HomeMy WebLinkAboutR-2010-125 San Souci Hotel Variance RESOLUTION NO. 2010-125 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE VARIANCE REQUEST SUBMITTED BY SCOTT BAKOS WITH THE FIRM BERMELLO AJAMIL& PARTNERS, INC., REPRESENTING THE PROPERTY OWNER,DANIA BEACH DEVELOPMENT GROUP/RILEA GROUP FROM CHAPTER 28, "ZONING"AND CHAPTER 26, "VEGETATION", FOR PROPERTY LOCATED APPROXIMATELY 550 FEET EAST OF SE 5TH AVENUE ON THE SOUTH SIDE OF EAST DANIA BEACH BOULEVARD, IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, "Vegetation", Article IV, "Landscaping' prescribes the landscape regulations in the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 21.16, prescribes the regulations for upper level setbacks within the Transit Oriented Corridor Zoning District (TOC-1) for the City of Dania Beach; and WHEREAS,the Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 6.21,"Off- Street Parking", prescribes the parking regulations within the City of Dania Beach; and WHEREAS, applicant, Scott Bakos with the firm Bermello Ajamil & Partners, Inc., representing the property owner, Dania Beach Development Group/Rilea Group, has applied for variances (VA-21-10) as follows: 1. To allow an 11.5 foot setback from the west property line(Dania Beach Code of Ordinances, Chapter 28, "Zoning", Article 21.16 requires 25 feet); 2. To allow a 16.5 foot setback from the east property line(Dania Beach Code of Ordinances, Chapter 28, `Zoning", Article 21.16 requires 25 feet); and 3. To allow parking spaces next to a wall with only 1 additional foot (Dania Beach Code of Ordinances,Chapter 28,"Zoning",Article 6.21 "Off-Street Parking",requires an additional 2 feet), for property located approximately 550 feet east of SE 5th Avenue on the south side of East Dania Beach Boulevard, in the City Dania Beach; and WHEREAS, the Planning & Zoning Board on June 16, 2010, recommended that the City Commission grant variance requests of VA-21-10,based upon the criteria set forth in Section 10.13, Article 10, of Chapter 28, "Zoning", of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-21-10 for the variances described above from requirements in Chapter 26, "Vegetation" and Chapter 28, "Zoning" of the City of Dania Beach Code of Ordinances, a copy of which application is attached and made a part of this Resolution as Exhibit"A", is approved provided the applicant installs a landscape buffer and a wall, if sufficient building space exists to accommodate a wall, to be installed along or adjacent to the east property line, subject to the approval of the adjacent property owner located on the east side of the subject property. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on October 12, 2010. C. K.
