HomeMy WebLinkAboutO-2010-025 Amend Land Development Code, Establish the IROM-AA Zoning District ORDINANCE NO. 2010-025 AN ORDINANCE OF THE CITY OF DANIA BEACH FLORIDA TO AMEND THE LAND DEVELOPMENT CODE BY AMENDING ARTICLE 100 "GENERAL USE REGULATIONS APPLYING TO ALL ZONING DISTRICTS" TO ESTABLISH THE IROM-AA ZONING DISTRICT; AMENDING ARTICLE 115 "INDUSTRIAL DISTRICTS: PERMITTED, PROHIBITED, SPECIAL EXCEPTION USES, AND CONDITIONS OF USE" REGARDING PERMITTED USES AND CONDITIONS OF USES, AMENDING ARTICLE 205 "TABULAR SUMMARY OF SITE DEVELOPMENT STANDARDS FOR ALL ZONING DISTRICTS" REGARDING SITE DEVELOPMENT STANDARDS, AMENDING ARTICLE 315 "HOTEL OVERLAY DISTRICT" REGARDING SIGN REGULATIONS AND REGULATIONS OF ESTABLISHMENTS SERVING ALCOHOL ON- PREMISES, AMENDING ARTICLE 505 "SIGN REGULATIONS" REGARDING PERMITTED SIGN TYPES AND REGULATIONS, AMENDING ARTICLE 610 "PUBLIC HEARING NOTICES" TO AMEND CERTAIN NOTICE PROCEDURES AMENDING ARTICLE 710 "NONCONFORMING USES, STRUCTURES, AND LOTS" TO IMPLEMENT THE IROM-AA ZONING DISTRICT, AMENDING ARTICLE 725 "DEFINITIONS" TO IMPLEMENT THE IROM-AA ZONING DISTRICT; AMENDING ARTICLE 835 "TELECOMMUNICATION TOWERS AND ANTENNAS" TO IMPLEMENT THE IROM-AA ZONING DISTRICT; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP OF THE CITY TO REZONE APPROXIMATELY 262 ACRES GENERALLY LOCATED WEST OF INTERSTATE 95 BETWEEN GRIFFIN ROAD AND NORTH OF STATE ROAD 84, AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach ("City Commission") finds it periodically necessary to amend its Code of Ordinances ("Code") in order to update regulations and procedures to implement municipal goals and objectives; and WHEREAS, Article VII, Section 2 of the Florida Constitution, and Chapter 166, Florida Statutes, provide municipalities the authority to exercise any power for municipal purposes, except where prohibited by law, and to adopt ordinances in furtherance thereof; and WHEREAS, Objective V of the Future Land Use Element of the City of Dania Beach Comprehensive Plan provides that the City of Dania Beach will maintain land development regulations and zoning regulations to implement the City's Comprehensive Plan; and 1 ORDINANCE#2010-025 WHEREAS, on September 14, 2010, the City Commission adopted a comprehensive amendment to the City's land development regulations known as "OneCode", to unify the City's regulations of zoning and land development into a single Land Development Code; and WHEREAS, in implementing the new Land Development Code, City Community Development Department staff identified inaccuracies and vague, imprecise or ambiguous language, and desires to adopt clarifications and corrections to improve the Land Development Code; and WHEREAS, on June 8, 2010, prior to adoption of OneCode, the City Commission instructed Community Development Department staff to review the current Industrial, Research, Office, Marine (IROM) zoning district and bring back amendments to allow certain additional outdoor uses; and WHEREAS, following analysis of the IROM zoning district regulations, Community Development Department staff proposes to adopt and apply a new zoning district, the Industrial Research, Office, Marine Airport Approach (IROM-AA) zoning district, for the properties currently designated under IROM zoning and generally located west of Interstate 95 between Griffin Road and north of State Road 84; and WHEREAS, the proposed IROM-AA zoning district would allow existing businesses to expand beyond the current range of uses allowed, which has been determined by Community Development Department staff to be consistent with the goals for development and economic growth of this area, and to implement the City's adopted Westside Master Plan; and WHEREAS, the City Commission further finds that, in conjunction with the adoption of the IROM-AA zoning district, it is necessary to adopt an amendment to the official zoning map of the City in order to reflect the creation and application of this new district, as described in Exhibit"A" and Exhibit"B"; and WHEREAS, Sec. 505-140 "Special signage regulations by location or type of use" of the Land Development Code currently provides for specialized signage provisions for shopping centers, hotels, office complexes and industrial complexes of eighty thousand (80,000) or more square feet of fully enclosed area under roof, located within one thousand (1,000) feet of Interstate 95 or Interstate 595; and WHEREAS, the City Commission finds that the additional sign types available to these properties are provided in recognition of the unique configurations of parcels abutting Interstate 2 ORDINANCE#2010-025 95 or Interstate 595, which restrict the usage of attached or monument identification signage, and which limit the visibility of permitted sign types from the adjacent elevated interstate highways; and WHEREAS, in further recognition of the unique conditions affecting the properties abutting Interstate 95 and Interstate 595, the City Commission desires to provide for usage of "digital signs" for properties subject to Section 505-140 of the Code and the Hotel Overlay District regulations of Section 315-50; and WHEREAS, the use of digital signs shall be consistent with recognized operational and safety standards; and WHEREAS, the Planning and Zoning Board, sitting as the City's Local Planning Agency, has reviewed this Ordinance, and has determined that it is consistent with the City's Comprehensive Plan; and WHEREAS, pursuant to Section 166.041 (c)(2), Florida Statutes, notice has been given by publication in a paper of general circulation in the City, notifying the public of this proposed Ordinance and of the time and dates of the public hearings; and WHEREAS, two (2) public hearings before the City Commission were held pursuant to the published notice described above; and WHEREAS, the City Commission finds that adoption of this Ordinance through its police powers will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the City's Comprehensive Plan. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the preceding "Whereas" clauses are ratified and incorporated as a record of the legislative intent of this Ordinance. Section 2. Uses within shopping centers shall be those of the C-2 Commercial District set forth in sec. 110-20 (list of permitted, special exception and prohibited uses for commercial and mixed-use districts). Applies to the following uses and districts: Retail uses not itemized: IROM, IROC, IROM-AA Personal service establishments: IROM, IROC, IROM-AA 25 Conditions of use: the following uses in the IROC District shall not be located on the site of buildings planned, designed, built, or used for industrial or warehouse use. Sales, service, display or repair of automobiles, motorcycles or trucks. 26 Conditions of use: the sale, rental, leasing, display or repair of fully assembled recreational vehicles or new campers is limited to new vehicles only in the IROC District, and in the IROM District, and IROM-AA district such use is limited to well-maintained FDOT-ready, vehicles in a front, street, side, or rear yard if separated from the adjacent roadways or rights-of- way by landscaping pursuant to the requirements of this Land Development Code. 30 Conditions of use: must be located on the same site as a shopping center containing in excess of one hundred thousand (100,000)square feet of gross floor area. Applies to the following uses and districts: Sales, service, display, repair, or any combination of these, of automobiles, motorcycles or trucks: IROC 33 Conditions of use: the uses listed below are permitted on those properties identified as plats 3, 7, and 8 in the interlocal agreement between Broward County and the City of Dania Beach pertaining to expansion and jurisdiction of Fort Lauderdale-Hollywood International Airport, executed by the City of Dania Beach on October 17, 1995 and by Broward County on September 12, 1995. Applies to the following uses and districts: Airport-related and airport-compatible uses: IROM, IROM-AA Automobile rental car agency: IROM, IROM-AA Passenger terminal: IROM, IROM-AA 34 Conditions of use: airport related and airport compatible uses shall include, but not be limited to, rental car facilities and storage lots, long-term passenger parking facilities, employee parking facilities, airline in-flight services, air cargo services, specialized aircraft and ground transportation equipment repair and maintenance excluding aircraft testing, and aviation-oriented training facilities. Applies to the following uses and districts: Airport-related and airport-compatible uses: IROM, IROM-AA 35 Conditions of use: the uses listed below are permitted in the IG District on parcels abutting the Dania Cut-Off Canal and Port Everglades, not including easements and rights-of-way,with a required set back at least five hundred (500)feet from any residential zoning district, and a required opaque fence{eight(8)to ten (10)feet in height adjacent to any public street. Applies to the following uses in the lG District: a. Marine cargo handling facilities b. Parking for vehicles and equipment c. Outdoor storage of materials, supplies, machinery, equipment, vehicles, trailers, cargo shipping equipment(i.e. flat racks, chassis, and containers), or products being processed in or transported through the property. d. Shipping and storage containers in ship yards or cargo port facilities may be stacked four(4) high not to exceed forty(40)feet as an accessory use. Outdoor activities and operations shall be permitted only between the hours from 8:00 a.m. to 10:00 p.m. During named hurricanes or tropical storms, no storage containers shall be stacked. e. Fuel tanks for fueling of vehicles and ships as an accessory use and as regulated and permitted by the applicable Broward County environmental agency. f. Security gatehouses, as an accessory use, including manufactured modular buildings,when setback at least one hundred (100)feet from NE 7th Avenue or Taylor Lane and complying with any applicable building code requirements, subject to the approval of the Broward Sheriffs Office and the Dania Beach Fire Department. g. When located on property no larger than three(3) net acres, having frontage on Taylor Lane and N.E. 7th Avenue,with access limited to NE 7th Avenue, the following are permitted: (1) Outdoor storage of materials, supplies, machinery, equipment, vehicles, trailers, and cargo shipping equipment(i.e. flat racks, chassis, and containers)or products being processed in or transported through the property. (2) Outdoor storage of cargo containers not to exceed two(2) stacks and sixteen (16)feet in height(no storage containers may be stacked during named hurricanes or tropical storms) 14 ORDINANCE#2010-025 36 Conditions of use: the uses listed below are permitted in the IG District on lots generally located along the Dania Cut-Off Canal from the east end of the city limits,west one hundred eighty(180) feet past the end of Taylor Lane, south of Taylor Lane to the north bank of the Dania Cut-Off Canal, and more specifically described as Parcel A and Parcel B of Transworld Plat, Powell Brothers Barge Terminal Plat, Derecktor's South Plat and Port Laudania Plat, less the east three hundred thirty-three(333)feet of the South seven hundred forty-three and eight-two hundreths(743.82)feet and Dania Canal, not including easements and rights of way, and unless otherwise stated below, set back a minimum of one hundred (100)feet from any residential zoning district. If there is any conflict between the provisions of this subsection and any other provision of this code, the provisions of this subsection will prevail. Uses permitted in the IG District within the location described above:: a. Manufacturing, painting and repair of boats in excess of 200 feet in length, associated assembly, fabrication, outfitting and maintenance, marine construction and equipment loading and handling operations b. Retail sales of material and supplies for construction and repair of vessels. c. Warehousing of materials, supplies, cargo and equipment related to shipyards, boatyards and marine construction businesses. d. Outdoor storage of materials, supplies, cargo, equipment, machinery, staging, vehicles, vessels, trailers ladders and other associated items related to shipyard, boatyard and marine PY Y construction. e. Storage containers required for storage of shipyard/boatyard materials, vessel supplies, carg o, and construction tools and materials. Storage containers shall not exceed fifty(50)containers per property.The containers shall not be stacked or used as ship building or repair work shops, and shall be set back a minimum of twenty-five(25)feet from Taylor Lane and at least twenty- five(25)feet from the Dania Cut-Off Canal. During named storms, all containers and loose materials shall be secured. f. One(1)office trailer not to exceed one thousand (1,000)square feet, set back a minimum of thirty-five(35)feet from Taylor Lane. The trailer shall be properly secured. g. Fuel tanks, including mobile fueling from fuel trucks or fuel barges,for fueling of vehicles and ships as an accessory use and as regulated and permitted by the State of Florida Department of Environmental Protection and Broward County's environmental protection agency. h. For those properties located along and with access to Taylor Lane, including those properties on the north side of Taylor Lane, parking of vehicles on hard surface or good rolled, crushed rock base, as an accessory use. i. Security gatehouse, including manufactured modular buildings, complying with applicable building code requirements, as an accessory use,when approved by the Broward Sheriffs Office,the city fire department, and the city public services director. j. Shipbuilding and repair. k. The following shipping, marine transportation and barge operation uses are recognized by the city as special uses for those certain properties as described above, and they shall be permitted for up to one hundred twenty(120) days in any calendar year, subject to the following conditions: (1) Prior written approval by the city manager and the community development director is required, if the length of time any one(1) use will be in operation will exceed fourteen (14) days. (2) For uses, excluding barges,which will be in operation for fourteen (14)days or less,written notice shall be provided to the community development department indicating the location and duration of the operation. (3) Prior written approval for barges shall be required regardless of duration. (4) Barges shall not exceed one hundred ninety(190)feet in length. (5) No more than two(2) barges are permitted at any one (1)time within the confines of the area described above. (6) The city commission may grant waivers of the above conditions based upon an applicant's demonstration of unique circumstances, practical hardship, or both, that are not generally applicable to other such uses. 15 ORDINANCE#2010-025 37 Conditions of use: outdoor assembly and repair of boats shall not be located within a required yard abutting a street, and shall not be located within one hundred (100)feet of any limited access Trafficway. Storage of weapons and ammunition generally associated with U.S. Border Patrol operations, not to exceed five hundred (500)square feet in floor area. h. Communications towers up to ninety(90)feet in height, subject to FAA requirements. 62 Reserved. 63 Conditions of use: fast food restaurants in the IROM, IROM-AA and IROC districts must be physically attached by a common wall to a shopping center containing in excess of fifty thousand (50,000)square feet of gross floor area, with no drive-in or drive-through facility. 64 Conditions of use:fish smoking, curing and canning in the IROC District is permitted only incidental and accessory to a restaurant. 65 Conditions of use:the following uses must be clearly incidental and accessory to an established marina. Applies to the following uses and districts: Fuel tanks for fueling of vehicles and ships, including retail sales of fuel: IROM, IR, PEDD, MA-1, IG, IROM-AA 18 ORDINANCE 92010-025 67 Conditions of use: permitted college and specialty schools in the PEDD District are business schools, colleges, private schools, and commercial schools(art, music, theatrical, business, technical). 68 Conditions of use:The display of outdoor recreational merchandise shall be accessory to a permitted retail or wholesale use and items permitted within such displays shall be limited to assembled children's play structures including climbing equipment, platforms, slides, swings, and playhouses designed for playground and residential yard use. Outdoor sales displays of fully assembled outdoor recreational merchandise shall be subject to the following standards: a. The display shall be located in a contiguous area which shall not exceed 750 square feet in total display area per licensed business. The total maximum display area shall be calculated by measuring the perimeter of the display area and calculating the square footage within such area. b. The display shall not encroach into parking spaces or aisles, and assembled recreational items within the display shall be set back at least four(4)feet from a property line, sidewalk, or parking lot. c. The items contained within the display shall not exceed twenty(20)feet in height. 69 Conditions of use: showrooms may display furniture, lighting, home furnishings, electrical, mechanical and plumbing equipment, large appliances, carpeting, tile, cabinets, marine equipment, and similar items as determined by the community development director. Applies to the following uses and districts: Wholesale: combined office-showroom-warehouse facilities: [ROM, IROC, IRO, IG, IROM-AA Wholesale: combined office-distribution-warehouse facilities: IRO 70 Conditions of use: fast food restaurants, full-service restaurants,takeout restaurants and catering businesses are permitted in the IG District accessory to a wet marina. 71 Conditions of use: Whenever application is made for a building permit to erect any building or improvement upon any site in the PEDD in which the premises may be or are contemplated to be used for industries or uses involving any processes, substance or mixture of substances which is toxic, corrosive, an irritant, a strong sensitizer, or which generates pressure through decomposition, heat or other means, if such substances or mixture of substances may cause substantial personal injury or substantial illness during, or as a proximate result of, any customary or reasonably foreseeable handling or use, or which is identified as hazardous by state or federal legislation, the use may be approved only by special exception pursuant to the procedures and requirements of article 630. Furthermore, the city commission shall not approve the special exception use until it has received written report by the city and port fire departments and any other governmental agency having jurisdiction. In determining whether to approve such use, the city commission shall consider its compatibility with other uses in the vicinity and the potentially harmful or dangerous effects of such use on persons and property. 72 Conditions of use: hotels shall comply with the following conditions: (1) Guestroom access shall be via interior corridors. (2) Individual wall or window mounted air conditioners(if used)shall not project beyond any exterior wall of the building. Applies to the following uses and districts: Hotels in the IROM, IROC, IRO, PEDD, IROM-AA AND MA-1 Districts. 73 Conditions of use: garage doors not permitted to face public right-of-way. 74 Conditions of use: on-site parking and storage of vehicles shall not be visible from the public right- of-way. 75 Provided the area is secured and screened by a fence or wall with a 10'wide landscape buffer with a continuous hedge and a tree planted every 40 linear feet and is separated from adjacent roadways or right-of-ways by landscaping pursuant to the requirements of Article 275"Landscaping Requirements". 19 ORDINANCE#2010-025 76 Provided the area is secured and screened with a 10'wide landscape buffer with a 5 foot high meandering or winding berm along the front property line and a 3 foot high meandering or winding berm along the side and rear property lines. That Article 315 "Hotel Overlay District" of the City of Dania Beach Land Development Code is amended as follows: Sec. 315-50. Signage. (A) Generally. Signage shall meet all the requirements of article 505, sign regulations, based on the underlying zoning district and use, except as provided in this section. In the event of conflict between this section and article 505, this section shall prevail. (1) In the event a commercial use is designed to front both the hotels and Griffin Road or Stirling Road, article 505 may be applied to allow individual signage on both sides of the commercial building. (B) Shared district monument sign. The properties within the Hotel Overlay District shall provide one (1) shared district monument sign, which shall identify all properties and uses within the designated overlay district subject to the requirements of the underlying sign regulations as modified in this section: (1) The shared district monument sign shall be located on a property adjacent to Griffin Road or Stirling Road, as applicable, and shall be substituted for a monument sign which would otherwise be permitted on that property. This does not preclude the placement of additional signage, identifying the Griffin Road or Stirling Road property only, if additional signage would be otherwise permitted under the sign regulations of article 505. (2) The shared district monument sign shall meet the requirements of sec. 505-140(C) (principal arterial design standards) except that the shared district monument sign is permitted to be seventy-eight(78) square feet in area and eight(8) feet in height. (3) The city commission may approve a larger monument sign than that permitted in this section, if it determines that the additional area is necessary to legibly identify all the shared overlay district uses on the sign. (4) The location, design, and size of the shared district monument sign shall be approved at the time application for the Hotel Overlay District is made. (C) Shared district pole sign. If any property within the Hotel Overlay District is located within one thousand (1,000) feet of Interstate 95, a single pole sign shall be permitted in the district,which pole sign shall be a shared district pole sign. (1) The shared district pole sign shall identify every use within the designated Hotel Overlay District which: 21 ORDINANCE#2010-025 (a) has greater than sixty thousand(60,000) square feet of enclosed area under roof, and (b) has no other existing pole sign identification within the Hotel Overlay District. (2) The shared district pole sign shall not exceed a height of fifty (50) feet or twenty-five (25) feet above the height of the elevation of the abutting interstate highway, whichever is less, and fifty(50) square feet in area per eligible advertised use. (3) No use shall be advertised on more than one (1) pole sign within the overlay district. (4) The city commission may approve a maximum size or height of this pole sign larger than that permitted in this section, if it determines that the additional area or height is necessary to legibly identify all the eligible shared overlay district uses on the sign. (5) No new pole signs-except a single shared district pole sign as permitted above shall be permitted within the overlay district. (6) Legal pole signs existing at the date of designation as a Hotel Overlay District shall become nonconforming signs with regard to the requirements of this overlay district, and shall be subject to the nonconforming sign provisions of sec. 505-180, unless one (1) such sign is modified and utilized as the sole shared pole sign for the overlay district. (7) A shared district pole sign may be a digitalgn in accordance with the requirements of Sec. 505-140 (B). Sec. 315-60. Alcohol Sales. (A) Sec. 110-50 of the Land Development Code, which provides distance separation requirements for alcoholic beverage establishments, shall not apply to establishments located on the premises of a hotel within a Hotel Overlay District. Section 6. That Article 505 "Sign Regulations" of the City of Dania Beach Land Development Code is amended as follows: Sec. 505-10. Definitions. Digital sign. An sign that is capable of displaying words, symbols, figures, or images that can be electronically or mechanically changed by remote or automatic means, excluding any sign or portion of a sign containing only time,temperature or date information. Nit. A unit of illuminative brightness equal to one candle per square meter measured perpendicular to the rays of the source. 22 ORDINANCE#2010-025 Sec. 505-40. Prohibited signs. It shall be unlawful to erect, cause to be erected, maintain or cause to be maintained any sign described as follows: (F) Signs with the optical illusion of movement or change of message by means of a design that presents a pattern capable of giving the illusion of motion, including signs with features which are capable of movement or presentation of a change of message by such means, whether or not actual movement is present. However, this shall not be construed to prohibit a changeable-copy sign +-that is changeable by manual removal or replacement of the sign or its content. The intent of this section is to provide for alternative on-premises sign types for shopping centers, hotels, office complexes and industrial complexes of eighty thousand (80,000) or more square feet of fully enclosed area under roof, located within one thousand (1,000) feet of Interstate 95 or Interstate 595. The additional sign types available to these properties are provided in recognition of the unique configurations of parcels abutting Interstate 95 or Interstate 595, which restrict the usage of attached or monument identification signa e limit the visibility of permitted sign types from the adjacent elevated interstate highwqys. M(ZhPole signs. Notwithstanding any other provision in this code, shopping centers, hotels, office complexes and industrial complexes of eighty thousand (80,000) or more square feet of fully enclosed area under roof, located within one thousand(1,000) feet of Interstate 95 or Interstate 595 shall be allowed to construct one (1) pole sign not exceed fifty (50) feet in height, or twenty-five (25) feet above the elevation of the abutting interstate highway, whichever is less. (a) Sign area shall not exceed forty-eight (48) square feet,provided that pole signs that existed on the date of adoption of this article and that have been legally erected on premises described above, shall be allowed to remain as long as they are not unsafe structures as provided for in the building code. Such signs shall not be expanded, enlarged or remodeled. Ordinary repairs and routine maintenance may be conducted and sign faces may be changed. (b) The sign may indicate only the name and nature of the business. (c) Digital signs are permitted if they abide by the following. 1. The display shall be static. Depictions that give an appearance of movement(such as video, animation,text scrolling, fading, blinking, flashing and racing) are prohibited. 2. Audio and pyrotechnics are prohibited. 3. A minimum interval of 15 seconds of display period per message is required so that a driver only sees one display while passingthe observing the posted speed. 4. A change of message must be accomplished within one second or less. No scrolling, fading, flashing, or other visual effects shall be permitted between messages. 5. The display is required to have an automatic turn-off in case of malfunctions. 6. A minimum spacing of 400 feet from the boundary of any property which is zoned to permit residential use is required. 7. The display shall not exceed a maximum brightness of 5,000 nits during dgyli hg t and 500 nits at night as measured with a meter aimed directly at the sign face at a distance of 100 feet from the display. 8. The message shall be limited to the commercial establishment, merchandise, service or entertainment which is sold,produced, manufactured or furnished at the property on which the sign is located. However,the City of Dania Beach may require emergency messages to be displayed on a digital sign to provide public information concerning natural disasters, severe weather alerts, Amber Alerts, and other emergency situations. Exceptions to limitations on the continuance of nonconforming uses and structures. (I) IROM, IROM-AA and IROC districts; special provisions. In the IROM, IROM-AA and IROC districts, any group of structures designed as a single site or operating as a single site (hereafter called a"project") as of the date that any portion of the structures or uses in the project became nonconforming shall be subject to the following provisions that supersede conflicting provisions of this article. (1) The location of nonconforming uses within structures located in the project may change as long as the total square footage of those respective uses is not increased within the project. (2) If sixty-five (65)percent or less of the gross floor area of the structures within a project is destroyed by casualty or act of God,the nonconforming structure(s)may be restored or reconstructed to the pre-destruction location and configuration so long as the gross floor area of the structure(s) is not increased. If a structure contains multiple spaces, the spaces may be combined so long as such combination does not expand a nonconforming use in a manner inconsistent with paragraph(1), above. Section 9. Height and setback requirements shall be those that are provided in any lease agreed to by the city.
