HomeMy WebLinkAboutR-2010-124 San Souci Hotel Special Exception RESOLUTION NO. 2010-124 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY SCOTT BAKOS WITH THE FIRM BERMELLO AJAMIL & PARTNERS, INC., REPRESENTING THE PROPERTY OWNER,DANIA BEACH DEVELOPMENT GROUP/RILEA GROUP,FOR A SPECIAL EXCEPTION USE TO ALLOW THE CONSTRUCTION OF A HOTEL IN THE TRANSIT ORIENTED CORRIDOR (TOC-1), AND THE ASSIGNMENT OF 240 HOTEL ROOMS FROM THE LOCAL ACTIVITY CENTER FOR PROPERTY LOCATED APPROXIMATELY 550 FEET EAST OF SE 5TH AVENUE ON THE SOUTH SIDE OF EAST DANIA BEACH BOULEVARD, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the Dania Beach Zoning Code provides that"hotels"are allowed as a special exception use in the TOC-1 (Transit Oriented Corridor) Zoning District; and WHEREAS, applicant, Scott Bakos with the firm Bermello Ajamil & Partners, Inc., representing the property owner, Dania Beach Development Group/Rilea Group, has applied for a special exception to allow a hotel use with the assignment of 240 hotel rooms from the Local Activity Center within the"TOC-l"Zoning District for property located approximately 550 feet east of SE 5ch Avenue on the south side of East Dania Beach Boulevard,in the City of Dania Beach; and WHEREAS, the Planning & Zoning Board on June 16, 2010, recommended that the City Commission grant the special exception request, based upon the criteria set forth in Chapter 28, "Zoning", Article 10.12. "Special Exceptions", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SE-22-10,for a special exception to allow a hotel with the assignment of 240 hotel rooms from the Local Activity Center in the TOC-1 (Transit Oriented Corridor)zoning district,for property located approximately 550 feet east of SE 51h Avenue on the south side of East Dania Beach Boulevard, in the City of Dania Beach, (a copy of which application is attached and made a part of this Resolution as Exhibit "A"), is approved with the following conditions: 1. For a period of one year, if the applicant has not submitted a building permit application within one year,the 240 hotel rooms returns to the city for assignment to future projects;and 2. Demolition and removal of all existing structures within 120 days of the approval. Section 2. That this approval shall automatically expire and become null and void unless building permits are obtained on or before twelve (12) months from the effective date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on October 12, 2010. C. K.
