A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, SUPPORTING THE ADOPTION OF HOUSE BILL 79
AND SENATE BILL 158, BOTH CREATING THE "FLORIDA BAN OF
TEXTING WHILE DRIVING LAW" DURING THE 2011 LEGISLATIVE
SESSION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Dania Beach holds the health and safety of its citizens as a
paramount concern; and
WHEREAS, wireless telephone use has become ubiquitous throughout Florida and the
nation, and the use of text messaging has grown exponentially in recent years; and
WHEREAS, a recent study by the Virginia Tech Transportation Institute has shown that
sending electronic messages while driving makes an accident 23 times more likely to occur; and
WHEREAS, a study by the National Safety Council has shown that texting while driving
has resulted in 330,000 distracted driving injuries every year; and
WHEREAS, with the support of employee unions, the United States Department of
Transportation has banned all commercial truck and bus drivers from sending electronic text
messages while driving; and
WHEREAS, House Bill 79 and Senate Bill 158 have been filed to create the "Florida
Ban of Texting While Driving Law";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the City Commission supports the adoption of House Bill 79 and
Senate Bill 158 creating the "Florida Ban of Texting While Driving Law" during the 2011
Legislative Session.
Section 2. That this resolution is incorporated into the City's 2011 Legislative
Agenda.
Section 3. That the City Clerk is directed to provide a copy of this resolution to the
Florida League of Cities, the Broward League of Cities, Broward County Legislative Delegation,
the Broward County Board of County Commissioners, each municipality in Broward County,
and other appropriate parties.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be in full force and take effect immediately
upon its passage and adoption.
