DANIA BEACH CITY COMMISSION
TUESDAY, OCTOBER 26, 2010— 7:00 P.M.
1. Call to Order/Roll Call
Mayor McElyea called the meeting to order at 7:00 p.m.

2. Invocation and Pledge of Allegiance
Vice-Mayor Castro gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Special Event request from Marine Industries Unlimited, Inc. for a Public Boat
Auction to be held Sunday, November 14, 2010 at Boomers, 1801 N.W. 1st Street,
from 10:00 a.m. - 1:00 p.m.
Vice-Mayor Castro motioned to approve the Special Event request for the Public Boat
Auction requested by Marine Industries Unlimited, Inc.; seconded by Commissioner
Grace. The motion carried unanimously.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Bob Mikes, Pat Sullivan and Phillip Miller, residents of NW 7th Street, Melaleuca Gardens,
requested installation of three Sabal Palms to buffer the noise from the railroad track, and to
eliminate the view of the high tension wires.
Mayor McElyea indicated that he knows where to obtain the trees.
Myrtle Corbin, 248 SW 13th Street, requested a donation from the City for the American Cancer
Society Relay for Life. She would like a team from every department in the City to participate in
the 2011 Relay for Life event. Ms. Corbin asked for the following: a $10,000.00 contribution
from the City; a proclamation declaring April 15-16 as Dania Beach Relay for Life Days; the
City to help coordinate teams to walk/run; and the City to decorate Dania Beach Boulevard in
purple during the week of April 11-16, 2011. She invited the Commission to attend the Kickoff
party on Wednesday,November 10, 2010 at Frost Park.
Commissioner Grace motioned to support Relay for Life with a pledge of$7,500.00.
City Manager Baldwin noted the funds would come from Contingency.
Commissioner Duke noted this is a community event and we need to look at it.
Commissioner Anton motioned to table this item to the next meeting so that staff can bring
forward a proposal as to where the funding will come.
Vice-Mayor Castro motioned to approve a donation of $5,000.00 tonight and for staff to
come back with $5,000.00 at the next Commission meeting; seconded by Commissioner
Duke. The motion carried unanimously.
Tammie James, 255 NW 12th Avenue, requested a road closure in front of her home to protect
her family and the neighborhood. She commented that she has had lots of robberies and break-
ins in front of her home.
Commissioner Grace noted she should have a petition.
Ms. James said the residents did sign a petition.
Vice-Mayor Castro advised her to bring the petition to the City Manager so it can be validated
and presented to the Commission for consideration.
Hank Thomas Downtown Dania
ania Beach Development LLC, announced that today the Broward
County Commission voted to allocate $22M to his project (Indigo Hotel) in Dania Beach. He
noted they plan to start construction in mid December. Mr. Thomas thanked the Commission for
their support.
Teddie Bohanan, 312 SW 15th Street, asked if we could check the absentee ballots personally,
because there are people voting twice. She also asked if we have a rule for Commissioners
receiving email or twitters during meetings.

Vice-Mayor Castro noted there is no prohibition from the Commission receiving text messages.
6. Public Safety Reports
Commissioner Duke complimented BSO for their quick response on a recent incident on 5th
Avenue.
Vice-Mayor Castro thanked BSO for taking care of the 5th Avenue Nature Cove speeding issue.
She further noted that the number of pedestrians on Griffin Road has increased and we need to
slow down the traffic. Vice-Mayor Castro said she is interested to know the status of the traffic
calming project on 5th Avenue.
Donn Peterson, BSO Chief of Police, noted 5th Avenue will continue to be an on-going effort.
He indicated that they have identified ten intersections for the red light cameras. Chief Peterson
advised that they met with representatives of the Broward County Traffic Engineering
Department regarding the Griffin Road issue, and there are some short and long term solutions
that are being considered.
Commissioner Grace thanked BSO for taking care of a problem at one of our parks.
Joe Fernandez, Fire Chief, commented that Lieutenant Jerome Snell will be having the "One
Year Anniversary"celebration for the Explorers team on Thursday,November 4 at 6:00 p.m. He
reported that the new firefighters are now on board and we are compliant with our national
standards.
Commissioner Duke complimented the members of the CERT Program and thanked them for
their service to the City.

Vice-Mayor Castro asked if this property was tax exempt. She also questioned if they have met
with the residents in the area regarding the future impact in their neighborhood.
Charles Cassini, on behalf of the American Maritime Officers, noted that they pay taxes on this
property, and they have a good relationship with the residents.

City Attorney Ansbro read the title of Ordinance#2010-025.
Corinne Lajoie, AICP, Principal Planner, noted this is the establishment of a new zoning district
entitled Industrial, Research, Office, Marine Airport Approach (IROM-AA) for existing IROM
zoned properties generally located west of I-95, from Griffin Road to the northern corporate
limits of the City. It also cleans up a lot of language in other areas. She explained each of the
items being addressed under this Ordinance which were included in the agenda back-up material.
The Planning and Zoning Board recommended approval of the proposed text amendments.
Mayor McElyea opened the Public Hearing.
Bob Mikes, 601 NW 7th Street, Melaleuca Gardens, warned and pleaded not to lose control of
this area. He remarked that one bad use can bring down the values of an entire community.
Dave Wright, SW 22"d Avenue, noted he is glad to see the City behind this proposal which will
benefit the residents in this area.
Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the
Public Hearing.
Vice-Mayor Castro reassured the public that most of the parcels in question are not impacting
residential areas.

Vice-Mayor Castro thanked everyone involved in trying to have this matter resolved. She also
recognized John Mullikin, South Florida Water Management District (SFWMD) for alerting the
City on such an important issue.

10. Discussion and Possible Action
10.1 Discussion on whether or not to cancel the December 28, 2010 City Commission
meeting
Vice-Mayor Castro motioned to cancel the December 28, 2010 City Commission meeting;
seconded by Commissioner Anton. The motion carried unanimously.
11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton noted the Broward County Aviation Division will do a presentation to the
County Commission on November 9, 2010. He encouraged people to participate and voice their
comments on the mitigation program.
Commissioner Anton noted he will be out of town for the CRA meeting on Wednesday,
November 3, 2010.

11.2 Commissioner Duke
Commissioner Duke addressed the code compliance issues in all three phases of the
Meadowbrook Condominium complex. He noted that the Code Compliance Unit identified
approximately 300 cases, which were mainly made subsequent to Hurricane Wilma.
Commissioner Duke advised that we are waiving fees and any related penalties because we do
not want to create any hardship on our residents; we just want life safety compliance.
11.3 Commissioner Grace
Commissioner Grace echoed the comments of Commissioner Duke.
Commissioner Grace provided an update of upcoming community events.
11.4 Vice-Mayor Castro
Vice-Mayor Castro noted the Certificate of Occupancy for the Library should be issued at the
end of November, and it will probably open in April, 2011.
Vice-Mayor Castro noted that we have received quotes for medians to be installed on SE 5th
Avenue and SW 2nd Avenue. She asked staff to bring back this item for discussion before the
Commission and neighborhood input, before any traffic calming devices are placed in that area.
Dominic Orlando, Director of Public Services, explained that we had to make sure that we have a
"no passing zone" with minimum speed limits. He further advised that part of the project
includes medians at the entryways, and staff is currently waiting for quotes.
Vice-Mayor Castro asked staff to show the pictures of the proposed project to the Commission
and the residents,before starting construction.
Vice-Mayor Castro spoke about a request for traffic data for some "as built"projects for certain
utility companies on SW 2 Avenue. She remarked that she wants to make sure that we are not
just doing Dixie Highway and 2nd Avenue, and that work is performed along the whole of SW
2nd Avenue.
Vice-Mayor Castro noted she was at the County today when they voted unanimously on Hank
Thomas' project for the Hotel Indigo.
Vice-Mayor Castro referred to the Meadowbrook Condominium code issues. She said that there
are some discussions in progress regarding a possible blanket engineer/architect permit for all
window projects. Vice-Mayor Castro indicated that Phil Reeves, our Building Official, is
currently working on this matter with Mr. Ralph Viviano, Chikee Brandimarte and other condo
representatives.

Mayor McElyea commented that a man running for Commissioner is telling people that he has
no interest in a certain area of the City. He said he should speak for himself instead of talking
about him or any other candidates.

There were no appointments at this meeting.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted he distributed a hard copy of the Oasis program to the Commission
and a presentation will be made at the next Commission meeting. He added that the project
information is displayed in the Atrium at City Hall for the benefit of our residents.
City Manager Baldwin advised, on behalf of George Jason, that the correct cost to mail an
absentee ballot is $1.22, otherwise it will be returned to the sender.

citizen comments' period shall begin promptly at 7:30 PM. Each speaker shall be limited to 3 minutes for his or her comments.

meeting of their intention to speak. If more than 10 speakers express a desire to speak, the Commission shall determine on a
meeting by meeting basis whether to (a) extend the time allotted for citizen comments to accommodate all speakers, or (b)
whether to limit the number of speakers or amount of time per speaker. A speaker's time shall not be transferable to another
speaker.
