Call to Order Mayor McElyea called the meeting to order at 6:00 p.m. 2. Roll Call Present: Mayor: C. K. "Mac"McElyea Commissioners: Bob Anton Walter Duke Bobbie Grace City Manager: Robert Baldwin City Clerk: Louise Stilson Code Attorney: Tim Ryan Absent: Vice-Mayor: Anne Castro City Attorney: Tom Ansbro 3. Abatement Requests 3.1 Abatement request for Jimmie's Chocolates for Public Service lot mowing and/or debris removal liens (13 total) for the vacant lot located south of 148 N. Federal Highway (Folio #0234-01-1640) Dominic Orlando, Director of Public Services, recommended an abatement of$4,255.62. Ken Smith, owner of Jimmie's Chocolates, explained that they recently purchased the vacant lot adjacent to their property. The previous owner passed away in 1990 and left no clear successor; therefore the property was untended and the City mowed the vacant lot from 1990-1997. Mr. Smith purchased the business in 1997 and has maintained the property since that time. Commissioner Anton motioned to abate the lien to $4,255.62, to be paid in 6 months; seconded by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote: Commissioner Anton Yes Commissioner Grace Yes Commissioner Duke Yes Mayor McElyea Yes 3.2 Extension request for the abatement approved for Jenifer Diana Christian for property located at 2870 W. MARINA DRIVE, Case #06-1211 (Folio # 0232-16-5400) Attorney Tim Ryan noted the Commission heard this case on January 21, 2010 and abated the lien to $5,000.00 to be paid within 180 days. The applicant is requesting an extension of time. Commissioner Duke motioned to confirm the lien of$5,000.00, and to extend the time by an additional 6 months, unless the property sells before that time; seconded by Commissioner Grace. The motion carried on the following 4-0 Roll Call vote: Commissioner Anton Yes Commissioner Grace Yes Commissioner Duke Yes Mayor McElyea Yes 3.3 Abatement request for Violet M. Klatt Rev Tr. for property located at 126 S. FEDERAL HWY, Case #06-1658 (Folio #0234-01-3590) 3.4 Abatement request for Violet M. Klatt Rev Tr. for property located at 100 S. FEDERAL HWY, Case #09-0073 (Folio # 0234-01-3560) Attorney Tim Ryan noted that the applicant has requested a continuance for Item #3.3 and Item #3.4 until the November Abatement Hearing. Commissioner Anton motioned to continue Item #3.3 and Item #3.4 until the November 18, 2010 Abatement Hearing; seconded by Commissioner Grace. The motion carried unanimously. 3.5 Abatement request for Thomas Flannery & Mario Perez for property located at 502 SW 2 AVENUE, Case # 07-0368 (Folio # 1203-04-0311) Attorney Tim Ryan noted the applicant requested a continuance until the November Abatement Hearing. Commissioner Grace motioned to continue Item #3.5 until the November 18, 2010 Abatement Hearing; seconded by Commissioner Anton. The motion carried unanimously. 3.6 Abatement request for Ronnie Koenig for property located at 2863 SW 58 COURT, Case # 09-1197 (Folio # 0232-17-1010) Attorney Tim Ryan noted this case involved 2 violations for furniture items on the outside of the premises. The fine ran for 104 days for a total of $10,649.50. The Special Magistrate recommended an abatement of$1,750.00. Commissioner Duke motioned to abate the lien to $1,750.00, as recommended by the Special Magistrate, to be paid in 30 days; seconded by Commissioner Grace. The motion carried unanimously. Gonzalez for property located at 715 SW 10 STREET, Case #06-1247 (Folio #1203-34-0050) Attorney Tim Ryan noted the case settled for $1,521.00, plus $500.00 for City costs. 3.8 Approval of the settlement received for Joceline Vedrine for property located at 717 SW 3 PLACE, Case #06-1442 (Folio #1203-36-0450) Attorney Tim Ryan noted the case settled for $8,599.00, plus the amount for the nuisance abatement and sidewalk repairs. 3.9 Approval of the settlement received for Joceline Vedrine for property located at 717 SW 3 PLACE, Case #09-0522 (Folio # 1203-36-0450) Attorney Tim Ryan noted the case settled for $3,199.00, plus the amount for the nuisance abatement and sidewalk repairs. 3.10 Approval of the settlement received for Jorge L. Carrillo & Maria Leyria for property located at 269 SW 6 STREET, Case #07-1495 (Folio # 1203-05-0170) Attorney Tim Ryan noted the case settled for $6,250.00. 3.11 Approval of the settlement received for Violet R. Kaminski for property located at 4510 SW 43 AVENUE, Case #07-2270 (Folio# 0125-04-0230) Attorney Tim Ryan noted the case settled for $5,000.00. 3.12 Approval of the settlement received for Nancy Parise for property located at 4909 SW 43 TERRACE, Case#08-0146 (Folio # 0136-06-0870) Attorney Tim Ryan noted the case settled for $3,500.00, plus $1,500.00 for the Public Service liens. 3.13 Approval of the settlement received for Daniel E. Bomback for property located at 2471 SW 58 MANOR WEST, Case#08-0678 (Folio # 0232-21-0090) Attorney Tim Ryan noted the case settled for$4,259.00. 3.14 Approval of the settlement received for Gloria Gaviria for property located at 5011 LEEWARD LANE 2902, Case #08-0830 (Folio #0232-AB-2020) Attorney Tim Ryan noted the case settled for $3,500.00. Snachez-Bernal for property located at 2411-2413 SW 58 MANOR, Case #08-1380 (Folio # 0232-21- 0150) Attorney Tim Ryan noted the case settled for $4,000.00, 3.16 Approval of the settlement received for Terrance L. Hunt & Janice Tribue for property located at 121 NW 4 AVENUE, Case#09-0416 (Folio # 0234-01-1270) Attorney Tim Ryan noted the case settled for $900.00, plus payment of $100.00 for Special Magistrate, and payment of outstanding $700.00 utility bill.
