HomeMy WebLinkAboutO-2011-004 Firefighters' Pension Plan - DROP ORDINANCE NO. 2011-004 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 18-43 "OPTIONAL FORMS OF BENEFITS", OF THE CITY CODE OF ORDINANCES RELATING TO THE POLICE AND FIREFIGHTERS' PENSION PLAN; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City has entered into an agreement with the International Association of Firefighters, Local 3080 Union which requires, among other things, an amendment to a certain section of the City of Dania Beach Code of Ordinances relating to the Police and Firefighters' Pension Plan; and WHEREAS, the City Commission has received and reviewed the actuarial impact statement concerning the cost impact of this ordinance amendment prepared by the Retirement System's actuary, and WHEREAS, the proposed ordinance amendment has been approved and recommended by the Pension Plan Board of Trustees; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,AS FOLLOWS: Section 1. That Section 18-43 "Optional Forms of Benefits", of the City of Dania Beach Code of Ordinances relating to the Police and Firefighters' Pension Plan is amended to read as follows: Sec. 18-43. Optional forms of benefits. . (b) Deferred retirement option plan. . Upon the effective date of commencement of participation in the deferred retirement option plan, membership in the system shall terminate and neither the employee nor employer contributions shall be payable. Except for members actively participating in the Florida Retirement System, T4ie-the member contributions to the system, including those picked up by the city, shall cease and instead of being paid to the system, shall be paid to the employee. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this Ordinance are repealed to the extent of such conflict. Section 3. The Plan provides that upon entry into the DROP the member contributions to the Plan,including those picked up by the City, shall cease and instead of being paid to the Plan, such contributions shall be paid to the member. The amendment would eliminate the contributions to the member after entry into the DROP. It is our opinion that this ordinance would have no actuarial impact on the Plan. There would be no change in the amount of benefits paid or in the amount of revenue to the Plan. While the ordinance would have no actuarial impact,it is still necessary for a copy of this letter and the proposed ordinance to be sent to the Division of Retirement before second reading of the ordinance.
