DANIA BEACH CITY COMMISSION
TUESDAY, NOVEMBER 23, 2010 — 7:00 P.M.
1. Call to Order/Roll Call
Vice-Mayor Castro called the meeting to order at 7:00 p.m.

Commissioner Grace motioned to excuse the absence of Mayor McElyea; seconded by
Commissioner Anton. The motion carried unanimously.
2. Invocation and Pledge of Allegiance
Vice-Mayor Castro gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Airport Advisory Board request for outreach funding
Jay Field, Chairman, Dania Beach Airport Advisory Board, referred to a memorandum
distributed to the Commission which is attached to and incorporated into these minutes. The
document submitted by the Airport Advisory Board is requesting the Commission provide
funding for a bulk mailing to the affected property owners in the amount of $1,500.00 per
mailing.
The Commission unanimously agreed that the City Manager could approve this item with
discretionary funds.
Commissioner Anton suggested the letter be mailed quarterly.
Commissioner Duke noted he does not want Jay Field to exhibit fear mongering in his mail out;
he does not want misinformation, he wants it to be factual. He indicated that the City Manager
and the Commission should have discretionary review of the materials to be published.
Mr. Field noted that his memo stated that the City Manager or Director of Community
Development would review the items.
Commissioner Anton clarified that the entire Airport Advisory Board would contribute to the
newsletter.
Bob Mikes, 601 NW 7th Street, clarified that the Interlocal Agreement provides that the input
should come from the citizens. He noted that the Airport Advisory Board is concerned with the
misrepresentation by the Aviation Department Director. Mr. Mikes remarked that we should not
let the County provide the information to our residents.
Commissioner Grace noted that it is important for our citizens to provide input; however, we also
need a staff member to draft the newsletter and show it to the Commission before mailing. She
thanked her new appointees to the Airport Advisory Board for their participation.
City Manager Baldwin clarified that the cost of the bulk mailing would be approximately
$1,500.00-$1,600.00 per mailing.
Commissioner Anton stated that the newsletter should be done at the discretion of the Airport
Advisory Board and not on a set schedule.
Commissioner Anton advised that on November 15, 2010, the County showed up at the Circuit
Court and noted the Interlocal Agreement is null and void and they do not want to abide by it.
He listed the reasons provided by the County in their statement. Commissioner Anton said that
our residents should make their County Commissioners aware of the comments made by their
attorneys. He indicated that the next calendar call is December 16, 2010 and the trial date could
be as late as April or May, 2011.
Commissioner Duke requested that all members of the Commission be informed when matters
will be discussed.
Vice-Mayor Castro commented on the article written by the Sun-Sentinel regarding the last
County Commission meeting, including the way they characterized the residents.

5. Citizen Comments
Victoria Payne, Executive Director, Chamber of Commerce, 102 W Dania Beach Boulevard,
provided an update of Chamber events.
Rhea Anchors, 401 SE 3rd Terrace, commented on the appearance of the cemetery.
Vice-Mayor Castro advised Ms. Anchors to talk to Public Services Director Orlando who will
address her concerns.
Craig Urbine, 1211 Stirling Road #105, representing property and business owners on Stirling
Road, noted they are trying to form a design district in the area. He thanked City staff that have
worked with them. The merchants do not want to wait for the whole process, and want to start
promoting the area prior to the official designation. Mr. Urbine asked the Commission for their
thoughts and comments.
Commissioner Anton noted.he told Mr. Urbine to come to the Commission before beginning the
designation process. He said he was intrigued by the idea and requested a consensus of the
Commission.
The Commission supported the request.
Alan Levy, 4901 NW 17th Way, Ft. Lauderdale, owner's representative for the Dania Beach
Design and Marine Center on Stirling Road, noted they seek the support of the Commission for
something great for.the City of Dania Beach. He advised that they are beginning to secure
tenants from other countries who want to be in our area. Additionally, they are creating a
merchants' association, and they will sponsor local events.
Pat Rafacz, 610 Trafalgar Court, commented that the first four resolutions on the Consent
Agenda pertain to purchases of equipment for the Fire Department. She noted that we are
currently in negotiation with the Fire Department and there is a possibility that they may go with
Broward County. Ms. Rafacz wondered if it was prudent to spend this money at this time and
suggested we table these items until a decision has been made.
Chickie Brandimarte, 101 SE 3rd Avenue, thanked Vice-Mayor Castro and City Manager
Baldwin as well as Fire Chief Fernandez, for assisting a person who had just been released from
the hospital. She remarked that our Firefighters are second to none. Ms. Brandimarte further
noted that Commissioner Anton provided a Thanksgiving meal for the family.
Commissioner Anton commended Fire Chief Fernandez and his staff for helping someone in
need. He noted that Ms. Brandimarte inspired him, and he hopes this inspires others.
Gregg Pagliarulo, 4641 SW 30th Way, firefighter in Broward County, commented on the items
for the Fire Department. He indicated we are very close to Broward County taking over the Fire
Department, and questioned if we could postpone these purchases because the trucks will be
used throughout all of Broward County.

6. Public Safety Reports
Joe Fernandez, Fire Chief, was available to answer questions.
Donn Peterson, BSO Chief of Police, noted Deputy Louis Batista responded to a burglary at a
business on Old Griffin Road, resulting in the subjects being detained and miscellaneous items
being recovered. He further commented that the next day someone was trying to sell a stolen
gun at Bass Pro Outdoor World and as a result of Deputy Batista's efforts a dangerous person
was apprehended and is now off the streets.

Commissioner Anton noted this was discussed with the Broward County Sheriff.
City Manager Baldwin advised that these items were discussed with the Sheriff and they will
take all the newly purchased items.

Fire Chief Fernandez explained that Item #7.6 relates to the additional materials for the ladder
truck which is offset by the surplus of the other vehicles under Item#7.3. He indicated that Item
#7.4 was part of the CIP; the cost was reduced by $60,000.00 in case we do merge with the
County. Chief Fernandez further referred to Item #7.5 and said that we will still provide
equipment for the Fire Department. He noted these items would replace two vehicles that would
be surplus.
Vice-Mayor Castro confirmed with Chief Fernandez that the Sheriff has agreed to assume the
debt for these items should the merger take place.
City Manager Baldwin noted the Sheriff would assume the debt on the cost of the fire apparatus.
Commissioner Anton motioned to adopt Items 0.347.6; seconded by Commissioner

BLOCK GRANT PROGRAM FOR FISCAL YEAR 2010-2011 IN THE APPROXIMATE AMOUNT OF
$224,253.00, TO PROVIDE FUNDING FOR STORMWATER IMPROVEMENTS IN CENSUS TRACT 804.04

City Attorney Ansbro read the title of Resolution#2010-201.
Commissioner Duke confirmed with Assistant City Manager Donnelly that we are switching
years on the grants.
Colin Donnelly, Assistant City Manager, noted that the City is eligible to apply for grants
through Broward County and we get an allocation of funds based on our population,
demographics and income levels. He further advised that every year the City determines how to
use these funds on a capital project. Assistant City Manager Donnelly indicated that public
hearings are held for our residents to provide input. He said that we will be swapping projects.

RAMP COMPANY FOR THE FROST PARK SKATE PARK PROJECT IN AN AMOUNT NOT TO EXCEED
$48,000.00, PROVIDING FOR CONFLICTS; PROVIDING FOR FUNDING, FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2010-199.
Mark Felicetty, Assistant Director of Parks and Recreation, provided a summary of the bid
process for this project. He noted this is the initial process and that other items will be added
yearly. Assistant Parks and Recreation Director Felicetty advised that the project should start in
January, 2011 and be completed within 90 days.
John Landi, 1432 NW 9th Street, commented the Skate Park done by American Ramp in Tamarac
was fine but not exactly right for the way skaters like them. He noted there needs to be no
breaks. John Landi said he would gladly consult with Parks and Recreation in case they want to
consider any modifications.

City Attorney Ansbro read the title of Ordinance#2010-025.
Corinne Lajoie, Principal City Planner, provided an overview of the amendments proposed

staff both recommend approval.

City Attorney Ansbro read the title of Resolution#2010-191.
Corinne Lajoie, Principal City Planner, noted that the applicant is requesting a variance to allow
a 672 square foot pole digital sign with an overall height of 50 feet. She provided an overview of
the request. Ms. Lajoie indicated that the applicant states that the DCOTA site is unique
compared to other sites within the City, as it is comprised of multiple buildings on approximately
33 acres, with only one access point from Griffin Road. The applicant also claims that the
majority of the visitors are not local and the site's limited visibility and access creates a hardship.
She indicated that among the several conditions required, the messages must be limited to the
establishment, merchandise, service or entertainment which is furnished on the property that the
sign is located. The only exception allowed is for the City of Dania Beach to display emergency
messages to provide public information concerning natural disasters, severe weather alerts,
Amber alerts, and other such emergency situations. Ms. Lajoie noted that staff is recommending
approval of the variance request, noting that the digital sign must comply with the regulations set
forth in the Unified Land Development Code.
Vice-Mayor Castro opened the Public Hearing.
Bill Laystrom, Law Offices of Doumar, Allsworth et al, representing DCOTA, noted the
renovations at the facility.
Commissioner Duke noted the corner property is an eyesore.
Vice-Mayor Castro noted the property belongs to the Florida Department of Transportation
(FDOT).
Attorney Laystrom advised that he is familiar with the property, and added that they will try to
rectify the matter.
Seeing as there was no one else to speak in favor or opposition, Vice-Mayor Castro closed the
Public Hearing.

DANIA BEACH BY BROWARD COUNTY (PROPERTY LOCATED AT 1540 GRIFFIN ROAD,
NORTH SIDE OF GRIFFIN ROAD, EAST OF 1-95 ALONG THE DANIA BEACH CUT-OFF
CANAL);PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
Commissioner Anton spoke about the possible purchase of the Atlantic Village Marina property
by Broward County. He noted that this matter has been postponed by the County until January
261 2011. Commissioner Anton requested the Commission approve the resolution in opposition
to the County taking the property off the tax roll.
Commissioner Duke noted the Commission knew that Mr. Spector would not develop this
property. He stated that he does not think a resolution will help, but he concurred.
Vice-Mayor Castro suggested staff contact the County to find out their intentions with this
property.
Commissioner Duke questioned why the City Attorney is not on top of this issue.
Commissioner Anton noted we have followed up on the three properties west of the Airport
which were supposed to be given back to the City, as stated in the Interlocal Agreement.

Commissioner Grace spoke about the renaming of SW 23rd Terrace in honor of Art Barker,
Habitat for Humanity. She noted that former Mayor Robert Chunn will be writing a letter to
Community Development Director Daniels who will work on naming the street.
Commissioner Grace provided an update on community events.
Commissioner Grace wants CRA Director Earle to utilize funds for parking.
Commissioner Grace thanked people for helping those less fortunate.
Commissioner Grace wished everyone a Happy Thanksgiving.
11.4 Vice-Mayor Castro
Vice-Mayor Castro thanked CRA Director Earle and Public Services Director Orlando for
helping with the signage in the beach/Marina area. She noted that the Florida Department of
Transportation(FDOT) will be a challenge. Vice-Mayor Castro said that Westrec has asked staff
to place signs to advertise the Marina.
Vice-Mayor Castro noted that she is still waiting for staff to provide a master plan for sidewalks
and street lights citywide, including the process and priorities to be followed.
Vice-Mayor Castro noted Community Development Director Daniels is working on an
alternative LAC for the Griffin Road Corridor.
Vice-Mayor Castro noted that Olsen Middle School has been designated as a "Schoolyard
Habitat" by the World Wildlife Federation. She is interested to see if Dania Beach can be
designated as a World Wildlife Conservation city. Vice-Mayor Castro further commented that
several cities in Broward County have already started the application process. She would like to
meet with City Manager Baldwin some time after January, to discuss this issue.
Vice-Mayor Castro asked Assistant City Manager Donnelly for the status on the Street Naming
request for Mr. Davis.
Colin Donnelly, Assistant City Manager, provided an update. He advised that the advertising,
mailing and the cost of the street sign for the co-designation of SW 6d' Street is approximately
$1,300.00, less the $250.00 application fee. Assistant City Manager Donnelly further stated that
the Commission could waive certain requirements.
Commissioner Anton motioned to waive the advertising requirements for both the Harold
Davis and the Habitat for Humanity requests; seconded by Commissioner Grace. The
motion passed unanimously.

surprise. She indicated that Broward County needs to start focusing on this project. Vice-Mayor

runway is not a good idea and there are other options that they could consider that would make
more sense. She pointed out that Enterprise funds do not need to go back to the Airport.
Vice-Mayor Castro noted that Dania Elementary is looking for volunteers.

WE CAN ASK THE RECIPIENTS TO OPT OUT OF MAILING AND SIGN ONTO A
CITY LIST SERVICE WHICH WOULD BE MUCH LESS EXPENSIVE.
AT A RECENT COUNTY COMMISSION MEETING, A SPEAKER FROM DANIA

Areas Evaluated
As described in the Report of the Appraiser,sales of residential property during
2001 and 2002 in a study area of approximately 18 square miles to the southeast,

Residential property in two specific areas was analyzed to determine the
difference in property values between comparable homes both within and outside
the SDEIS's 65 DNL based on the 2000 Noise Contours, as shown in the
addendum to the Report of the Appraiser.

of the Dania Cut-Off Canal,and east of I-95. The one property not
