DANIA BEACH CITY COMMISSION
TUESDAY, DECEMBER 14, 2010 — 7:00 P.M.

Mayor McElyea called the meeting to order at 7:05 p.m.

2. Invocation and Pledge of Allegiance
Commissioner Grace gave the invocation followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
Representatives of the Dania Bears presented plaques and oranges to the Commission and
various staff members of the Parks and Recreation Department, Fire Department and BSO, in
appreciation for everything the City does to support their team.
Commissioner Anton thanked the coaches for the support they provide to the youth.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Jeffery Hatcher, 125 NW 7th Avenue, requested a stop sign on the corner of NW 7th Avenue and
2 Street in order to slow down traffic.
Vice-Mayor Castro noted we may need to work with Broward County on this matter so they can
determine whether or not it is appropriate.
Tammie and Shouneqa James, 255 NW 12th Avenue, provided a brief history of Tamara James, a
nationally renowned basketball player, and invited everyone to attend the ceremony to retire her
jersey to be held at the University of Miami. They also requested the Commission rename NW
12th Avenue as Tamara James Avenue".
Commissioner Grace asked the Commission to get a busload of residents to attend the ceremony
in Coral Gables on December 30.

Claire Jeanine Satin 600 NE 2 Street President of the Friends of the Dania Beach Library,
may,
presented applications to the Commission to become members of their organization.
Victoria Payne, Chamber of Commerce, 102 W. Dania Beach Boulevard, provided an update of
Chamber events.
Patty Hart, 517 NE 2nd Place, requested an update on the Pirates Inn property, seeing as Hank
Thomas is not doing the vertical mall.
6. Public Safelyports
Donn Peterson, BSO Chief of Police, reported on a two-day operation in Dania Beach and the
surrounding cities which resulted in 185 arrests. He also provided and update on the incident on
the 3500 block of Griffin Road,two blocks west of The Field Restaurant.
Vice-Mayor Castro asked for the status of the traffic speed plan for that area.
Chief Peterson read an excerpt of the report he submitted to City Manager Baldwin following
discussions with interested parties in June, 2010. The Florida Department of Transportation
(FDOT) conducted a survey of the area directly adjacent to The Field Restaurant and concluded
that there are three steps to the plan:
• Implementing lighting improvements
• Assessing the need for signalized pedestrian crossing
• Assessing the need for relocating the bus stop
Additionally they identified two things that the City of Dania Beach could do to address this
matter,which were completed in July 2010:
• Trimming landscaping that impacted existing lighting
• Coordinating with the business owners regarding the use of a golf cart on the sidewalk to
transport patrons to and from the parking area
Chief Peterson pointed out that some of these are long-term projects that would take time to
accomplish.

City Attorney Ansbro read the title of Ordinance #2010-027.
Mayor McElyea opened the Public Hearing.
Jay Field, 4501 SW 30th Way, asked if we would save money by moving the election to
November.
City Clerk Stilson responded that the cost of the November election should be $10,000.00-
$15,000.00.
The Commission generally agreed this change would bring savings to the City as well as a better
voter turnout.
Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the
Public Hearing.

City Attorney Ansbro read the title of Ordinance#2010-029.
Mayor McElyea opened the Public Hearing.
Jay Field, 4501 SW 30th Way, questioned how filling of vacancies would work.
City Attorney Ansbro advised if the proposed Charter changes are approved at the March 8, 2011
General Election, the vacancy would have to be filled by appointment of the City Commission,
as opposed to holding a special election.
Mr. Field disagreed with the proposed Charter amendment and remarked this was not a
democracy.
Patricia Flury, 402 SE 6th Avenue, noted the Charter Review Committee worked hard with the
City Attorney on this issue. She clarified that the appointment would be until the next City
election.
City Attorney Ansbro noted that the ordinance will be amended accordingly.

THE LAND DEVELOPMENT CODE TO ALLOW OUTDOOR STORAGE OF PASSENGER VEHICLES,
TRAILERS AND TRACTOR-TRAILERS AS A SPECIAL EXCEPTION USE IN THE I-G ZONING DISTRICT
AND PROVIDING FOR CONDITIONS OF USE; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING)
City Attorney Ansbro read the title of Ordinance#2011-001.
Kristin Dion, City Planner, noted that the applicant is requesting a text amendment to allow
outdoor vehicle storage in the IG zoning district as a Special Exception Use. She provided an
overview of the request. The Planning and Zoning Board recommends approval of the proposed
text amendment. Ms. Dion advised that staff is recommending approval, subject to staff
conditions. In addition to the text amendment, the applicant will need to apply for the special
exception approval, which will be heard by the Planning and Zoning Board only. She advised
that staff will recommend a sunset period of five years due to the recommendations within the
Westside Master Plan.
City Attorney Ansbro noted there have been no complaints from the neighbors in the area.

Vice-Mayor Castro questioned if the community was noticed for the text amendment change.
She expressed her concern with the proximity to the residential area.
Commissioner Grace requested a buffer as a requirement.
City Attorney Ansbro responded there is currently a five foot landscape buffer. He noted that
notices could be provided before the second reading of the ordinance.
Commissioner Grace motioned to adopt Ordinance #2011-001, on first reading; seconded

11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton wished everyone a Happy Holiday Season.
Commissioner Anton commented that we need to recognize the work of the coaches in the
community for the benefit of our children.
Commissioner Anton thanked Neal McAliley, Special Counsel, and Bill Albee, for their help and
advice on the Airport issue.
11.2 Commissioner Duke
Commissioner Duke noted this has been a challenging year but the Commission has worked
together to move the City forward. He thanked the residents for their input and participation in
all our projects. Commissioner Duke also thanked City staff and his fellow Commissioners and
their partners, for doing a great job. He further recognized the members of the advisory boards
for their work and feedback. Lastly, he wished everyone a Happy and Safe Holiday Season.
11.3 Commissioner Grace
Commissioner Grace remembered the families who have lost their loved ones this year.
Commissioner Grace reminded everyone of the upcoming Martin Luther King, Jr. celebration.
Commissioner Grace wished everyone Happy Holidays.
11.4 Vice-Mayor Castro
Vice-Mayor Castro thanked the Fort Lauderdale Parrot Heads Club for cleaning up Anglers
Avenue/Ravenswood Road, which is another gateway to the City.
Vice-Mayor Castro noted she presented a plaque and Key to the City to Captain Zini, of the
Allure of the Seas, currently the largest cruise ship in the world.

Vice-Mayor Castro noted she attended the Pearl Harbor Memorial service held at the Coast
Guard Station in Dania Beach.
Vice-Mayor Castro wished everyone a Happy Holiday Season and a Healthy and Prosperous
New Year.
11.5 Mayor McElyea
Mayor McElyea noted this has been a good year and next year will be even better. He wished
everyone Happy Holidays.
12. Appointments
There were no appointments at this meeting.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted that we will begin working on the Oasis project immediately. He
indicated that the residents will be kept informed on how the project is moving along.
City Manager Baldwin noted that $400,000.00 in revenue in the Parking Enterprise Fund was
counted twice during budget preparations. He apologized for the accounting error.
City Manager Baldwin requested a Special Meeting on Tuesday, December 21, to discuss
BSO/Fire Department negotiations. He advised that he will bring a final proposal for
Commission vote.
It was the consensus of the Commission to hold a Special Meeting on Tuesday, December 21,
2010 at 7:00 p.m.
City Manager Baldwin wished everyone a Merry Christmas and a Happy New Year.
13.2 City Attorney
City Attorney Ansbro stated he understands that the Frost House/Dania Beach Water Gardens is
for sale and expecting a cash buyer for $500,000.00. He pointed out that the City has first right
of refusal on the property and has 15 days to counter the offer.
The Commission directed City Manager Baldwin and Finance Director Bates to bring a proposal
for Commission consideration.

Comments by Dania Beach citizens or interested parties that are not part of the regular printed agenda may be made during each
Commission meeting during the period set aside for"Citizen Comments." A thirty(30)minute"Citizen Comments"period shall
be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. The
citizen Comments' period shall begin promptly at 7:30 PM. Each speaker shall be limited to 3 minutes for his or her comments.
Persons desiring to speak during the citizen comment period shall inform the City Clerk immediately prior to the beginning of the
meeting of their intention to speak. If more than 10 speakers express a desire to speak, the Commission shall determine on a

considered at this hearing will need a record of the proceedings and for such purpose may need
to ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based.
