Call to Order/Roll Call Mayor McElyea called the meeting to order at 7:00 p.m. Present: Mayor: C. K. "Mac" McElyea Vice-Mayor: Anne Castro Commissioners: Bob Anton Walter Duke City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson Absent: Commissioner: Bobbie Grace 2. Invocation and Pledge of Alle ig ance Deacon Richard Hadley, St. Ruth Missionary Baptist Church, gave the invocation followed by the Pledge of Allegiance to the United States Flag. Vice-Mayor Castro motioned to excuse the absence of Commissioner Grace; seconded by Commissioner Duke. The motion carried unanimously. 3. Presentations and Special Event Approvals 3.1 Special Event request from South Florida Event Planners for a Starz and Stripez Casino Night to be held on Saturday, February 19, 2011, from 5:00 p.m. - 11:00 p.m., at the I.T. Parker Community Center City Attorney Ansbro explained this is a non-profit charity event and all requirements have been met. Vice-Mayor Castro motioned to approve the Special Event request for the Starz and Stripez Casino Night; seconded by Commissioner Duke. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Jerilyn Grimm, 821 NW 8th Avenue, Melaleuca Gardens, noted she has been a registered voter in Broward County for 27 years and she has voted on most local, state and federal elections. She questioned the ethics of the upcoming election and added that what she sees happening in Dania Beach is offensive to every citizen casting their vote in the hope of honest and independent representation. Ms. Grimm said she thought it was wrong that the wife of a City Commissioner was representing two candidates running as a team. She advised that she contacted the State Division of Elections in Tallahassee and was told it was legal, but was considered dirty politics. Ms. Grimm remarked that the seats on the Dania Beach City Commission are independent and should not go to a team. It was her opinion that the candidates would be puppets for Commissioner Duke. She urged the citizens to be wary of voting for a team. Kurt Ely, 245 SW 1st Avenue, noted tomorrow is Mayor McElyea's birthday. He provided stories of flying with Mac' . Clive Taylor and Clare Frost, 642 NE 3rd Street, thanked everyone for their support and participation in the Vintage Motorcycle Show event. They provided an update and added that they will need more space next year. Ms. Frost advised they handed a detailed budget to the City Manager. Mayor McElyea noted the Vintage Motorcycle Show should be a two-day event so people stay in our hotels and eat in our restaurants. George Jason, 4549 SW 37th Avenue, thanked everyone for participating in the Mt. Sinai United Methodist Church 105th Anniversary celebration. Teddy Bohanan, 312 SW 15th Street, is concerned because men are putting their hands on women and terrorizing them regarding the upcoming election. Addendum 3.2 Presentation by Tyler Chappell, FIND Commissioner Tyler Chappell, Florida Inland Navigation District (FIND) Commissioner, provided an update on the Florida Boating Improvement Program (FBIP). He said this is a great opportunity for the City to improve the Dania Beach Marina. RESOLUTION#2011-016 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN APPLICATION WITH THE STATE OF FLORIDA IN CONNECTION WITH FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,February 8,2011 —7:00 p.m. ("FWC") GRANT FUNDS UNDER THE FLORIDA BOATING IMPROVEMENT GRANT PROGRAM; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2011-016. Commissioner Duke motioned to adopt Resolution #2011-016; seconded by Vice-Mayor Castro. Vice-Mayor Castro confirmed with Mr. Chappell that the grant would require a fifty percent match from the City. She further questioned the likelihood of the City receiving this grant. Mr. Chappell advised that this is a very competitive program and they like to fund the projects where there are small populations. He further noted that the program includes derelict vessels as well as removal of vessels. Commissioner Duke amended his motion to include an application for derelict vessels; seconded by Vice-Mayor Castro. The motion carried unanimously. Colin Donnelly, Assistant City Manager, noted that BSO has a $50,000.00 grant from the Broward County Marine Advisory Commission for derelict vessel removal. Vice-Mayor Castro asked City Attorney Ansbro if there is any recourse for derelict vessel owners. She further requested staff to bring some budget ideas for next year regarding this issue. 6. Public Safety Reports Donn Peterson, BSO Chief of Police, reported all is going well with the BSO Fire transfer. He provided information on some burglaries which have recently occurred in the City. Mayor McElyea temporarily adjourned the City Commission meeting at 7:41 p.m., in order to conduct a Special CRA Board meeting. Mayor McElyea reconvened the City Commission meeting at 7:51 p.m. 7. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2011-007. Corinne Lajoie, Principal City Planner, explained this is a request to amend the Land Development Code aka One Code, Land Development Regulations, by creating a Marine Zoning District for use within the CRA, as well as other text amendments. She provided an overview of the text amendments to the Land Development Code. Ms. Lajoie advised that the Planning and Zoning Board as well as staff recommend approval of the request. Mayor McElyea opened the Public Hearing. David Wright, Edgewater Road, noted he owns property in the affected area and he has an issue with the allowed height and setbacks of buildings. He asked for someone to call him when a change is made to IROM-AA because it affects him. Mr. Wright further advised that the Airport will be installing radiation on the Airport property. Commissioner Anton suggested Mr. Wright contact County Commissioner Rodstrom to make them aware of his concerns. Ms. Lajoie confirmed for Vice-Mayor Castro that the height of the buildings is ultimately determined by the County due to the proximity to the runway. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,February 8,2011 —7:00 p.m. Vice-Mayor Castro asked staff to include additional verbiage to the ordinance stating that people who have previous Avigation Easement Agreements with the Broward County Aviation Department will not be impacted. Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the Public Hearing. Commissioner Anton motioned to adopt Ordinance #2011-007, with amendment, on first reading; seconded by Vice-Mayor Castro. The motion carried on the following 4-0 Roll Call vote: Commissioner Anton Yes Vice-Mayor Castro Yes Commissioner Duke Yes Mayor McElyea Yes 9.2 RESOLUTION#2011-009 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY APOSTLE FAY WILLIAMS, SENIOR PASTOR, REPRESENTING THE BOARD OF DIRECTORS OF EBENEZER DELIVERANCE TEMPLE, FOR AN EXTENSION TO VARIANCES (VA-49-09,VA-56-09,VA-57-09 AND VA-61-09)ORIGINALLY APPROVED BY RESOLUTION 2010-029 ON FEBRUARY 23, 2010, FOR PROPERTY LOCATED AT 2340 GRIFFIN ROAD, IN THE CITY OF DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2011-009. Kristin Dion, City Planner, noted that the applicant is requesting an extension of the previously approved parking and landscape variances. She provided an overview of the request. Mayor McElyea opened the Public Hearing. Pastor Faith Williams, representing Ebenezer Deliverance Temple, noted they are a positive source for the community. She asked for an indefinite extension of the variance as long as they remain there. Seeing as there was no one else to speak in favor or opposition, Mayor McElyea closed the Public Hearing. Commissioner Duke motioned to adopt Resolution #2011-009, as long as it remains to be a church; seconded by Commissioner Anton. Discussion and Possible Action Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,February 8,2011—7:00 p.m. 10.1 Request for Letters of Interest—Airport Affected Property Valuation Commissioner Anton noted he asked for this item and requested approval. Commissioner Duke noted it is a good idea and consistent with what the Commission wants to do. He indicated the scope of work should be fine tuned. Commissioner Anton requested the document be reviewed by City Attorney Ansbro and Special Airport Counsel Neal McAliley. Commissioner Anton motioned to approve moving forward with the Request for Letters of Interest; seconded by Vice-Mayor Castro. The motion carried on the following 4-0 Roll Call vote: Commissioner Anton Yes Vice-Mayor Castro Yes Commissioner Duke Yes Mayor McElyea Yes 10.2 Legislative Agenda (Continued from January 25, 2011) City Manager Baldwin noted that the Commission has had this for some time now. He stated that staff would like to update the Legislative Agenda packet annually, prior to each session. City Manager Baldwin asked the Commission if they would like to make any changes before it is sent to Carole Duncanson. Commissioner Anton noted that he does not support the Red Light Cameras. He understands it would generate revenue; however he thinks it is unconstitutional. Commissioner Anton also said he has an issue with the Pension Reform. He stated that he does not want to take anything away from employees who already receive a pension. Commissioner Duke noted he agrees with Commissioner Anton on the Pension Reform; however he supports the Red Light Cameras. He thought City Manager Baldwin and Chief Peterson were already moving forward with this program. He said we need to determine our position as a Commission, and questioned when we are going to implement it. Commissioner Duke suggested placing this item on the agenda for the second meeting in March. Mayor McElyea noted we need to wait and see what the legislature does with regards to the Red Light Cameras. Vice-Mayor Castro suggested removing the Red Light Cameras because the legislature has settled the case. She commented she we were thought doing a test run on the cameras. Vice- Mayor Castro noted that this matter could be discussed at a later date, treating it as a public safety issue instead of a revenue enhancement for the City. She concurred with other Commissioners' positions regarding the Pension Reform. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,February 8,2011 —7:00 p.m. Vice-Mayor Castro motioned to approve the Legislative Agenda packet with the exception of the Red Light Cameras and the Pension Reform items; seconded by Commissioner Anton. The motion carried unanimously. 10.3 Southeast Traffic Calming Workshop Commissioner Duke noted the workshop was well attended and the general consensus was to install medians, stop signs, no passing signs and to paint double yellow lines. He suggested staff seek out locations for stop signs. Vice-Mayor Castro noted some residents are concerned with the lack of crosswalks in the City. She suggested adding the crosswalks to the application together with the stop signs. Vice-Mayor Castro would also like to submit an application for the bike lanes, if the road qualifies. She agreed with painting the double yellow lines and installing no passing signs. Commissioner Anton noted that these measures will not preclude us from taking additional steps in the future, if necessary. Mayor McElyea supported the recommendations made at the workshop. Commissioner Duke motioned to accept the recommendations as provided in the agenda packet; seconded by Commissioner Anton. The motion carried unanimously. 10.4 Florida Fish and Wildlife Conservation Commission (FWC) grant funds under the Florida Boating Improvement Program (FBIP) This item was discussed under Presentations. 11. Commission Comments 11.1 Commissioner Anton Commissioner Anton asked people to be vigilant regarding the upcoming election. He noted that recently some signs were stolen from vehicles in the parking garage, which has surveillance cameras. Commissioner Anton asked Chief Peterson to be vigilant and prosecute those involved in that type of action to the extent of the law. 11.2 Commissioner Duke Commissioner Duke presented a "Pound for Pound Challenge" as a Relay for Life fundraiser. He explained how the program works for those who would like to participate. 11.3 Commissioner Grace Commissioner Grace was not present at this meeting. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,February 8,2011 —7:00 p.m. 11.4 Vice-Mayor Castro Vice-Mayor Castro commented on the Ocean Waterway Mobile Home Park meeting with Broward County Aviation Department (BCAD). She further noted that Melaleuca Homeowners Association will be meeting with BCAD tomorrow night as well. Vice-Mayor Castro encouraged the residents in the northeast section of the City to also meet with BCAD to have an idea of what could be coming their way. Vice-Mayor Castro noted that a school bus was reported speeding along 401h Avenue. She asked Public Services Director Orlando to look into some pot holes on the sidewalk on 40th Avenue. Vice-Mayor Castro advised that there is a submerged vessel with oil and gas in the area near 25th Avenue. Vice-Mayor Castro advised that the Metropolitan Planning Organization (MPO) is still considering having Dania Beach as a site for the FEC Railroad station location. Vice-Mayor Castro noted that she was elected as Vice-Chair of the Broward County Planning Council. 11.5 Mayor McElyea Mayor McElyea noted we are still working on the seagrapes at the beach. Mayor McElyea spoke about a bus driver speeding in the area near SE 3rd Avenue. Mayor McElyea noted there was a City employee speeding on Gulfstream Road. He also commented that the truck had the tail lights out. Mayor McElyea pointed out that we need to make sure that our vehicles are in good condition and periodically checked. 12. Appointments There were no appointments at this meeting. 13. Administrative Reports 13.1 City Manager City Manager Baldwin had no comments. 13.2 City Attorney City Attorney Ansbro had no comments.
