WHEREAS,the Dania Beach Zoning Code Chapter 28,"Zoning",Article 21,"Downtown Transit Oriented Development(TOD)and Transit Oriented Corridor(TOC)Districts",provides for all permitted and special exception uses within the TOD, TOC-1 and TOC-2 zoning districts; and WHEREAS, the Dania Beach Zoning Code, Chapter 28, "Zoning", Article 21.18, "Use Table",provides that"Auditoriums and convention halls"are allowed as a special exception use in the TOC-1 zoning district; and WHEREAS, Vincent Pyle, owner of the Danians Shopping Center, representing Josefa Sanchez,Exquisite Occasions,Inc. a/k/a Starlite LLC has applied for a special exception request to allow a banquet hall facility for property located at 601-603 East Dania Beach Boulevard in the City of Dania Beach; and WHEREAS, the Planning and Zoning Board on August 18, 2010, recommended that the City Commission grant the special exception request based upon the criteria set forth in Chapter 28, "Zoning",Article 6,"Supplementary Use Regulations",Section 6.40,"Special Exception Uses",of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That that certain application 5E-35-10 for a special exception use approval to allow a banquet hall facility in the TOC-1 zoning district for property located at 601-603 East Dania Beach Boulevard, in the City of Dania Beach(a copy of which application is attached and made a part of this Resolution as Exhibit"A"), is approved. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. We are hereby applying for a special exception in the use of the premises located at 601-603 East Dania Beach Blvd. Dania Beach, F1 33004 at the Danians Plaza. The business is to be a Banquet Hall/Catering and which will not cause a detrimental impact to the value of existing contiguous uses as it would create more customer flow to the plaza, or to the uses in the general area or to the zoning district that it located in. There is adequate landscaping and screening as required in this chapter and additional beautification will-be added such as ornamental plants. There is adequate parking and loading provided and ingress and egress is so designed as to cause minimal interference with traffic in any of the abutting streets. It is our firm belief that the use will be consistent with the existing comprehensive plan. It would definitely not have a detrimental environmental impact upon contiguous properties or upon properties located in the general area or be inconsistent with the health, safety or welfare of the community. The use of this premises as a Banquet Hall/catering wil not have a detrimental effect on vehicle or pedestrian traffic or parking conditions and will not result in the generation or creation of traffic in consistent with the health, safety and welfare of the community. The use will not utilize turning movements in relation to its access to public roads or intersections or its location in relation to other structures or proposed structures on or near the site that would be hazardous or a nuisance. It will not have any detrimental effect on the future development of contiguous properties or the general area according to the comprehensive plan.
