TUESDAY, JANUARY 25, 2011 — 7:00 P.M.
1. Call to Order/Roll Call
Mayor McElyea called the meeting to order at 7:05 p.m.

2. Invocation and Pledge of Allegiance
Reverend Andrew Dixon, Mt. Sinai United Methodist Church, gave the invocation followed by
the Pledge of Allegiance to the United States Flag.
3. Presentations and Special Event Approvals
3.1 Airport Options—Neal McAliley
Neal McAliley, Special Counsel for airport matters, presented a PowerPoint overview on the
status of the City's challenges against the expansion of the Ft. Lauderdale-Hollywood
International Airport. The presentation is saved as an attachment to the minutes.
Jay Field, 4501 SW 30t` Way, Chairman of the Airport Advisory Board, provided the following
three recommendations from the Board:
• That the City move forward with the sound reduction and sales assistance program at the
same time, as proposed by Broward County Aviation Department
• That the City reaffirm to Broward County that no Avigation Easements will be accepted
and to further ask the County to stress to the Federal Aviation Administration (FAA) that
no easements of any kind should be included in any program
• That an official poll be conducted asking the residents what type of noise impact
mitigation they want for their homes
Mr. Field noted that at last night's Special meeting of the Airport Advisory Board, Kent George,
Broward County Aviation Director, stated that he is ready to move forward with the project.
Victor Lohmann, 1404 Nautilus Isle, thanked the Airport Advisory Board and the City for the
flyer that was distributed to the residents regarding Airport activities. He said he is tired of
someone else saying what is best for him. Mr. Lohmann stated that he wants to be heard and
asked what they want. He indicated that he and other people he knows do not support the sales
assistance program. Lastly, Mr. Lohmann asked that the City follow up with Kent George's
offer to conduct some preliminary valuations of the properties.
Clifford Iacino, 1771 SW 30th Place, was annoyed by the Market Absorption Rate Study
presented by Kent George at last night's meeting. He explained in detail the purpose of the
Study and how dangerous it is. Mr. Iacino suggested spending money and enlisting the services
of the Urban Development Department of Florida Atlantic University (FAU) to look at the
minutia and ramifications of what is being said so that everyone can see what is being done. The
people know they are being had and this is not a good deal.
Linda Sacco, 4481 SW 38th Terrace, noted the citizens are caught between two sets of rules that
keep changing. She offered a couple of suggestions in order to keep Dania Beach whole.
Bob Mikes, 601 NW 7th Street, noted Kent George had credible points at last night's meeting.
He said there will be pollution in our communities from the aircrafts, which will be hazardous to
children's health. Mr. Mikes agreed that we should bring someone from FAU to conduct a
study. He suggested we look at the Ft. Lauderdale Interlocal Agreement. We should also look at
Martin County to see what the homeowners' were paid to avoid the cost of litigation.
3.2 Request by Pinkey April Johnson (Psychic Life Reading) for a new Local Business
Tax Receipt for a Palmistry/Fortuneteller License for property located at 4409
Stirling Load
Russ Cormican, on behalf of Pinkey Johnson, was present to answer questions. He advised Ms.
Johnson provided all the necessary documentation for this application. Mr. Cormican asked for
the request to be approved.
Nick Lupo, Code Compliance and Business Tax Licensing Manager, explained that the applicant
has met all the conditions. However, the property has some violations in connection with the
parking area that still need to be corrected.
Mr. Cormican noted that it is his understanding that the final inspection to approve the new
parking lot is tomorrow.

Vice-Mayor Castro motioned to approve the Local Business Tax Receipt for a
Palmistry/Fortuneteller License for Psychic Life Reading, subject to final inspection;
seconded by Commissioner Anton. The motion carried on the following 5-0 Roll Call vote:

3.4 Request for the Red Bird Baseball Team to use C.W. Thomas Park—John Hitchmon
John Hitchmon, Jr., Manager and Coach of the Red Bird Baseball Team, requested to bring
baseball back to Dania Beach.
Commissioner Grace said it was time to bring the Red Birds back home. She further noted that
if there are any fees involved, they need to work that out with the Parks and Recreation
Department.
3.5 Special Event request from Al Behrendt Enterprises, Inc. for The Dania Beach
Marine Flea Market to be held March 17-20, 2011, in the Dania Jai Alai Parking Lot
Jennifer Dudas, representing Al Behrendt Enterprises, Inc. asked for approval of their request.
Vice-Mayor Castro motioned to approve the Special Event request for the Dania Beach
Marine Flea Market; seconded by Commissioner Grace. The motion carried unanimously.
3.3 South Florida Water Management District Presentation
Carole Morris, South Florida Water Management District (SFWMD), presented a PowerPoint
update on the current water conditions. The presentation is saved as an attachment to the
minutes.
Vice-Mayor Castro noted she and the Mayor are enrolled in the Water Academy. She remarked
this is a very serious issue and she will become more involved when she leaves office. Vice-
Mayor Castro encouraged everyone to conserve water.
4. Proclamations
There were no proclamations at this meeting.
5. Citizen Comments
Myrtle Corbin, 248 SW 131h Street, provided an update on the Dania Beach Relay for Life, which
will be held at Frost Park on April 15-16, 2011. She requested to receive the City's funds by
mid-February.

George Jason, 4549 SW 37th Avenue, provided an update on the upcoming Mt. Sinai Methodist
Church 105th Anniversary.
Craig A. Leonard, 345 NE 3`d Avenue, noted he never received the letter to vacate the drainage
easement.
Dominic Orlando, Director of Public Services, noted he will meet with Mr. Leonard to resolve
the issue.
Teddie Bohanan, 312 SW 15d' Street, read an article to the elected officials written by George
Washington. She requested the elected officials remember the people they serve.
Theresa Garcia, Chairman of the Board, Dania Beach Chamber of Commerce, 102 W. Dania
Beach Boulevard, read a statement clarifying the Chamber's position with regards to political
issues. She noted the Chamber will not host any candidate forums.
Clare Vickery, 816 SE 2nd Street, was available to answer any questions on the Arts and
Antiques Festival.
6. Public Safety Reports
Joe Fernandez, Fire Chief, reported the Broward County Commission approved the merger with
BSO today. He advised that the go-live date is January 29, 2011 for the beginning of services;
however, this is an on-going process that will take some time. Chief Fernandez noted he will
keep the Commission updated during the transition period.
Donn Peterson, BSO Chief of Police, commended the Code Enforcement Unit for their
continued assistance. He discussed an issue that they have been working on for three years.
Chief Peterson explained that with the help of the Code Unit and Special Counsel Tim Ryan the
City finally obtained ownership of the property. He commended Corporal Ricardo Rey on his
actions in arresting a robber.
Mayor McElyea temporarily adjourned the City Commission meeting at 8:33 p.m., in order to
conduct a Special CRA Board meeting.
Mayor McElyea reconvened the City Commission meeting at 8:3 8 p.m.

City Attorney Ansbro read the title of Ordinance #2011-003.
Mayor McElyea opened the Public Hearing.
Derrick Hankerson, 746 SW 3rd Street, supported the request. However, he thought the number
of requests for renaming streets is increasing. He urged the Commission to consider a policy of
not renaming streets after individuals until they are deceased.
Commissioner Grace noted that Mr. Davis passed away on Sunday. She provided the details of
his funeral.
Patty Hart, 517 NE 2nd Place, noted Mr. Davis passed away knowing that the request was in
progress.
Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the
Public Hearing.

10. Discussion and Possible Action
10.1 Legislative Agenda
Colin Donnelly, Assistant City Manager, advised that the City Manager requested we table the
discussion on the items to be included in the Legislative Agenda. However, he has received a
proposal from Carole Duncanson to continue providing lobbying services which was approved at
the last Commission meeting.
Commissioner Duke motioned to keep Carole Duncanson as the City's Lobbyist; seconded
by Vice-Mayor Castro. The motion carried unanimously.
11. Commission Comments
11.1 Commissioner Anton
Commissioner Anton noted that Broward County discussed the possible purchase of the Atlantic
Village Marina property. He advised that they denied the plat as well as moving forward with
the sale of the property. Commissioner Anton explained that the City was against the County
purchasing this property because it would come off the tax roll.
Commissioner Anton asked that we find a way to poll the residents directly affected by the
Airport Expansion as recommended by the Airport Advisory Board.
Commissioner Anton noted that the lights are out at the entrance to Melaleuca Gardens. He
remarked that we are trying to prevent this area from becoming a blighted neighborhood, and
someone needs to explain what is going on so we can put a plan in place.
Dominic Orlando, Director of Public Services, noted he was told they were repaired yesterday.
He advised that they are looking at removing the dead shrubs and replacing them with palm
trees.
Commissioner Anton recommended Director Orlando attend the next Melaleuca Gardens
Homeowners' Association meeting so he can get input from the neighbors.
Vice-Mayor Castro pointed out that palm fronds could fall and we need to be careful not to
increase our liability.
Commissioner Anton talked about a bridge that goes into the Airport Park that has graffiti and
the lights are out. He asked Director Orlando to find out who is responsible for the maintenance
of this bridge in order to have these issues resolved.
11.2 Commissioner Duke

Commissioner Duke referred to the possible purchase of the Atlantic Village Marina by Broward
County. He noted that he thinks the County Commission is in favor of leaving this property on
our tax roll.
Commissioner Duke noted that on Friday, January 28, there will be a nice ceremony for the Fire
Department at I.T. Parker Community Center beginning at 10:00 a.m.
Commissioner Duke commented on meetings he attended.
Commissioner Duke spoke about the upcoming Elections in Dania Beach. He asked how we are
going to advertise the Charter amendments for the voters to consider.
City Attorney Ansbro noted the ballot questions will be advertised in the Dania Beach Press as
well as any roadshows to the different homeowners associations.
Commissioner Duke noted that the Airport Shade meeting held prior to the Commission meeting
tonight was excellent. He remarked he was very happy to see the Commission working together
on such an important issue.
11.3 Commissioner Grace
Commissioner Grace provided an update on events she attended.
Commissioner Grace noted she was very impressed with the participation of our residents at the
Airport Advisory Board meeting held last night. She hoped the County Commissioners would
understand the importance of keeping the Interlocal Agreement intact.
Commissioner Grace noted she was disappointed to see that her request for sponsorship of the
2011 Broward Black Elected Officials Gala on February 27, 2011 at the Seminole Hard Rock
Hotel was not approved at the last Commission meeting. She advised that she has now become
part of the committee so the City of Dania Beach will be able to participate. Commissioner
Grace indicated that she asked the committee to make sure that there will be children from Dania
Beach to qualify for scholarships.
Commissioner Grace noted that solar lights are out on SW 3rd Street and 3rd Terrace.
11.4 Vice-Mayor Castro
Vice-Mayor Castro noted the solar lights are out throughout the City. She asked Director
Orlando if there is any issue with them.
Dominic Orlando, Director of Public Services, advised that there are two phases of light fixtures
and provided details. He added that the wattage was too much for the batteries. Director
Orlando further noted that the latest proposal we received will replace the entire head. He
indicated that we need a Change Order for additional lights for the Oasis project. Director

Orlando clarified for Vice-Mayor Castro that he thinks there is a plan for citywide solar lighting
which is currently in the office of the City Manager.
Vice-Mayor Castro noted she agrees with the comments made earlier regarding engaging any of
the colleges to conduct some studies on property values.
Vice-Mayor Castro noted some residents have asked her about the flooding on Bryan Road and
whether there are any plans being considered.
Director Orlando advised there is nothing being done in-house. He noted he will contact the
County for an update and report back to the Commission.
Vice-Mayor Castro spoke about the Library grand opening. She noted that Claire Satin and the
Friends of the Library want to be involved. Vice-Mayor Castro asked if we could set a date and
include them in any forthcoming meetings.
Colin Donnelly, Assistant City Manager, noted that Parks and Recreation Director Kristen Jones
contacted Ms. Satin yesterday.
Director Orlando advised that some months ago it was discussed that the tentative date for the
grand opening of the Library would be during the first week in April.
Vice-Mayor Castro would like to do a walk-through of the building before the shelving and
books are inside.
Vice-Mayor Castro thanked everyone involved in arranging the 5th Avenue meeting. She
remarked that people are very excited and positive about the proposal.
Vice-Mayor Castro noted that it has come to her attention that Department Heads have not had a
performance review for some time. She asked if we could do a review without worrying about a
matrix and the raises. Vice-Mayor Castro would like to find a way to give our Department
Heads, probably the hardest working key people in our organization, some feedback on their
performance.
City Attorney Ansbro advised he will look into this issue.
11.5 Mayor McElyea
Mayor McElyea spoke about a house located in the Oasis project area.
Dominic Orlando, Director of Public Services, advised that he visited the house and that the
space is insufficient to park a car; that is why they put pavers. He added that we could do
something but we would need more money.
The Commission directed Director Orlando to look into the matter and bring a plan back for
consideration.

Avenue area.

Subject: RUNWAY MITIGATION PLAN
1. The Dania Beach Airport board recommends the city go forward with the sound reduction
and sales assistance program at the same time as proposed by Broward County Aviation
Department.
2. We l ecommend the city reaffinn to Broward County no avigation easement under any
circumstances. At present, the FAA wishes to place an easement on a property that is in the
sales assistance program but not sound reduced. BCAD is opposed to the FAA position.
BCAD asks the city to inform the Broward County Commission this and any other avigation
easement is unacceptable. The hope is that with pressure from Broward County, the proposal
for an avigation easement by the FAA will be dropped.
3. We recommend an "official" poll of what noise impacted residents wish to do. Will they
be interested in sound reduction with a wait and see on the noise or do they wish to try and
sell their i:ome immediately. We believe the airport board in conjunction of the city's staff
could implement this project.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA, PROVIDING THAT A PORTION OF SW 6t' STREET BE CO-DESIGNATED AS
HAROLD A. DAVIS STREET, WHICH PORTION IS LOCATED BETWEEN PHIPPEN-
WAITERS ROAD AND SW 12" AVENUE IN THE CITY OF DANIA BEACH, PROVIDING
FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN

ORDINANCE NO. 2011-004
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA, AMENDING SECTION 18-43 "OPTIONAL FORMS OF BENEFITS", OF THE
CITY CODE OF ORDINANCES RELATING TO THE POLICE AND FIREFIGHTERS'
PENSION PLAN; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
Copies of the proposed ordinances are on file in the Office of the City Clerk, City Hall, 100 West
Dania Beach Boulevard, Dania Beach, Florida, and may be inspected by the public during
normal business hours.
Interested parties may appear at the meeting and be heard with respect to the proposed
ordinances. Any person who decides to appeal any decision made with respect to any matter
considered at this hearing will need a record of the proceedings and for such purpose may need
to ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based.
