the electrical system includes upgrades
integrating the existing lime softening system power with the new nanofiltration plant power in
accordance with Addendum 7.
Allowance Scope of Work:
CDM will remove and dispose the existing lime softening motor control center and provide and
install a new lime softening motor control center in the new Membrane Process Building
Electrical Room. CDM will connect the existing electrical loads from the Lime Softening System
to the new Membrane Process Building Electrical Room.
The Work includes the following:
On-site investigation to identify and tag all existing lime softening wires and loads;
Provide and install new lime softening motor control center;
Sawcut existing foundation and extend existing lime softening power feeders;
Connect existing lime softening wires to new motor control center power feeders; and
Remove and dispose existing lime softening motor control center and electric room.

Item No. 2—Control Upgrades from Existing Lime Softening System.
Price Proposal—August 14, 2009 Scope of Work

controls the existing lime softening system with the new nanofiltration plant controls in
accordance with Addendum 7.
Allowance Scope of Work:
CDM will incorporate the existing lime softening controls into the new Membrane Process
Building Control Room. CDM will connect to the existing lime softening control wiring to the
new Membrane Process Building Control Room. CDM shall remove and dispose the existing
lime softening control panel,
The Work includes the following:
On-site investigation to identify and tag all existing lime softening control wiring;
Sawcut existing foundation and extend existing lime softening control wires;
Connect existing control wiring to the new Membrane Building Control Room PLC;
Provide programming and graphic screens;
Relocate existing air compressor; and
Remove and dispose existing lime softening control panel.
Item No. 3—Upgrade Primary and Backup Power System.
Price Proposal-August 14, 2009 Scope of Work
CDM's price proposal includes a new 400-kW generator to operate the nanofiltration plant and
the high service pumps.The existing 350-kW generator will operate the current lime softening
system. CDM's price proposal includes utilizing the existing high service pump station 300-kVa
transformer and installing a second transformer at the plant's northeast corner and a 1600A
service for the existing lime softening system and new nanofiltration plant in accordance with
Addendum 2 and 7.
Allowance Scope of Work:
CDM will install a new single 750-kW generator to operate the new nanofiltration plant,the
nanofiltration expansion, the existing high service pumps and existing lime softening system.
CDM will remove the existing 350-kW generator serving the high service pump station and
existing lime softening system from service.This improvement will stream line maintenance;
reduce spare parts and improve backup power response time.

CDM will replace the existing high service pump station 300-kVa transformer with a single 500-
kVa transformer and 2000A service for the new nanofiltration plant,the existing high service
pumps and existing lime softening system.This will simplify the electric system and electric bill
and will potentially result in a slight savings because of FPL demand charges.
Summary of Changes Between CDM's Price Proposal and the Allowance's Scope of Work:
Please reference attached Drawing-Allowance No. 2—Item No.3— Upgrade Primary and
Backup Power System
Deducts(Reference Red Highlights in the attached drawing):
400-kW Generator;
1600A service from new transformer to main switchboard;
Power feeder from 400-kW generator to main switchboard; and
350-kW Generator skin type enclosure.
ADDS(Reference Blue Highlights in the attached drawing);
750-kW Generator;
Power feeders from new 500-kVa transformer to 2000A main switchboard;
Power feeders from 750-kW generator to main switchboard;
Demolish existing generator building with existing 350- kW generator; and
Disconnect and remove high service pump feeders to existing 300-kVa transformer.
The performance of (Item 1) — Rehabilitate Electrical System and (Item 2) — Control Upgrades
requires an extension of the Contract Time for an additional 60 days. This Work, however does
not impact the completion of the new nanofiltration system but commences after successful
startup of the new nanofiltration system.
