HomeMy WebLinkAboutR-2011-024 - Approving the request made by Sam Jazayri, president of 36th St. Acquisitions Inc. for a second extension to the site plan approval RESOLUTION NO. 2011-024 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE REQUEST MADE BY SAM JAZAYRI, PRESIDENT OF 36TH STREET ACQUISITION, INC., FOR A SECOND EXTENSION TO THE SITE PLAN APPROVAL SP-64-07, APPROVED BY RESOLUTION NO.2008-002 AND SPECIAL EXCEPTION REQUEST SE-73-07 APPROVAL BY RESOLUTION NO. 2008-001 ON JANUARY 8, 2008, FOR PROPERTY LOCATED AT 2400 COLLINS ROAD (GENERALLY LOCATED ON THE SOUTH SIDE OF COLLINS ROAD, WEST OF THE FORT LAUDERDALE HOLLYWOOD INTERNATIONAL AIRPORT),IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,on January 8,2008,the City Commission approved a special exception request (SE-73-07)to allow a distribution use by Resolution 2008-001, which expired on January 9, 20093, for property located at 2400 Collins Road(generally located on the south side of Collins Road,west of the Fort Lauderdale Hollywood International Airport), Dania Beach; and WHEREAS, on January 8, 2008, the City Commission approved a request for a site plan (SP-64-07)to allow for the construction of a 240,560 square foot warehouse/office complex,along with the approval of a 27%pervious area waiver,by Resolution 2008-002,which expired on January 9, 2009, for the property; and WHEREAS,on January 27,2009,pursuant to Resolution 2009-013,the Dania Beach City Commission approved an extension to the special exception request,pervious area waiver and site plan approval until January 27, 2011; and WHEREAS, Sam Jazayri, President of 361h Street Acquisition, Inc, is requesting a second extension of the special exception request,pervious area waiver and site plan approval until January 27, 2013; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the request to extend the expiration date for the approvals of the special exception request SE-73-07 and site plan SP-64-07 until January 27, 2013, is approved. Section 2. That such approval is also subject to the conditions previously approved by the City Commission. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on March 9, 2011. (Ty 0 ,29 C. K.
