A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,APPROVING THE VARIANCE REQUEST SUBMITTED BY
HANK THOMAS,REPRESENTING KSA MECHANICAL, FROM THE DANIA
BEACH LAND DEVELOPMENT CODE,FOR PROPERTY LOCATED AT 4160
RAVENSWOOD ROAD, OWNED BY SAAD MALUMOUD, CITY OF DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS,the Dania Beach Land Development Code,Part 1,Article 115,Section 115-40,
prescribes the Schedule of permitted uses allowed within the City of Dania Beach; and
WHEREAS, Part 1, Article 115, Section 115.-50, of the Dania Beach Land Development
Code prescribes certain conditions of use associated with the Schedule of permitted uses,within the
City of Dania Beach; and
WHEREAS, Hank Thomas, representing KSA Mechanical (Applicant), has applied for a
variance (VA-29-10) from the Land Development Code Part 1, Article 115, Section 115-50,
Conditions of use item (73) to allow garage doors to face a right-of-way, associated with an
automotive use for property located at 4160 Ravenswood Road, Dania Beach, owned by Saad
Malumoud; and
WHEREAS,the Planning&Zoning Board on August 18,2010,recommended that the City
Commission grant variance request VA-29-10,based upon the criteria set forth in Part 6,Article 625,
"Variances of the Land Development Code",of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-29-10,for the variance described above from
requirements in the Land Development Code of the City of Dania Beach Code of Ordinances,a copy
of which application is attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

To Whom It May Concern,
We at KSA MECHANICAL SERVICES would like to ask for a variance to our
Proposed Text Amendment as identified in Zoning Code 10.13. Variances. The
building at 4160 Ravenswood Rd is an existing structure, that has not been altered
from its original design and would not provide any special privilege to us denied
by any other applicant rejected by this chapter to other lands, structures or
buildings in the same zoning district. Furthermore the property sits on a unique
embankment that obscures the sight line of the right-of-way(i.e. Lee Wagner Blvd.
which makes the need for garage doors unnecessary. Not granting this variance,
would deny us the ability to take full advantage of our properties full capabilities,
as a result making are time at this location untenable. The fact that the distance
from the street to the building structure, is some 120 feet, further demonstrates
that it causes no harm to the aesthetic harmony of the area. We are committed to
be a strong partner with The City of Dania Beach, as well as the other businesses.
We hope that this can be resolved, so that we can continue to grow and prosper
together.
