MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, NOVEMBER 9, 2010 — 7:00 P.M. 1. Call to Order/Roll Call Mayor McElyea called the meeting to order at 7:00 p.m. Present: Mayor: C. K. "Mac"McElyea Vice-Mayor: Anne Castro Commissioners: Bob Anton Walter Duke Bobbie Grace City Manager: Robert Baldwin City Attorney:: Thomas Ansbro City Clerk: Louise Stilson 2. Invocation and Pledge of Allegiance Pastor Robert Sands, Griffin Road Baptist Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Presentation by Marlowe & Company Howard Marlowe, Marlowe & Company, noted that for twenty-six years they have provided effective representation in Washington, D.C. for government entities and non-profit groups from across the country. He said it is important for them to visit Dania Beach in order to get more acquainted with what is going on in the City. Michael Willis, Marlowe & Company, noted that all of our projects have been approved; however, we are still waiting for a federal budget which has not yet been finalized. He indicated they are looking at new projects for next year, particularly the bridge replacement project. 3.2 Special Event request by the Miami Dolphins Foundation for a Cycling Challenge, to be held on Saturday,November 20, 2010 at Frost Park from 8:00 a.m. - 11:00 a.m. Vice-Mayor Castro motioned to approve the Special Event request for the Miami Dolphins Foundation Cycling Challenge; seconded by Commissioner Grace. The motion carried unanimously. i 3.3 Special Event request for the 51h Annual Dania Beach Vintage Motorcycle Show, to be held on Saturday, January 29, 2011 from 11:00 a.m. —5:00 p.m. at Frost Park. The applicant is also requesting a donation of$8,600.00, and a fee waiver for the Special Event application. Commissioner Duke noted this is one of the best events in town and we should support it. Clare Frost, representing the event, noted they are asking for money because they want to do some major advertising this year as well as adding a live band. She provided a brief summary of the proposed program. City Manager Baldwin noted there is a discussion item on tonight's agenda regarding donations. PP P q Commissioner Grace motioned to approve the Special Event request for the 5th Annual Dania Beach Vintage Motorcycle Show, to provide the amount of $8 600.00 and to waive Y � the application fee; seconded by Vice-Mayor Castro. Vice-Mayor Castro noted there may be funds available in the CRA Fund. She would also like to see more sponsorship for fundraising. The motion carried unanimously. 3.4 Fee Waiver request for use of the I. T. Parker Community Center by Royalty Inc. on December 18, 2010, as recommended by the Parks, Recreation and Community Affairs Advisory Board on October 19, 2010 Kurt Ely, Chairman, Parks, Recreation and Community Affairs Advisory Board, introduced representatives of Royalty, Inc. Jabrina Thompson, founder, explained Royalty, Inc. is a non-profit organization to help girls in our community between the ages of 10-18 years. Their goal is to guide and lead young girls in the right direction. She advised they will also be having a Toy Drive during the holidays and provided information on how to make donations and obtain tickets. Commissioner Grace motioned to approve the Fee Waiver request for use of the I. T. Parker Community Center by Royalty Inc.; seconded by Vice-Mayor Castro. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 6. Public Safety Reports Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Donn Peterson, BSO Chief of Police, reminded everyone to change the batteries in their smoke detectors. He was available to answer questions. Commissioner Grace noted she had an incident and she called the sergeant on duty and the voice message said the mailbox was full. She stated that in cases like this, she needs an alternate number. Commissioner Grace further commented that she had to endure the noise for two hours until a police officer responded. Chief Peterson encouraged Commissioner Grace and the residents to call him if they ever have problems. 5. Citizen Comments Jay Field, 4501 SW 30th Way, commented on the Broward County Commission meeting held today. He noted that we need to start communicating with the people in our neighborhoods. Mr. Field advised that the Airport Advisory Board will soon be holding a special meeting and some recommendations will be presented to the Commission. We need to examine how we are moving forward before the Broward County Aviation Department starts circulating their surveys. He thanked the Commissioners for showing their support at the County Commission meeting today. Bob Mikes, 601 NW 7th Street, commented that Kent George, Broward County Aviation Director, is a clever fellow and we need to be ready to take him on. He noted that Mr. George does not give straight answers to the Broward County Commission. Mr. Mikes stated that the City needs to retain a specialist. Commissioner Anton noted we have a consultant available, and we will bring him on board if necessary. Mr. Mikes noted that he thinks the Interlocal Agreement was good 15 years ago. He stated that they are afraid of the language in the Agreement Mr. Mikes indicated that the item was deferred until the fourth Tuesday in January, 2011. He suggested the Commission should have a workshop in preparation for the County Commission meeting. Vice-Mayor Castro noted that we need to educate our residents and make them understand that this is actually happening and that it is time to take action. She also stated that Mr. George once told her that he would never recommend anything to the Board of County Commissioners that would involve any compensation that the Federal Aviation Administration (FAA) was not funding. Vice-Mayor Castro thanked Mr. Mikes and Mr. Field for their services to the citizens of Dania Beach. Commissioner Grace noted she will be changing her appointments to the Airport Advisory Board tonight. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Mr. Mikes stated that Mr. George was not being credible to the audience and the media in attendance at the County Commission meeting. Rae Sandler, 810 NW 7th Avenue, Melaleuca Gardens, thanked Bob Anton and Anne Castro for speaking at the County Commission meeting on behalf of the residents of Dania Beach. She also thanked Brenda Chalifour for her continuous help. Mark LaRocca, 4511 SW 34th Avenue, noted he attended the County Commission meeting today. He thought Kent George was misrepresenting the County Commission. Mr. LaRocca requested a professional and the necessary resources to get the information we need. Betty Sokol, 609 NW 1 oth Street, noted there are people hot-topping driveways in the area without permits. She said that the property owner at 817 NW 1 oth Street gave them a check for $100.00 for doing the job. Ms. Sokol indicated that she and other members of the COPS program advised the property owner to cancel the check. Linda Sacco, 4481 SE 38th Terrace, thanked BSO for taking steps to have juveniles integrated into the Criminal Justice Programs. She noted that today's County Commission meeting was intense. Ms. Sacco thanked Anne Castro for defending the credentials of the people who spoke at the meeting. She also thanked Bob Anton for his rebuttal to Kent George about communication issues. Lastly, Ms. Sacco noted that Commissioner Duke and Commissioner Grace should speak up at the next County meeting. Clare Vickery, 49 N. Federal Highway, commented the Enterprise Zone was approved last month. She noted that the children's exhibit in the Atrium at City Hall comes from her gallery, and there will be more at the Arts and Antique Festival in January, 2011. Ms. Vickery said she hoped it would not be necessary to receive public funds this year. Victoria Payne, Executive Director, Chamber of Commerce, 102 W. Dania Beach Boulevard, provided an update of Chamber events. She asked the City to consider keeping the current bus stop when the Library opens. Patty Hart, 517 NE 2nd Place, spoke for Jackie Long, daughter of Harold Davis, who requested a street co-designation for SW 6th Street at the September 14, 2010 Commission meeting. She noted that the advertising will cost approximately $1,000.00, and they do not have the money. Ms. Hart indicated that there are 13 homes on that street and they all signed the petition. She requested the fees be waived for the co-designation. Chickie Brandimarte, 101 SE 3rd Avenue, #604A, addressed the code violations at Meadowbrook Condominium. She questioned why people who bought their units 20 years ago are being fined. The code has changed since then, and the City needs to work with the people and show some compassion. Ms. Brandimarte asked the Commission to make it clear to the Meadowbrook residents that the City is not out to get them. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Commissioner Grace noted this was her agenda item tonight. She agreed with Ms. Brandimarte and remarked that we do need to show compassion to the residents. Commissioner Grace directed the City Manager to find a solution for the residents of Meadowbrook. City Manager Baldwin responded we will do what we can. Commissioner Duke noted this was discussed at the last meeting, and we all concur with Commissioner Grace. He indicated that the Hold Harmless suggested by Commissioner Grace may be a good idea. Commissioner Anton noted he checked with Code Compliance before the last meeting. He said the concern is what happens if a major storm comes through and the windows may not be safe. Commissioner Anton explained that the Code Compliance Unit has been working with the residents and contractors to fix the situation. He cautioned to tread lightly on this issue. Commissioner Anton asked the City Manager to work with Code and come back with a plan for the people in Meadowbrook. He wants everyone to understand that we are not picking on anyone, but that we are trying to do what we are responsible for doing. Ralph Viviano, 131 SE 3rd Avenue, Meadowbrook, said they are not afraid of code enforcement, but they need to let people know what the codes are and how they work. He said people are warned when they purchase the units to check with the City for permits before doing any work. Mr. Viviano said the Permit Department is not always responsive. Vice-Mayor Castro noted we need .to do a better job of communicating. She indicated that we should have a Code Compliance representative do a walk-through at the units and explain the process to the residents. Vice-Mayor Castro pointed out that the real issue is cost; we need to get creative for everyone's benefit. She added that the ultimate solution is safety. 7. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 37th Year Community Development Block Grant(CDBG) Program Colin Donnelly,Assistant City Manager, provided a PowerPoint overview of the program, which was included in the agenda packet. He noted the application is due to Broward County at the beginning of December, 2010. Commissioner Duke commented this matter was discussed at the last CRA meeting and the Board unanimously agreed that this should be integrated into the CRA Federal Highway project. Mayor McElyea opened the Public Hearing. Manny Jeffers, 4405 SW 35th Avenue, noted his street has been torn up more than once and he thought this was a waste of time and money. Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the Public Hearing. Commissioner Anton motioned to move forward with the project; seconded by Commissioner Grace. He asked the Commission to disclose any communication they had on these matters. 9.2 RESOLUTION#2010-188 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY JOAN LETO, TRUSTEE FOR THE PROPERTY OWNER JOAN LETO TRUST Minutes of Regular Meeting Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. FOR A SECOND EXTENSION TO THE APPROVED SITE PLAN (SP-41-08) GRANTED BY RESOLUTION 2008-190; VARIANCE (VA-43-08) BY RESOLUTION 2008-189 AND FLEX ALLOCATION (LUF-42-08) BY RESOLUTION 2008-188 ON OCTOBER 14, 2008, FOR PROPERTY LOCATED ON THE NORTH SIDE OF STIRLING ROAD APPROXIMATELY 1/4 MILE NORTHWEST OF THE I-95/STIRLING ROAD EXIT ON SW 19TH COURT, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2010-188. Kristin Dion, City Planner, noted this is the second extension request for a previously approved assignment of flex, variances and site plan for the construction of a 130-room hotel. She provided a brief summary of the project and added that the applicant asked for a two year extension. Staff recommends a one year extension with the condition that the code violations are cleared within three months of the date of the approval. Mayor McElyea opened the Public Hearing. Seeing as there was no one to speak in favor or opposition,he closed the Public Hearing. Commissioner Anton motioned to adopt Resolution #2010-188, with staff recommendations; seconded by Commissioner Duke. The motion carried unanimously. 9.3 RESOLUTION#2010-189 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST MADE BY JON M. GRANT OF GRANT VENTURES DANIA CONDOS LLC, FOR AN EXTENSION TO THE APPROVED SITE PLAN (SP-30-09) AND FLEX ALLOCATION (LUF-33-09) GRANTED BY RESOLUTION 2009-203 AND VARIANCE (VA-32-09) BY RESOLUTION 2009-202 APPROVED ON OCTOBER 27, 2009, FOR PROPERTY LOCATED AT 4638 SW 32ND AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2010-189. Kristin Dion, City Planner, noted the request is for a two year extension of the previously approved flex allocation, variances and site plan for the construction of a 20-unit apartment building. The applicant stated that he would need more time to obtain financing and that he is currently seeking investor partnerships as an alternative solution. She indicated that staff recommends approval of the requested extension. Mayor McElyea opened the Public Hearing. Discussion and Possible Action 10.1 Oasis Proj ect City Manager Baldwin provided a brief history of the project which is designed to reduce crime through creation of environmental improvements in neighborhoods. He indicated that the residents are enthusiastic about the project. The Commission agreed to locate the program in the area of SW 3rd Avenue from Dixie Highway to Sheridan Street. City Manager Baldwin thanked g Y Y g Fred Bloetscher, Public Utility Management and Planning Services, Inc. (PUMPS), and his FAU students that worked on the project. This is an inexpensive project that will have a long term effect on the neighborhood. He advised that the estimated cost of construction is $180,000.00, which will be paid through CPTED funding. City Manager Baldwin recommended approval of the project. Commissioner Grace noted that the Northwest Byrd Pointe Association would like the program to be implemented in their area. City Manager Baldwin advised that if the Commission finds the project to be effective, it could be applied citywide. Commissioner Duke motioned to move forward with the Oasis Program; seconded by Commissioner Grace. Vice-Mayor Castro commented that College Gardens is a very difficult area which needs to be considered. She stated that we need to stick with that neighborhood and finish it before moving into another area. The motion carried on the following 5-0 Roll Call vote: r Commissioner Anton Yes Vice-Mayor Castro Yes Commissioner Duke Yes Mayor McElyea Yes Commissioner Grace Yes 10.2 Charitable Donations City Manager Baldwin indicated that last year the Commission rejected staff s policy recommendations and we are now looking for direction from the Commission. He pointed out that we have more requests for donations than the Commission budgeted. City Manager Baldwin advised that the total requests are over $80,000.00 and the budgeted amount is $28,500.00. He noted that we have a small Contingency Fund this year. City Manager Baldwin stated that we are hoping to see some improvement in our budget situation this year. Commissioner Grace noted that we should leave $10,000.00 for the Area Agency on Aging. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Commissioner Anton noted we need a procedure because we hand out taxpayer money like candy. He stated that people need to apply for donations and if there are additional requests, they need to be on the agenda. Commissioner Anton would like to see a draft policy before we make a decision on what organizations we are supporting. Vice-Mayor Castro noted the motorcycle club should not be considered as a charitable donation, it should come from the Economic Development Fund. She further indicated that charitable organizations should benefit the entire City, not just local areas. We should have an application process, with a resolution format for donations and an explanation. Commissioner Duke advised that he met with a representative from Family Central and they do a lot for the community. He noted that the Arts and Antique is economic development. Commissioner Duke further commented that the Broward Children's Center does not meet the criteria for donations. Vice-Mayor Castro noted that we need information before making decisions. City Manager Baldwin noted he will bring a policy forward for Commission consideration. Addendum 10.3 Discussion of Code enforcement actions at Meadowbrook—Commissioner Grace This item was discussed under Citizen Comments. 11. Commission Comments 11.1 Commissioner Anton Commissioner Anton requested a consensus from the Commission before bringing a consultant on-board for the Airport issue. We are under a time constraint to get this done because January 25, 2011 is the next County Commission meeting when the Airport will be discussed. It was the consensus of the Commission to make the necessary arrangements to bring a consultant on board who can advise the Commission on the best course of action. Commissioner Anton advised that at the November 16, 2010 County Commission meeting, Attorney Debbie Orshefsky is approaching the Commission to purchase the Atlantic Village Marina property which is currently in foreclosure. He noted that the 2010 taxes for that property are over $100,000.00, and we should receive 25% of that amount. Commissioner Anton remarked that the County will buy these properties and we do not know when they will be put back on the tax roll. He suggested we look at this matter and have someone attend the County Commission meeting so we can address this issue. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Commissioner Anton complimented the people who attended the County Commission meeting today. He noted that four of the Commissioners were present at the meeting; the Mayor could not be there because he was sick. 11.2 Commissioner Duke Commissioner Duke followed up on the properties coming off the tax roll, and stated they will not come back. Commissioner Duke further commented that in addition to keep fighting the south runway expansion, we need to continue with our redevelopment plans and promote tourism and our marine industry. Commissioner Duke noted that City Manager Baldwin is making progress with BSO regarding Fire Rescue negotiations. Commissioner Duke noted that Assistant City Manager Donnelly reported there may be some grant funding available for beach renovations. Commissioner Duke noted that the CRA Board is the City Commission and they recently approved neighborhood improvements throughout the City. 11.3 Commissioner Grace Commissioner Grace noted she also spoke to Assistant City Manager Donnelly regarding grant opportunities for the beach. Commissioner Grace advised that CRA Executive Director Earle will be doing presentations at all civic associations next week. He will explain the funds to be allocated to each neighborhood and follow the recommendations of the board members representing each community. Commissioner Grace noted she wants to make some changes to her appointments on the Airport Advisory Board. The new appointees are: Shaun Koby to replace Boisey Waiters, Jr., and David Clark to replace Jimmy Crimminger. Commissioner Grace noted she has the petition for street closure from Tammie James. She handed the petition to the City Manager. City Manager Baldwin noted we will close the street without the petition. 11.4 Vice-Mayor Castro Vice-Mayor Castro noted that there is a solar light out on 101h Avenue that needs to be checked. Vice-Mayor Castro thanked Jaxson's Ice Cream Parlor for sponsoring the USS Jason Dunham which is currently in town. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. Vice-Mayor Castro noted she would like to have the CRA meetings televised. She asked staff to look into the matter. Vice-Mayor Castro noted that Westrec Marinas is doing a great job at cleaning the Marina. She advised that the signs are an issue and that she has discussed the matter with the City Manager. Vice-Mayor Castro spoke about today's Airport meeting at the County. She noted nobody has thanked Rae Sandler who is doing a great job. Vice-Mayor Castro also commended Chris Johnston, a pilot who spoke at the Commission meeting today and was criticized by the County Commission. She thanked everyone involved in this important issue that would impact the entire City. 11.5 Mayor McElyea Mayor McElyea asked Anna Gispert, Dismas Charities, to come to the podium. Anna Gispert and Cathy Bellew, Dismas Charities, invited everyone to visit their facility. Mayor McElyea noted he attended the Florida Power and Light (FPL) awards for Occupational Health and Safety Administration(OSHA). 12. Appointments Commissioner Grace made two appointments to the Airport Advisory Board under her comments. Vice-Mayor Castro motioned to approve the appointments; seconded by Commissioner Anton. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted that the trees requested by Bob Mikes at the October 26, 2010, Commission meeting were installed in the NW 7 h Street area in Melaleuca Gardens. City Manager Baldwin noted that he is going to work with Public Services Director Orlando to have bollards and chains installed at the end of Tammie James' street. City Manager Baldwin noted that there will be a City team participating in the Relay for Life headed by Dominic Orlando, Director of Public Services and Joe Fernandez, Fire Chief. City Manager Baldwin advised that he will be meeting with BSO tomorrow regarding the. Fire Department issues. Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,November 9,2010—7:00 p.m. 13.2 City Attorney City Attorney Ansbro noted he received a new engagement letter from Neal McAliley, White and Case, to account for the legal fees related to the current litigation at the circuit court. He advised this is the same retainer agreement as before with a break down of costs. City Attorney Ansbro requested consensus to execute the letter. (General Information) Acronym of R.O.Y.A.L.T.Y. R.O.Y.A.L.T.Y is the acronym for Recognizing Our Youth's Ability to Lead Throughout Their Years. Description of R.O.Y.A.L.T.Y. It is anon-profit mentoring organization for girls between the ages of 10-18. Our goal is to mold young girls into respectable educated young ladies through enrichment activities in leadership, education, self-awareness, and community service. • The ability to have one-to-one relationships with mentors and professional support in a group setting will help R.O.Y.A.L.T.Y. girls reach their full potential. The Division's activity is currently in its final phase, which is focused on Meadowbrook Lakes Condominiums South. The initiative started when Code Compliance responded to a written complaint on work being done without permits on several units. The offending party then pointed out a number of other properties that had done work without permits and Code Compliance was obliged to follow up on those complaints. In the spirit of fairness and to remove any perception of selective enforcement, it was the Code Compliance Manager's decision to inspect each unit in all buildings for work that had been done relating to windows, doors, patio enclosures and shutters. This resulted in a large number of Notices of Violation for work done without permit, some of which posed serious property and/or life safety issues. Since this issue began Code Compliance has worked hard to keep the level of communication high through contact with the building association presidents. Both the Code Compliance and Building Divisions have made every effort to ensure that the permit and regulatory costs were kept to a minimum. While individual circumstances vary, as a rule there have been no penalties (such as double permit fees), and time extensions have been routinely granted. City's Approach to Achieving Compliance The violations being addressed at Meadowbrook Condominiums are primarily related to the Florida Building Code, or in the case of longer standing violations, the South Florida Building Code. These codes establish minimum standards primarily for public health and life safety, and secondarily for protection of property as appropriate. As such, there are no exemptions to, or waivers for past infractions. This means that if violations of the building code exist, it is the responsibility of the owner to have them corrected, without regard to who created the violation or when it originallyoccurred. The Code Compliance P and Building Divisions are aware that some of the code violations being addressed occurred without the owners' knowledge. In some cases it has been determined that owners paid contractors for permit costs and that permits were never obtained by the contractors. Several actions are taking place to ensure the most efficient and painless processing possible for Meadowbrook homeowners. 1. As stated above, the City has made a policy of not assessing penalties and allowing for time extensions, where necessary. Building Division has reviewed its records and discovered two cases that occurred early in the process which received a double-fee penalty. Reimbursements are being prepared for those cases, and if more cases are discovered they will be reimbursed. 2. Building Division inspections utilize the code that was in effect when the work was done, i.e., older cases are not being required to meet current building code standards if the work was done under a previously effective building code. 3. Building Division is inspecting properties and when possible, is making allowances for work as-is or with minor corrections. 4. Building and Code Divisions are working with the Broward County Urban Planning and Redevelopment Department's Contractor Licensing and Enforcement Division to identify and contact those contractors who charged homeowners for permits but did not obtain them from the City. These contractors will be required to pay for the permits in question or will be reported to the Florida Department of Professional Regulation. 5. As most cases involve improvements that are similar (window and door replacement, storm shutters, enclosures), engineering requirements are also similar. The Building Division is utilizing standard engineering drawings and specifications and accepting Hold Harmless Indemnification agreements from individual property owners in lieu of requiring each individual homeowner to provide engineering drawings and specifications. 6. The City does not recommend contractors for any type of work. In the case of Meadowbrook Condominiums, the building association presidents are aware of contractors that have been working to help correct violations. Owners are encouraged to coordinate with their association for information on contractors. Staff will continue to assist in resolution of the code issues at Meadowbrook Condominiums in a manner that is sensitive to the homeowners' individual circumstances.
